Terms & Conditions

We are Panoramic View Vacations, LLC, and we are excited to help you with your travel. The following terms & conditions (the "Agreement") describe what you can expect from us. The terms "we," "us," and "our" refer to Panoramic View Vacations, LLC, and the term "you" refers to the individual who signs this agreement.

By booking your arrangement with us or using our website, you agree to be bound by the terms of this Agreement and any additional terms and conditions of any Supplier that apply to your booking, travel arrangements, or use of any website content. You agree on behalf of yourself and those you represent to comply with all such terms and conditions, including paying all amounts when due. You agree that any violation of any such terms and conditions may result in (a) the cancellation of your reservation or purchase, (b) your forfeiture of any monies paid for your reservation or purchase, (c) you're being denied access to the applicable travel-related product or service, and (d) our right to debit your account for any costs we incur as a result of such violation.

You represent and warrant that (a) you are of sufficient age to use our services and website and can create binding legal obligations in connection with your use, (b) you are legally authorized to act on behalf of those you represent and accept these terms and conditions on their behalf, and (c) the information supplied by you or members of your group is true and correct. You are responsible for informing such other persons of all terms and conditions applicable to their travel arrangements. You understand that you are financially responsible for any use of our services or website by you and those using your name or account.

Products and Suppliers

We sell travel-related products from suppliers and service providers ("Suppliers"). Each Supplier has its terms and condition that apply to your particular arrangements in addition to our general terms and conditions, and you should make sure you understand them. Specific software and content found on our website are owned or licensed by our Suppliers or us, your use of which may be subject to further conditions. Our website, which is referred to throughout this Agreement, can be found at http://www.panyourview.com.

Panoramic View Vacations, LLC is acting as an intermediary or a "Booking Agent" for products and services that are not directly supplied by us (e.g., air carriage and ground transportation, hotel accommodations, meals, tours, cruises, etc.). We are not a co-vendor of such products and services. You will enter into a separate contract with such Suppliers concerning such products and services.

All airline tickets are subject to supplemental price increases that may be imposed after the date of purchase. Post-purchase price increases may be applied due to additional costs imposed by a supplier or government. You may be charged additional sums by Panoramic View Vacations, LLC to offset increased fees, fuel surcharges, taxes, and fluctuations in foreign exchange markets or any combination thereof. Accepting these terms and conditions hereby consents you to any post-purchase price increases and authorizes us to charge my credit card for such additional amounts.

Use of our Services and Website

You agree you will only use our website or services to make legitimate reservations or purchases and shall not make speculative, false, or fraudulent reservations or reservations in anticipation of demand. You will only use our website and services in compliance with applicable law.

Our website may contain links to third-party websites that we provide only as a convenience to you. You should take precautions to ensure that whatever links you access are free of viruses, worms, trojan horses, or other destructive mechanisms. The existence of these links does not imply that we endorse such websites or any included content. We are not responsible for such websites or content or any data privacy practices of such websites.

Deposits and Payments

All prices listed are per person based upon shared double occupancy unless otherwise clearly specified. Prices do not include items of a personal nature, such as laundry, wines, water, beverages, food (other than at all-inclusive resorts or where clearly specified), passport and visa fees, insurance, and foreign port taxes unless specifically indicated in the package inclusions. Prices are correct at the time of publication; however, as airfares continually fluctuate and classes of service may have limited capacity, tour package prices and availability will change accordingly.

Deposits: A non-refundable deposit is due at the time of reservation. All reservations can be paid in full when booking as long as space is still available. The deposit payment lets us hold a reservation for you but does not guarantee the price. The price can only be guaranteed once we receive full payment and other travel documents have been issued, subject to any terms and conditions of the Supplier. We will advise you of the date that full payment is required.

Reservations: Guests are required to make reservations in their full name as it is listed on his/her government identification that is being used for travel. Payments can be made online with major credit cards.

Refunds: Any deposits from you are non-refundable. If you purchased travel insurance through Panoramic View Vacations, any approved refund would be returned to the credit card that was used to make the reservation, minus the cost of the travel protection.

Late payments: If there is an outstanding balance after the final payment due date, a late fee will automatically be added to your invoice. Your reservations will be canceled if your account is not paid in full within five days of the final payment date.

Reinstatement of Cancelled Reservation: If your travel reservations have been canceled, and you notify us within 14 days that you want to reinstate your reservations, a service reinstatement fee of $50 ($200 for international tours) will be added to your invoice, and must be paid in advance to apply for reconfirmation of services.

Cancellations and Changes

Your contract with your Suppliers may allow them to cancel or amend bookings. As your Booking Agent, we will ensure that you are promptly notified of any significant changes once we become aware of such changes if there is time before your departure, but we accept no liability for any changes or costs incurred that may result. Subject to the Supplier’s terms and conditions, you will then have the choice of accepting the change of arrangements, accepting an offer of alternative travel arrangements if one is made available by the Supplier, or canceling your booked arrangements and receiving any applicable refunds. We do not guarantee that any refunds will apply.

If you have booked a flight and we are alerted to a significant schedule change by your airline before you leave the United States, we will contact you by email to advise you of this. Please ensure that you have given us your contact email address and regularly check for messages before you leave. We have no control over airline schedule changes and accept no liability for costs arising from such changes.

After you leave the US, you must check with the airline that any onward flights you have confirmed are operating as booked. We strongly recommend contacting your airline at least 72 hours before the scheduled departure of each flight to do this. Please note that for some airlines, you must confirm with them your intention to fly.

If You Change Your Booking

Changes to an existing reservation must be approved by the supplier. All changes to your travel arrangements will incur our standard service fees of $50 per person in addition to any additional Supplier charges. Please note that all reservation changes are subject to availability and the terms and conditions of the product purchased.

Changes to name details are not allowed by many airlines and other Suppliers. While we will endeavor to make such a change, if necessary, please remember that most airlines and Suppliers treat a name change as a cancellation, to which standard conditions and charges would apply.

Flights must be taken in the sequence they appear on your ticket or e-ticket confirmation. If you plan not to take a flight as booked, please get in touch with the airline as far in advance as possible to discuss your options. If you do not check in on time for a confirmed reservation, the airline may register you as a ‘no-show,’ which could result in extra charges and/or your whole flight itinerary being canceled and/or render your ticket void.

If You Cancel Your Booking

All cancellation requests must be received in writing. Email all requests to kdallas@panyourview.com. You may be entitled to a partial refund if you cancel your arrangements. In addition to the cancellation terms and conditions of your Supplier(s), our standard fees will apply as may be outlined on your receipt or booking confirmation. If you decide to cancel arrangements before the balance due date, any deposits paid are non-refundable.

Refunds will only be paid to you once we have received the funds back from the Supplier(s). Generally, flight tickets cannot be refunded if they are partially used. We are not responsible for a Supplier’s failure to pay a refund.

If the reason for your cancellation is covered under the terms of your travel insurance policy, you may be able to reclaim your cancellation charges through your insurer.

Passport, Visa, and Immigration Requirements

You are responsible for fulfilling the passport, visa, and other immigration requirements applicable to your itinerary. You should confirm these with the relevant embassies and/or consulates. We do not accept any responsibility if you cannot travel due to not complying with any such requirements.

Passports must be valid for at least six months after the travel date. Some countries require a full blank “VISA” page in the passport for stamping purposes. Any information provided in the travel description pertains to US citizens only. Non-US citizens should check with the respective consulate of the country(s) to be visited for current entry requirements. We strongly suggest all cruise passengers have a valid passport in their possession while cruising.

Travel Documents and Destinations

Our general practice is to send documents to our customers electronically whenever possible, provided full payment is received no later than your Final Payment Due date, 30 days or earlier before travel. If paper documents are requested when e-documents are available, documents will be delivered via USPS approximately 14-21 days prior, and a fee of $30 will apply. A complete street address is required (no PO boxes).

It is your responsibility to ensure that all of the details on your travel documents are correct and to bring any errors or discrepancies to our attention immediately. Your travel documents are valuable and should be safeguarded as if they were cash. It is not always possible to replace travel documents in case of loss, theft, damage, etc.

Before booking international travel, we recommend that you review any U.S. Government prohibitions, warnings, and advisories applicable to your destinations. By offering travel to any particular destination, we do not represent that travel to such a destination is safe or without risk. For complete travel details, visit www.travel.state.gov.

We encourage you to register for a free "The Smart Traveler Enrollment Program" account. It’s a free service that allows U.S. citizens traveling or living abroad to receive the latest security updates from the nearest U.S. embassy or consulate. When you enroll in STEP, you will receive current information about your destination country.

You further agree that in connection with your activities, you will not permit the use of our services or website by anyone residing or staying in a country for which such use is prohibited under U.S. regulations.

Insurance

Travel insurance is vital to your arrangements to cover unexpected events such as trip cancellation, trip interruption, lost baggage, medical expenses, and more. Travel insurance has been offered as part of your travel arrangements. You will be required to accept or deny insurance in writing before your travel arrangements have been finalized.

Travel Guidance and Vaccinations

U.S. Citizens should refer to the travel advice posted by the U.S. Department of State at travel.state.gov for all the countries they intend to visit. Vaccinations may be required for some or all the places you intend to visit. You are responsible for ensuring that you have arranged all necessary vaccinations for your itinerary.

The COVID-19 pandemic, also known as the coronavirus pandemic, is an ongoing pandemic of coronavirus disease 2019 (COVID-19) caused by severe acute respiratory syndrome coronavirus 2 (SARS-CoV-2).

I understand and agree to the following:

1. Health and Other Hazards: You agree that it is your personal decision to travel, and you are doing so with full knowledge of current travel recommendations and travel restrictions concerning the risks of COVID-19. We assume no responsibility for and shall not be liable for unsafe conditions or health hazards, including pandemics or other illnesses. We have no special knowledge of dangers during travel or at destinations. For information about such dangers, we recommend going to the State Department travel website at www.travel.state.gov, click on "Find International travel Information,” then click on "Country Information," and fill in the name of the destination country. For medical and health information, we recommend going to the Centers for Disease Control website at www.cdc.gov/travel, then click on “Destinations” and scroll to the destination country's name.

2. Vaccination Requirements and Other Rules: Panoramic View Vacations, LLC holds no responsibility for Covid-19-related requirements that travel suppliers and governments may impose from time to time, such as health affidavit forms, and health screenings before departure or upon arrival, face coverings, or quarantines. For the latest Covid-19 government travel regulations, the client should review IATA's website at www.iatatravelcentre.com. For the latest travel supplier requirements, check the supplier's homepage.

3. Financial Condition of Travel Suppliers: We are not responsible for the acts or omissions of travel suppliers or their failure to adhere to their schedules, provide services or refunds, financial default, or failure to honor future trip credits. We have no special knowledge regarding the financial condition of the suppliers, and we have no liability for recommending a trip credit instead of a refund.

4. Rebooking: If requested, we will assist with obtaining any refunds due or rebooking trips using future credits, but we will charge a non-refundable fee for such services.

5. Insurance: We strongly recommend purchasing trip cancellation and travel accident insurance for your protection. Please note that unless you buy a cancel-for-any-reason policy, most policies have a specific clause stating they do not cover epidemics and pandemics, especially when travel warnings are in place. No representation or description of the insurance made by our staff constitutes a binding assurance or promise about the insurance. You agree to hold us harmless for your election, not to purchase travel insurance, or for any denial of the claim by the travel insurer as it relates to COVID-19 or any other claim under the policy.

Important Notice Regarding Airline Reservations

Ticketing: If you arrive at an airline ticket or passenger check-in counter with your confirmed ticket and find that the airline shows no reservation, do not leave the counter. Check your ticket. If the status box shows "OK" for the flight in question, the airline policies typically require them to accommodate you on that flight, or if that is not possible, they must either find you a substitute flight or pay you denied boarding compensation. If necessary, ask to speak to a supervisor.

Airline use of Insecticide Spray

Some countries require insecticide spraying of aircraft before a flight or while you are on the aircraft. Federal law requires that we refer you to the Department of Transportation’s Disinfection Information page on their website when booking for further information. http://airconsumer.dot.gov/spray.htm.

Hazardous Materials Disclosure

Federal law forbids the carriage of hazardous materials aboard aircraft in your luggage or your person. A violation can result in five years of imprisonment and penalties of $250,000 or more (49 U.S.C. 5124). Hazardous materials include explosives, compressed gases, flammable liquids and solids, oxidizers, poisons, corrosives, and radioactive materials. Examples: paints, lighter fluid, fireworks, tear gases, oxygen bottles, and radio-pharmaceuticals.

There are notable exceptions for small quantities (up to 70 ounces total) of medicinal and toilet articles carried in your luggage and certain smoking materials carried on your person. For further information, review the information found on TSA’s prohibited items webpage at http://www.tsa.gov/traveler-information/prohibited-items.

Hotel/Resort Accommodations

Most rooms requested are double beds based on double occupancy unless otherwise expressly stated. Specific bed type requests can be submitted to the hotel/resort on your behalf; bed types are subject to availability. Based on availability, single, triple, and quad occupancy rooms can be provided upon request.

Resort accommodations are provided with an all-inclusive package unless otherwise stated. Check-in time is generally not before 3:00 p.m.; check-out time is before noon. Please be sure that adequate accommodations arrangements have been considered when a late-night flight is being used.

Meals are provided as specified within your itinerary.

Ground transportation is provided as indicated on your travel documents.

If You Have a Complaint

If you have a problem during your holiday, please inform the relevant Supplier (e.g. your hotel) immediately. Should they be unable to resolve the matter, please immediately contact us in the United States through email at kdallas@panyourview.com or phone at 833-782-8747.  If you fail to contact us timely, we will not be permitted the opportunity to investigate your complaint and attempt to rectify any error while you are away, which may affect your rights under this Agreement.

Indemnification

You agree to indemnify us, our affiliates, and any of our Suppliers. Any such parties’ officers, directors, employees, and agents from and against any claims, causes of action, demands, losses, damages, or other costs (including reasonable legal and accounting fees) brought by you or third parties as a result of (a) your breach of this Agreement, (b) your violation of any law or rights of any third party, or (c) your use of our website.

Privacy Policy

You consent to our processing and sharing of personal information about you and other members of your party that you have provided to us in accordance with the terms of and for the purposes set forth in our privacy policy. You represent that you have read and agree to the terms of our privacy policy, which can be found on our website.

Additional Terms

FORCE MAJEURE

There may be times when either party cannot perform, or complete performance, under the travel contract for reasons out of each other’s control. If a force majeure event occurs, the parties will look to and follow the cancellation policies of the suppliers, what is stated in the travel proposal, and these terms & conditions. Any policy changes are at the sole discretion of the supplier (if applicable) and Panoramic View Vacations, LLC. Passengers will be informed of their options if a force majeure event occurs.

Additional Terms

FORCE MAJEURE

There may be times when either party cannot perform, or complete performance, under the travel contract for reasons out of each other’s control. These are called force majeure events and, if they occur, make performing under the contract inadvisable, commercially impracticable, illegal, or impossible. Events that may trigger this provision include, but are not limited to, acts of God, acts of government, acts of war or civil unrest, insurrection or revolts, military action, strikes or other labor activities, criminal or terrorist activities of any kind, or the threat thereof, pandemics, epidemics, illnesses or health conditions prevalent in the area of travel, earthquakes, hurricanes, lightning, and explosions, unexpected legislation, or any other event outside the reasonable control of either party.
