Motorcoach Tour Services Agreement

This Services Agreement (“Agreement”) and Terms and Conditions (“Terms”) between Destins by Dorsey, LLC (“Agency”) and you (“you” or “Traveler”) become effective upon your signature (electronic or written) until terminated in writing by you or Agency. By signing this Agreement, you accept these terms and conditions outlined below:

General Terms: 

1. Non-Refundable & Non-Transferable Payments:  

   - All payments made toward this bus trip with Destins by Dorsey LLC are non-refundable and non-transferable due to binding contractual agreements with our vendors. Travelers are strongly encouraged to purchase travel insurance to protect their investment.

2. Travel Insurance:  

   - Destins by Dorsey LLC strongly recommends travelers purchase travel insurance to cover unforeseen cancellations, emergencies, or other circumstances.

3. Reservations and Participant Information:  

   - All reservations for this bus trip must be made exclusively via the Destins by Dorsey LLC Booking Page. Travelers must provide full and accurate information matching government-issued identification.  Any name changes after booking may incur additional fees. Name change fees will apply for any errors made by the customer.

4. Payments:  

   - All balances for the trip must be paid in full no later than November 22, 2025. Failure to make full payment by this deadline will result in automatic cancellation of the reservation and enforcement of applicable cancellation penalties as per this agreement.

5. Force Majeure:  

   - Destins by Dorsey LLC is not responsible for cancellations or interruptions due to acts of nature, strikes, government actions, weather conditions, or other events beyond our control. Travelers agree that changes may occur, and no refunds will be issued for missed events or itinerary adjustments. Destins by Dorsey LLC strongly recommends travelers purchase travel insurance to cover unforeseen cancellations, emergencies, or other circumstances.

6. Liability Release:  

   - By signing this Agreement, you acknowledge that Destins by Dorsey LLC is not liable for:

- Injuries, delays, or damages resulting from third-party service providers (e.g., motor coach companies).

- Natural occurrences, weather disruptions, acts of terrorism, or other unpredictable events beyond its control.

All travelers assume full responsibility for their well-being during the trip, in accordance with the "Assumption of Risk" provision established in the Destins by Dorsey LLC Terms & Conditions. This includes risks associated with travel delays, interactions, and environmental factors.

7. Group Harmony and Conduct of Travelers:  

   - To ensure the well-being and experience of the entire group:

Destins by Dorsey LLC reserves the right, at its sole discretion, to expel any traveler from the trip without refund in the case of disruptive, unsafe, or inappropriate behavior  (e.g., intoxication, verbal abuse, or failure to adhere to group rules) during the group tour.

- Any individual removed will bear all costs associated with early termination and will not qualify for refunds.

8. Waiver and Acknowledgment:  

   - Travelers are required to sign a Motorcoach Tour Liability Waiver and Release Agreement before participating in the trip. Failure to return the signed waiver will result in forfeiture of participation, with no refunds issued.

9. Travel Documents & Information:  

   - Itinerary and trip-related documents will be provided electronically 15 days prior to departure, provided all payments are complete. Additional fees may apply for printed materials.

11. Photo & Video Release:  

    - By participating in the bus trip, travelers grant Destins by Dorsey LLC the right to use any photographs, videos, or testimonials for promotional purposes without compensation.

12. Binding Arbitration:  

    - Any disputes or claims arising from participation in this motorcoach tour will be resolved through binding arbitration in Houston, Texas.

13. Passenger Agreement:  

    - Acceptance of these terms and conditions is a requirement for participation in the motorcoach tour. This acknowledgment is incorporated during the booking checkout process.

14. Assumption of Risk:  

    - Travelers voluntarily assume all risks involved in group travel, including but not limited to transportation-related risks, interactions with other participants, and exposure to environmental hazards.

15. Cancellations by Traveler:  

    - Written notice is required for cancellations. Refunds are not available for this tour. Travel insurance claims must be pursued independently. All payments to Destins by Dorsey LLC are non-refundable and non-transferable. 

16. Age Restriction:

This tour is exclusively for participants aged 21 years or older. By signing this Agreement or completing the booking process, each participant affirms that they are at least 21 years of age. Participants will be required to present a valid government-issued photo ID as proof of age before participating in the tour. Destins by Dorsey LLC reserves the right to deny participation to any individual unable to provide such identification, without any refund or compensation.

17. Chargeback Clause

By completing your booking, you expressly agree not to initiate chargebacks or payment disputes for any reason. Should you be unable to participate in the trip, you are encouraged to utilize travel insurance, which is strongly recommended. Failure to comply with these terms constitutes a breach of this Agreement, and Destins by Dorsey LLC reserves the right to pursue legal remedies, including arbitration, to recover disputed charges and associated costs. Additionally, participants will be held responsible for any fees or expenses incurred by Destins by Dorsey LLC in relation to disputed payments.
