HOSTED TRIP PARTICIPATION
AGREEMENT & TERMS

This Hosted Trip Participation Agreement & Terms (the “Agreement”) governs participation in a hosted group travel experience organized by Travel Obsession Agency LLC (“Travel Obsession Agency,” “Agency,” “we,” “us,” or “our”). By signing this Agreement and/or submitting payment toward the hosted trip, the traveler (“Traveler,” “you,” or “your”) acknowledges and agrees to the following terms.
1. Nature of the Hosted Trip
A hosted trip is a pre-designed, curated group travel experience. Travel Obsession Agency coordinates the components identified in the applicable trip proposal, booking page, invoice, itinerary, or other trip-specific materials. The hosted trip is not an individualized travel-planning engagement, and no separate planning fee is charged for participation in the hosted trip package.
Requests for customized travel arrangements outside the hosted trip package, including substantial itinerary changes, pre- or post-trip extensions, or other individualized planning, may require a separate travel-planning engagement and applicable fee.
2. Trip-Specific Inclusions and Exclusions
The specific accommodations, activities, transportation, events, meals, amenities, and other services included in the hosted trip are those expressly identified as included in the trip-specific booking materials. Any item not expressly identified as included is excluded and is the Traveler’s responsibility.
Airfare is not included unless expressly stated otherwise in the trip-specific booking materials. Travelers are responsible for arriving at designated meeting or transfer points at the required time.
3. Pricing, Deposits, and Payment
Trip pricing is based on the selected package, room category, occupancy, and other trip-specific factors. A reservation is not confirmed until Travel Obsession Agency receives the required deposit and any required traveler information or documentation.
- All payments must be made according to the payment schedule shown on the Traveler’s invoice or booking page.
- Failure to make a required payment by its due date may result in cancellation of the reservation and forfeiture of amounts already paid, subject to applicable supplier terms and law.
- Prices may be based on occupancy. A change in occupancy, including a roommate cancellation, may result in a revised per-person price or single-occupancy supplement.
- Any supplier-imposed taxes, fees, or surcharges arising after booking may be passed through to the Traveler where permitted and applicable.
4. Traveler Cancellation and Refunds
Cancellation terms are trip-specific and will be disclosed in the applicable booking materials. Unless the trip-specific terms expressly provide otherwise, deposits and payments are non-refundable once paid to the extent the Agency has incurred or committed funds to suppliers or other non-recoverable trip costs.
A Traveler who chooses not to participate, arrives late, leaves early, misses an activity or transfer, or otherwise fails to use an included component is not entitled to a refund for unused services unless a refund is actually received from the applicable supplier and is due to the Traveler under the trip-specific terms.
5. Agency Cancellation, Minimum Participation, and Trip Viability
Hosted trips may depend on minimum participation levels and group commitments. Travel Obsession Agency reserves the right to cancel, postpone, restructure, or modify a hosted trip when minimum participation is not achieved, when a supplier materially changes or withdraws services, or when circumstances reasonably make operation of the trip impracticable, unsafe, or commercially unreasonable.
If Travel Obsession Agency cancels a hosted trip, the Agency will communicate the available refund, credit, rebooking, or other options based on recoverable funds and applicable supplier terms. The Agency is not responsible for independently purchased airfare, lodging, transportation, or other expenses unless expressly agreed in writing.
6. Itinerary and Supplier Changes
Travel arrangements are subject to change. Travel Obsession Agency may make reasonable substitutions or modifications to accommodations, transportation, venues, activities, schedules, or other trip components when necessary due to availability, weather, operational requirements, supplier changes, safety concerns, or circumstances outside the Agency’s reasonable control. When practical, the Agency will seek a comparable alternative.
7. Room Occupancy and Roommates
Travelers booking double, triple, or other shared occupancy are responsible for satisfying the applicable occupancy requirements. If a roommate cancels, fails to pay, or otherwise withdraws, the remaining Traveler(s) may be responsible for any resulting increase in the room rate or occupancy supplement. Travel Obsession Agency is not obligated to provide or replace a roommate unless expressly offered as part of the trip.
8. Traveler Responsibilities
Each Traveler is responsible for reviewing all trip materials and ensuring that they meet destination entry requirements and are physically and legally able to participate in selected activities. Travelers are responsible for valid passports, visas, identification, vaccinations or health documentation where required, and compliance with applicable laws and supplier rules.
Travelers must promptly provide accurate names, dates of birth, contact information, and other information reasonably required to complete reservations. Costs arising from incorrect or late information may be charged to the Traveler.
9. Traveler Conduct
Travelers are expected to conduct themselves in a manner that does not endanger, threaten, harass, abuse, or materially disrupt other travelers, Agency representatives, suppliers, or the operation of the trip. Travel Obsession Agency may remove a Traveler from a group activity or terminate participation when the Agency reasonably determines that the Traveler’s conduct creates a safety risk, violates law or supplier rules, or materially interferes with the group experience. Any resulting costs are the Traveler’s responsibility, and refunds are not guaranteed.
10. Travel Insurance
Travel insurance is strongly recommended. Coverage may include trip cancellation or interruption, medical emergencies, evacuation, baggage loss or delay, and other covered events, depending on the policy selected. Travel Obsession Agency does not guarantee that any particular claim will be covered. The Traveler is responsible for reviewing policy terms, exclusions, deadlines, and coverage limits.
If the Traveler declines travel insurance, the Traveler accepts the financial risk associated with cancellation, interruption, medical events, supplier disruptions, and other circumstances that may not result in a refund.
11. Third-Party Suppliers
Travel Obsession Agency arranges services provided by independent third-party suppliers, which may include hotels, resorts, airlines, cruise lines, tour operators, transportation providers, excursion companies, restaurants, venues, and other service providers. These suppliers are independent entities and are not employees or agents of Travel Obsession Agency.
The Agency is not responsible for the acts, omissions, insolvency, schedule changes, service failures, or other conduct of independent suppliers except to the extent responsibility cannot lawfully be excluded. Supplier terms and conditions may also apply to the Traveler’s reservation.
12. Force Majeure and Events Beyond Reasonable Control
Travel Obsession Agency is not liable for delay, modification, interruption, or cancellation caused by events beyond its reasonable control, including severe weather, natural disasters, epidemics or pandemics, acts of government, war, terrorism, civil unrest, labor disruptions, transportation failures, supplier closures, or similar events. Any refund, credit, or rebooking rights will depend on applicable supplier terms, recoverable funds, and governing law.
13. Photography, Video, and Media Release
Hosted trips may include photography and video captured by Travel Obsession Agency, its representatives, contractors, or other participants. To the extent permitted by law, the Traveler grants Travel Obsession Agency LLC permission to use photographs, video, and other recordings in which the Traveler appears for lawful promotional, advertising, social media, website, and marketing purposes without additional compensation.
A Traveler who does not wish to be intentionally featured in Agency-created marketing content should notify Travel Obsession Agency in writing before the trip. The Agency will make reasonable efforts to honor that request for posed or intentionally captured content, but cannot guarantee exclusion from incidental group or background images taken in public or group settings.
14. Health, Safety, and Activities
Travel may involve risks that cannot be eliminated. Travelers are responsible for evaluating their ability to participate in activities and for following safety instructions provided by suppliers. The Agency may decline or discontinue a Traveler’s participation in an activity when reasonably necessary for safety or supplier compliance. Nothing in this Agreement waives rights or liabilities that cannot legally be waived.
15. Changes Requested by the Traveler
Changes to a confirmed reservation are subject to availability, supplier rules, and any applicable change fees or price differences. Material changes that require substantial redesign or individualized planning may be treated as a separate planning engagement and may require an additional fee. Name changes, cancellations, and other modifications may also be subject to supplier charges.
16. Communications and Electronic Records
The Traveler agrees that trip-related notices, invoices, documents, and updates may be delivered electronically using the email address, telephone number, booking platform, or other contact information provided by the Traveler. The Traveler is responsible for monitoring these communications and promptly advising the Agency of changes to contact information.
17. Limitation of Liability
To the fullest extent permitted by applicable law, Travel Obsession Agency’s liability for claims arising from its own services will be limited to direct damages actually caused by the Agency and will exclude indirect, incidental, special, exemplary, or consequential damages. Nothing in this Agreement excludes liability that cannot lawfully be limited or excluded.
18. Disputes and Governing Law
The parties agree to attempt in good faith to resolve disputes informally before commencing formal proceedings. Unless applicable law requires otherwise, this Agreement will be governed by the laws of the State of South Carolina, without regard to conflict-of-law principles. Any venue or dispute-resolution requirements contained in separately incorporated Agency terms or applicable supplier terms remain subject to governing law.
19. Entire Agreement and Trip-Specific Terms
This Agreement, together with the applicable trip-specific booking page, invoice, payment schedule, cancellation policy, itinerary, and any written addenda expressly incorporated into the booking, constitutes the agreement governing the Traveler’s participation. If a trip-specific term directly conflicts with a general provision of this Agreement, the trip-specific term controls for that hosted trip to the extent of the conflict.
No oral statement modifies this Agreement. Any waiver or material modification by Travel Obsession Agency must be in writing. If any provision is found unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
20. Acknowledgment and Acceptance
By submitting payment toward the hosted trip, the Traveler confirms that they have reviewed and understand this Agreement and the trip-specific booking terms, including the payment and cancellation provisions. The Traveler acknowledges that travel insurance has been recommended and accepts responsibility for complying with destination and supplier requirements.
