TERMS AND CONDITIONS

PLEASE READ THESE TERMS AND CONDITIONS IN THEIR ENTIRETY.  IF YOU DO NOT AGREE WITH THEM, PLEASE DO NOT PROCEED WITH UTILIZING THE SERVICES OF UNIQUE DESTINATIONS, LLC. D/B/A UNIQUE DESTINATIONS TRAVEL COMPANY (“Unique Destinations Travel”).

Unique Destination Travel looks forward to the opportunity to act as your booking agent for your travel needs. Access to and use of the services of Unique Destinations Travel and our website is subject to acceptance of these terms and conditions (“Terms and Conditions”). By accessing, using or obtaining any content, products, or services through our offices or through our website, you, the purchaser, and/or traveler (“Customer” and “passenger” and “you/your”) agree to be bound by these terms. No alterations to these Terms and Conditions may be made unless in writing by an authorized officer of Unique Destinations Travel.

USE OF INFORMATION AND SERVICES

You warrant that you are at least 21 years of age and possess the legal authority to enter into this agreement and to make travel bookings with Unique Destinations Travel by any means, including our Web site in accordance with these Terms and Conditions. You agree to be financially responsible for all of your travel bookings (as well as for use of your account by others, including, without limitation, minors living with you). You assume the responsibility to supervise all usage of Unique Destinations Travel communications by minors under your name or account. You also warrant that all information supplied by you or members of your household transacting business with Unique Destinations Travel is true and accurate. Without limitation, any speculative, false, or fraudulent reservation or any reservation in anticipation of demand is prohibited. You agree that the travel services reservation facilities provided by Unique Destinations Travel shall be used only to make legitimate reservations or purchases for you or for another person for whom you are legally authorized to act. Separate supplier terms and conditions will apply to your reservation and purchase of travel-related goods and services that you select. You agree to abide by the Terms and Conditions of purchase imposed by Unique Destinations Travel and any supplier with whom you elect to deal, including, but not limited to, payment of all amounts when due and compliance with the supplier’s rules and restrictions regarding availability and use of fares, products, or services. You understand that any violation of any supplier’s conditions of purchase may result in the cancellation of your reservation(s) or purchase, in your being denied access to any flights, hotels, cruises, or automobiles, in your forfeiting any monies paid for such reservation(s) or purchase, and in Unique Destinations Travel debiting your account for any costs Unique Destinations Travel incurs as a result of such violation.  You expressly authorize Unique Destinations Travel to debit your account in accordance with these Terms and Conditions.  You shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of your travel bookings through your client portal provided by Unique Destinations Travel.

 

PRICE QUOTES

Price quotes for travel are not guaranteed until reservations are confirmed with full passenger names and deposit payment. All prices are subject to change without notice and are subject to availability. Unless otherwise noted, price quotes typically do not include airfare, baggage fees, gratuities, meals, telephone calls, resort fees, incidental items, souvenirs, airport transfers, or travel insurance.

 

PAYMENTS AND CANCELLATIONS

Unless otherwise defined during the reservation process, final payment is due prior to departure or consumption in accordance with each supplier’s (airline, hotel, cruise line, transfer company, sightseeing operators, and other travel service vendors) terms and conditions involved in your travel booking. If final and full payment is not received by the applicable due date, reservations are subject to cancellation and deposits shall be forfeited. In some cases, there is NO REFUND once a booking is made and paid for. Your right to a refund if you change or cancel your travel plans is limited. All cancellation requests must be sent to Unique Destinations Travel in the form of an email. As a result of the cancellation, Unique Destinations Travel and third-party supplier’s cancellation penalties will apply, which are detailed in your travel documentation, and on each supplier’s website. Cancellation penalties are advised at the time of booking and provided to you upon confirmation. If you have any questions or believe any penalties are unclear, please contact Unique Destinations Travel. Cancellation fees will be charged to the credit card you authorized to pay for travel services. Unique Destinations Travel’s cancellation fees are separate from vendor cancellation fees. Vendor policies regarding cancellation fees will be provided to all Customers in trip quote documents. There is a minimum monthly payment of $50 for Group Cruises unless otherwise noted in the quote and/or agreement. 

If you cancel, your cancellation fee will be $100 per person + the Vendor’s Fee, if applicable.

 

CHANGE FEES   

If you decide to change any portion of your confirmed arrangements prior to departure or during your trip, we will attempt to assist you. Due to Vendor(s) policy(ies) or time restraint(s), certain bookings may be unable to be changed. Administrative charges of $50 or more per change/per person may be assessed at the time of booking and depend upon the circumstances of the request. All desired changes must be sent via email to Unique Destinations Travel. Changes will not be processed until the $50 administrative charges have been received.

 

TRAVEL INSURANCE

Travel insurance is strongly recommended. It may be purchased and may cover cancellation for covered reasons as outlined in the insurance policy. Insurance policies vary with differing exclusions (such as pre-existing conditions, work-related issues, supplier bankruptcy, change of mind, etc.). The specific policy terms contained in the travel insurance policy govern any coverage and exclusion, and Unique Destinations Travel makes no guarantee or representation with regard to such travel insurance policy and shall have no liability arising out of or related to any travel insurance policy.

 

TRAVEL IDENTIFICATION

Photo identification is required for all travel. It is the responsibility of each Customer to obtain and carry a valid passport, visa(s), and all other documents required by applicable government regulations. When traveling domestically or internationally, the U.S. Transportation Security Administration (TSA) and the U.S. Department of Homeland Security (DHS) advise that everyone carry at least two forms of acceptable identification in order to board a flight. Acceptable identification can be found at http://www.tsa.gov/traveler-information/acceptable-ids; examples are DHS-designated enhanced driver’s license, USA Passport, or a foreign government passport. The name, date of birth, and gender that appear on the identification card must exactly match the same details that are listed on airline ticket(s) and booking records. Unique Destinations Travel strongly recommends that you take into account that certain countries will not admit a passenger if their passport expires within six (6) months of the date of entry. Non-United States citizens may require additional documentation for travel. Children and infants also require appropriate travel documents. Minors traveling with one parent, and/or without both parents, may be stopped and refused entry unless authenticated and verified consent forms are provided to the authorities; please see https://help.cbp.gov/app/answers/detail/a_id/268/kw/travel for forms.

For USA child groups under age 19 arriving by land or sea from the contiguous territory and traveling with a school group, religious group, social or cultural organization, or sports team, the U.S. Customs and Border Protection Agency may also require an original or copy of a child’s birth certificate, a Consular Report of Birth Abroad, or a Naturalization Certificate. Parental or legal guardian consent forms must be provided to the supervising adult/Group Leader. You acknowledge any failure to strictly comply with these requirements may result in denied boarding or an undue delay at an airport security checkpoint and may result in Customer missing flight(s), and subsequent scheduled travel bookings on cruises and tours. You should check each supplier’s website to ensure you and all members in your travel group or party obtain and carry the travel documentation required.

 

ENTRY AND EXIT REQUIREMENTS

Each foreign country holds different views of past criminal offenses, whether within or outside of their boundaries.  If you have a current or past offense, and you are unsure how the country you are traveling to (or through) views that offense, please contact that country directly for entry and exit requirements. (Details can be found at http://travel.state.gov/travel/cis_pa_tw/cis/cis_4965.html.) Unique Destinations Travel respects the privacy of all customers and believes that it is an invasion of privacy for any member of our staff to make such an inquiry to Customers.  However, the Customer acknowledges responsibility for verifying entry and exit requirements and complying with such requirements. 

 

TRAVEL DOCUMENTS

Upon receipt by Unique Destinations Travel, travel documents will be delivered via US Postal Services, UPS, or FedEx to Customers. For late bookings and rebooking, or if expedited delivery of documents is necessary, a $25 shipping fee will apply. Although we check all documents prior to delivery, please check your documents to confirm the accuracy of all information. Call us immediately at (251) 255-6596 if any errors are found. Tickets and vouchers are specific to individuals, non-negotiable, and nontransferable instruments.  Keep them in a safe place at all times and secure them in your possession. At the time that services are rendered, you may be required to present the voucher or ticket to the vendor in order to obtain the services. Lost, stolen, or destroyed tickets and vouchers cannot be replaced or refunded.

 

 

AIRLINE CONFIRMATION, CHECK-IN, SEAT ASSIGNMENTS, MISSED FLIGHTS

It is important that you confirm your flight details with the airline prior to departure: 24 hours in advance for domestic flights, and 72 hours in advance for international flights. Failure to confirm international flights or failure to use any portion of an airline reservation may result in automatic cancellation by the airline for all continuing and return flights. Familiarize yourself with your airline’s policies and requirements before booking. Unless directed otherwise by the airlines, it is important to arrive at the airport at least 2 hours prior to departure for domestic flights and 3 hours prior to departure for international flights. Late arrival at the airport can result in loss of assigned seats or denial of boarding. Denial of boarding is not eligible for refund or travel insurance reimbursement. Airfare rebooking is subject to airline penalties, rebooking fees, plus any cost difference of the new flight. Seat assignments are subject to change by the airline without notice.

 

PHOTOGRAPHY | VIDEO

Unique Destinations Travel reserves the right to use any photograph/video taken at any Unique Destinations Travel event or during any travel activity, without the express permission of those included within the photograph/video.  By attending Unique Destinations Travel events or providing photographs or videos to Unique Destinations Travel, you understand that same may be used for promotional purposes. Unique Destinations Travel may use the photograph/video in publications or other media produced or used by Unique Destinations Travel including but not limited to: brochures, invitations, books, newspapers, magazines, television, websites, Facebook, and other social media or advertising sources.

 

SAFETY RISKS

Travel to certain destinations may pose a greater risk than other locations. Unique Destinations Travel strongly urges customers to remain informed of current news events, travel prohibitions, warnings, announcements, and advisories issued by the United States Government prior to booking international travel.

By offering travel opportunities to particular international destinations, Unique Destinations Travel does not warrant that such destination is advisable, safe, or without risk and Unique Destinations Travel shall not be liable for any damages, injuries, or losses that could result from such travel. Customer booking constitutes acknowledgment that the Customer’s travel is at his or her own risk.

The Smart Traveler Enrollment Program (STEP) is a free service provided by the U.S. Government to U.S. citizens who are traveling to or living in, a foreign country. STEP allows you to enter information about your upcoming trip abroad so that the Department of State can better assist you in an emergency. Registration is recommended and provided by going to https://step.state.gov/step/

FORCE MAJEURE/ACT OF GOD

Travel to foreign locations may be interrupted or made impossible by Acts of God, natural disasters, hurricanes, earthquakes, fires, floods, tornados, tsunamis, or by pandemics, famine, terrorism, strike, war, Governmental restrictions, or closure.  Unique Destinations Travel shall bear no responsibility or liability for these sorts of occurrences that are out of its control.

DISCLAIMER OF LIABILITY

Unique Destinations Travel and its owners, members, employees, shareholders, officers, directors, successors, agents, and assigns, do not own or operate any entity which is to, or does, provide goods or services for trips or tours. Unique Destinations Travel is not liable for the acts, errors, omissions, representations, warranties, breaches, or negligence of any supplier, or personal injuries, death, property damage, or other damages or expenses resulting from causes outside of the control of Unique Destinations Travel. Unique Destinations Travel shall not be responsible for travel delays or cancellations or any illness, death, injury, damage, or loss of vacation time arising from any travel or travel interruption. Changes to the cruise port of call or itineraries due to mechanical, weather, or world events beyond our control are at the sole discretion of the cruise line and vendors and may occur with limited or no notice. Any applicable compensation resulting from such occurrences is also at the sole discretion of the supplier. All services and accommodations are subject to the laws and regulations of the country in which they are provided. Unique Destinations Travel is not responsible for any baggage or personal property of any individual participating in the trips arranged by Unique Destinations Travel. Individual travelers can purchase a travel insurance policy, if desired, that may cover expenses associated with the loss of luggage or personal property.

RELEASE

By electronically signing this Terms and Conditions form, I am confirming that I have read this document in its entirety (5 total pages) and I hereby release and discharge Unique Destinations, LLC, d/b/a Unique Destinations Travel Company, its agents, owners, members, employees, officers, directors, shareholders, and successors from and against any and all liability arising from my participation in this trip and my travel. I agree that this release will be legally binding upon myself, my heirs, successors, assigns, and legal representatives. Furthermore, it is my intent to fully assume all risk of travel and to release Unique Destinations, LLC, d/b/a Unique Destinations Travel Company from any and all liability to the maximum extent permitted by law.
