BAG TRAVEL TERMS AND CONDITIONS

These Terms and conditions are agreed to by the user of this site, or a participant booking a service through this site, or a person who a service is booked for or on behalf of someone else, hereinafter be referred to as “You” or “Your”, and BAG Travel LLC, a California limited liability company, hereinafter referred to as “BAG Travel” “Our” “We” “Us” or “The Company”.

BOOKING:
Reservations must be made in your FULL LEGAL NAME as it appears on your current, valid passport. Your name on your invoice MUST match your current, valid passport.

Provided that Your full payment is received no later than Your Final Payment Due date, travel documents, itineraries, and travel instructions will be sent via email 30 days or earlier prior to travel.

DEPOSITS & FEES:
Things happen and even airlines give you a refund within 24 hours of booking. So, Your deposit is refundable up to 72 hours after booking. Beyond that, it is non-refundable. Please allow at least five to seven business days for any refunds to be processed.

In addition, BAG Travel charges a non-refundable booking fee of $50 (USD) per booking. This fee will be non-refundable upon booking a trip with Our site.

REFUND POLICY:

Except for as otherwise stated in these Terms and Conditions, payments to BAG Travel are non-refundable and non- transferable. This is because BAG Travel has contractual agreements with hotels, airlines, and other vendors that will not allow us to obtain any refunds. This way, we can keep Our package prices competitive and allow You to make monthly payments for your dream vacation.  

PASSPORT & ID REQUIREMENTS: 
Guests are required to make reservations in the full, legal name that is listed on her/his government document they will use for travel.

If you need to make any changes to a name after travel documents have been issued, clients will be responsible for all name change fees, if applicable. Please reach out to requests@bagtravel.net with the subject line: “Name Change Request” for any pre-trip name change requests. Name change requests must be submitted at-least 30 days before trip departure and are allowed only with a non-refundable, $50 (USD) Name Change Fee. Please note that there is no guaranty that You will have to ability to change your name once booked.

TRAVEL PROTECTION ASSURANCE:
Please note our refund and deposit policy carefully. Life happens, but for piece-of-mind a very competitively-priced group travel insurance policy option is offered for all BAG Travel bookings. You may review the rate, description and select travel protection assurance as an option before checkout. If You wish to add the travel protection assurance at a later date, please note that it may available up-to 30-days before departure.

PAYMENT PLANS:
When you book with BAG Travel, we will calculate an evenly divided automatic billing plan for you, and you will know in advance the day of every month that Your payment will be processed.

Your initial Deposit + Booking Fee is due at the time of booking, and your future payments will be charged according to the schedule you see on your invoice.

Your name on your invoice MUST match your State Issued I.D.

Late Payment Fee (non-refundable) of $50 per person is required after the Final Due Date posted for the trip. BAG Travel reserves the right to deny late payments and cancel your trip booking, however. 

ROOMMATES:
You must ensure your roommate(s) if any, are also making timely monthly payments.

Your selected roommate(s) should make their reservations within 30 days of your reservation. If not, your reservations will be adjusted to current occupancy and price will change.

If you need assistance finding a roommate, the link to a “roommate finder app” tool will be provided upon request.

INTELLECTUAL PROPERTY RIGHTS & RELEASE:

Copyright. The photographs, graphics, literal and artistic works produced by the Company are protected by Federal Copyright Law (all rights reserved) and may not be reproduced in any manner not contemplated in this Terms of Use without the Company’s explicitly written permission. The photographs taken of You while participating in The Company’s services shall be owned by the Company and You grant the company to share the images on social media, social networking websites, and on vendor websites. The Client must obtain written permission from the Company prior to selling any photographs owned by the Company.

Marks. The Company may use, reproduce, and distribute Your service marks, trademarks, and trade names (if any) (collectively, the " Marks") in connection with the use of Our site or performance of the services. Any goodwill received from this use will accrue to You. The Company may not engage in activities or commit acts, directly or indirectly, that may contest, dispute, or otherwise impair Your interest in Your Marks. You may not cause diminishment of value of the Company Marks through any act or representation. You may not apply for, acquire, or claim any interest in any either party’s respective marks, or others that may be confusingly similar to any of them, through advertising or otherwise.

Release. You grant permission to the Company and its agents, assigns, licensees, and sublicensees, permission to use Your image or likeness in any and all forms of media for commercial purposes, advertising, trade, personal use, or any and all other uses. Therefore, Company may use Your likeness and image on Company’s website, social media accounts or other advertising. You release all claim to profits that may arise from use of the images.

WE DO NOT PROMISE THAT OUR WEBSITE OR ANY CONTENT, SERVICE OR FEATURE OF OUR WEBSITE WILL BE ERROR-FREE, FUNCTIONAL, CORRECT, COMPLETE, APPROPRIATE, OR UNINTERRUPTED, OR THAT ANY DEFECTS WILL BE CORRECTED, OR THAT YOUR USE OF OUR WEBSITE WILL PROVIDE SPECIFIC RESULTS.  OUR WEBSITE AND ITS CONTENT ARE DELIVERED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. ALL INFORMATION PROVIDED ON THE SITE IS SUBJECT TO CHANGE WITHOUT NOTICE. WE CANNOT ENSURE THAT ANY FILES OR OTHER DATA YOU DOWNLOAD FROM OUR WEBSITE WILL BE FREE OF VIRUSES OR CONTAMINATION OR DESTRUCTIVE FEATURES. INDEMNIFICATION AND LIMITATION OF LIABILITY:

You agree to indemnify and hold BAG Travel, its officers, members, directors, shareholders, successors in interest, employees, agents, suppliers, agents, subsidiaries and contractors harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees) due to or arising out of or in connection with your use of Our site and services provided, including, but not limited to, as a result of any technological failures such as a payment processor error(s) or system failure(s), mishaps that may occur from using BAG Travel’s services where BAG Travel was not grossly negligent or participated in willful misconduct.

Except where prohibited by law, in no event will BAG Travel be liable to You for any indirect, consequential, exemplary, incidental or punitive damages, including lost profits, even if advised of the possibility of such damages.

If, notwithstanding the other provisions of these Terms and Conditions, BAG Travel is found to be liable to You for any damage or loss, which arises out of or is in any way connected with your use of Our site or any services, BAG Travel’s liability shall be limited, an not to exceed One Hundred Dollars ($100.00).

GOVERNING LAW:

These Terms and Conditions are governed by the state laws of California. Should any conflict arise, California state laws will apply.

SEVERABILITY:

If any part of these Terms and Conditions is deemed unlawful and/or unenforceable, all other provisions contained herein will remain in full force and effect.

CODE OF CONDUCT:
BAG Travel expects that You and any other participants using our site or services on Your behalf to adhere to our code of conduct (“Code of Conduct”). By not adhering to our code of conduct, We reserve the right to cancel Your reservation, without a refund.  

You must adhere to this code of conduct in all of our activities, dealings and use of the site:

• Create and contribute to an environment of mutual respect and inclusion for others;
• You shall not engage in any acts of discrimination or harassment based on sex, gender, sexual orientation, transgender identity, gender identity, ethnicity, race, national origin, religion, disability, age or any other protected class.
• act honestly and with integrity, maintaining the highest standards of personal and professional ethical behavior;
• deal fairly with, and be courteous and respectful to, all of Our employees, agents, affiliates, directors, members, customers and suppliers; and
• comply with all laws and regulations that apply to BAG Travel and not knowingly participate in any illegal or unethical activity.

You agree to notify BAG travel if You know of anyone violating the foregoing Code of Conduct.

Using Our site and making reservations for this package signifies Your acceptance and agreement of Our complete Terms and Conditions.
