PASSENGER AGREEMENT
All passengers must complete a Passenger Agreement to confirm their booking. This agreement includes acceptance of the terms and conditions, liability waiver, and arbitration clause. Travel documents will not be released until the agreement is completed.
CANCELLATION POLICY
Epiphany Travel Agency adheres to all vendor cancellation fees and procedures. Once reservations are made, cancellations must be submitted in writing. Please email your cancellation request to FeliciaBrandon@epiphanytravelagency.com with your invoice number, full name, and date of travel. If you don't receive an acknowledgment within 48 hours, call 770-299-9395 to confirm receipt.
PAYMENTS
After your deposit has been paid, a monthly installment plan will be created for your trip. Monthly installment payments must be made by the 28th of each month excluding the initial deposit, which is due immediately. Each month your card will be charged for your monthly payment. If you need to change your form of payment, a new credit card authorization form must be completed no later than 5 days PRIOR to your next payment due date. THERE IS NO GRACE PERIOD FOR FINAL PAYMENTS. Missing the final payment deadline could result in the cancellation of your vacation package.
RELEASE FROM LIABILITY
Epiphany Travel Agency, its shareholders, directors, officers, employees, and affiliates (collectively "Epiphany Travel Agency") does not own or operate any entity which provides goods or services for your trip, including, for example, hotels or other lodging facilities, airlines, vessels, buses, vans, or other transportation companies, local ground operators, providers or organizers of optional excursions or equipment used thereon, food service, or entertainment providers, etc. All such persons and entities are independent contractors. As a result, Epiphany Travel Agency is not liable for any negligent or willful act or failure to act by such persons or entities, or any other third party.
Without limitation, Epiphany Travel Agency is not responsible for any injury, loss, or damage to person or property, death, delay, or inconvenience related to the provision of any goods or services caused by or resulting from, but not limited to: acts of God, government actions, force majeure, war or civil unrest, strikes or labor activities, criminal or terrorist acts or threats, overbooking or downgrading of accommodations, structural or other defective conditions in lodging facilities, mechanical failures in transportation, accidents, bites from animals or insects, recreational activities, sanitation issues, food-related illnesses, limited access to medical care, difficulty in evacuation, epidemics, or other conditions beyond Epiphany Travel Agency's control. In addition, I release Epiphany Travel Agency from its own negligence and assume all associated risks.
ASSUMPTION OF RISK
I acknowledge that travel, such as the trip I am undertaking, involves hazardous activities with potential risks, including illness, injury, or death caused by forces of nature, animals, negligence by Epiphany Travel Agency or third parties, or criminal acts. Weather conditions may be severe or unpleasant, and medical facilities may not be readily available. I accept these risks as part of my adventure and hold harmless Epiphany Travel Agency from third-party negligence claims.
BINDING ARBITRATION
I agree that any disputes related to this agreement, promotional material, or the trip itself shall be resolved exclusively by binding arbitration in accordance with the Federal Arbitration Act, 9 U.S.C. §§1-16, either through the Commercial Rules of the American Arbitration Association (AAA) or the Comprehensive Arbitration Rules & Procedures of Judicial Arbitration and Mediation Services, Inc. (JAMS). Proceedings will be governed by substantive Georgia law and will take place in Atlanta, GA. By agreeing to these terms, both parties waive their right to a trial by jury.
CHARGEBACK AGREEMENT
By booking with Epiphany Travel Agency, the client acknowledges and agrees not to file a chargeback dispute for services rendered, including travel planning, coordination, and booking. Any disputes or concerns regarding services must be addressed directly with Epiphany Travel Agency, as outlined in our Terms and Conditions.
VOLUNTARY PARTICIPATION
I confirm that my participation in the trip is voluntary, and I am fully aware of the hazards involved. I have read the description of the trip provided by Epiphany Travel Agency and am participating with full knowledge of the risks.
KNOWING AND VOLUNTARY EXECUTION:
I have carefully reviewed these Terms & Conditions and fully understand them. By signing, I voluntarily agree to release Epiphany Travel Agency from liability, assume risks, and comply with the Binding Arbitration Clause.
PHOTOGRAPHIC RELEASE
Epiphany Travel Agency may take photos or videos of trips and participants, which I authorize them to use for promotional purposes without compensation.
USE OF WEBSITE
Agreement between Customer and Epiphany Travel Agency: The Epiphany Travel Agency website is offered on the condition of your acceptance of the terms, conditions, and notices detailed herein. By using the website, you agree to these terms.
