SunFire Travel Group/SunFire Travel Group LLC offers retail travel services to customers, which are provided by separate and independent vendors of travel services. SunFire Travel Group/SunFire Travel Group LLC does not operate, control, or otherwise provide the services of the independent travel vendors. Hence, customer agrees that SunFire Travel Group/SunFire Travel Group LLC acts only as agent for the client in acquiring transportation, hotel accommodations, sightseeing and other privileges, or services for the clients’ benefit, and on the express condition that SunFire Travel Group/SunFire Travel Group LLC shall not be responsible or liable for any loss, refund, defaults, wrongful or negligent acts, accident, injury, delay, defect, omission or irregularity which may occur or be occasioned, whether by reason of any act, negligence or default of any company or person engaged in or responsible for carrying out any of the arrangements, or otherwise in connection therewith. SunFire Travel Group/ SunFire Travel Group LLC is not held liable or responsible for airline service changes, flight delays, cancellations or seat selections. Hotel bed assignments are requests/ preferences & are based upon availability at the time of check in & not guaranteed. SunFire Travel Group/SunFire Travel Group LLC retains the right to change these terms & conditions at anytime.
SunFire Travel Group/SunFire Travel Group LLC act only in the capacity of agent for the suppliers of the travel services named in the Itinerary or otherwise providing services or goods in connection with the tour (the Suppliers”), such as airlines, hotels, sightseeing tour operators, bus lines, car rental companies, and providers of entertainment. We assume no responsibility for any personal injury, property damage, or other loss, accident, delay, inconvenience, or irregularity which may be occasioned either by reason (1) any act or omission of any of the Suppliers or their failure to provide services or adhere to their own schedules. (2) any defect in or failure of any vehicle, craft, equipment, or instrumentality owned, operated, or otherwise used or provided by the suppliers; any matter beyond our exclusive control including but not limited to a delay or cancellation of a flight that causes you to miss any portion of the Tour. (3) any supplier price drop after your travel arrangements have been confirmed, paid in full, or ticketed. All prices and itineraries are subjected to change.
Travel arrangements involving airline and cruise components are subject to supplemental price increases that may be imposed by the supplier and/ or government after you have completed your purchase. Suppliers have their own contracts covering cancellation penalties and other terms and conditions, and you may be bound by those contracts regardless of whether you receive notice of their terms.
We have no special knowledge regarding the financial condition of the Suppliers, unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which you may travel. For information concerning possible dangers at destinations, we recommend contacting the Travel Warnings Section of the U.S. State Department at www.travel.state.gov, and click on “Travel Warnings.” For medical information, we recommend contacting the Centers for Disease Control at (877) FYI-TRIP or www.cdc.gov/travel. You assume full and complete responsibility for checking and verifying all passport and visa requirements, vaccinations, or other entry requirement of the destinations and for complying with all laws of the country in the Itinerary. And all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination(s). You are also responsible for respecting the authority and following the directions of the tour guide during a Tour. We may exclude you from participating in all or any part of the tour if, in our sole discretion, your condition or behavior renders you unfit for the tour or unfit for continuation once the tour has begun. Unfitness may include, without limitation, any behavior that, regardless of its cause, is inappropriate or offensive or interferes with the delivery of tour services, or may constitute a hazard or embarrassment. In such case, our liability shall be strictly limited to a refund of the recoverable cost of any unused portion of the tour. We are not responsible for the behavior of other tour participants toward you. Should you decide not to participate in certain parts of the tour, no refunds will be made for those unused parts. You must be 18 or over to participate in the tour. You agree to release us from liability for any matter for which we disclaim liability under this Agreement. You agree to indemnify and hold us harmless from and against our liability to third parties arising out of your or your companions’ actions or omissions.
You agree to grant us (and third parties with whom we may engage in joint marketing) a worldwide and royalty-free, permission to use your photographic, video, or digital likeness solely for our promotional and/or marketing purposes. If there are any conflicts between this Participant Agreement, the Reservation Form, and the Itinerary, this Participant Agreement shall apply.
Your acceptance of this itinerary, invoice, registration or your clicking I agree below, signify your agreement with the following terms and conditions. You hereby release SunFire Travel Group/SunFire Travel Group LLC from all claims arising out of any problem covered in these terms and conditions, responsibilities & liabilities as per stated above.
COVID-19 WAIVER
Coronavirus COVID-19 Release, Assumption of Risk, Waiver of Liability & Indemnity Agreement
The 2019 Novel Coronavirus* (COVID-19, “Coronavirus”) is a known and rapidly evolving pandemic that is affecting travel worldwide, with continued spread and impacts expected.
Client is fully aware of the current global Coronavirus COVID-19 virus outbreak, the current travel restrictions, and inherent risks involved if choosing to travel.
Client understands that it is his/her responsibility to check the latest travel information regarding this virus outbreak with the CDC. https://wwwnc.cdc.gov/travel/notices
Client understands that it is his/her responsibility to have travel insurance to ensure they have coverage for all medical needs and trip cancellation but understands that concerns or fear of travel is not a covered reason for cancellation relating to the Coronavirus/ COVID-19 and will be denied. Client holds SunFire Travel/SunFire Travel Group LLC harmless for his election to not purchase travel insurance or any denial of claim by travel insurer as it relates to COVID-19 or any other claim under the policy.
Travel insurance generally only covers unforeseen events. Most insurers classified COVID-19 as a 'known event' late January 2020. Please note that most policies have a specific clause stating they do not cover epidemics and pandemics, especially when travel warnings are in place. Client understands that he/she is bound by the terms of the insurance policy as it relates to Coronavirus/COVID-19.
Client is aware the travel warnings, travel restrictions and rules and understands the risks, is accepting of these and knows that SunFire Travel/SunFire Travel Group LLC holds SunFire Travel/SunFire Travel Group LLC harmless for any travel restrictions, death, illness, cancellations by suppliers, hotels, airlines, cruise lines, tour agencies or any other travel provider, financial loss, quarantining rules or measures put in place at airports or destinations you are traveling through. Client further agrees to hold SunFire Travel/SunFire Travel Group LLC harmless for any financial penalties or fees imposed by the by suppliers, hotels, airlines, cruise lines, tour agencies or any other travel provider due to cancellations or postponements due to COVID-19 and agrees not to institute a credit card dispute or “charge back” to SunFire Travel/SunFire Travel Group LLC for said penalties or fees.
Client is aware that additional screening procedures and restrictions may take place at airports and in public areas. Client is aware that these restrictions may include mandatory face coverings and/or temperature checks in airports, hotels, cruise ships, trains or other means of transport.
Client is aware that Immigration restrictions may be put in place before or during your travels that may impede your ability to enter or exit your destination as planned.
Client is aware that it is his/her personal decision to travel and is doing so with full knowledge of current travel recommendations and travel restrictions with regards to the Coronavirus COVID-19 and takes full responsibility for his/her actions with regards to this.
IMPORTANT INFORMATION REGARDING COVID-19 AND IMPACT ON TRAVEL
Please be advised the travel Itinerary included on this document is for travel with COVID-19 being a known global risk. You and/or your travel group should be aware that COVID-19 and the health and security measures around COVID-19 may impact elements of your trip and influence the operation of some travel services. The country you and your group reside in, the country or countries you are travelling to or via, and the airline(s) you are travelling on may all have strict requirements on travel to limit the spread of COVID-19. These requirements may include but are not limited to: • Wearing of masks at airports, while in flight and when out in public. • Active testing for COVID-19 that may include blood testing before permission is granted to board any flight or enter a country. • Being able to show proof of health via formalized means (Certificate or similar) • Subject to screening on arrival at your destination country or any transit countries. • Subject to quarantine periods in any country subject to screening results. • Changing restrictions on sightseeing, due to closures or other public health concerns. • Subject to limitation/restrictions on travel to the destination by your country of residence/citizenship. • Possible compulsory quarantine on return to your country of residence/citizenship. COVID-19 is causing constant and ongoing changes in the application of the above types of measures and the way an airline, airport or country chooses to deal with the threat of COVID is constantly changing. It is the individual’s responsibility to keep themselves informed of all requirements in relation to their trip and any COVID-19 based restrictions, and we suggest these are constantly monitored right up until departure, as they can change at any time. The same applies to any travel companions and all members of a group who may be travelling. Travel agency and/or travel agent is not liable for any loss due to failure to read and understand this information, as the considerations included in this document may be critical to your upcoming trip.
