I authorize Lost With Lady LLC to charge the credit card or bank account indicated on this invoice for the noted amount on today's date. This payment is for the services described on the invoice. I understand that all payments made to Lost With Lady LLC are non-refundable. I certify that I am an authorized user of this credit card and that I will not dispute the payment with my credit card company, so long as the transaction corresponds to the terms indicated on this invoice.
By moving forward with this transaction am also acknowledging and agreeing to the Terms & Conditions listed below.
Reservations can be made online at ladyjbookums.net, and then at a third-party site (Travel Joy), by calling Lost With Lady LLC at 404-692-0991, or by emailing us at travelers@lostwithlady.com.
IDENTIFICATION: Guests must make reservations using the full name that appears on their passport. If any changes to the name are needed after travel documents have been issued, the guest will be responsible for any applicable name change fees.
PAYMENTS: Reservations can be made online using major credit cards.
REFUNDS: All payments to Lost With Lady LLC are non-refundable and non-transferable. This policy is in place because we have contractual agreements with hotels, airlines, and other vendors that do not allow us to obtain refunds. This helps us keep our package prices competitive and allows for monthly payment plans on vacations. For this reason, travel insurance is included in all Lost With Lady group and or individual trips.
CHARGEBACKS: Before initiating a dispute with your bank, please contact Lost With Lady LLC at 404-692-0991 or email us at travelers@lostwithlady.com to discuss resolving any account issues. Filing chargebacks may lead to the cancellation of your reservation and could affect your ability to book future travel with Lost With Lady LLC.
ROOMMATE MATCHING: Roommate matching is available for our female and male travelers on most tours. Matches will be made 45 days before the trip departure date.
PASSPORTS AND VISAS: It is the responsibility of passengers to ensure they possess the necessary travel documents and to verify requirements with the relevant consulate(s) or visa agency. Passports must be valid for at least 6 months beyond the date of travel. Some countries require a full blank page labeled "VISA" in the passport for stamping purposes. Information provided in travel descriptions applies specifically to US citizens. Non-US citizens should consult the consulate of the country(s) they plan to visit for current entry requirements. Lost With Lady LLC does not provide or verify travel requirements for non-US citizens. We strongly recommend all cruise passengers carry a valid passport while cruising.
TRAVEL INSURANCE: All group trips and private trips booked through Lost With Lady LLC include travel insurance as part of the travel package. This insurance covers trip cancellation, interruption, baggage loss, and more. If you book your flight through Lost With Lady LLC, we will also ensure that your flight is covered by travel insurance. However, if you choose to book your flight independently, you will be responsible for ensuring your flight separately.
TRAVEL DOCUMENTS: Upon receiving full payment by your Final Payment Due date, travel documents and instructions will be sent to you via email and/or mail at least 30 days before your scheduled travel date.
CHILDREN: All children under 18 must be accompanied by an adult. The minimum age for children on Lost With Lady Group Trips tours is 13. If you are booking a private or customized trip, the age requirement may vary. Each trip will specify the age requirements. Accompanying adults are responsible for the safety of their children. Please note that many countries have adopted practices to prevent international abductions of children. If a person under the age of 18 years will be traveling with an adult other than his/her parents or with only one parent, a notarized letter written by the parents, or non-traveling parent, granting authorization to travel, including the dates of travel, should be carried.
PRICES: All prices quoted are per person based on double occupancy of a twin room unless otherwise specified. Prices exclude personal expenses such as laundry, alcoholic beverages (unless stated otherwise, such as at all-inclusive resorts), passport and visa fees, and foreign port taxes unless expressly included in the package details. Prices are accurate at the time of publication. Due to fluctuations in airfares and limited seat availability in different service classes, tour package prices and availability may vary. In the event of human or computer error, Lost With Lady LLC reserves the right to re-invoice for the correct price or service. Passengers who choose not to pay an increase will receive a full refund if they notify Lost With Lady LLC in writing within five days of receiving the price increase notification.
AUTOMATIC BILLING PLAN: Upon booking, you can opt-in to our automatic billing plan for your convenience. This means your future payments will be processed automatically. Upon booking, we will calculate an evenly divided automatic billing plan for you. You will receive advance notice of the processing date for each monthly payment. Your initial deposit is due at the time of booking, and subsequent payments will be charged according to the schedule outlined in your invoice. There is no charge for participating in our automatic billing plan.
You can choose to opt out of automatic billing by emailing us at customerservice@lostwithlady.com after making your reservations.
PAYMENTS & CANCELLATION:
Deposit: A deposit is required at the time of reservation. Please note that all deposits are non-refundable and non-transferable. If you

The amount due and details of any monthly payment plan will be clearly outlined.
Full Payment: All reservations can be paid in full at the time of booking as long as the tour still has available space.
Late Payment: Any outstanding balance by the Final Payment Due date listed on your invoice will result in a late fee of $250, which will be automatically added to your invoice one day after the final payment date.
Installment Payments: You are responsible for keeping up with your payment plan. If you can’t make a payment on time for any reason, please contact us and let us know. If you miss THREE payments in a row, your trip will be canceled with no refunds from us.
Reinstatement of Reservations: If your travel reservations have been canceled, and you notify us within 14 days that you want to reinstate your reservations, a service reinstatement fee of $250 will be added to your invoice and must be paid in advance to apply for reconfirmation of services.
Last Minute Reservations: All reservations must be made no later than 60 days before departure. If requested services cannot be confirmed, payment will be refunded. If services are confirmed, final payment is due within 24 hours, and all applicable cancellation penalties will apply.
Form of Payment: Lost With Lady LLC accepts all major credit or debit cards (American Express, Discover, Mastercard, Visa). You may also complete payment using 3rd parties such as Affirm, Uplift, After Pay, or Klarna.
Refunds: All payments to Lost With Lady LLC are non-refundable and non-transferable. This is because Lost With Lady LLC has contractual agreements with hotels, airlines, and other vendors that will not allow us to obtain any refunds. This way, we can keep our package prices competitive and allow you to make monthly payments on your vacation. For refunds, refer to your travel insurance policy.
Cancellation: Once reservations have been made, cancellations will only be accepted in writing. Email your cancellation request to travelers@lostwithlady.com with your invoice number, full name, and travel date. Once your email has been received, you must complete the cancellation request form sent to you via email to complete the cancellation process. If you do not receive an acknowledgment within 48 hours, please call (404) 692-0991 to ensure your information was received.
Also if you prepaid for shared accommodations and your traveling companion cancels their trip due to one or more of the covered reasons listed in your policy, the insurance will reimburse any additional accommodation fees you are required to pay, such as a single supplement fee (if applicable).
Reservation Name Changes: Name changes due to incorrect information being provided will incur a $250 per person charge plus any additional supplier fees. Please note that name changes to airline reservations are subject to full cancellation and rebooking. Replacing a traveling passenger with another traveling passenger constitutes a cancellation, subject to cancellation penalties, and is not covered by this Reservation Name Changes policy. Changes or additions after departure are subject to local rates at the time of amendment and must be paid directly by the passenger to the service provider. There are no refunds for unused services.
COVID-19 WAIVER OF LIABILITY:
In Spring 2020, the World Health Organization (WHO) declared the Novel Coronavirus (COVID-19) a worldwide pandemic. The Centers for Disease Control (CDC) issued several preventative measures to combat the virus, such as frequent hand washing, wearing a mask or face covering, and keeping at least 6 feet away from others. If contracted, this virus can cause the traveler severe illness. For more information on the COVID-19 virus, please visit the CDC webpage at www.cdc.gov.
COVID-19 LIABILITY WAIVER
I acknowledge and agree to the following:
- COVID-19 is a highly contagious virus that can spread through person-to-person contact.
- Lost With Lady LLC has provided me with the best available information regarding the pandemic-protective policies and practices of the vendors and suppliers in my travel itinerary after reasonable inquiry.
- Suppliers associated with Lost With Lady LLC may have their own COVID-19 prevention policies in place, which are subject to change. I understand that Lost With Lady LLC does not create these policies, and I acknowledge that these policies may change at any time.
- I understand that despite efforts by suppliers, compliance with safety measures may vary among travelers.
- Each state/country has its own pandemic-protective policies and regulations. I am responsible for knowing, understanding, and following the COVID-19 policies of all states/countries listed in my travel itinerary, including any updates. I acknowledge that entry into a country may be denied for reasons within or outside of my control.
- By traveling, I acknowledge that I may be subject to voluntary or involuntary quarantine at home or in the travel location(s).
- I am responsible for knowing, understanding, and adhering to the COVID-19 policies of all vendors included in my travel itinerary, including any updates.
- With full awareness of the risks involved, I, on behalf of myself and my traveling companions (including family, spouse, estate, heirs, executors, administrators, assigns, and personal representatives), assume all risks of travel. I hereby release and forever discharge Lost With Lady LLC, its officers, agents, independent contractors, affiliates, employees, successors, and assigns (collectively the “Released Parties”) from any and all liability, claims, demands, actions, and causes of action, whether direct or indirect, arising out of or related to any loss, damage, injury (including death), whether caused by the negligence of the Released Parties or any third-party vendor or supplier partnering with Lost With Lady LLC.
- I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all costs, expenses, damages, claims, lawsuits, judgments, losses, and liabilities (including attorney fees) arising directly or indirectly from or related to any claims made by or against the Released Parties due to bodily injury, harm, death, loss of use, monetary loss, or any other injury related to my use of Lost With Lady LLC services or the services of Lost With Lady LLC’s suppliers or vendors, specifically related to COVID-19.
FORCE MAJEURE:
There may be circumstances where either party is unable to fulfill or complete their obligations under the travel contract due to events beyond their control. These events are known as force majeure events and may render performance under the contract inadvisable, commercially impracticable, illegal, or impossible. Examples of such events include, but are not limited to, acts of God, government actions, war or civil unrest, insurrection or revolts, military actions, strikes or labor disputes, criminal or terrorist activities, pandemics, epidemics, prevalent illnesses or health conditions in the travel area, earthquakes, hurricanes, lightning, explosions, unforeseen legislation, or any other event beyond the reasonable control of either party.
In the event of a force majeure event, the parties will adhere to the cancellation policies outlined by the suppliers, as well as those specified in the travel proposal and these terms and conditions. Any modifications to these policies are subject to the discretion of the supplier (if applicable) and the Travel Agency. Passengers will be promptly notified of their available options should a force majeure event occur.
TRAVELERS WITH DISABILITIES: To ensure a fulfilling experience on your journey with Lost With Lady LLC, we recommend selecting a trip that aligns with your physical capabilities. Travelers requiring assistance, including those with physical disabilities, and sight or hearing impairments, must notify Lost With Lady LLC before making a reservation for assessment and approval. Additionally, such travelers must be accompanied by an individual responsible for providing necessary assistance. Please note, tour managers, guides, drivers, and other personnel associated with tours, hotels, and ships are unable to provide personal assistance.
To participate in escorted tours, passengers must be capable of comprehending and following instructions provided by the Tour Director throughout the tour for both operational success and personal safety. Lost With Lady LLC reserves the right to decline participation or remove any individual from a tour if prior notification was not provided or if continued participation is deemed to significantly impact the services offered to other guests. Any associated expenses, including cancellation fees or costs for alternative travel arrangements or return travel, will be the responsibility of the passenger.
Escorted tours typically involve a fast-paced itinerary with extensive walking over uneven terrain. Clients should be able to maintain the tour's pace in the interest of group harmony. Clients with specific needs may find independent travel more suitable. Lost With Lady LLC can recommend alternative touring options based on individual requirements.
WHEELCHAIRS & WALKERS: USA TOURS: By the Americans with Disabilities Act (ADA), Lost With Lady LLC aims to accommodate disabled travelers as much as possible, considering the specific tour itinerary. However, certain tour features may not be fully accessible for individuals requiring wheelchairs, scooters, or other special equipment. We regret that individual assistance cannot be provided to travelers with wheelchairs or mobility devices, and some itineraries may not accommodate wheelchairs or motorized scooters.
Passengers must inform Lost With Lady LLC of their accessibility needs before booking to allow us to assess the availability of reasonable accommodations. While Lost With Lady LLC will make every effort to accommodate special access requirements, we cannot guarantee this in all cases.
INTERNATIONAL TOURS: Hotels, sea, and river cruises outside of the United States are not obligated to comply with ADA requirements. Therefore, they may lack ramps, wide entryways, or elevators to accommodate disabled passengers or devices such as wheelchairs, walkers, and motorized scooters. Due to physical constraints and space limitations, wheelchairs, walkers, and motorized scooters may not be accommodated aboard motor coaches and river cruises.
SERVICE ANIMALS: Service animals cannot be accommodated on international escorted tours. Passengers planning to travel on USA escorted tours and who require a service dog due to a disability should contact Lost With Lady LLC before booking a tour to discuss their needs and explore available options.
AIRLINES: Lost With Lady LLC is not responsible for the services and policies imposed by airlines. Airline schedules and flights are subject to change without prior notice. Lost With Lady LLC is not liable for any penalties incurred for tickets, whether international or domestic, that are not issued by Lost With Lady LLC due to schedule or flight changes.
Airline reservations made online are subject to review by Lost With Lady LLC. If deemed necessary, reservations may be rebooked to comply with minimum connecting time requirements or tour package itineraries. In such cases, affected passengers will be promptly notified.
Airlines may require immediate ticket issuance for specific flights, even when standard ticketing rules allow for issuance at a later date. In such instances, Lost With Lady LLC will require immediate full payment of the airfare. This requirement supersedes the invoice terms and conditions and specified payment due dates. Failure to make full payment may result in cancellation of seats by the airline, potentially preventing rebooking on the same flights or at the original airfare. Any costs associated with alternative air arrangements and airfare will be solely the responsibility of the passenger.
AIRLINE TICKETS: Lost With Lady LLC issues airline tickets electronically approximately 30 days before departure. Please note that once issued, these tickets are fully non-refundable.
AIRLINE SEAT ASSIGNMENTS: For group flights, airline seat assignments are solely at the discretion of the airlines. All airline contracts arranged by Lost With Lady LLC are for economy-class seats only. If you prefer a different class of service, we recommend purchasing your own flights and opting for a land-only package from Lost With Lady LLC.
AIRLINE FREQUENT FLIER PROGRAMS: Passengers are responsible for contacting their airline directly regarding mileage eligibility and accrual. Airline frequent flier programs determine whether miles will be awarded based on their own rules, which are subject to frequent updates. Some discounted or promotional airfares, as well as certain code-share flights, may not be eligible for mileage accrual. Private airfares may also qualify for reduced mileage compared to standard published airfares of the same class.
Lost With Lady LLC will record frequent flier numbers provided by passengers before issuing travel documents. However, the inclusion of frequent flier numbers in airline records does not guarantee mileage eligibility, as this is determined solely by each airline. Changes in airline schedules may affect the eligibility of flights initially considered for mileage accrual.
Passengers are strongly advised to provide their frequent flier account information during online check-in or at the airport check-in desk. After travel commences, it may not be possible to retroactively apply for frequent mileage credit. Passengers are also responsible for verifying if previously earned mileage can be used for flight upgrades
CONTACT INFORMATION: In compliance with TSA Secure Flight requirements, passengers are required to provide Lost With Lady LLC with their full name as it appears on their passport (or other government-issued ID used for travel), date of birth, gender, address, phone number, and email for all passengers. It is crucial that passengers ensure their names are accurately listed on their invoices. Lost With Lady LLC cannot be held responsible for passengers who do not receive invoices or travel documents, or who are denied boarding due to inaccurate information.
AIRLINE NAME CHANGES: Any name change, including minor spelling corrections, may require airline reservations to be canceled and rebooked. Reservations are subject to current availability and pricing at the time of rebooking. Once airline tickets are issued, subsequent name corrections will be subject to an airline rebooking fee which may be as much as the full value of the airline ticket plus a $250 revision fee per change.
Lost With Lady LLC will not be held responsible for the denial of services by a carrier due to any name discrepancy. Name changes must be advised in writing at travelers@lostwithlady.com.
AIRLINE TAXES & FUEL SURCHARGES: If you have purchased airfare through Lost With Lady LLC, airline taxes and fuel surcharges are included. Before the completion of full payment, there is a possibility of price increases due to changes in government-levied taxes and fees or fuel surcharges. To avoid potential increases, you may opt to finalize your payment sooner so that your tickets can be issued. Once tickets are issued, they are no longer subject to potential price increases but are fully non-refundable.
Certain international and domestic flights may incur air taxes that must be paid locally. In such cases, the specific flights and tax amounts will be outlined in our package presentation and pre-departure documentation.
SCHEDULE CHANGES: In the event of an airline schedule change, Lost With Lady LLC will make every effort to notify passengers of the revised flight schedule before departure. Lost With Lady LLC is not accountable for schedule changes, which may include alterations in routing or the number of stops in the itinerary. Lost With Lady LLC cannot offer compensation for changes to schedule, modifications to seat assignments, or cancellations made by an airline.
If passengers make any changes directly with their airline that affect their flight itinerary, it is their responsibility to notify Lost With Lady LLC of the amended flight details in writing at travelers@lostwithlady.com. Lost With Lady LLC cannot be held liable for ground services, such as arrival and departure transfers if flight changes occur without our knowledge.
HOTEL ACCOMMODATIONS: All rooms requested are standard twin-bedded (two single beds) rooms with private facilities unless specifically requested otherwise, such as a king or double-size bed. While Lost With Lady LLC will make bed type requests on your behalf, bed types are subject to availability. Room allocation is solely at the discretion of the hotel management on a run-of-house basis. Some single rooms may be smaller than standard rooms; room size is not dictated by the number of occupants.
Air-conditioning availability and usage abroad, especially in many European hotels built before central air-conditioning, may differ from standards in the United States. Air-conditioning may be turned off at night or during cooler months. All hotel rates are non-negotiable and are based on agreements between Lost With Lady LLC and its suppliers. Generally, hotel check-in time is after 3:00 p.m., and check-out time is before noon. If arriving on a late-night flight, ensure adequate accommodation arrangements are made.
Lost With Lady LLC reserves the right to substitute hotels of equal standard if necessary. No refunds will be provided for any difference in accommodation costs.
HOTEL & CRUISE PROFILES: Lost With Lady LLC's hotel and cruise ship profiles are compiled based on information provided by our hotel and cruise ship partners and their representatives, including property images and descriptions. Star ratings may vary between countries. Lost With Lady LLC endeavors to keep information up to date; however, we are not liable for inaccuracies, or changes in property descriptions, amenities, or images provided by third parties.
MEALS: As specified in each itinerary, meals are provided based on the hotel's or restaurant's buffet or set menu. Generally, beverages are not included unless explicitly stated. While Lost With Lady LLC cannot guarantee specific requests, we will make every effort to accommodate special dietary needs if notified in writing at least 4 weeks before departure at customerservice@lostwithlady.com.
TRANSFERS: Lost With Lady LLC provides transfers as specified for each tour using cars, minibusses, or motor coaches when airfare is purchased through Lost With Lady LLC. If you purchase a land-only tour or deviate from the stated arrival and/or departure dates in the itinerary, you are responsible for arranging your own transfer to the hotel.
Your arrival transfer is guaranteed for up to two hours from your scheduled arrival time to accommodate minor delays. Lost With Lady LLC or the transfer company is not liable for flight delays beyond two hours from your originally scheduled arrival time, regardless of the cause. If a delay occurs due to flight issues, immigration, and customs procedures, or baggage handling, it is your responsibility to arrange alternative transportation, such as a taxi. Transfer costs are non-refundable, and any additional expenses are your responsibility.
The cost of our transfers reflects the round-trip service, including 'dead-leg' fees, where drivers must travel to airports, hotels, or piers solely for pick-up, thereby forfeiting a one-way fare. Additionally, entrance and parking fees may apply at airports, seaports, and hotels, where drivers may wait for up to an hour.
Lost With Lady LLC's transfer drivers, though not employees, are dependable and provide a comprehensive welcome service, ensuring you are safely transported to your destination and addressing any inquiries during your journey.
SIGHTSEEING & ITINERARY: Lost With Lady LLC tours are conducted using motor vehicles appropriate for the number of participants. Our tours are designed to accommodate both individuals and groups. The times listed in itineraries are approximate and serve as guidelines. Some itineraries may require early morning starts for sightseeing to maximize daylight hours or to avoid afternoon heat in tropical and desert climates.
It is your responsibility to arrive on time for all scheduled flights, cruises, and tour components. Late arrival may result in a "no-show" status, and refunds will not be provided for unused services. We cannot guarantee the exact number of participants on any tour; you may travel with a large group or exclusively with your companions. However, our services will remain consistent regardless of group size.
Travelers requiring assistance or with disabilities should refer to the "Travelers With Disabilities" section for specific guidelines. Please note that on religious holidays and national celebrations, certain monuments and sites may be closed. In such cases, itineraries may be adjusted accordingly.
Occasionally, due to holidays, unforeseen circumstances, or weather conditions, there may be last-minute changes affecting the tour sequence, locations visited, or hotel accommodations. We reserve the right to modify the itinerary and substitute hotels of similar categories when necessary, without cost adjustment.
GROUP COHESION: To maintain a positive group dynamic, Lost With Lady LLC reserves the right to accept, reject, or remove any individual deemed disruptive or incompatible with the group's interests. This includes individuals who are intoxicated or under the influence of drugs, which may adversely affect the group's experience. Any expenses incurred, including cancellation fees or costs for alternative travel arrangements or return home, will be the responsibility of the passenger. Please note that all unused services are non-refundable.
CRUISES:
SHIP & INITERARY CHANGES: Cruise itineraries and ships are subject to change without prior notice. Occasionally, cruise ships may be chartered or departure dates canceled by the cruise line. In such instances, all payments made will be refunded. Lost With Lady LLC assumes no liability for ship substitutions or itinerary alterations enforced by the cruise line. Passengers are responsible for any associated losses, including airline ticket issuance or cancellation fees, and visa costs.
HEALTH REQUIREMENTS: Lost With Lady LLC advises travelers to consult their healthcare provider for current health requirements. Additionally, you may refer to the Centers for Disease Control (www.cdc.gov) and/or the World Health Organization (http://www.who.int/en/) for their recommendations. Required vaccinations, if any, must be documented by the client's healthcare provider on a valid vaccination certificate, which the client must carry as proof of inoculation where required.
Participants with heart disease, chronic illness, physical disabilities, advanced pregnancy, or mental health conditions are advised against participating in our rigorous travel programs. Any traveler showing signs of illness, such as fever, upon arrival at the destination or during the tour, will be isolated from the group and directed to a local medical facility for assessment. Clearance from an accredited medical facility is required before the individual can rejoin the group.
All costs associated with medical treatment and related expenses, including additional hotel stays or transportation not originally included in the itinerary, are the responsibility of the passenger.
LUGGAGE: Checked bags are typically restricted to a total dimension of 62 inches (length + width + height, e.g., 26" + 26" + 10" = 62") and a maximum weight of 50 lbs (23 kg). Additional charges for checked bags may apply on many airlines. Lost With Lady LLC is not liable for fees related to checked bags, excess luggage, or overweight charges imposed by airlines.
If your luggage is lost or damaged by the airline, it is crucial to file a baggage claim form with the carrier before leaving the airport. We recommend using brightly colored luggage tags, straps, or other distinctive markers to aid in identifying your luggage upon arrival or to describe it accurately if it becomes lost.
LUGGAGE (ESCORTED TOURS): Lost With Lady LLC provides each traveler on escorted tours with an allowance for one piece of luggage per person, along with a carry-on bag. Any additional baggage will incur a handling charge of $100 per piece. Please note that Lost With Lady LLC cannot accept responsibility for the loss or damage of luggage and personal belongings. In the event of loss or damage, it is imperative to report the incident immediately and obtain a written report from local authorities for submission to your insurance provider.
TIPPING GUIDELINES:
At Lost With Lady LLC, we recommend the following tipping guidelines for our tours:
- Drivers (including private cars and motorcoach drivers): $5-$10 per person per day
- Tour Guides: $10-$20 per person per day
These guidelines ensure that our dedicated drivers and knowledgeable tour guides are recognized for their excellent service throughout your journey.
PASSENGER AGREEMENT: All passengers must complete a Passenger Agreement before traveling with Lost With Lady LLC and, by doing so, formally accept Lost With Lady LLC’s Terms & Conditions. Passengers booking online will need to complete the Passenger Agreement at the time of booking. Travel documents will only be released upon receipt of a completed Passenger Agreement. Lost With Lady LLC reserves the right to cancel bookings and return deposits if a completed Passenger Agreement is not received. The Passenger Agreement includes these Terms & Conditions, including the Release from Liability, Assumption of Risk, and Binding Arbitration Clauses. Completion of the Passenger Agreement signifies agreement to these Travel Terms & Conditions and Lost With Lady LLC’s Release from Liability, Assumption of Risk, and Binding Arbitration Clause.
RELEASE FROM LIABILITY: Lost With Lady LLC, its shareholders, directors, officers, employees, and affiliates (collectively "Lost With Lady LLC") do not own or operate entities providing goods or services for your trip, such as hotels, airlines, transportation companies, and excursion providers. These entities are independent contractors. Therefore, Lost With Lady LLC is not liable for any negligent or willful acts or failures to act by these third parties. Lost With Lady LLC is not responsible for injury, loss, damage, death, delay, or inconvenience arising from acts of God, government actions, force majeure, war, civil unrest, terrorism, overbooking, accommodations issues, transportation failures, animal encounters, recreational activities, health issues, epidemics, or any other causes beyond its control. By agreeing to these terms, I release Lost With Lady LLC from liability, including negligence, and assume all associated risks.
ASSUMPTION OF RISK: I understand that travel, including the trip I am undertaking with Lost With Lady LLC, involves hazardous activities and inherent risks of illness, injury, or death. These risks may arise from natural forces, animals, insects, plants, the negligence of Lost With Lady LLC, its affiliates, or other individuals and entities, whether known or unknown, as well as the willful or criminal conduct of third parties. I acknowledge that weather conditions can be severe, adverse, or unpleasant and that medical services or facilities may be limited or unavailable during my trip. Despite these risks, I willingly accept them as integral to the adventure and enjoyment of my travel experience. I hereby assume full responsibility for any risks of illness, injury, or death, including those resulting from the negligence of Lost With Lady LLC, and agree to release Lost With Lady LLC from any claims arising from third-party negligence.
I affirm that I understand the physical requirements of the activity I will be participating in with Lost With Lady LLC. I currently do not have any known physical, medical, or mental condition that would hinder my ability to safely participate in this tour or activity. I willingly accept all risks that may arise directly or indirectly from any such condition. I hereby authorize Lost With Lady LLC or my local ground handler, or others acting on their behalf, to arrange for any emergency medical treatment and hospitalization that may be necessary for me due to my participation in this activity, without requiring further consent from me.
BINDING ARBITRATION: I agree that any dispute concerning, relating to, or referring to this Agreement, the brochure, or any other literature concerning my trip, or the trip itself, shall be resolved exclusively by binding arbitration under the Federal Arbitration Act, 9 U.S.C. §§1-16, either under the then-existing Commercial Rules of the American Arbitration Association (AAA) or under the Comprehensive Arbitration Rules & Procedures of the Judicial Arbitration and Mediation Services, Inc. (JAMS). These proceedings will be governed by substantive (but not procedural) Georgia law and will be conducted in Atlanta, GA. The arbitrator, and not any federal, state, or local court or agency, shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, conscionability, or formation of this contract, including any claim that all or any part of this contract is void or voidable. By agreeing to these terms and conditions, you and Lost With Lady LLC are waiving the right to a trial by jury.
VOLUNTARY PARTICIPATION: I acknowledge that I have voluntarily applied to participate in the trip designated on this application (or a trip which I may change to) and that I have read the description of the trip as it appears on the current Lost With Lady LLC website relating to the trip, together with all information contained in this application. I am voluntarily participating in this trip with knowledge of the hazards involved.
KNOWING AND VOLUNTARY EXECUTION: I have carefully read these Terms and Conditions and the booking information sections of this document and fully understand its contents. I am aware that this is a release of liability and a contract between myself and Lost With Lady LLC, and I agree of my own free will. By signing, I agree to these Travel Terms & Conditions and Lost With Lady LLC’s Release from Liability, Assumption of Risk, and Binding Arbitration Clause for myself, each member of my traveling party, and any minor children accompanying me.
PHOTOGRAPHIC RELEASE: Lost With Lady LLC may take photographs or video of its trips, and trip participants grant Lost With Lady LLC permission to do so and for it to use the same for promotional or commercial use without payment of any compensation to the participant.
