The following are the Terms and Conditions for Xperience World Travel a (dba of Pickleball Sports Apparel LLC.) And are applicable for services provided by Xperience World Travel and any websites owned and operated by Xperience World Travel.
This Agreement describes the terms and conditions applicable to the services available through this Site and through our office. This Agreement describes Your responsibilities and, among other things, limits the liability of Xperience World Travel. Before submitting a travel information request or an account registration form and \or using any of the services provided by this Site or Xperience World Travel, please read all of this Agreement carefully. By accessing any areas of this Site or by using our services, users (“Users” or “You”) agree to be legally bound and to abide by these Terms and Conditions. If you do not agree with any part of these Terms and Conditions, You do not have permission to use my Site and You MUST NOT USE THIS SITE OR OUR SERVICES. Xperience World Travel reserves the right, in its sole discretion, to amend this Agreement at any time by posting the amended terms on this Site or by providing You with a copy of the amended agreement. The amended terms shall be effective from and after the earlier date that they are posted on the Site or otherwise provided to You by Xperience World Travel. Xperience World Travel acts as a travel agent only. We sell various travel-related products on behalf of numerous transport and accommodation service providers, including, but not limited to, airlines, coach, rail, cruise line operators, and hotels and escorted tours companies. Xperience World Travel does not own, operate, manage or control these independent suppliers of services and is not liable for their acts or omissions. Xperience World Travel’s obligations to you are to make travel bookings on your behalf and to arrange relevant contracts between you and the travel service providers. We have no responsibility for these services, nor do we have the authority to make any warranty or representation regarding their standards. Requests cannot be guaranteed. All bookings are subject to the terms and conditions and limitations of liability imposed by these travel service providers, not Xperience World Travel. You understand that your legal recourse is against the specific provider, not Xperience World Travel. Conditions can change rapidly in a country at any time. It is your responsibility to check the USA Government Travel advisories for your intended destination at travel.state.gov/content/travel.html.
You, the User, acknowledge that all content included on this Site or in documents received by personal delivery, mail, e-mail or fax, including the information, data, software, photographs, graphs, video, typefaces, graphics, music, sound, images, illustrations, maps, designs, icons written and other material and compilations (collectively “Content”) are intellectual property and copyrighted works of Xperience World Travel and \or various third party providers (“Providers”). Reproductions or storage of information or works retrieved from this Site, in all forms, media and technologies now existing or hereafter developed, is subject to the U.S. Copyright Act of 1976, Title 17 of the United States Code.
Trademarks and service marks or Xperience World Travel used by Xperience World Travel other product and company names identified on this Site may be the trademark, trade name, service mark, logo, symbol, or other proprietary designation of a third party. The use of services of any name, trademark, trade name, service mark, logo, symbol or other proprietary designation or marking of or belong to any third party, and the availability of specific good or services from such third party through Xperience World Travel should not be construed as an endorsement or sponsorship of Xperience World Travel by any such third party, or the participation by such third party in the offering of goods, services or information through Xperience World Travel. The services of Xperience World Travel are intended for personal or wholesale use. The content and information given to You, including without limitation, price, and availability of travel services, as well as the infrastructure used to provide such content and information, is proprietary to Xperience World Travel or its suppliers and providers. Accordingly, as a condition of using our services, You agree not to use this Site or its contents or information for any commercial or non personal purpose (direct or indirect) or for any purpose that is unlawful or prohibited by these Terms and Conditions. You agree not to modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell or re-sell any information, software, products, or services obtained from this Site. In addition, You agree not to access, monitor or copy an content or information of this Site using any robot, spider, scraper or other automated means or any manual process for any purpose without express written permission of Xperience World Travel.
Unless a Provider has agreed otherwise, all products, services, advice, merchandise, and information available through this Site or by Xperience World Travel are provided on an “as is”, “as available” basis without warranties of any kind, either expressed or implied, including but not limited to, warranties of title or implied warranties of merchantability or fitness for a particular purpose. Without limiting the above, no warranty or guarantee is made regarding the availability of products and/or services through the Site or, where applicable, at any participating retailer or retailer location; that use of this Site and all software, products or services associated with this Site will be error free; regarding the results that may be obtained from the use of this Site; regarding the completeness, accuracy, reliability or quality of any information content, data, service, advice or merchandise provided or available through this Site; or regarding the performance or non- performance of this Site. You expressly agree that the use of this Site and the services provided by Xperience World Travel is as Your sole risk.
IN NO EVENT SHALL XPERIENCE WORLD TRAVEL INCLUDING ITS RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRENTATIVES, AFFILIATES, OR PROVIDERS (COLLECTIVELY, THE ‘COVERED PARTIES’), BE LIABLE FOR ANY INJURY, DEATH, LOSS, CLAIM, DAMAGE, ACT OF GOD, ACCIDENT, DELAY, OR ANY SPECIAL, EXEMPLARY, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, WHETHER BASED IN CONTRACT, TORT, OR OTHERWISE, WHICH ARISE OUT OF OR ARE IN ANYWAY CONNECTED WITH ANY USE OF THIS SITE OR WITH ANY DELAY OR INABILITY TO USE THIS SITE, OR FOR ANY INFORMATION, SOFTWARE,PRODUCTS OR SERVICED OBTAINED THROUGH THIS SITE, EVEN IF A COVERERD PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMEGES.
Further, the Covered Parties accept no responsibilities for any damage and \or delay due to Provider cancellations, shortages, sickness, pilferage, labor disputes, machinery breakdown, quarantine, pandemic, government restraints, weather or causes beyond the Covered Parties’ control. No responsibility is accepted for any additional expense, omissions, delays, re-routing or acts of any governmental authority. No Covered Party shall be responsible for any Provider’s breach of any warranty including, but not limited to, implied warranties of fitness for a particular purpose or of merchantability, nor shall any Covered Party be responsible for any other wrongdoing of a Provider (including any liability in tort), as to any products and\or services available through this Site or by Xperience World Travel. No Covered Party shall be responsible for any Provider’s failure to comply with these Terms and Conditions nor for any Provider’s failure to comply with applicable federal, state and local law including, without limitation, laws governing the sale, warranty and return of perishable.
If, notwithstanding the above, a Covered Party is found liable for any loss or damage relating to the use of this Site or services provided by Xperience World Travel, User agrees the liability of any such party shall in no event exceed the fee or charge to the User assessed by Xperience World Travel in connection with the use of this Site. All comments, feedback, suggestions, and ideas disclosed, submitted, or offered to a Covered Party in connection with Your use of this Site (collectively, “Comments”), shall be and remain the exclusive property of Xperience World Travel and may be used by a Covered Party in any medium and for any purpose worldwide without obtaining Your specific consent. For example, Your Comments could be used on this Site and in radio, television and print advertisements. Your first name, first initial of Your last name, and town and state may be used with any Comments You submit. No Covered Party is under any obligation to maintain Your Comments (and the use of Your first name and first initial of Your last name with any comments) in confidence, to pay to You any compensation for any Comments submitted, or to respond to any of Your Comments. You agree, You will be solely responsible for the content of any Comments You make.
To the extent this Site contains links to outside services and resources, and concerns regarding such services or resources should be directed to the particular outside service or resource provider. None of the Covered Parties guarantees or warrants the accuracy or completeness of the information or content included on the Website of these outside services and resources.
Before Booking with Xperience World Travel please read the following:
XPERIENCE WORLD TRAVEL STRONGLY SUGGESTS THAT YOU PURCHASE TRAVEL INSURANCE.
Travel Insurance: Xperience World Travel strongly suggests YOU purchase separate travel insurance to cover possible additional costs. If You choose not to or fail to purchase travel insurance, You are fully responsible for any costs related to the cancellation or delay of Your travel purchase. Refunds are not possible for any reason, so please protect Your travel investment with travel insurance. Comprehensive travel insurance benefits may include trip cancellation, interruption, travel delay, lost baggage, worldwide health and medical coverage, emergency medical evacuation, hurricane protection, terrorism and more.
LIABILITY: Xperience World Travel is not liable for any negligent or willful act or failure to act of any travel service provider or of any third party. In addition and without limitation, Xperience World Travel is not responsible for any injury, loss, death, inconvenience, delay, or damage to person or property in connection with the provision of any goods or services, whether resulting from, but not limited to, acts of God or force majeure, illness, disease, acts of war or civil unrest, insurrection or revolt, animals, strikes or other labor activities, criminal or terrorist activities of any kind, overbooking or downgrading of accommodations, mechanical or other failure of airplanes or other means of transportation, or any failure of any transportation mechanism to arrive or depart on time. Also be advised that certain foreign facilities or amenities, such as air-conditioning systems in public places, hotels, and motor coaches may not be up to U.S. standards. If due to weather, flight schedules, or other uncontrollable factors you are required to spend additional night(s), you will be responsible for your own hotel, transfers, and meal costs. Baggage is entirely at owner's risk. You may see the name Xperience World Travel affixed to motor vehicles, on signs around the hotel, or elsewhere. This use of our name is purely for reasons of identification and does not denote ownership, supervision, or control by Xperience World Travel in any way. The prices of these tours are based on rates in effect (including foreign exchange rates) at the time of printing and are subject to change without notice. Under circumstances where liability cannot be excluded, such liability is limited to the value of the purchased travel arrangements. You specifically agree that Xperience World Travel is not liable for any consequential loss or damage.
PASSPORTS: All individuals departing from the United States of America must be in possession of a valid passport. Please check that your passport is valid for at least 6 months beyond your intended travel time. It is your responsibility to ensure that you have valid travel documentation, including but not limited to passports and visas, which meet the requirements of immigration and other government authorities at every destination. You are responsible for confirming with the United States Department of State or the representative government agency of the country to which you are traveling to confirm the requirements for visas and/or other requirements for admission to your destination. Any fines, penalties, payments, or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be your sole responsibility.
PRE-DEPARTURE DOCUMENTATION: It is important that you carefully read all trip-related documents that you receive from us as soon as you receive them. It is your responsibility to contact us if any information is incorrect. We cannot accept any liability if you do not notify us of any inaccuracies within 45 days of your receipt of those documents. This agreement, our release and waiver of liability and assumption of risk and indemnity agreement, and, if required, a medical statement or certification must be signed and submitted by you in order to travel with us. If we do not receive these signed documents from you prior to departure, we reserve the right to treat your booking as cancelled by you and impose the cancellation fees described in this agreement.
HEALTH AND MEDICAL: Our tours are physically active, with varying levels of demands and fitness requirements depending on the specific itinerary. You represent that neither you nor the Child (if applicable) do not have any condition, physical or mental, that would create a hazard for you or other participants or affect other people’s enjoyment of the tour. You understand that you are solely responsible for determining your emotional and medical suitability for the tour and will consult with your, or the Child’s, physician and/or a travel medicine expert, regarding medical and health safety precautions appropriate for the Tour. You represent and warrant that you have answered fully and truthfully the questions posed to you on the guest questionnaire regarding your and/or the Child’s, medical history and condition, and will notify Boundless Journeys immediately if those answers require amendment or supplementation.
Note that we are not a medical authority. If you have a physical condition, dietary restrictions, or other conditions (pre-existing medical) that will require special attention during the tour, you must inform us in writing when the booking is made. We may require a medical certificate if you have a special condition.
We assume no responsibility for any medical care provided to you. You agree to assume all costs of medical care and related transportation that are provided to you during the tour.
REAL ID: Beginning May 7, 2025, if you plan to use your state-issued ID or license to fly within the U.S., it is your responsibility to make sure it is REAL ID compliant. If you are not sure if your ID complies, please check with our local state department of motor vehicles, or visit www.tsa.gov/real-id.
TRAVEL DOCUMENTS: Travel documents include, without limitation, airline tickets, hotel vouchers, tour vouchers, or any other document (whether in electronic form or otherwise) used to confirm an arrangement with a service provider. Travel documents may be subject to certain conditions and/or restrictions such as, but not limited to, being non-refundable, non-date-changeable, and subject to cancellation and/or amendment fees. Travel documents cannot be transferred to another person to use. All airline tickets must be issued in the name of the passport/photo identity holder. An incorrect name on a booking may result in an inability to use that booking and the booking being cancelled. Any errors in names, dates, and timings may result in an inability to use that booking and the booking being cancelled. Any errors in names, dates, and timings on your documentation will be your responsibility if we are not advised at the time of booking. Please reconfirm your flights at least 24 hours prior to departure.
HEALTH AND SPECIAL REQUIREMENTS: It is your responsibility to ensure you are aware of any health requirements, health advisories, or health travel restrictions applicable to your travel destinations and to ensure that you carry all necessary vaccination documentation. Xperience World Travel is not responsible for providing you with this information. Travel carriers and local authorities at travel destinations may require specific testing prior to boarding and/or upon arrival at your destination, including, but not limited to, a temperature check as a result of the COVID-19 pandemic. You may be denied entry onto your carrier and/or entry upon arrival at your destination, or be required to self-quarantine at your destination and upon your return to the United States. You must comply with local government regulations. Additional costs are your responsibility. Check with the Center for Disease Control and Prevention for current information prior to and during your travel. www.cdc.gov
FLIGHT CONFIRMATION: We strongly suggest that clients reconfirm exact flight times with the carrier prior to departure. Air travelers are required to check in at least 2 hours prior to departure time for domestic flights and 3 hours for international flights and must report to the gate at least 30 minutes prior to departure time. Failure to comply may result in the loss of the seat to another passenger.
INTERNATIONAL FLIGHTS: Some countries require insecticide spraying of aircraft prior to a flight or while you are on the aircraft. Federal law requires that we refer you to the Department of Transport disinfection website. (www.transportation.gov/airconsumer/spray).
REFUSAL OF SERVICE: Service providers reserve the right to refuse service to travelers at their sole discretion, including, without limitation, if the traveler: (i) Lacks proper documentation for the country of destination; (ii) Has a contagious disease; (iii) Is under the influence of alcohol, drugs, or narcotics; and/or (iv) Manifests disruptive and/or unruly behavior. Xperience World Travel assumes no liability for the acts of the service provider in refusing service.
FOR ALL BOOKINGS:
Xperience World Travel offers many services including but not limited to airline tickets, accommodation rooms, rental cars, customized vacation packages, villa rentals, apartment rentals, sightseeing tours, private guide service, cooking classes, museum and event ticketing, rail ticketing, escorted tours, group travel and corporate incentive programs.
REFUNDS: Because Xperience World Travel pre-pays its vendors for Your trip we cannot offer a refund after full payment has been received. There is a 100% penalty for a NO SHOW. If you have paid in full, and then cancel more than 90 days prior to departure we will do our best to get any refundable amount that has already been paid but we cannot guarantee a refund. If You fail to purchase travel insurance, You are fully responsible for any costs related to the cancellation or delay of Your travel package. Refunds are not possible for any reason, so please protect Your travel investment with travel insurance. Once You have paid in full or begun Your trip, substitutions, cancellations, or changes are not possible for any reason. All services are prepaid on Your behalf and cannot be changed at the last minute.
Important Conditions: Prices are subject to increase prior to the time you make full payment. Prices are not subject to increase after you make full payment, except for charges resulting from increases in government-imposed taxes or fees. By signing below you expressly acknowledge your acceptance of these conditions (i.e. increases before full payment and increases attributable to government -imposed taxes or fees after full payment will be your responsibility) applicable to your purchase.
DISABILITIES: Any preexisting physical, mental, or emotional disability that may require attention or treatment must be reported in writing prior to the beginning of travel planning. A medical release form may be required to participate in adventure programs and other programs involving physical exertion offered by Xperience World Travel. This is noted in the description of such trips.
Escorted and Group Tours
Deposits: All deposits are non-refundable. Deposits start at $300 per person for all escorted and group tours, unless otherwise stated in writing. All bookings must be paid in full 90 days prior to departure. Your reservation is not confirmed until 7 days after we receive Your deposit. Under no circumstances will You be allowed to depart on a tour without having made full payment.
Refunds: are not possible for unused meals, entrance fees, accommodations, transportation, etc. No substitutions of any kind will be permitted. The “trip inclusions” begin at the designated time and place on “day one” of the itinerary, and end after breakfast on the last day outlined in the itinerary. Xperience World Travel acts only as an agent in securing hotels, transportation, and other travel services, and in no event shall Xperience World Travel be liable in the event of any failure by any person or company to render any transportation, lodging, or other travel services to be provided on the trip. Any cancellation fees or penalties will be Your responsibility. If You fail to purchase travel insurance, You are fully responsible for any costs related to the cancellation or delay of Your tour. Refunds are not possible for any reason, so please protect Your travel investment with travel insurance.
By placing Your deposit for travel, You agree that You have read and understand Xperience World Travel no refund policy.
Custom Trip Planning
With Xperience World Travel custom trip planning service, customers work with a Travel Specialist to plan their trip from beginning to end. With Xperience World Travel custom trip planning service, customers choose the star level or type of accommodation they want, along with the desired city or location, dates, and budget they would like to stay within. Xperience World Travel then works to find accommodations, services, sightseeing tours, villas, escorted tours or packages at the customer’s desired budget and the client’s desired route and date of travel.
All clients who use our custom trip planning service will receive the following benefits:
- Maps, sightseeing guides, regional information, basic driving directions if renting a car, travel tips and complimentary travel documents.
- Contact information for any problems that arise during Your trip.
- One-on One personalized consultation with a Travel Specialist with experience in Your destination of travel
- Xperience World Travel will supply You with the total packaged price of all services including all taxes before You are asked for final payment. The services and items listed in the package price are priced as and presented as a “package”. Individual items prices listed in a package will not be released. A fee may be incurred for planning this type of package or a FIT tour.
Deposits
Once Xperience World Travel has agreed to plan Your travel and before any services are booked, You will be asked to place a nonrefundable deposit of at least $300 per person to begin confirming requested services. All bookings must be paid in full 90 days prior to departure. Your reservation is not confirmed until 7 days after we receive Your deposit of at least $300 per person. Under any circumstances, full payment is required prior to departure and receiving Your final confirmation kit.
General Conditions
Forms of Payment: Xperience World Travel accepts major credit cards. Your credit card will be used to secure sailings, accommodation’s, sightseeing tours, motor coaches, escorted tours, dining reservations etc. and will be given directly to the supplier to reserve the above-mentioned services. Xperience World Travel does not give or sell EVER any credit card or personal data to any provider without your knowledge or consent. The Total Charges” that You will pay for using our services will always be disclosed to You before You are asked for final payment.
Chargeback Policy
If You have a complaint about any service we provide, please contact us first. Customer satisfaction is Very important to us, and we strive to stand behind our products and services that we sell. We will make every attempt to ensure that You are completely satisfied with the services we’ve provide You. Xperience World Travel considers credit card charge backs to be fraud if You made no reasonable effort to notify us that a problem existed, or to resolve or clarify a situation or matter. You agree that You will not chargeback any amounts charged to Your credit card by Xperience World Travel. If You chargeback a credit card for a payment initiated by You, You agree that we may recover the amount of the chargeback, as well as the chargeback fee of $150. By any means we deem necessary.
Accommodations and Special Requests:
Accommodation and services made available through Xperience World Travel website or offices are subject to these disclosed terms and conditions.
Xperience World Travel will supply general descriptions, photographs, location information, amenities, and other detailed information to help You have all You need to make an informed booking decision, You will be given an accommodation reference number or name that represents the accommodation within our database only. The exact accommodation with complete name, address and contact information will be given only after purchase. This policy prevents competitors or others from undermining our efforts to supply a complete service to our customers. Our goal is to provide our customers with a high level of personalized service and offer a level of knowledge about Your destination unmatched by any other company.
All accommodations reservations are guaranteed for double occupancy (one double bed or two twin beds unless You have requested otherwise). Other reservations for apartments, villas, etc. will list the service booked on the voucher issued. Xperience World Trave requests that our accommodation suppliers provide non-smoking rooms. However, room assignments are based on availability and are at the accommodation’s discretion. We cannot guarantee a non-smoking room, nor can we guarantee You will have one bed or two, If You have special requests (such as smoking room, pet accommodations, type of bedding, connecting rooms, view, floor location, etc.) You must call the accommodation and verify that special requests can be met after Your reservation is confirmed. Xperience World Travel makes no guarantee that special requests will be met. An accommodation reservation cannot be refunded, canceled, or modified on the basis that a special request was not (or could not be) met by the accommodation.
Accommodation Star Ratings:
Xperience World Travel star rating system is provided for Your reference. Like other well-known accommodation rating systems. Xperience World Travel uses a number of factors in evaluating the quality of participating accommodations such as: size of rooms, décor/furnishing, amenities, public areas, hospitality services, maintenance/housekeeping, reputation. Xperience World Travel screens participating accommodations carefully and updates our information periodically to ensure the validity of our ratings. Our rating systems may sometimes differ from those of other rating systems that You may be familiar with. We do not warrant or guarantee that our star rating system is identical to or consistent with any other star rating system.
Xperience World Travel will book Your reservation in a property with at least an equal or higher star level that You requested. Please note that is possible that the accommodation You are booked in could be a Resort or Boutique accommodation, which will at least meet the minimum qualifications of the star level You initially requested.
Late Arrival and Failure to Check-in on First Night:
If You are going to be delayed, cannot meet Your transfer or find that You cannot check in to Your accommodation on the date and time You requested, You must contact the accommodation to let them know. If You fail to check in to Your accommodation on the day of Your reservation and do not alert the accommodation, Xperience World Travel or the service provider, the remaining portion of Your reservation will be canceled, and You will not be entitled to a refund.
Special Needs:
If You have special needs (e.g., wheelchair accessible room) You must tell Your Travel Specialist in advance and verify that special needs can be met. So long as You give advance notice before paying Your deposit, your accommodation reservation will be refunded, canceled, or modified if special handicapped needs cannot be met.
Must be 21 Years of Age: The guest on the reservation must be 21 years or older to check into the accommodation.
Frequent Traveler Points: Frequent Traveler points, upgrades, certificate vouchers and other discounts or incentives will not apply to Xperience World Travel services.
Service Issues:
Proper protocol must be followed to report any issues. Failure to do so will eliminate our ability to properly handle the issue, and Xperience World Travel is not responsible for any loss that occurs due to the issue.
Issue Protocol:
If You experience an issue with a service or tour, You must first contact the number or numbers of the service provider listed on Your voucher or other documentation. If You are unable to reach someone at those numbers provided, You must call the emergency number of the county You are visiting and of the service provider. If You are unable to reach someone at that number, You must then contact the USA office. If it is after hours, You must call the USA Emergency number. Once You have reached the service provider, You must fully explain the issue and provide them with a contact number to reach You. If the issue is not resolved to Your liking, You must call the USA office to inform us of the issue. If the USA office or USA emergency number is not contacted, we will not be able to assist You with Your issue, and we will be unable to offer a resolution this is speedy and fair.
If You experience an issue a hotel or other overnight accommodation, You must first contact the property manager to see if the issue can be resolved at the property. If not, please follow the protocol for service or tour issues.
Complaints:
Should any complaints arise with regards to any services, accommodation or tours, the matter must be promptly reported by the guest to the tour leader if on a tour, to the hotel AND directly to Xperience World Travel. Xperience World Travel will supply You with the local and international number for any problems that arise. All complaints will be dealt with fairly and without delays. The guest must notify Xperience World Travel within 12 hours of any issues during the period of their stay in order for Xperience World Travel to take immediate action so as to solve the matter during Your stay. Xperience World Travel and its subsidiaries are not responsible for any complaints received after the fact or after You have departed from the hotel, villa, or service which the complaint applies, Xperience World Travel is not liable for problems that arise the Xperience World Travel is not notified of in a timely manner that affords Xperience World Travel the opportunity to correct the problem.
Trips cancelled or changed by Xperience World Travel and Flexibility
Although unlikely, Your trip may be canceled due to unforeseen circumstances. If Xperience World Travel cancels a trip You have paid for, the entire amount You have paid to Xperience World Travel will be refunded to You within (14) fourteen days after the trip’s cancellation. Once this occurs, Xperience World Travel and its representatives will have no other obligations to customers on canceled trips. Xperience World Travel is not responsible for refunds on airfare purchases. Xperience World Travel is registered with the State of California as a seller of travel.
Please be aware that most travel bookings are non-refundable and cancelled bookings will incur charges. These charges can be up to 100% of the cost of the booking, regardless of whether travel has commenced. Where we incur any liability for a cancellation fee or charge for any booking that you cancel, you agree to indemnify us for the amount f that fee or charge.
We reserve the right to cancel, alter or modify any tour without prior notice for any reason, including but not limited to for the safety and/or comfort of clients and for circumstances of Force Majeure, which is defined in this agreement below. This includes the right to replace or substitute guides and accommodations in the tour materials, modify the order in which places are to visited, and make other changes in the itinerary. You acknowledge that the amenities, accommodations, transportation, route, schedule, and itinerary may change without prior notice due to local circumstances or events, which may include mechanical breakdown, flight cancellations, illness, strikes, political disputes, weather, border crossing problems, and other unforeseeable factors. If, prior to departure, we make a significant change because of a problem with a supplier (e.g., bankruptcy), we will, as soon as reasonably possible, notify you of available alternatives.
If we must cancel due to insufficient tour enrollment, all trip members will be notified a minimum of 60 days before the trip departs and will receive a full refund of payments made to Xperience World Travel.
Any changes may require a supplemental payment from you or result in a partial or full refund. This refund will constitute full settlement of claims you may have arising out of our cancellation. Unless doing so would create an unstable financial situation for us, we will refund any deposits already paid in the event of a cancellation due to Force Majeure less any non-refundable deposits paid to our third party suppliers. We will work with our suppliers to try and obtain any non-refundable deposits so that we can give you a full refund. We cannot guarantee such a result, though.
DEPOSITS AND PAYMENTS. Payments are due as follows:
Scheduled Group Departures:
At booking: Deposit of $500 USD per person, plus internal airfare (if applicable).
90 days prior to Scheduled Group departure: Balance due.
Custom Tours:
Custom Tour planning fee: $250 USD paid after initial consultation (will be deducted from final balance).
Initial group deposit: $500 USD to proceed with confirmation of Custom Tour dates.
Within two weeks of confirmation: $500 USD per person, plus internal airfare (if applicable).
120 days prior to Custom Tour departure: Balance due.
Group size pricing adjustments: The custom tour price is based on the number of participants in your group and the agreed upon itinerary. If your group size decreases in size prior to departure, we reserve the right to adjust the price accordingly.
Exceptions: Payment schedules for some safaris, custom trips, and certain special events vary from the above schedule. These exceptions are noted in the detailed trip itineraries.
All payments may be made by check or credit card. Prices are in US dollars, and all payments must be made in US dollars. If you pay by check, your reservation will be considered provisional until the check has cleared the bank. Returned checks will incur a returned check fee.
CANCELLATIONS BY YOU AND REFUNDS: To cancel your booking, you must call us immediately and then promptly send notification in writing to us and your travel agent (if applicable) by email or mail. When providing notice to us, call our office at 1-805-400-8145 and then send written notice to us by email at xperienceworldtravel@gmail.com, or mail at Xperience World Travel 6249 Sunmist Way Citrus Heights Ca 95621. Cancellation fees will be applied per person according to the following schedule, based on the date we receive your written notification, not when you send it or notify us by phone:
Standard cancellation fee schedule for Scheduled Group Departures**
- Minimum fee is $100 per person
- 90 to 61 days prior to departure: 25% of the trip price
- 60 to 46 days prior to departure: 50% of the trip price
- 45-0 days prior to departure: 100% of the trip price
Standard cancellation fee schedule for Custom Tours**
- Deposit is nonrefundable.
- 120 to 91 days prior to departure: 25% of the trip price
- 90 to 61 days prior to departure: 50% of the trip price
- 60-0 days prior to departure: 100% of the trip price
**Note: Cancellation and transfer schedules for cruises, safaris, custom trips, and certain special events and private trips are often stricter. These exceptions are clearly indicated in the cancellation policies for each of these trips. Internal airfare purchased on your behalf by Xperience World Travel is subject to the airline’s cancellation policies.
***Non-refundable deposits: If we make special arrangements for you that require payment of non-refundable deposits to suppliers, we may subtract any such deposit from any refund due to you.
No refunds will be provided for any unused portion of a tour once the tour begins, including if you leave a tour for any reason, miss the tour’s departure date, or have to be removed from a tour. There are no exceptions to this cancellation and refund policy, including for reasons related to weather, civil strife, personal, family or medical emergencies or any other circumstances beyond our control.
For this reason, we Highly Recommend that you purchase trip cancellation and interruption insurance.
SINGLE SUPPLEMENT: Accommodations are based on double occupancy. A single supplement is paid for by participants who specifically request single accommodations, subject to availability.
Single Supplement for Scheduled Group Departures. If you reserve at least 120 days prior to departure, you may be eligible for a reduced or free single supplement. This is generally limited to the first one or two solo travelers to reserve, and the reduction is outlined in the pricing for each trip. Free or reduced single supplements are not combinable with other offers or promotions.
If you are traveling alone and wish to share accommodations, we will try to match you with a roommate of the same gender. If you reserve at least 120 days ahead and request a roommate but one is not available, you will receive a $500 reduction from the standard single supplement (unless otherwise noted in the detailed itinerary for your specific trip).
Single Supplement for Custom Tours. Custom Tour prices are generally based on two or more participants; therefore, single supplements for “solo” Custom Tours will vary and are available upon request.
TRANSFERS: You may transfer to another scheduled trip that is within the same calendar year without penalty by notifying us of your wish to transfer more than 120 days prior to the original trip’s scheduled departure. After that time our normal cancellation fees apply.
CHANGES BY YOU: If you request to change your tour dates or alter your itinerary after we confirm your booking, we will do our best to accommodate your request. If we can make such changes, a change fee may be applied. (There are no change fees for transfers described in the preceding paragraph.) The type and scope of change dictates the amount of the change fee and such fees can be substantial. Our outside suppliers, including hotels, often impose additional fees or penalties for changes and cancellations.
PRICE ADJUSTMENTS: Quoted trip prices are set far in advance of departure based on our projections of fuel, exchange rates, inflation, tariffs, government fees, airfares and other costs using available information. The price at booking is guaranteed under normal conditions. In the rare event that current costs create an unsustainable financial situation if we were to fully absorb the increases, we reserve the right to pass on these unexpected costs to you in whole or in part. We will give you advance written notice of any price increase and the reason for it. If we do so and your trip price increases by more than 10% of the original tour cost excluding any insurance premiums, you may cancel the booking within 10 days of receipt of notice of the surcharge and obtain a full refund, less any non-refundable deposits to our suppliers. We will work with our suppliers to try and obtain any non-refundable deposits so that we can give you a full refund. However, we cannot guarantee such a result.
A NOTE REGARDING ISSUED CREDIT: If your trip was postponed and you have scheduled a new journey, or not yet decided on your future travel, you have received a travel credit. Xperience World Travel credits have no cash value, can be used towards the costs of a Xperience World Travel trip only, and are subject to our payment, transfer, postponement, and cancellation policies (Terms & Conditions). Your credit will be applied toward your new trip, and a cost difference may apply. If the new cost is lower, you will receive a credit for the difference. If the new cost is higher, the difference will be collected from you according to our payment terms.
ALTERATIONS OR CANCELLATION BY YOU AFTER COMMENCEMENT OF TRAVEL: We will forward any alteration that you request after your tour has commenced to our independent suppliers. We will work with them to try and accommodate reasonable requests but cannot guarantee that any changes will be possible after your tour has commenced. Changes after departure can create severe complications. In the event you request a change, you will be liable for any cancellation charges and change fees that may be imposed for the booking of revised arrangements and for all costs associated with the arrangements themselves.
Exchange Rate:
In the event of currency exchange fluctuations between the U.S Dollar and the destination currency, Xperience World Travel reserves the right to adjust accordingly the cost of the “trip or “trips”. Your currency exchange rate is not locked until final payment.
Rental Car Service
The following terms and conditions will apply to rental car requests made:
- Xperience World Travel rental care reservations are non-changeable, non-endorsable, non-transferable, and non-refundable to or by You:
- Valid Drivers’s License AND credit card or, in the rental car company’s discretion, debit card, which is consistent with the transactional details provided to Xperience World Trave, must be presented when a vehicle is picked-up at the designated location.
- When picking up the vehicle, a credit card or, at the rental car company’s discretion, debit card, will be required to pay for any additional ancillary charged (including insurance, child seats, gas etc). Debit cards may not be accepted:
- Xperience World Travel does NOT provide rental car insurance. It is the customer’s sole responsibility to determine the applicability and eligibility of any preexisting insurance coverage. Xperience World Travel’s car rental suppliers generally offer several insurance alternatives as an incremental and completely distinct transaction, which the customer can purchase at the time of pick-up. In some cases, it may be possible to purchase rental car insurance at the time of booking Your services, if this is desired, please inquire.
- All rentals will include time and mileage only and are subject to road tax and other charges as per the terms of the rental car company.
- Express service and loyalty programs (frequent flyer points, frequent rental points, etc.) are not applicable to Xperience World Travel rentals.
Vacation Packages
Vacation packages available through Xperience World Travel will be subject to the published conditions of carriage and, as appropriate, rules of the applicable airline, accommodation, car rental company, or attractions and services provider. The following terms and conditions will apply:
- Any package including an airline ticket purchase is subject to the terms and conditions listed in the Airline Service section.
- Any package including an accommodation purchase is subject to the terms and conditions listed in the Accommodation section.
- Any package including a car rental purchase is subject to the terms and conditions listed in the Car Rental section above: and
- Any package including a tour or attraction purchase is subject to the Terms and Conditions listed in this Terms and Conditions document and is subject to the terms and conditions set forth by the tour and attraction provider.
Airline Services
In addition, the following terms and conditions apply to Xperience World Travel booking Your airline services:
- All tickets are non-refundable, non-endorsable and non-changeable unless specifically stated otherwise on an individual case basis only. Credit will not be given for any unused airline tickets and cannot be used toward any future purchases unless specifically stated otherwise on an individual case basis only.
- Once an airline ticket is purchased, any modification by Xperience World Travel will incur an additional expense to You;
- All airline tickets will be subject to the terms and conditions of the issuing supplier or airline.
RESPONSIBILITY: Certain services reserved by Xperience World Travel, including but not limited to transportation, accommodations, restaurants, sightseeing and activities may be purchased from various independent suppliers not affiliated with Xperience World Travel (referred to as “Third Party Supplier(s)” or “Supplier(s)”). Xperience World Travel takes reasonable care in selecting competent, reliable and qualified suppliers based on information that is reasonably available to us. That said, we act only as an intermediary for these Third Party Suppliers and do not and cannot control the quality of their services. You acknowledge that you are aware and clearly understand that these Third Party Suppliers are independent contractors, are not managed by Xperience World Travel, and are not agents or employees of Xperience World Travel. In the event of an injury, damage to property, delay or any other loss, compensation must be sought from the Third Party Suppliers, not from Xperience World Travel. You understand further that each of these Third Party Suppliers is subject to the laws of the state or country in which the service is provided. The liability of Third Party Suppliers may be limited by their tariffs, conditions of carriage, tickets and vouchers, and international conventions and agreements.
PRE-DEPARTURE DOCUMENTATION: It is important that you carefully read all trip-related documents that you receive from us as soon as you receive them. It is your responsibility to contact us if any information is incorrect. We cannot accept any liability if you do not notify us of any inaccuracies within 45 days of your receipt of those documents. This agreement, our release and waiver of liability and assumption of risk and indemnity agreement, and, if required, a medical statement or certification must be signed and submitted by you in order to travel with us. If we do not receive these signed documents from you prior to departure, we reserve the right to treat your booking as cancelled by you and impose the cancellation fees described in this agreement.
DOT Regulations
Please be aware of:
1) Fees and taxes that You may be charged during Your trip that are not included in the vacation package price given (ie foreign airport taxes levied upon arrival and /or departure);
2) Any hotel taxes that will be charged upon check-in or check-out (ie local city hotel tax, bed tax);
3) Baggage fees for airfare or for specific seats.
4) Taxes for airfare (changes in taxes after You have purchased Your ticket).
5) Other fees for airfare not included in Your initial vacation purchase.
Xperience World Travel and all its partners, suppliers, subsidiaries and affiliates, make every effort to honor the package price quoted originally, however: under certain circumstances Your price may be subject to increase prior to full payment due to an increase in the cost for one or more of the travel components of Your package. By booking through Xperience World Travel and /or a subsidiary there of, You expressly acknowledge Your acceptance of these conditions applicable to Your purchase.
Additional Travel & Accommodation Terms and Conditions
In addition to any terms and conditions described above, the following terms and conditions apply to Xperience World Travel custom trip planning services:
- All accommodation reservations are non-cancellable, non-refundable, non-changeable and non- transferable by You. Once You purchase a reservation, Your method of payment will be charge for the amount shown, regardless of whether or not the reservation is used. Credit will not be given for any unused reservations and cannot be used toward any future purchases.
- Once Xperience World Travel request has been booked, it cannot be modified by You;
- Upon check-in, guests must present a valid ID and credit card or, in the accommodation’s discretion, debit card, in their name that is consistent with the transactional details provided to Xperience World Travel, (the amount of available credit required will vary by accommodation). Debit cards may not be accepted. You will be given vouchers which outline the service You have booked with Xperience World Travel and such vouchers must be presented at time of check-in.
- A Voucher, when issued by Xperience World Travel and presented to the Attraction Operator, tour guide, transfer or accommodation shall entitle the person named on the Voucher, subject to these Travel & Accommodation Terms and Conditions, to use the service described in the Voucher. The service operator will verify the identity of the person named on the Voucher prior to accepting the Voucher; and may require a signature from such named person(s). The person named on the Voucher will be required to present a government issued photo ID to the Service Operator.
- A Voucher is valid for redemption only by the person named on the Voucher. A Voucher has no cash value and cannot be assigned, or transferred, in whole or in part.
- The issuance of a Voucher by Xperience World Travel or its subsidiaries is final. There are no refund, credits, exchanges, or cancellations of a Voucher once it has been issued by Xperience World Travel. A Voucher is like cash: a destroyed, lost, or stolen Voucher cannot be reprinted, reissued, or refunded. A Voucher may be redeemed only once and only by the Service Operator. Before departing on Your trip, You should confirm that the information that a Voucher contains is accurate;
- Service availability may change after a Voucher is issued. When Xperience World Travel is informed in advance of a significant change to the availability of a service or accommodation, Xperience World Travel will use reasonable efforts to notify You. IN the event a service is canceled, rescheduled or postponed by the Service Operator, You should immediately contact Xperience World Travel:
- Xperience World Travel reserves the right to modify and otherwise change these Terms and Conditions at its sole discretion. No amendment, modification or waiver to these Terms and Conditions shall be binding on Xperience World Travel unless made in writing and signed by an authorized officer of Xperience World Travel.
- YOU ACKNOWLEDGE THAT THE USE OR ENJOYMENT OF THE SERVICES BOOKED MAY BE HAZARDOUS AND INHERENTLY RISKY. TO THE MAXIMIM EXTENT PERMITTED BY LAW, YOU AND THE PERSONS NAMED ON THE VOUCHER WILL ASSUME ALL RISK OF PERSONAL INJURY OR DEATH, OR LOST, STOLEN, DAMAGED OR DESTROYED PROPERTY; OR OTHER LIABILITY, ARISING OUT OF OR IN CONNECTION WITH THE USE AND OPERATION OF THE SERVICES BOOKED, AND ALL ACTIONS OR EVENTS OCCURRING PRIOR TO, DURING, AT OR AFTER, THE SERVICE.
FURTHERMORE, TO THE MAXIMUM EXTENT PERMITTED BY LAW, XPERIENCE WORLD TRAVEL SHALL HAVE NO LIABILITY FOR ANY PERSONAL INJURY OR DEATH: OR LOST, STOLEN, DAMAGED OR DESTROYED PROPERTY; OR OTHER LIABILITY ARISING OUT OF OR IN CONNECTION WITH THE SERVIED BOOKED, AND ALL ACTIONS OR EVENTS OCCURRING PRIOR TO, DURING, AT OR AFTER, THE SERVICES BOOKED. I ASSUME THE RISK AND EXPENSE OF ALL SUCH INJURY, DAMAGE, LOSS, ADDITIONAL EXPENSE, ACCIDENT, DELAY, SCHEDULE CHANGE OR OTHER IRREGULARITY.
10) Xperience World Travel will assign a Travel Specialist to assist You throughout the planning of Your trip. You are responsible to supply any flight schedules, passport named, or information needed to plan Your trip in a timely manner. Xperience World Travel is not responsible for delays caused by information not given to us in a timely manner. If You have any questions about this, please call our office, we will be happy to answer any questions You Have. Every Reasonable effort will be made by Xperience World Travel to supply itineraries, services and accommodations as outlined. If these cannot be supplied due to causes beyond Xperience World Travel’s control
Xperience World Travel reserves the right without prior notice to substitute or delete such service and accommodations.
Entire Agreement, Modification, No Waiver. These terms & Conditions constitute the entire and only understanding between the parties and replace any prior understandings or agreements (whether oral or written) relating to the subject matter hereof. The failure of Xperience World Travel to exercise any of its rights shall not be construed as a waiver or relinquishment of the future performance of any of its rights, and Your obligations with respect to such future performance shall continue in full force and effect.
Pandemics, state of emergency. In the event of health pandemics or states of emergency, the suppliers operating Your trip may change, delay, or cancel the services they offer for your trip at their sole discretion and with little or no advance notice. Government officials in the destinations you visit may change entry requirements, health protocols and other rules for inbound visitors (including health screenings and tests and mandatory quarantines) at their discretion and with little or no advance notice. You agree that Xperience World Travel shall not be liable for any loss or damage caused by such changes, delays, or cancellations. You understand and agree that it is Your responsibility to comply with the government’s rules in the destinations You are visiting that are in effect during Your trip.
Force Majeure. Xperience World Travel shall not be deemed to be in breach of any terms and conditions or otherwise liable to You, and shall not be required to provide any refund due to delay in performance or non-performance of any of Xperience World Travel obligations hereunder due to any circumstances beyond Xperience World Travel’s control, including, but not limited to , acts of God, explosion, flood, forceful wind, fire, accident, war or threat of war (declared or undeclared). Acts of terrorism sabotage, insurrection, riots, strikes, civil disturbance, sickness, epidemics, pandemics, quarantines, government intervention, weather conditions, defects in machinery and vehicles, delays, bankruptcy of supplier, or other unforeseeable events (“Force Majeure”). If Xperience World Travel and \or any of its suppliers are affected by Force Majeure, Xperience World Travel shall be entitled to, and may in its sole and absolute discretion, and without lability, therefore, vary or cancel any itinerary or arrangement in relation to Your trip.
No Chargebacks for trip delays, changes, or cancellations. Your verbal communication of your credit card details to an employee of Xperience World Travel is a binding agreement for charging Your credit card.
As such, You waive any right to a chargeback in the case of trip delays, changes, or cancellations for any cause (except fraud), including a Force Majeure event, and You agree to the refund policies and procedures as outlined in the Terms and Conditions of the suppliers operating components of Your trip. If You attempt without Xperience World Travel’s prior written authorization to chargeback, reverse, or recollect a trip payment already made, Xperience World Travel reserves the right to collect all additional costs, fees, and expenses associated with such chargeback, reversal, or recollection including, but not limited to, attorney fees.
DENIAL OF PARTICIPATION: Xperience World Travel reserves the right to deny participation in the tour to any traveler that Xperience World Travel, in its sole discretion, judges to be incapable of meeting the rigors and requirements of the tour activities, or whose actions or deportment it judges unsuitable for group travel. During the tour, Xperience World Travel has the right in its sole discretion to remove anyone who it determines to detract from others’ enjoyment of the tour. The decision of the local guide or local supplier is final on all matters that may threaten the safety or interfere with the well-being of others.
DISPUTE RESOLUTION. In the unlikely event a dispute arising out of, in connection with, or relating to this agreement and/or the transactions and relationships among the parties contemplated by this agreement, you agree that the dispute shall be submitted to a neutral third party mediator in Vermont, with both parties dividing equally the costs of such mediator. If the dispute cannot be resolved through mediation, then (a) the dispute shall be filed and resolved exclusively by binding arbitration through the American Arbitration Association in Vermont; (b) the dispute will be governed by Vermont law; and (c) any arbitration award shall be binding and judgment upon the arbitrator’s award may be entered or enforced in any court of competent jurisdiction.
ACKNOWLEDGMENT OF ARBITRATION. You understand that our agreement contains an agreement to arbitrate. You understand that after signing our agreement, you will not be able to bring a lawsuit concerning any dispute that may arise which is governed by the arbitration agreement, unless it involves question of constitution or civil rights. Instead, you have agreed to submit all claims and disputes within the scope of this agreement to an impartial arbitrator or arbitrators in accordance with the arbitration procedures set forth in this agreement.
LIMITATION OF REMEDIES. You agree that the sole remedy for any default by Boundless Journeys arising under this agreement shall be the return of the paid tour cost, to the extent consistent with applicable law. To the maximum extent permitted under applicable law, Boundless Journeys shall not be liable for any special, consequential, indirect, incidental or other damages arising out of or in any way connected to this agreement, including lost profits, whether such damages arise in contract, negligence, tort, under statute, in equity, at law, or otherwise, even if Boundless Journeys has been advised of the possibility of such damages. You expressly waive any right you may have to recover such damages.
SEVERABILITY AND SUCCESSORS AND ASSIGNS. If any provision of this agreement shall be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render the agreement unenforceable or invalid as a whole. Such unenforceable provision will be replaced with one that is valid and enforceable and which achieves, to the extent possible, the original objectives and intent of the original provision. This agreement shall inure to the benefit of and be binding upon Boundless Journeys and the Participant and their respective heirs, legal and personal representatives, successors and assigns.
ELECTRONIC OR HANDWRITTEN SIGNATURE: Both parties agree that you may acknowledge and agree to these Terms: (i) electronically; (ii) by handwritten signature; (iii) by any other electronic means, including, without limitation, via email acceptance of these Terms; or (iv) by your implied consent deemed via your actions, which shall include without limitation the payment of the invoice and/or your use of the services provided by Xperience World Travel or any other travel supplier related to your booking. All such means will be deemed to constitute effective acknowledgement and execution of this Agreement and shall be sufficient to bind the parties to the terms and conditions of this Agreement.
GOVERNING LAW: The construction, validity, and performance of these Terms and any disputes between the parties shall be governed by and construed according to the laws of the State of California, without giving effect to its conflict of law principles, and any federal laws applicable therein. Both parties submit to the exclusive jurisdiction of the courts of the State of California with respect to any legal proceedings relating to these Terms.
