Terms & Conditions

We are First in Flight Travel and are excited to help you with your travel. The following terms & conditions (the "Agreement") describe what you can expect from us. The terms "we", "us", and "our" refer to First in Flight Travel and the term "you" refers to the individual who signs this agreement. 

YOUR AGREEMENT WITH FIRST IN FLIGHT TRAVEL

 

Before we make or finalize arrangements for your trip, we require that you sign below or click “I Agree” on our website. Your signature or click will signify your agreement with the following terms and conditions:

 

1. Agent for Suppliers:  First in Flight Travel  (“FITT”) acts as a sales agent for any airline, hotel, car-rental company, tour operator, cruise line, or other service provider named in your itinerary or confirmation (“Suppliers”).  We are not responsible for the acts or omissions of the Suppliers or their failure to adhere to their own schedules, provide services or refunds, financial default, or failure to honor future trip credits. We have no special knowledge regarding the financial condition of the Suppliers and no liability for recommending a trip credit in lieu of a refund. Itineraries shown are subject to change with or without notice. First in Flight Travel will make every effort to inform clients of changes as soon as possible.

 

2. Risks of Travel and Release: We assume no responsibility for and shall not be liable in any way to the Client for death, bodily injury, illness, damage, delay or other loss or detriment to person or property, or financial costs both direct and indirect incurred, or for First in Flight Travel's failure to commence, perform and/or complete any duty owed to the Client if such death, delay, bodily injury (including emotional distress or injury), illness, damage or other loss or detriment to person or property is caused by the acts or omissions of any party not under our control, or any acts of God, unsafe conditions, terrorism, health hazards including pandemics, illnesses, weather hazards, or the suitability for a disabled person of any portion of any trip. We have no special knowledge of dangers during travel or at destinations. For information related to such dangers, we recommend going to the State Department travel website at www.travel.state.gov,  click on "Find International travel Information” then click on "Country Information", and  fill in the name of the destination country. For medical and health information, we recommend going to the Centers for Disease Control website at www.cdc.gov/travel, then click on “Destinations” and scroll to the name of the destination country. It is your personal decision to travel, and you are doing so with full knowledge of current travel recommendations and travel restrictions with regards to the risks of COVID-19. YOU HEREBY EXPRESSLY ASSUME ALL OF THESE RISKS AND DANGERS, AND YOU HEREBY EXPRESSLY AGREE TO FOREVER RELEASE, DISCHARGE AND HOLD US, AND OUR AGENTS, EMPLOYEES, OFFICERS, DIRECTORS, ASSOCIATES, AFFILIATED COMPANIES, GUIDES,  GROUP  LEADERS, AND SUBCONTRACTORS HARMLESS AGAINST ANY AND ALL LIABILITY, ACTIONS,  CAUSES  OF  ACTIONS, SUITS, CLAIMS, AND DEMANDS OF ANY AND EVERY KIND AND NATURE WHATSOEVER WHICH YOU NOW HAVE OR WHICH MAY HEREAFTER ARISE OUT OF OR IN CONNECTION WITH THESE RISKS AND DANGERS.

 

3. Vaccination Requirements and Other Rules: We have no responsibility for COVID-19-related requirements that travel suppliers and governments may impose from time to time, such as required vaccinations, health affidavit forms, COVID-19 screenings prior to departure or upon arrival, face coverings, or quarantines. For the latest COVID-19 government travel regulations, we recommend going to IATA’s website at https://www.iatatravelcentre.com/international-travel-document-news/1580226297.htm. For the latest travel supplier rules, check the website of each supplier, and keep checking because these rules are constantly changing, and we are not responsible for those changes.

 

4. Other Foreign Entry Rules: You assume full and complete responsibility for checking and verifying any and all passport, visa, or other entry requirements of your destination and your connecting points, and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination. Many countries require your passport to be valid for six months or more after your date of entry. Some countries will not admit persons convicted of a crime. Some countries require both parents’ consent for minors to travel. Any information or advice given by First in Flight Travel regarding visas, vaccinations, climate, clothing, baggage, special equipment, etc. is purely advisory, provided as a courtesy to the Client, and First in Flight Travel is not responsible for any errors or omissions in the information provided, or in the information provided to Clients by third parties such as government or travel authorities.

 

5. Fees and Price Drops: You agree to pay the travel planning, change, and other fees. All of our fees are non-refundable. If a Supplier drops the price of a trip after booking, we will try to assist you with rebooking if the Supplier allows it, and a fee may apply. We do not guarantee any refunds or successful rebooking.

 

6. Price Increases: Travel arrangements involving airline and cruise components are subject to Suppliers’ supplemental price increases that may be imposed by the supplier and/or government, even after you have completed your purchase. You hereby consent to any such price increases and authorize your credit or debit card to be used for them. Suppliers have their own contracts covering cancellation penalties and other terms and conditions, and you may be bound by those contracts regardless of whether you receive notice of their terms. First in Flight Travel shall provide notice to the affected Client as soon as reasonably possible upon learning of the necessity to impose a surcharge in accordance with this section.

 

7. Insurance: For your protection, we strongly recommend that you purchase trip cancellation and travel accident insurance. Please note that, unless you buy a cancel-for-any-reason policy, most policies have a specific clause stating they do not cover epidemics and pandemics, especially when travel warnings are in place. No representation or description of the insurance made by our staff constitutes a binding assurance or promise about the insurance. You agree to hold us harmless for your election not to purchase travel insurance or for any denial of claim by travel insurer as it relates to COVID-19 or any other claim under the policy. First in Flight Travel shall have no liability for loss, theft of or damage to baggage or personal effects of Clients while participating in a Product tour. Clients should not leave personal belongings unattended in any public areas, on board any mode of transportation, or elsewhere, and are responsible at all times for their own effects and belongings. We cannot accept responsibility for and in no event shall be liable for loss or damage of valuables or other articles left in or on facilities used by us such as hotels, homestays, vessels, expedition vehicles, or any other mode of transportation.

 

8. Credit Card Merchant: You agree not to initiate a chargeback against us.

 

9. Supplier Terms and Conditions: By agreeing to these terms, you also agree to the attached Terms and Conditions provided by the supplier. 

 

10. Pricing & Quotes: All prices are subject to change until a deposit is made. We are not responsible for price changes made after acceptance of a proposal if deposit was made promptly. 

 

11. Booking Contract: A booking is confirmed and these Terms shall apply when First in Flight Travel, or an authorized agent acting on First in Flight Travel's behalf, have received the applicable deposit from the Client and the Client has received written confirmation from First in Flight Travel of such booking. The Client confirming the booking must be no less than 18 years of age and agrees to provide full, complete, and accurate information as requested by First in Flight Travel to confirm such booking. Any Client confirming a booking on any Products with more than one Client named and booked on such booking represents and warrants to First in Flight Travel that: i) they have all requisite consents and authority to make such booking on behalf of all other Clients named on the booking, and have communicated all necessary information to the other Clients in order for them to give free and fully informed authorization to do so; ii) the information that they are providing regarding all clients is complete and accurate, and they have obtained all necessary consents and permissions to share such information with First in Flight Travel for the purposes of completing the booking; and iii) they will inform all other named Clients on the relevant booking of the applicability of these Terms to the booking and the Clients’ relationship with First in Flight Travel.

 

12. Claims and Complaints: Client agrees to bring any complaints to us as soon as possible in order to provide us with the opportunity to address such complaint properly. Client agrees to inform the travel advisor at the earliest opportunity. First in Flight Travel assumes no liability for complaints that are not properly brought to our attention with sufficient notice to resolve or attempt to resolve any Client complaints. Any complaint made after the completion of a Product tour must be received in writing within 30 days of returning from your trip. Client acknowledges and agrees that First in Flight Travel will not accept any liability for claims received after this period.

 

13. Images and Marketing: The Client agrees that while participating in any of our group trips images, photos or videos may be taken by other Clients and/or First in Flight Travel Representatives that may contain or feature the Client in part or in whole. The Client acknowledges that they consent to any such pictures being taken and agree that Client hereby grants a perpetual, royalty-free, worldwide, irrevocable license to First in Flight Travel, its affiliates and assigns, to reproduce for any purpose whatsoever (including marketing and promotions), in any medium whatsoever, whether currently known or hereinafter devised, without any further obligation to the Client or compensation payable to such Client.

 

14. Refusal of Service: First in Flight Travel retains the right to refuse service to any Client at any time, for any lawful reason whatsoever, in its sole discretion.

 

15. Online Bookings: All online reservations shall be deemed as booked in the United States, and shall be subject to United States law and jurisdiction.
