VACATION CONFIRMATION / CONTRACT / ACCOUNT INVOICE: Thank you for choosing to partner with Lisell Travel, LLC! In turn, we have partnered with suppliers to create a customized journey; our goal is to provide a worry-free, unique, and wonderful travel experience. To ensure that you understand the conditions of your vacation and components, please review the following policies and procedures completely. Making a booking constitutes your complete understanding and agreement of all the terms and conditions pertaining to your travel arrangements.

FUTURE PAYMENTS: To make future payments using your card on file, please click on your invoice link that has been emailed to you to make your payment request.

PASSPORTS: Everyone, including children and infants, MUST have a VALID passport to travel internationally (not Passport Card). Failure to comply may  result in denial of boarding, no refund, no exceptions (out of the USA). Lisell Travel, LLC is NOT responsible for passports in ANY way. Passports are required to be valid for 6 months from your return date. PASSPORT CARDS ARE NOT VALID FOR TRAVEL INTERNATIONALLY VIA AIR! It is the responsibility of each traveler to obtain and carry a valid passport, visa(s), inoculations, and all other documents required by applicable government regulations. For up-to-date requirements US citizens should visit www.travel.state.gov. When travelling domestically within the USA or internationally, the U.S. Transportation Security Administration (TSA) and U.S. Department of Homeland Security (DHS) advise that everyone carry at least two forms of acceptable identification in order to board a flight, found here: http://www.tsa.gov/traveler-information/acceptable-ids. We strongly recommend that you consider that certain countries will not admit a passenger if their passport expires within six (6) months of the date of entry. Non-USA citizens may require additional documentation. Children and infants also require all such travel documents. Minors traveling with one parent, and/or without both parents, may be stopped and not admitted, unless authenticated and verified consent forms are provided to the authorities.

Recommended inoculations and vaccinations for travel may change and you should consult your practitioner for current recommendations before you depart. It is your responsibility to ensure that you meet all health entry requirements, obtain the recommended inoculations and vaccinations, take all recommended medication, and follow all medical advice in relation to your trip. Inoculation requirements can be found on the Center for Disease Control website at https://www.cdc.gov/.

You acknowledge any failure to strictly comply with these requirements may result in denied boarding or an undue delay at an airport security checkpoint causing traveler to miss flight(s), and subsequent scheduled travel bookings tours.  Lisell Travel, LLC bears no responsibility for advising and/or obtaining required travel documentation for you, or for any delays, damages, and/or losses including missed portions of your vacation related to improper documentation or government decisions about entry.

IMPORTANT: For international travel, airline ticketing names must match passport exactly (first, middle, last), no exceptions. For information regarding passport applications or renewals, please visit the U.S. Department of State website. Lisell Travel, LLC is not responsible for disruptions in your travel plans due to travelers providing incorrect information.

TRAVEL RESTRICTIONS: Passengers with prior criminal convictions are responsible for ensuring that they are not restricted by the laws of the country to which they are traveling. For example: Passengers with DUI/DWI convictions may be prohibited from traveling to Canada. Passengers traveling without proper documentation or meeting destination requirements may be denied boarding or entry to an international destination and will not be entitled to a refund.

PLANNING DEPOSITS FOR INDIVIDUAL (NON-GROUP) TRIPS: In your original "quote request" form, we explained the planning deposit. To perform the professional services required to plan and arrange your travel, a planning deposit or service retainer may be required. Planning deposits are due prior to suggested itineraries being presented and will be refunded using a VISA gift card after travel is complete. In the unfortunate event that plans are canceled or if the itinerary is not fulfilled for any reason, the planning deposit will convert to a non-refundable research fee and will be retained by Lisell Travel, LLC. If a service retainer is required, it is non-refundable and will not be applied to the reservation or refunded after travel.

CHANGES TO RESERVATIONS: ANY changes made to your existing room reservation are subject to the current rates, promotions, and terms at the time of change. If the number of individuals occupying a room changes, the remaining travelers will be responsible for any additional costs incurred as a result of the change in the per-person occupancy rate. An administrative change fee of $25 may be charged in addition to travel supplier fees.

TOURS/PACKAGE PRICES: are subject to change without notice due to currency fluctuations, tariff changes or increase in operations costs.  In addition, group tours/packages are based on a Minimum Number of passengers traveling; if the number of passengers falls below the minimum required, a surcharge may be imposed on all passengers.  If problems occur during your tour, always contact the local tour representative for the best resolution.  Phone numbers are found in your final documentation.

CREDIT CARD CHARGES: Client understands that Lisell Travel, LLC has relationships with many travel supplier partners; charges on the client's credit card statement may appear as Lisell Travel, LLC or as the name of a preferred supplier partner. Client understands that he/she shall be liable for any and all charges placed on credit cards in the event such charges are declined or charged back for any reason, including any unauthorized or fraudulent use of my credit card. Agency shall not be responsible for any losses or damages associated with the fraudulent use of credit card and client shall hold Agency harmless from any and all losses, damages or claims of any kind arising from or connected to the fraudulent use of credit card.

Before initiating a chargeback, we ask you first to call us to discuss any questions or concerns about our charges. We will work with you in attempting to resolve your concerns. By using our service to make a reservation, you accept and agree to our cancellation policy. We retain the right to dispute any chargeback that is improper and recover any costs, including attorney’s fees related to improper chargebacks. Additionally, in the event of an improper chargeback, we retain the right to cancel any travel reservation related to that improper chargeback. The following chargeback scenarios are improper, and we retain the right to investigate and rebut any such chargeback claims:

  • Chargebacks resulting from non-cancellable reservations, whether or not the reservation is used.
  • Chargebacks resulting from charges authorized by family, friends, associates or other third parties with direct access to your credit card. This does not include credit card fraud.
  • Chargebacks arising from inconsistency or inaccuracy with regard to the supplier’s product description.
  • Chargebacks resulting from force majeure or other circumstances that are beyond the control of Lisell Travel or the Supplier.
  • Chargebacks resulting because you do not agree with the cancellation policy.
 

FINAL PAYMENT: The final payment MUST be received by the communicated due date. Final payments are not automatically charged. We will email you reminders for your final payments, but guests are ultimately responsible for ensuring their final balance is paid by the due date. No payments are made automatically; you must communicate with your travel advisor to ensure payment is made before the due date. Lisell Travel, LLC is not responsible for cancellations due to payments made after this date. Late fees may apply.

LATE FEES: Final payments not received prior to the due date above will incur a $50 late fee. All reservations are subject to cancellation and hotel penalties as described above if final payment is not received on the due date. Late fees are not covered by travel insurance and are always non-refundable.

CANCELLATION PENALTIES FOR INDIVIDUAL (NON-GROUP) TRIPS: If a trip booked by Lisell Travel, LLC is cancelled, all deposits are NONREFUNDABLE. Travelers will be charged a $100 per person administrative fee by Lisell Travel, LLC. This is separate and incremental to any fees or penalties levied by the travel supplier. Regarding Airline tickets: If Lisell Travel, LLC booked your tickets, they are 100% non-refundable and subject to individual airline penalties/fees.

CANCELLATION PENALTIES FOR GROUP TRAVEL: If a group guest booked by Lisell Travel, LLC cancels and the guest has not purchased CFAR (Cancel for Any Reason) travel protection, travelers will be charged a $100 per person administrative fee by Lisell Travel, LLC. This is separate and incremental to any fees or penalties levied by the travel supplier. Regarding Airline tickets: If Lisell Travel, LLC booked your tickets, they are 100% non-refundable and subject to individual airline penalties/fees (see Travel Protection below).

TRAVEL PROTECTION: Lisell Travel, LLC encourages the purchase of Travel Protection, including “cancel for Any Reason” coverage. Travel Protection can help minimize the monetary loss incurred due to unforeseen events such as: cancellation, missed connections, baggage loss, trip delay, and primarily medical emergencies. Travelers who opt out of travel protection coverage will be asked to sign a waiver indicating that they decline coverage. This waiver must be received by Lisell Travel, LLC before the reservation can be deposited and confirmed.

CANCEL FOR ANY REASON TRAVEL PROTECTION: Cancel for Any Reason Travel Protection can only be purchased at the time your reservation is made; it cannot be added after the initial trip deposit is received. Your Lisell Travel Specialist will quote your insurance policy cost upon initial trip quote. If you do not purchase travel protection, there are no refunds of any kind, including deposits.

All the above would be protected with the optional Travel Protection apart from late fees. If you do not have insurance – natural disasters (such as hurricanes), cancellations for ANY reason (medical/personal emergencies, cancellation of the wedding, etc.) do not relieve you from these penalties. ONLY the Travel Protection will ensure you coverage. All cancellations must be received in writing.

RISKS: Customer acknowledges that travel to any location includes certain risks, dangers, and perils (the “Risks”), including without limitation exposure to bad weather, diseases, viruses, epidemics, pandemics, illnesses or other conditions which may exist while traveling or in travel destinations. Such Risks are unavoidable, and Lisell Travel, LLC disclaims any and all liability for harm to Customers related to such Risks. Customer agrees to waive any claims against Lisell Travel, LLC for the Risks, and to hold harmless, defend and indemnify (including reasonable attorneys’ fees) Lisell Travel, LLC for any claims or liabilities arising from or related to such Risks, to the fullest extent permitted by law.

COVID-19 TRAVEL WAIVER: As the worldwide COVID-19 coronavirus pandemic remains ongoing at this time, I acknowledge that for this reason, and other reasons not reasonably foreseeable at this time, these travel plans may be interrupted or cancelled by the supplier that is providing them, a government entity or other third party over with Lisell Travel has no control.  I further acknowledge that the supplier’s own cancellation, rebooking and refund policies, subject to any applicable law that is now or may later be in effect, will govern my rights and remedies, including my right to receive a refund, in such an event.  Moreover, I understand that should I elect to purchase travel protection, the terms of the policy will dictate whether, and to what extent, coverage for any financial loss may exist under the circumstances.  By accepting and submitting my e-signature, I hereby agree to hold Lisell Travel harmless and release if from any and all liability for any damages, including but not limited to monetary losses, I may incur as a result of such interruption or cancellation of these travel plans.

TRAVELING WITH CHILDREN: Children under 18 years of age not traveling with both parents or legal guardian(s) may need to present a notarized letter from the absent parent/guardian granting permission to travel and provide emergency medical care if necessary. We can provide more information and sample letters at your request. Lisell Travel, LLC is not responsible for lack of compliance to provide proper documentation to airport authorities. It is the responsibility of the traveler & the traveler’s parents/guardians to provide proper documentation to airport authorities.

AIR TRAVEL: Flight details including departure times are always subject to change by the airlines. We recommend reconfirming the date and time of flights with your tour operator or airline at least 24 hours for domestic and 72 hours for international.  Failure to use any portion of your reservations may result in automatic cancellation of all continuing and return reservations. Recommended minimum check-in time for domestic flights is 2 hours, and for international flights, 3 hours.  Some charters require 3 hours advance check-in. Government issued photo ID is required at check-in on all flights.  If traveling to a foreign country, without proper identification, a passport, and necessary visas, you WILL NOT be permitted to depart.  It is your responsibility to verify your necessary travel documents as well as inoculations. We are required by law to tell you that ¨Federal law forbids the carriage of certain hazardous materials, such as aerosols, fireworks, and flammable liquids, aboard the aircraft. If you do not understand these restrictions, contact your airline or go to http://www.faa.gov/about/initiatives/hazmat_safety.

BAGGAGE FEES: Due to continual changes in airline baggage policies it is suggested that you inquire with your airline's website for up-to-date fees & information. Lisell Travel, LLC is NOT responsible for additional fees incurred for baggage or seating assignments. BAGGAGE FEES ARE NOT PART OF AN ALL-INCLUSIVE PACKAGE! Please review "Updated Checked Bag and Carry On Bag Rules" at www.TSA.gov

TRAVEL DOCUMENTS: Travel documents will be sent to you no later than ten (10) days prior to departure date. Please read through these documents immediately. Contact your Lisell Travel Specialist if you find any discrepancies, misspellings, incorrect dates etc. If incorrect legal names were provided, airline or tour operator change fees are not the responsibility of Lisell Travel, LLC. Included in your travel documents (if airfare is purchased through us) are airline electronic ticket receipts (proof of purchase, not boarding passes, or actual tickets). Boarding passes are printed at the time of check in; online with the airline directly, or at the airport when showing passport & checking in luggage. It is particularly important that you take your travel documents with you in addition to passports and a major credit card for any baggage fees that may apply. 

CAR RENTALS: All rentals are subject to rental agency, airport, local, and state taxes and fees.  Any voluntary or involuntary change of plans may affect rental rates.

HOTEL/RESORT CHECK IN: Check-in time at most resorts/hotels is 3:00pm (local time). If you arrive prior to 3:00pm your room may not be ready. The resort/hotel may offer to store your luggage in a secure location on property so you may start enjoying your vacation without delay. Change into something more comfortable and enjoy a nice lunch, swim in the pool, walk along the beach, etc. until you are notified that your room accommodation is ready for check in.

HOTEL/RESORT FEES: Some hotels and resorts charge a resort fee or resort charge.  This is payable directly to the hotel at the time of check in or check out. If applicable to your reservation, we will communicate the current fee or process at time of booking.

DEBIT CARD USAGE: Your resort or hotel will require a credit card upon check in for any incidentals. We do NOT recommend the use of debit cards for hotel check ins as the hotel will place a "hold" on your debit card that may restrict the use of your funds. This hold can stay on your debit account for as long as 10 days post travel. Please contact us with questions regarding the use of debit cards in foreign countries.

SARGASSUM UPDATE: Some beach locations in Mexico and the Caribbean have recently experienced Sargassum seaweed. While Sargassum can be an inconvenience, this natural phenomenon is important to the oceanic ecosystem. Sargassum provides a food source and shelter to a variety of marine and plant species (shrimp, crab, birds, fish, turtles, and whales). Three species of sea turtle, some endangered, rely on Sargassum mats as nurseries for their eggs. Sargassum also helps to provide a barrier for beach erosion and can be used as biofuel and landfill. In short, it can be annoying, but it is also vital to the ocean landscape that we love. It is a seasonal occurrence and shouldn't ruin your vacation.

HONEYMOON & ANNIVERSARY TRAVELERS: You MUST bring a copy of your marriage certificate to qualify for any complimentary honeymoon/anniversary package (photocopy is recommended). Failure to have such proof of marriage will result in the resort denying these complimentary privileges (if applicable). PLEASE notify your Lisell Travel, LLC agent if you are celebrating a Honeymoon or Anniversary so that they can notate this in your reservation. Typically resorts will honor these packages up to 30 days before or after your honeymoon/anniversary date.

DISCLAIMER OF LIABILITY: Lisell Travel is acting as a mere agent for suppliers in selling travel-related services, or in accepting reservations or bookings for service that are not directly supplied by Lisell Travel (such as air and ground transportation, hotel accommodations, meals, tours, cruises, etc.)  Lisell Travel, therefore, shall not be responsible for breach of contract or any intentional or careless actions or omissions on part of such suppliers, which result in any loss, damage, delay, or injury to your or your travel companions or group members.  Unless the term “guaranteed” is specifically stated in writing on your tickets, invoice, or reservation itinerary.  Lisell Travel does not guarantee any of such suppliers’ rates, bookings, reservations, connection, scheduling, or handling of baggage or other personal effects.  Lisell Travel shall not be responsible for any injuries, damages, or losses caused to any traveler in connection with terrorist activities, social or labor unrest, mechanical or construction failures or difficulties, diseases, local laws, climatic conditions, criminal acts or abnormal conditions or developments, or any other actions, omissions, or conditions outside the travel agency’s control.  Traveler assumes complete and full responsibility for, and hereby releases the agent and travel agency from any duty of checking and verifying any and all passport, visa, vaccination, or other entry requirements of each destination, and all safety or security conditions at such destinations, during the length of the proposed travel.  For information concerning possible dangers at international destinations, contact the Travel Advisory Section of the U.S. State Department.  For medical information, call the Public Health Service.  By embarking upon his/her travel, the traveler voluntarily assumes all risks involved in such travel, whether expected or unexpected.  Travelers are warned of such risks and advised to obtain appropriate travel protection coverage against them.  Traveler’s retention of tickets, reservations, or bookings after issuance shall constitute a consent to the above, and an agreement on his/her part to convey the contents hereto to his/her travel companions or group members.

WHAT YOU SHOULD KNOW ABOUT THE POSSIBILITY OF TRAVEL RELATED BANKRUPTCIES:

Hopefully, there will not be any more travel related bankruptcies, but it has to be recognized that they might occur.  You should know how they might affect you.

  1. If a Travel Vendor (which includes airlines, cruise lines, tour companies or anyone with whom Lisell Travel books travel) declares bankruptcy, it may not be required to issue refunds or honor tickets purchased before the date it declares bankruptcy.
  2. Travel agents are not allowed to refund tickets for Travel Vendors that have declared bankruptcy.  Money given to Lisell Travel immediately becomes the property of the Travel Vendor and we are required by laws to comply with the Travel Vendor orders.
  3. If a Travel Vendor declares bankruptcy it might continue service, limit service, or stop service completely.  Other Travel Vendors might accept passengers or customers under limited circumstances from the defaulted Travel Vendor.
  4. By accepting the services listed in this invoice, I agree that Lisell Travel, LLC cannot be held responsible for tickets or services purchased for a travel vendor if that travel vendor declares bankruptcy. 
 

FORCE MAJEURE: Lisell Travel assumes no liability for, any loss, damage, delay, or cancellation resulting in whole or in part from an Act of God or any other force majeure condition, including, without limitation: fire, volcanic eruption, hurricane, environmental pollution or contamination, inclement weather, earthquake, low or high water levels, flood, water or power shortages or failures, tropical storms or hurricanes, riots or civil commissions or disturbances, and any other acts of a similar nature, sabotage, arrests, strikes or labor disruptions, restraint of rulers or peoples, expropriations, acts of terrorism, war, insurrection, quarantine restrictions, government health advisories, epidemics, pandemics, or warnings or alerts of any kind of nature, government seizures, refusal or cancellation or suspension or delay of any government authority or any license, permit or authorization, damages to its facilities or the travel supplier and its facilities, or any other unforeseen circumstances or any other factors unforeseen by Lisell Travel that impacts negatively on, or hampers, its ability to fulfill any of its contractual conditions. In the circumstances amounting to force majeure, we will not be required to refund any money to you, although if we can recover any monies from our suppliers, we will refund these to you without any charge by Lisell Travel. Our planning fee is always non-refundable.

GOVERNING LAW/SUBMISSION TO JURISDICTION. JURY WAIVER/NOTICE OF CLAIM: This Agreement and all attachments hereto and the rights of the parties hereunder shall be governed by and construed in accordance with the laws of the State of Texas exclusive of conflict or choice of law rules. Any claims shall be brought in a court of competent jurisdiction located in Texas. You agree that you will only bring claims against Lisell Travel in your individual capacity and not as a plaintiff or class member in and purported class action or representative proceeding. Lisell Travel shall not in any case be liable for other than compensatory damages, and your payment of a deposit on a trip means that you agree to these conditions of sale and expressly waive any right to punitive damages. You understand and agree that no claims will be considered and that you will not bring suit against Lisell Travel unless you have first provided a typewritten notice of claim to Lisell Travel within 30 days after the trip or cancellation of the trip.

ENTIRE AGREEMENT & SEVERABILITY: This agreement, including the terms and conditions of our suppliers, any other documents, including invoices, we provide you, constitutes the entire agreement and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, with respect to Lisell Travel. If any provision of these Terms shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.

I have reviewed the itinerary and documents and have checked for accuracy.  I understand all the terms and conditions, fees, change rules and refund policies associated with the travel arrangements as on this notice and in other documents and brochures pertaining to this trip.  I understand that travel protection is available at an additional charge and if purchased I have reviewed the policy and understand the coverages.
