TERMS & CONDITIONS

We are Gilded Getaways, LLC and are excited to help you with your travel. The following terms & conditions (the "Agreement") describe what you can expect from us. The terms "we", "us", and "our" refer to Gilded Getaways, LLC and the term "you" refers to the individual who engages our services.

PLANNING FEES & PROFESSIONAL SERVICES

We charge a non-refundable planning fee for our time, expertise, research, and professional travel consulting services.

This fee is not a deposit toward travel and is not tied to any specific booking or supplier. It is payment for the professional services we provide, which may include, but are not limited to:

  • Destination research and recommendations (up to 3 destination or date changes are covered - additional changes may incur an additional planning fee)
  • Custom itinerary design and revisions
  • Supplier sourcing and vetting
  • Pricing analysis and optimization
  • Travel strategy and logistics planning
  • Ongoing consultation and communication

By submitting payment, you acknowledge and agree that:

  • The planning fee is earned immediately upon receipt
  • The planning fee is non-refundable under any circumstances
  • The planning fee applies regardless of whether you choose to book the trip, modify the itinerary, or discontinue services

Travel planning is a collaborative and subjective process. While we strive to align every itinerary with your preferences, personal dissatisfaction with itinerary style, options presented, or recommendations does not constitute grounds for a refund.

NO CHARGEBACK POLICY FOR PLANNING FEES

By engaging our services and submitting payment, you expressly agree:

  • You will not dispute or initiate a chargeback for planning fees under any circumstances
  • You acknowledge that planning services are intangible, time-based, and delivered upon engagement, making them non-returnable

In the event of a chargeback or payment dispute, you agree that:

  • You remain fully responsible for the original fee amount
  • You will be responsible for any associated costs incurred by us, including but not limited to:
    • Chargeback fees
    • Administrative time
    • Collection costs
    • Legal fees

You further agree that documentation of work performed, including emails, itinerary drafts, proposals, and communication history, constitutes valid proof of services rendered.

PAYMENT AUTHORIZATION & ACKNOWLEDGMENT

By submitting payment for planning services, you confirm that you have read, understood, and agreed to these Terms & Conditions, including the Planning Fee and No Chargeback Policy.

TRAVEL AGENT

We act as a travel agent only. We sell various travel related products on behalf of numerous transport and accommodation service providers, including, but not limited to airlines, coach, rail, cruise line operators and hotels. We do not own, operate, manage or control these independent suppliers of services and are not liable for their acts or omissions.

Our obligations to you are to make travel bookings on your behalf and to arrange relevant contracts between you and the travel service providers. We have no responsibility for these services, nor do we have the authority to make any warranty or representation regarding their standard. A request cannot be guaranteed. All bookings are subject to the terms and conditions and limitations of liability imposed by these travel service providers. You understand that your legal recourse is against the specific provider, not us.

IMPORTANT CONDITIONS

Prices are subject to increase prior to the time you make full payment. Prices are not subject to increase after full payment, except for charges resulting from increases in government-imposed taxes or fees. By proceeding with booking, you acknowledge and accept these conditions.

CANCELLATION

Most travel bookings are non-refundable and cancelled bookings may incur charges up to 100% of the cost of the booking, regardless of whether travel has commenced.

Where we incur any liability for a cancellation fee or charge for any booking which you cancel, you agree to indemnify us for the full amount of that fee or charge.

DEPOSIT AND FINAL PAYMENT

A minimum deposit may be required to secure bookings. All deposits are non-refundable unless otherwise stated by the supplier. Final payment is due by the date indicated on your invoice. Some services, including airfare, may require full payment at time of booking.

CREDIT CARD TRANSACTIONS

If any travel service provider is unable to provide the services for which you have contracted, your remedy lies against the provider, not against us.

If payment has been made to us by credit card, you agree that you will not seek a chargeback against us. If a chargeback is initiated, you agree to be held liable for the full amount, including any fees, penalties, or costs incurred by us in disputing or recovering the funds.

If we incur any costs, including attorneys’ fees, in recovering payments, you agree to be responsible for those costs.

TRAVEL PROTECTION

We strongly recommend purchasing travel insurance. We are not an insurance provider and are not responsible for the submission, processing, or outcome of any claims.

ADDITIONAL FEES

Additional taxes, resort fees, and surcharges may be charged locally by suppliers and are your responsibility.

RESPONSIBILITY

We do not own or operate the travel services you purchase. All suppliers are independent contractors and are not agents or employees of Gilded Getaways, LLC.

LIABILITY

We are not liable for any injury, loss, damage, delay, or inconvenience caused by any third party or event beyond our control, including but not limited to acts of God, weather, illness, strikes, or supplier failure.

Where liability cannot be excluded, it is limited to the value of the travel services purchased.

PASSPORTS & VISAS

You are responsible for ensuring all required travel documentation is valid and meets all entry requirements. Any fines or issues resulting from improper documentation are your responsibility.

TRAVEL DOCUMENTS

Travel documents are subject to supplier restrictions and may be non-refundable or non-transferable. It is your responsibility to review all documents for accuracy.

HEALTH & SPECIAL REQUIREMENTS

You are responsible for understanding and meeting any health or vaccination requirements for your destinations.

Our system uses SSL encryption, which is the same technology banks use to protect sensitive information.
