By signing below, I authorize Bright Path Travel to charge the credit card provided herein.

 You authorize Bright Path Travel (or our agents) to credit any amounts that have been charged in error. You are responsible for all amounts, including any associated costs of recovery:

-If you close the credit or debit card account you provide to Bright Path Travel;

-If you charge back any fees that were validly charged under this Agreement;

-If your credit or debit card expires;

-or if you have provided an incorrect account number or have insufficient funds at any time (including declinations of validity charged amounts).

In any such event, you agree Bright Path Travel is entitled to withhold all Services until you satisfy all payment deficiencies. Bright Path Travel has no obligation to refund any amounts previously paid by you as a result of suspension or termination of Services.

You confirm that:

-You are authorized to act on behalf of yourself and all travelers on the same booking.

-You are an authorized user of this credit or debit card, 

-You will not dispute any payment of fees under this Agreement.

 IT IS THE TRAVELER’S RESPONSIBILITY TO READ THESE POLICIES BEFORE SIGNING UP FOR ANY TRIP OR REMITTING ANY PAYMENTS. THESE POLICIES ARE A LEGAL AGREEMENT BETWEEN YOU AND BRIGHT PATH TRAVEL.


This Bright Path Travel Travel Policies (the “Policies”) is a legally binding agreement between you, the Traveler ("You," “Your” or “Traveler”) and Bright Path Experiences, LLC d/b/a Bright Path Travel, a foreign limited liability company operating in California, and shall be effective on the date you complete registration for a trip and make payment. The Policies describe the terms governing your participation in a trip with Bright Path Travel.

TRIP PAYMENTS

Deposit: A non-refundable and non-transferable deposit is required to hold a space on the tour. All reservations (except where specified) will require a deposit, and the amount due and the monthly payment plan will be clearly noted. 

Full Payment: All reservations can be paid in full at the time of booking as long as the tour still has available space.

Payment Types & Currency: TravelJoy is the primary method for Bright Path Travel invoicing. Credit Cards and ACH are acceptable methods of payment, but must be approved by Bright Path Travel. All payments are in U.S. Dollars.

Payments after deposit: As stated on the registration, monthly minimum payments are required every month until paid in full to keep your reservation current, unless the reservation was paid in full at the time of registering. 

Past Due Payments: A traveler who misses a payment will be notified 7 days after the missed payment date via email that they have missed payment. If payment is not made within 24 hours of the email, the traveler understands that they have been canceled from the tour and all monies paid to date are non-refundable.

Past Due Final Payment: A traveler who has not paid their final payment (one week) after the final payment due date will be notified via email they have been canceled from the trip and their total amount paid to date forfeited.

Late Payment: A late payment of $250 per person is required after final due date listed on your payment plan. All late payment requests must be approved by an email from Bright Path Travel or Eboni Payne before the final payment deadline.

Reinstatement of Reservations: If your travel reservations have been canceled, and you notify us within 14 days that you want to reinstate your reservations, a service reinstatement fee of $250 will be added to your invoice and must be paid in advance to apply for reconfirmation of services.

Last Minute Reservations: All reservations must be made no later than 60 days before departure. If requested services cannot be confirmed, payment will be refunded. If services are confirmed, final payment is due within 24 hours, and all applicable cancellation penalties will apply.

Reservation Name Changes: Name changes arising from the provision of incorrect information will incur a fee of $250 per person, plus any applicable supplier-imposed charges. Name changes to airline reservations are generally not permitted and may require full cancellation and rebooking, subject to all associated penalties and fare differences. Substituting one traveler for another constitutes a cancellation of the original reservation and will be subject to applicable cancellation penalties. Such substitutions are excluded from this Reservation Name Changes provision. Any modifications or additions requested after travel has commenced are subject to prevailing local rates at the time of change and must be paid directly to the service provider by the traveler. No refunds will be issued for unused services.


WHAT IS NOT INCLUDED IN THE TOUR COST

● Round-trip airfare, departure taxes, and checked baggage fees.

● Passport fees, visas, and visa photos as required

● Personal items such as souvenirs, laundry services, beverages/wines, liquors, a-la-carte orders, meals other than specified on the tour itinerary.

● Expenses incurred in making individual travel arrangements in conjunction with the tour.

● Any other items not specifically mentioned on the tour itinerary.

 
REQUIRED TRAVELER INFORMATION

Over 21 years of Age: You certify that you are 21 years of age or older.

Passport: You agree to provide Bright Path Travel with a copy of your passport by uploading the copy along with the “Registration Form” you complete when making a reservation to participate in one of the tours.

Valid Passport: It is your responsibility to check that your passport is valid 6 months past the date the tour ends, to get a new passport in a timely manner, and to provide the new passport information to Bright Path Travel (if requested) by Final Payment due date.

Past Due Passport: If the traveler is unable to attend the trip due to an expired passport, any refund of monies will be based on Bright Path Travel's cancellation policies as of the date of withdrawal from the trip.

Travel Arrangements: Arrival and departure flight details are required to be submitted by email to Bright Path Travel no later than the Final Payment due date. This information is required to know when travelers are expected, and when applicable, to arrange transfers.

Confidential Information: You agree to provide Bright Path Travel with information about your medications, dietary restrictions, emergency contact, etc., when completing the Registration Form, but any changes to this information must be submitted to Bright Path Travel no later than the Final Payment due date. This information is held in confidence and is only used in case of an emergency.


FOOD & DIETARY CONSIDERATIONS

By joining a Bright Path Travel trip, you acknowledge and agree that Bright Path Travel is not responsible for any illnesses, allergies, or adverse reactions that may result from consuming food or beverages during the trip. While Bright Path Travel carefully selects dining experiences and works with trusted restaurants, each traveler is responsible for assessing ingredients, dietary needs, and potential food sensitivities.

Travelers with allergies or dietary restrictions must communicate their needs in advance by providing this information in the required Registration Form. Bright Path Travel will make reasonable efforts to accommodate dietary restrictions; however, we cannot guarantee the complete absence of allergens or specific food accommodations. Travelers are encouraged to exercise caution and diligence when consuming meals, particularly in destinations where dietary restrictions may be less understood or difficult to accommodate.

By participating in a Bright Path Travel trip, you assume full responsibility for your dietary choices and any associated risks. It is your responsibility to verify ingredients and food preparation methods with restaurants, chefs, or vendors before consuming meals. Bright Path Travel shall not be held liable for any adverse reactions, illnesses, or health-related issues that may arise from food or beverage consumption during the trip.


TRAVELER PHYSICAL REQUIREMENTS AND SPECIAL NEEDS

All Bright Path Travel tours require walking and other physical exertion. Travelers should expect to walk an average of 2–3 miles per day, navigate steps, board and exit various modes of transportation, and manage personal belongings without assistance. On certain itineraries, particularly in Europe, daily walking distances may increase to 5–7 miles and may involve uneven terrain. For these reasons, our tours are not suitable for individuals who are physically challenged, mobility impaired, or unable to maintain the pace of the group.

Travelers requiring any form of personal assistance, including those with physical disabilities or sight or hearing impairments, must notify Bright Path Travel prior to booking for review and approval. Such travelers must be accompanied by a qualified companion who will provide all necessary assistance, including walking, dining, boarding transportation, carrying luggage, and other personal needs. Tour managers, guides, drivers, hotel staff, and other personnel are not permitted to provide this assistance.

To participate in an escorted tour, travelers must be able to understand and follow instructions from the Tour Director at all times for the safe and successful operation of the tour. Bright Path Travel reserves the right to deny participation or remove any individual from a tour if advance notification was not provided or if, in our sole judgment, continued participation would hinder the experience or safety of the group. Any expenses incurred, including cancellation fees and costs for alternate travel arrangements, will be the traveler’s sole responsibility.

No refunds will be issued if a traveler chooses to opt out of included activities. Clients with special needs may find independent travel more suitable, and Bright Path Travel can suggest alternative arrangements based on specific requirements.

Wheelchairs & Walkers 

USA Tours: Pursuant to the Americans with Disabilities Act (the ADA), Bright Path Travel seeks to accommodate disabled travelers to the extent possible and consistent with the specific tour itinerary. Nevertheless, you may find that certain tour features may not be accessible to the extent that you require a wheelchair, scooter, or other special equipment to participate. We cannot provide individual assistance to travelers with wheelchairs or other mobility devices. We regret that some itineraries cannot accommodate wheelchairs or motorized scooters. Passengers are required to advise Bright Path Travel of their accessibility requirements prior to booking in order for Bright Path Travel to determine if reasonable accommodations are available. Bright Path Travel will endeavor to accommodate special access needs but does not guarantee that it will be able to do so in all cases. 

International Tours: Hotels, sea, and river cruises outside of the United States are not required to comply with ADA requirements and, therefore, may not have ramps, wide entryways, or elevators to accommodate disabled passengers or devices such as wheelchairs, walkers, and motorized scooters. Due to physical constraints and space limitations, wheelchairs, walkers, and motorized scooters may not be taken aboard motor coaches and river cruises. 

Service Animals: Service animals cannot be accommodated on international escorted tours. Passengers on the USA escorted tours who require a service dog because of a disability should check with Bright Path Travel prior to booking a tour.

AIRLINES

Bright Path Travel is not responsible for the services and policies imposed by the airlines. Airline schedules and flights are subject to change without notice. Bright Path Travel is not responsible for penalties incurred for tickets, international or domestic, not issued by Bright Path Travel due to schedule and/or flight changes. Airline reservations completed online are subject to review and, should Bright Path Travel deem it necessary, may be rebooked to match minimum connecting time requirements and/or tour package itineraries, in which case you will be notified immediately. Airlines reserve the right to demand immediate issuance of tickets whenever they determine that specific flights are heavily booked, even when normal ticketing rules do not require tickets to be issued until a later date. In this instance, Bright Path Travel will require immediate and full payment of the airfare. This situation overrides invoice terms and conditions and payment due dates. If full payment is not received, seats will be cancelled by the airline and may not be available to be rebooked on the same flights or at the same airfare. Any replacement air arrangements and airfare will be the sole responsibility of the traveler. 

Airline Tickets: Bright Path Travel airline tickets will be issued electronically approximately 30 days prior to departure and are fully non-refundable. 

Airline Seat Assignments: The airlines bear the sole authority of assigning seats on group flights. All Bright Path Travel airline contracts are for economy-class seats only. If you require another class of service, you may consider purchasing your own flights and purchasing your land-only package from Bright Path Travel. 

Airline Frequent Flier Programs: Travelers are responsible for contacting their airline directly regarding mileage eligibility and accrual. Airline frequent flier programs determine whether to award miles in part or total based on their own rules, which are updated frequently. Some discounted or promotional airfares, as well as some code-share flights, are not eligible for mileage accrual. Some private airfares, such as a "Bright Path Travel Airfare," are not eligible for mileage or may qualify for reduced mileage, even if the same airline class of service is eligible for full mileage when sold as an "Instant Purchase" published airfare. Not all published airfares are eligible for mileage. Bright Path Travel will record frequent flier numbers when provided by the traveler prior to travel documents being issued. However, the addition of frequent flier numbers to airline records does not guarantee mileage eligibility which is at the sole discretion of each airline. Airline schedule changes may result in flights that were initially eligible for mileage accrual no longer being eligible. We highly recommend traveler provide their frequent flier account information whenever checking in online and/or at the airport check-in desk. After travel has commenced, it is often not possible to apply for frequent mileage credit. Travelers are also responsible for determining whether previously earned mileage may be applied to flights to secure upgrades. 

Contact Information: Pursuant to TSA Secure Flight requirements, travelers are responsible to provide Bright Path Travel with their name as it appears on their passport (or other government-issued I.D. when traveling), date of birth, gender, address, phone number, email and fax data for all passengers. Passengers must ensure that names are correctly listed on their invoices. Bright Path Travel will not be responsible for passengers who do not receive an invoice or documents or are denied boarding due to inaccurate information.

Airline Name Changes: Any name change, including minor spelling corrections, may require airline reservations to be canceled and rebooked. Reservations are subject to current availability and pricing at the time of rebooking. Once airline tickets are issued, subsequent name corrections will be subject to an airline rebooking fee which may be as much as the full value of the airline ticket plus a $250 revision fee per change. Bright Path Travel will not be held responsible for the denial of services by a carrier due to any name discrepancy. Name changes must be advised in writing at Info@BrightPathTravel.com. 

Airline Taxes & Fuel Surcharges: If you purchased airfare, airline taxes, and fuel surcharges are included. Prior to the completion of full payment, there is a potential for a price increase(s) due to increases in government-levied taxes and fees and/or fuel surcharges. To avoid potential increases, you may choose to accelerate your final payment in order that your tickets may be issued. Once issued, airline tickets are no longer subject to potential increases but are fully non-refundable. Certain overseas domestic flights are subject to air taxes which can only be paid locally; in these cases, the specific flights and amounts of those taxes are indicated in our package presentation and pre-departure documentation.

ARRIVAL, TRANSFERS, AND DELAYS

Travelers arriving by air are responsible for allowing sufficient time to deplane, gather luggage, and travel to the designated meeting location to join the tour. Bright Path Travel will not delay the departure of the group for travelers arriving after the designated tour start time as listed in the individual itineraries.

Travelers are required to notify Bright Path Travel in the event the airline should change the arrival or departure time of a flight by sending a text to either (1) the “WhatsApp” group chat for the tour or (2) 818-483-4343.

Travelers who are delayed for whatever reason are responsible for notifying Bright Path Travel of their situation and to communicate regularly with Bright Path Travel as to their anticipated arrival time. Delayed travelers are responsible for joining the group as soon as possible, and if the ticket was not provided through Bright Path Travel, at their own expense, if their arrival occurs after the last scheduled transfer.

On tours where scheduled transfers are provided, travelers who elect to take alternate transportation to the hotel, for any reason, will not be reimbursed for the transfer expense incurred.

HOTEL ACCOMMODATIONS

All rooms requested are standard twin-bedded (two single beds) rooms with private facilities unless you have specifically requested a king/double-size bed. Please understand although we will make a bed type request on your behalf, bed types are subject to availability. Room selection in all cases is strictly at the discretion of the hotel's management on a run-of-house basis. Some single rooms are smaller than a standard room size. The number of persons accommodated does not dictate the room size. 

Although available at most 4 and 5-star hotels, the use of air-conditioning abroad differs greatly from the United States. Many European hotels were built before central air- conditioning was introduced. Air-conditioning is often shut down at night and from the end until the start of the summer months. All hotel rates are not negotiable and based on Bright Path Travel's agreements with its suppliers. Hotel check-in time is generally not before 3:00 p.m., and check-out time is before noon. Please be sure that adequate arrangements for accommodations have been taken into consideration when a late-night flight is being used. We reserve the right to make substitutions with hotels of equal standard. There will be no refunds for any difference in the cost of those accommodations.

ROOMMATE MATCHING 

Bright Path Travel will arrange a roommate for any traveler that does not reserve their room with a companion. When making your reservation, please select “double occupancy - Match me with a Roommate” and enter “request roommate match” when prompted for your roommate’s name. Roommates will not be assigned until 45 days prior to your trip, and 75% of your reservation total has been paid. After Final Payment, no changes can be made to the room type (double or single occupancy).

Travelers will share a room with a person of similar gender and age whenever possible. No special request, of any type, regarding your roommate can be accommodated.

If you wish to room with a specific person, put their name on the reservation form or advise Bright Path Travel upon registration.


LUGGAGE

Luggage (Airlines): Checked bags are typically limited to a total dimension of 62 inches by adding length + width + height (example: 26"+26"+10" = 62”) and a maximum weight of 50 lbs (23kg). Many airlines apply charges for checked bags. Bright Path Travel is not responsible for checked bag fees, excess luggage, or weight charges levied by an airline. If the airlines lose or damage your luggage, a baggage claim form MUST be filed with the carrier before leaving the airport by the traveler. We recommend using brightly colored luggage tags, straps, or other identifiers to help you locate your luggage upon arrival or to describe it if it is lost.

 Luggage (Escorted Tours): All Bright Path Travel escorted tour vehicles allow one piece of luggage per person, plus a carry-on bag. Additional baggage will be subject to a handling charge of $100 per piece. As Bright Path Travel will not be responsible for loss or damage to luggage and personal belongings, you MUST report any loss or damage immediately at the time of the incident and obtain a written report from the local authority for submission to your insurance provider.


CANCELLATION OF TOURS BY BRIGHT PATH TRAVEL

On rare occasions, Bright Path Travel must cancel a tour, either because there are not enough travelers to operate the tour or due to other events outside the control of Bright Path Travel. Bright Path Travel will cancel tours due to a lack of travelers prior to final invoicing; however, Bright Path Travel reserves the right to cancel any tour at any time up to the day of departure due to no fault of Bright Path Travel.

In the event of a cancellation by Bright Path Travel, all monies paid to Bright Path Travel for the canceled tour will be promptly refunded to the traveler minus credit fees. Bright Path Travel is not responsible for any penalties imposed by the airlines.


CANCELLATION BY THE TRAVELER

All cancellations MUST be in writing and sent by email no less than thirty (30) days before departure of the tour. The effective date of the cancellation, and any cancellation penalties, will be based on the date of receipt of the written cancellation. If you cancel less than 6 months before departure, then you understand that NO REFUNDS will be issued. Refunds for payments made directly to 3rd parties are subject to their refund policies, irrespective of the date of cancellation. Please refer to the cancellation dates on your registration and invoice. Any penalty imposed by your airline(s) is the complete responsibility of the traveler.

THERE ARE NO EXCEPTIONS TO BRIGHT PATH TRAVEL’S CANCELLATION POLICIES.


INSURANCE

Trip Cancellation Insurance: Life is unpredictable, and your trip is an investment worth protecting. If unexpected circumstances arise, travel insurance can help you relax and enjoy your trip, offering coverage for cancellations, delays, or emergencies.

While not required, we recommend securing a travel insurance policy—especially one with an option to "Cancel for Any Reason". To make this process easier, Bright Path Travel can provide a quote for travel insurance through our preferred provider. Alternatively, you may opt to obtain your own travel insurance.

Emergency Medical Insurance: Your personal medical insurance generally does not cover you when traveling. To cover the risk of a medical emergency or accident while traveling, you should consider purchasing medical evacuation insurance.


ITINERARY CHANGES

Itineraries are subject to change due to a variety of factors completely out of the control of Bright Path Travel. In the event there is an itinerary change, comparable lodging, meals, and activities will be provided.

Force Majeure: No damages shall be due to a traveler for failure by Bright Path Travel to perform obligations related to delivery of tour services if such failure is as a result of Acts of God (including fire, flood, earthquake, storm, hurricane, volcano eruption, or other natural disasters), war, invasion, act of foreign enemies, cyber-attacks, hostilities (regardless of whether war is declared), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalism, government sanction, blockage, embargo, labor dispute, strike, lockout or interruption or failure of electricity, internet or telephone services, or illness, accident, or death of the Bright Path Travel Representative, any one of which could make delivery of tour services impaired or impossible to perform.


DOCUMENTS REQUIRED TO TRAVEL

It is the traveler's responsibility to obtain and present the required documents necessary for travel. This includes, but is not limited to, a valid government-issued photo ID, passport, Visa, Letter of Invitation, shot record, etc. Travelers who have any questions as to their ability to obtain and present the required documents necessary to travel to a country should address their questions to the embassy or consulate of the country to which they will be traveling BEFORE signing up for a Bright Path Travel tour.

On certain tours, Bright Path Travel will offer to obtain a Visa for travelers. However, the traveler must be a passport holder from the United States or Canada, and/or cannot have a criminal conviction, and/or cannot have an exception that would prohibit the routine issuance of a Visa. In such cases the traveler will be responsible to obtain their own Visa.

Any traveler who cannot obtain proper documentation to travel, no matter when or how that discovery is made, will be responsible for whatever cancellation penalties are in force at the time of cancellation from the Bright Path Travel tour or denial of travel.


INVOLUNTARY/VOLUNTARY DEPARTURE FROM A TOUR IN PROGRESS

Bright Path Travel reserves the right to remove any traveler from a tour should the Bright Path Travel representative(s) determine that the traveler cannot meet the physical requirements of the tour as stated in the itinerary, is disruptive to the tour time schedule, or is adversely affecting the overall group dynamics. In the event a traveler is removed from a tour, Bright Path Travel will not refund any monies. Transportation costs to return home, airline penalties, and any other expenses will be the responsibility of the traveler.

In the event a traveler voluntarily chooses to leave a tour prior to its scheduled conclusion, Bright Path Travel will not refund any monies for the unused portion of the tour arrangements. Transportation costs from tour departure point to the airport, airline penalties, and any other expenses will be the responsibility of the traveler.


USE OF 3RD PARTY OPERATORS

Some Bright Path Travel trips, as noted in the itinerary, are scheduled with tour operators who sell their tours to the general public. The traveler acknowledges that other groups and/or individuals may be a part of the same tour.


PHOTOGRAPHIC RELEASE

Bright Path Travel may capture photographs and/or video recordings during its trips. By participating, travelers grant Bright Path Travel a perpetual, worldwide, royalty-free license to use, reproduce, modify, adapt, and publish such images or recordings, in whole or in part, for promotional, advertising, or other commercial purposes, in any media now known or hereafter developed, without further notice or compensation to the traveler. Travelers waive any right to inspect or approve the finished product or any use thereof, and release and discharge Bright Path Travel from any and all claims, demands, or causes of action arising out of or in connection with the use of such images or recordings, including, without limitation, claims for invasion of privacy, misappropriation, or defamation.


HOW WE PROTECT YOUR PERSONAL INFORMATION

We take commercially reasonable steps to protect the information you provide to us from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. Please understand, however, that no security system is impenetrable. We cannot guarantee the security of our databases or the databases of the third parties with which we utilize, nor can we guarantee that the information you supply will not be intercepted while being transmitted over the Internet. In particular, e-mail sent to us may not be secure, and you should therefore take special care in deciding what information you send to us via e-mail.


ASSUMED RISK

Travel has its own inherent risks, and the Traveler acknowledges such risks exist, up to and including death. Bright Path Travel will take all reasonable precautions regarding the safety of travelers. It is the Traveler's responsibility to determine their level of risk tolerance, including the decision to participate in a tour to a country or continent where State Department alerts and warnings have been issued. If the tour is scheduled to operate (i.e. not canceled by Bright Path Travel), standard cancellation policies apply if the Traveler elects to cancel because their risk tolerance has been exceeded.

TRAVELER ASSUMES THE RISK OF ANY HARM, ACCIDENT OR DAMAGE WHICH MAY BE DONE TO OR SUFFERED BY YOU OR TO ANY OF YOUR PROPERTY RELATED TO YOUR TRAVEL WITH BRIGHT PATH TRAVEL.

Bright Path Travel will not be responsible for damage or injury to any person who sustains an injury as a result of traveling with Bright Path Travel. Bright Path Travel is not responsible for the actions, expenses or harm incurred by travelers who, through their own actions or through the advice/actions of other travelers, disregard the instructions of the Bright Path Travel representative(s), engage in activities with other travelers that cause harm, depart from the planned activities of the tour, or follow the instructions of a non-Bright Path Travel representative(s). By embarking upon your travel with Bright Path Travel, you knowingly and voluntarily assume all risks involved in such travel, whether expected or unexpected risks, of injury or illness to yourself or others, or other damage, including death.


RELEASE OF LIABILITY

Knowing the risks, and in consideration for being permitted to participate on a Bright Path Travel tour, and as an inducement for Bright Path Travel to allow you to participate on a tour, you agree to release and hold harmless Bright Path Travel, its officers, agents, affiliates, employees, assigns, owners, representatives, volunteers, sponsors, and officials from any liability, present and future, known or unknown that is associated with Traveler’s participation in travel with Bright Path Travel (“Release of Liability”), from any and all claims, demands, losses, expenses, damages, liabilities, actions, causes of action of any nature, including but not limited to personal injury, illness, disease, wrongful death and property damage, that in any manner arise from or relate to your participation in travel with Bright Path Travel. This extends to and includes any and all claims, liabilities, injuries, damages, and causes of action that you do not presently anticipate, know, or suspect to exist, but that may develop, accrue or be discovered in the future, and you voluntarily assume that risk as part of the Policies. You agree that this Release of Liability shall bind the members of Traveler’s family and spouse, if Traveler is alive, and Traveler’s heirs, assigns, and personal representatives if Traveler is deceased.

Third Parties Actions: You understand that Bright Path Travel works with “Third Parties” for hotel accommodations, meals, tours, etc. As Bright Path Travel attempts to only work with those Third Parties who have shown an acceptable level of stability, dependability and responsiveness to problems and complaints, nevertheless, Bright Path Travel does not control the actions or failure to act of the Third Parties it works with. Therefore, you acknowledge that Bright Path Travel is not responsible for any breach of contract, failure to comply with any laws, or any intentional or negligent actions or omissions on the part of such Third Parties, which result in any loss, damage, delay, inconvenience or injury to you, including any losses resulting from any changes in rates unless marked on your invoice, tickets, or reservation itinerary as Guaranteed, or any losses in connection with booking, reservation, connection, or scheduling problems or in connection with the handling or loss of baggage or other personal effects. Bright Path Travel shall not be responsible for any injuries, damages, or losses caused to any traveler in connection with terrorist activities, social or labor unrest, mechanical or construction failures or deficiencies, diseases, local laws, climactic conditions, abnormal conditions or developments, or any other actions, omissions, or conditions outside Bright Path Travel’s control.

You execute this Release of Liability voluntarily and with full knowledge of its significance, and with the intent of binding yourself, spouse, children, if any, and your heirs, legal representatives, and assigns. Traveler expressly agrees that this Release of Liability is intended to be as broad and inclusive as permitted by law. Traveler has carefully read this Release of Liability section and fully understands its contents.


COVENANT NOT TO SUE

You agree and covenant on behalf of yourself, that you will never directly or indirectly institute any legal, equitable, administrative or other action, complaint or proceeding against Bright Path Travel, its officers, agents, affiliates, employees, assigns, owners, representatives, volunteers, sponsors, successors and assigns thereof, arising from or pertaining to your participation in travel with Bright Path Travel. This covenant applies and extends to any and all claims, liabilities, injuries, expenses, losses, damages, and causes of action that you do not presently anticipate, know, or suspect to exist, but that may develop, accrue, or be discovered in the future.


DISCLAIMER OF WARRANTIES

Your participation in travel with Bright Path Travel is offered “AS IS” and without any warranty or guaranty of any kind. Bright Path Travel has not made and does not make any warranty or representation whatsoever, either express or implied, as to whether the travel will or will not meet your expectations, the quality or capacity of the experience you may have, nor any other representation or warranty whatsoever.


INDEMNITY

Traveler shall indemnify, defend, protect and hold Bright Path Travel, its shareholders, directors, officers, employees, agents, successors and assigns, free and harmless from and against all claims, losses, liabilities (including, but not limited to, negligence and tort), damages, judgments, suits, and all legal proceedings, and any and all costs and expenses in connection therewith (including attorneys’ fees) arising out of or in any manner related to your participation in travel with Bright Path Travel, including, without limitation, claims for injury to or death of persons and for damage to property. You agree to give Bright Path Travel prompt notice of any such claim or liability. This provision shall survive the end of the travel participation with Bright Path Travel.


OTHER PROVISIONS

Attorneys’ Fees: In the event litigation shall be instituted to enforce any provision of the Policies, the prevailing party shall be entitled to recover reasonable attorneys’ fees and expenses incurred. ● Governing Law: Both Bright Path Travel and Traveler agree that any dispute involving the Policies shall be governed by and construed in accordance with, the laws of the state of California.

Integration of Documents: The Policies, invoices, and any registration documents contain all of the understandings and representations between Bright Path Travel and the Traveler.
