TRAVEL WITH NISHA LLC – TERMS & CONDITIONS

 

 

 

 

1. Agency Disclosure

 

 

Travel With Nisha LLC (“the Agency”) acts solely as an intermediary between clients and travel suppliers including airlines, hotels, cruise lines, tour operators, and transportation companies. The Agency is not responsible for the acts, errors, omissions, delays, or changes of any supplier.

 

 

 

 

2. Travel Quote & Research Fees (Non-Refundable)

 

 

A non-refundable quote and planning fee is required before any travel research begins.

 

Quote Fee Structure:

• $50 – Individual Trip

• $100 – Small Group Trip 10+ rooms

• $250 – Large Group/Wedding Travel 15+rooms

 

These fees:

• Are non-refundable

• Are not applied to your booking

• Are not part of your travel arrangements or supplier payments

 

Accepted Payment Methods for Quote Fees:

Apple Pay, Zelle, or Cash App only.

 

 

 

 

3. Photographic & Video Release

 

 

By participating in a trip or group event, clients grant Travel with Nisha LLC permission to use any photos or videos taken during travel for promotional or commercial use without compensation.

 

 

 

 

4. Special Needs, Medical, or Accessibility Requests

 

 

It is the client’s responsibility to notify Travel with Nisha LLC of:

• Medical needs

• Mobility or accessibility accommodations

• Dietary restrictions

• Room-type requirements (e.g., ADA, walk-in shower, near elevator)

 

Failure to notify the agency may result in unmet needs at the destination.

 

 

 

 

5. Tipping Guidelines (Optional but Customary)

 

 

Tipping is at your discretion. Industry-standard guidelines are:

• Drivers (private or motorcoach): $5–$10 per person, per day

• Tour Guides: $10–$20 per person, per day

 

 

 

 

6. Deposits, Payments & Fees

 

 

• All deposits are non-refundable and non-transferable.

• Cash is not accepted for any travel reservations.

• Monthly payment plans will be clearly listed on your invoice when applicable.

• Full payment may be made at the time of booking.

 

Late Payment:

• A $25 late fee is automatically added the day after the final payment due date.

• If your balance is more than 5 days past due, your reservation will be canceled and all prior payments become non-refundable.

 

Refunds:

Refunds are only available if you purchased travel insurance and if the supplier’s insurance policy allows for reimbursement under their conditions.

 

 

 

 

7. Cancellations

 

 

• All cancellations must be submitted in writing.

• Life happens—however, all supplier penalties and non-refundable terms still apply.

 

 

 

 

8. Additional Resort, Destination, or Local Fees

 

 

Any additional fees charged at the resort, hotel, cruise port, or destination (including:

• Resort fees

• Environmental fees

• Tourism taxes

• Security deposits

• Incidentals

 

are the sole responsibility of the guest and will not be paid or reimbursed by Travel With Nisha LLC.

 

 

 

 

9. Passports & Visa Requirements

 

 

• Travelers are responsible for ensuring all travel documents are valid.

• Passports must be valid at least 6 months beyond travel dates.

• Some countries require full blank visa pages.

• Requirements listed apply to U.S. citizens; non-U.S. citizens must check with the appropriate consulate.

• Cruise passengers are strongly advised to travel with a valid passport, even on closed-loop sailings.

 

 

 

 

10. Client Responsibilities

 

 

Clients are responsible for:

• Providing accurate personal information (names, dates of birth, passport info)

• Reviewing all confirmations within 24 hours

• Understanding baggage rules and check-in procedures

• Meeting all payment deadlines

• Complying with destination entry requirements

• Notifying the agency of special needs

 

 

 

 

11. Liability Release

 

 

Travel With Nisha LLC is not responsible for:

• Weather, natural disasters, or acts of God

• Supplier delays, schedule changes, overbooking, or cancellations

• Illness, injury, property loss, or travel disruptions

• Supplier failure to provide services

 

Travel With Nisha LLC acts only as a booking agent and is not liable for supplier actions.

 

 

 

 

12. Group Travel Terms

 

 

• Group pricing may change if minimum requirements are not met.

• Complimentary rooms or group leader perks do not reduce other travelers’ rates.

• Deadlines must be followed for all group reservations.

 

Travel Agent Attendance:

If a group trip includes 20 or more booked guest rooms, the travel agent may attend the trip if it aligns with travel dates, pricing, and supplier guidelines. Attendance is not guaranteed.

 

 

 

 

13. Arbitration Agreement & Limitation of Claims

 

 

Any dispute involving Travel with Nisha LLC will be resolved exclusively through binding arbitration.

 

Client may only pursue an amount equal to or less than what was directly paid to Travel with Nisha LLC.

 

Client waives:

• The right to sue Travel with Nisha LLC in any court

• The right to file a chargeback or bank dispute

 

Arbitration Terms:

• Governed by Georgia state law

• Conducted through the American Arbitration Association (AAA)

• Based on AAA Commercial Arbitration Rules

• Must be completed within 120 days of arbitrator appointment unless extended

• One arbitrator will be assigned (mutually selected or appointed by AAA)

• Arbitration costs split unless the arbitrator rules otherwise

• Both parties agree to uphold the final arbitration award

 

 

 

 

14. Processing Timeline

 

 

Please allow 24–72 hours for quotes, changes, or updates. More time may be required depending on supplier response times.

 

 

 

 

15. Acceptance of Terms

 

 

By paying the quote fee, submitting payment, or signing electronically, the client agrees to all Terms & Conditions stated above.
