We will not be liable for any such unauthorized access unless caused solely by our gross negligence, in which event you will be entitled to compensation up to a maximum of the value of the services purchased by you.

SSL encrypts all communications between your computer and our server so that the information can only be read and understood by us. A closed lock in the bottom corner of your browser window shows a secure connection. For further information, please consult your browser's security specifications. If your browser is equipped with SSL your transaction will automatically be secured.

The common standard in the Internet to signal a secure site is a closed lock at the bottom of the browser. As long as the lock is displayed closed, your information is secure and encrypted to avoid abuse. To check that you have a secure connection (in Internet Explorer), click the right mouse button and properties, then certificates. Then you will see if the connection is secure or not.

4. Researching a Holiday With Us

4.1 Website Accuracy

We will try to ensure that the information on our Website is accurate and up to date. However, when booking your holiday online please read the ‘important information' section carefully to ensure you are aware of any changes to the facilities and services on offer.

4.2 Prices

All prices on our Website and in our brochures are subject to change. We reserve the right to alter the prices of any of the holidays shown on our Website, in our brochures and other literature, prior to purchase. You will be fully advised of your itinerary and pricing at time of booking. Special offers and prices change as we work with a live system. Unless otherwise stated, prices are per person, based on two people sharing and include flights and accommodation. Transfers and other additional services may be added for an additional cost which will be advised to you at the time of booking. Customers travelling in the First & Business Class Cabins on Emirates may be entitled to complimentary transfers. Some destinations such as the Maldives require resort transfers to be booked prior to arrival in the country. If you do not choose to book these through us you will need to book directly with the hotel at least 72 hours before you depart. Some properties may ask you to book their compulsory gala dinner at Christmas or New Year, which you will be informed of when you make your booking.

In addition, we reserve the right to alter the prices of any of the holidays shown on our Website at any time in the event of an increase in any government-imposed tax or fee. In case of human or computer error, Emirates Vacations reserves the right to re-invoice for the correct price or service. A full refund will be made to passengers who choose not to pay an increase. If we do not hear from you within this time, we are entitled to assume that you will pay the corrected price. Any corrected price must be paid with the balance of the cost of your arrangements or within 14 days of the corrected price invoice issue date, whichever is the later (and provided such payment is made before the date of travel).

The flight may touch down (for example, to refuel, or to allow further passengers to embark) while still utilising the same flight number. We may not always know this at the time of booking. Sometimes, when you connect, you may be required to collect your luggage and re-check in.

Where a sector of a flight itinerary is not utilised without contacting the carrier directly, any remaining sectors may be subject to cancellation without further notification. Where this situation arises, we are unable to accept responsibility for any costs incurred.

The flight timings given on booking are for guidance only and are subject to change. The latest flight times will be those shown on your e-tickets. We are not liable if there is any minor change to a departure or arrival time previously given to you or shown on your e-ticket. Please reconfirm your flights with the airline.

You are advised to present yourself for check in at the airport at least three hours prior to departure. Should you miss your flight, this will be treated as a cancellation. Should you miss your flight to the USA while overseas, you will be required to pay for any new travel arrangements.

This Website is our responsibility as your tour operator. It is not issued on behalf of and does not commit the airlines mentioned herein or any airline whose services are used in the course of your travel arrangements.

We reserve the right to change the airline or airlines operating your flights at any time without notice in accordance with 7.4 below.

Special payment conditions may apply during peak periods (public holidays, exhibitions and special events, Eid holidays, Christmas and New Year, etc). You will be advised of these at the time of booking.

Responsibility for making all payments and passing information and/or documentation to the other passengers on a booking rests with the lead named person on the booking. Please note that we can only communicate with, and send documentation to, the lead name person unless you have booked through a Travel Agent in which case we will communicate with the lead name via your Travel Agent.

5.2 Payment Required to Confirm Your Holiday Booking

When you book with us, you will be required to make a depoist towards your vacation. It is your responsibility to ensure that all of the information you provide regarding your booking is accurate and complete in all respects. It is important you check the details of your booking confirmation and notify us immediately if anything is inaccurate.

5.3 Booking Confirmation

A booking is accepted by us only if and when we issue confirmation of acceptance of the booking and availability of the relevant accommodation, flights and other services and facilities. Once full payment has been made for an accepted booking, we will issue you with your Emirates Vacations travel documents including your flight ticket and service vouchers for land services.

It is important to check your Emirates Vacations travel documents to make sure that all the details are exactly as you requested. In the event of any discrepancy, please contact us or your Travel Agent immediately as it may not be possible to make changes later.

When a booking is made through a Travel Agent, all monies paid by you to the Travel Agent are held by the Travel Agent as your agent, until such time as we have accepted your booking and thereafter the monies are held by the Travel Agent as our agent.

5.4 Communications

Where you make a booking directly with us, communications from us will be sent to the email address you provided at the time of booking. Where a booking is made through a Travel Agent, communications with us must be via the Travel Agent.

5.5 Ways of Paying

For bookings made over the phone or in person, payments can be made by cheque, cash, debit or credit card. Credit cards may incur a fee which we will advise you of at time of booking. Please note, should it be necessary to re-present a cheque to our bank which has been returned without being honoured by your bank, an administration charge will be applied.

Although they will be noted on your booking, any failure to meet special requests will not entitle you to compensation or constitute a breach of these terms and conditions by us.

6. Important Travel Information

The U.S. Department of State produces useful advice for those travelling overseas, including information about health, insurance, money and safety, along with up-to-date details on individual destinations. This can be found on www.state.gov/travel. Travel advice changes, so please check the travel advice for your destination prior to booking, and regularly before travelling. We will not be responsible for any consequences arising out of your failure to check the relevant travel advice for your chosen destination.

6.1 Visiting a Muslim Country during Ramadan and General Behavior

Ramadan will be observed from May 2018 (these dates can change by a day or two from location to location). Visitors to a Muslim country are advised to respect those fasting by refraining from drinking, eating or smoking in public during daylight hours and to wear modest dress in public areas.

Most hotels and resorts have screened-off private areas for non-Muslims. Some tours, entertainment, bars and facilities may be restricted. In Abu Dhabi alcohol is not served in bars and restaurants during Ramadan, although drinks can generally be ordered via room service. In Dubai alcohol can still be served outside of fasting hours while selected hotels in Oman are able to serve alcohol during Ramadan.

If you commit any illegal act when on holiday or if in our reasonable opinion or the reasonable opinion of the Company representative or another person in authority your behaviour is disruptive, threatening or abusive we may terminate your travel arrangements without any liability on our part.

If the Captain of your flight or any of our overseas staff or agents believes that you could be disruptive or that you are suffering from a contagious disease which may reasonably be considered a direct threat to others, they can also refuse to allow you to proceed with your travel arrangements, restrict your movements on board or remove you from your accommodation or excursion. If that means you are not allowed to board your outbound flight from the USA or any connecting flight, we will treat your booking as cancelled and you will be liable for any cancellation charges that apply. If this occurs while overseas, you will be responsible for getting yourself and your party home at your own cost.

6.2 Passports & Visas

You must ensure that you have a valid passport in good condition and any necessary visas before travelling. Most destinations require that your passport remains valid for at least six months after your return date. It is also advisable to make a copy of all important travel documents to take with you.

Your specific passport, visa and other immigration requirements are your responsibility and you should confirm these with the relevant Embassies and/or Consulates. We do not accept any responsibility, and will not be held liable, if you cannot travel because you have not complied with any passport, visa or immigration requirements.

6.3 Travel Insurance

We strongly recommend that prior to travelling, you obtain a fully comprehensive policy of travel and medical insurance suitable for your specific requirements. It is your responsibility to ensure that the insurance cover you purchase is suitable and adequate for your particular needs.

6.4 Health Matters

It is recommended that you contact your doctor at least six weeks prior to traveling regarding any overseas health requirements or vaccinations that you may need. Certain countries ban you from possessing certain prescription drugs. Please check with your consulate before you travel.

The Centers for Disease Control and Prevention provide useful information on recommendations for vaccinations and other travel related health precautions for your overseas trip. This can be found at https://wwwnc.cdc.gov/travel/.

It is your responsibility to ensure that you are fit to travel and participate in all parts of the services you have booked and undertaken.

6.5 Early Check-in and Late Check-out

Flight times may result in you arriving early to or departing late from your hotel. If this is the case we strongly advise you to either book your accommodation room the night before so that you can be assured it is ready on your arrival, or to extend your hotel booking for the night of your departure so you have full use of its facilities until you leave the hotel. If you have any questions regarding this, before proceeding to book contact our team who will be happy to assist you. After you book you may incur change fees if anything is incorrect or you wish to make any amendments).

6.6 Excursions You Buy Whilst on Vacation

Excursions or other tours that you may choose to book or pay for whilst you are on holiday are not part of your package holiday provided by us. For any excursion or other tour that you book, your contract will be with the operator of the excursion or tour and not with us. We are not responsible, and will not be held liable, for the provision of the excursion or tour or for anything that happens during the course of its provision by the operator.

6.7 Fees Payable Locally

The country you travel to may require you to pay fees (including tourism fees) locally.

Please note that for stays in the Emirate states of Dubai and Ras Al Khaimah the Government has introduced a compulsory AED20 (approximately USD5.50) per room per night tourist tax, payable to the hotel upon check out. The UAE Government may introduce this tourist tax in other states or increase the current fee at any time and without notice.

7. Changing or Cancelling a Booking

7.1 If You Wish to Change Your Booking

If you wish to change your travel arrangements in any way, for example your chosen departure date or accommodation, we will do our utmost to make these changes but it may not always be possible.

Any request for changes must be made in writing (which in this clause, includes email) from the lead person on your booking or your travel agent. You will also be required to cover any supplier amendment fees and any increases to the cost of your vacation as a result of your amendment.

If you decide to make a change to your existing booking, in the event that we can meet that request, you will be charged a Change fee per person in addition to any applicable rate changes or extra costs incurred, as well as any costs incurred by ourselves and any costs or charges incurred or imposed by any of our suppliers. The change fee schedule is as follows:

Change Change Fee Per Person

First change request

Complementary + plus any applicable rate changes or extra costs incurred,  as well as any costs incurred by ourselves and any costs or charges incurred or imposed by any of our suppliers.

Each subsequent change

$50 per person + plus any applicable rate changes or extra costs incurred, as well as any costs incurred by ourselves and any costs or charges incurred or imposed by any of our suppliers.

If you wish to change your travel arrangements within 14 days of departure this will be treated as a cancellation and re-booking and you will have to pay the applicable cancellation charges set out in clause 7.3 You will also be required to cover any increase to the cost of your holiday as a result of your amendment.

Please note that certain travel arrangements may not be changeable after a reservation has been made and any alteration request could incur a cancellation charge of up to 100% of the cost of the original travel arrangement booking in addition to the charges above.

Please note when we quote a price for an amendment to your booking, this price is not guaranteed until the time you instruct us to make the change, and we will confirm the price at this stage.

When the price per person is dependent on the number of people in the accommodation and the number of people changes, the price will be re-calculated based on the new party size. Any increase in price payable is not a cancellation charge. A separate cancellation charge will be levied in respect of any bookings cancelled. A new booking confirmation will be issued as appropriate on which the cancellation charge will be shown.

Subject to the above, you will only be permitted to make date changes twice to your original booking dates. After this, date changes will automatically be treated as a cancellation and re-book regardless of how far out from departure at the time of request

7.2 If You Cancel Your Booking

You or any member of your party may cancel your travel arrangements at any time. Written notification from the lead passenger or your travel agent must be received at our offices.

Since we incur costs in cancelling your travel arrangements, you will be required to pay cancellation charges, which may in some instances be recovered under your policy of insurance. Please refer to 7.3 for details on cancellation and amendment fees.

Please note that if you do not cancel in advance you may also incur a no-show fee in addition to any other supplier imposed penalties.

Please note that certain travel arrangements may not be cancelled after a reservation has been made and any cancellation could incur a cancellation charge of up to 100% of the cost of the original travel arrangement booking.

7.3 Cancellation Charges

Please note, certain travel arrangements (including but not limited to travel during certain travel periods, specific room types and published flights and special fares) may not be altered or cancelled after a reservation has been made and any cancellation could incur a charge of up to 100% of the cost of the original travel arrangement booking. Please ask for full details of cancellation charges at the time of booking.

Period before departure unless otherwise indicated                                                                                                                  Cancellation charge as a % of total holiday cost (Excluding any insurance premiums and any amendment fees already paid to us)
Within 24 hours of making a booking No Charge
More than 75 days Loss of deposit
50 - 75 days 50% of the total holiday cost
15 - 49 days 80% of the total holiday cost
0 - 14 days 100% of the holiday cost

Separate cancellation charges may be applicable for certain arrangements (e.g. train journeys, cruise holidays, safaris) and during peak periods (e.g. public holidays, exhibitions and special events, Eid holidays, Christmas and New Year).

Please note that for certain travel arrangements and flights, the cancellation charge may be higher than those shown above. This includes, without limitation, certain travel periods and room types, published flights and special fares which are often non changeable and non-Refundable at the time of reservation. In these cases, tickets are often issued with the airline immediately and as such 100% cancellation fee applies as soon as the booking is made. Please ask for full details of cancellation charges at the time of booking.

Charges for amendments or cancellations are calculated from the date we receive your request or notification.

7.4 If We Change Your Booking

It is unlikely that we will need to make any alteration to your travel arrangements but sometimes circumstances change and alterations have to be made. We reserve the right to change your booking at any time. If we make a major change to your holiday, we will inform you or your travel agent as soon as reasonably possible if there is time before your departure. You will have the choice of either accepting the change of arrangements, accepting an offer of alternative travel arrangements of comparable standard from us if available (we will refund any price difference if the alternative is of a lower value), or cancelling your holiday and receiving a full refund of all monies paid.

You must tell us which one of the above choices you wish to make within 7 days of being informed of the major change we are making, or as soon as reasonably practicable if your departure is less than 7 days from the date you receive notification. If we do not receive notification from you about your choice, you are deemed to have accepted the change of arrangement proposed by us.

These options do not apply for minor changes.

Examples of minor changes include alteration of your outward/return flights by less than 12 hours, changes to aircraft type, change of accommodation to another of the same or higher standard, and/or changes of carriers.

We shall not be liable for any changes to or cancellation of a holiday due to events beyond our control. Examples of events beyond our control include, but are not limited to, war or threat of war, riot or civil disturbance, political unrest, terrorist activity or threatened terrorist activity, industrial disputes or threatened industrial disputes, strikes, fire, floods and other natural disasters, nuclear disasters, adverse weather conditions, acts of God, acts of government, closure of airports, and/or failure of a carrier, a hotelier or other person to operate services for any reason.

8. If Issues Arise During Your Vacation

8.1 If You Have A Complaint

It is strongly recommended that you communicate any complaint to the supplier of the services in question (e.g. hotel) as well as to our local representative/agent without delay and complete any available report form whilst on holiday. If you fail to do so we will have been deprived of the opportunity to investigate and rectify your complaint whilst you were on your holiday and this may affect your rights under this contract.

If your complaint cannot be completely resolved locally please follow this up within 30 days of your return home by writing to our Customer Services Department at Customer Relations, Emirates Vacations, P. O. Box 7631, Dubai, United Arab Emirates or by email: ekhcustomerrelations@emirates.com. providing your booking reference and all other relevant information.

8.2 Feedback

We value your feedback. If you would like to share feedback with us about your holiday experience, you can do so by post or email. Please provide as much information as possible, including your Emirates Vacations booking reference and holiday dates where applicable.

You can write to us at Customer Relations, Emirates Vacations, P.O. Box 7631, Dubai, United Arab Emirates or e-mail us at ekhcustomerrelations@emirates.com.

8.3 Our Liability to You

Our obligation is to take reasonable care in the performance of our contractual obligations, subject to and in accordance with these Booking Conditions. The Company is not itself a provider of accommodation, ground services, tours or other activities nor does it control the third parties who provide such services in connection with your holiday.

We do not accept liability for any injury, illness, death, loss, damage, expense, cost or other claim of any description whatsoever which results from (i) the act(s) and/or omission(s) of the person(s) affected or any member(s) of their party; or (ii) the act(s) and/or omission(s) of any third party regardless of whether they are connected with the provision of your arrangements and which were unforeseeable or unavoidable; or (iii) events beyond our control.

Except in the cases of death or injury, our liability is limited to a maximum of the booking price attributable to the person affected. You will only receive the maximum when you prove that no benefit or enjoyment has been obtained. In all other circumstances, we may agree to pay compensation that is reasonable and proportionate for the reduction in value of your booking and any loss of enjoyment you prove subject to the above maximum.

Where properties are not featured in our brochures or other literature or on our website, we will not be liable for any claims that such properties booked at your express request do not satisfy your expectations.

Your booking may be serviced by carriers, providers of accommodation, car rental companies, catering and other parties who have their own booking conditions of carriage and business and over whom we may have no direct control. Their booking conditions may strictly limit the circumstances in which compensation is payable to you by them and you agree to be bound by their booking conditions. Such booking conditions are available from us upon request. Air, sea, rail and road transport is subject to various International Conventions that limit the liability of the carriers. International Conventions which may apply include, without limitation: in respect of international air travel, the Warsaw Convention 1929 (as amended) or the Montreal Convention 1999; in respect of rail travel, the Berne Convention 1961; in respect of carriage by sea, the Athens Convention 1974; in respect of carriage by road, the Geneva Convention 1973; and in respect of hotels, the Paris Convention 1962. The carriage by air of passengers and their baggage is in addition subject to the Conditions of Carriage of the carrier concerned.
