RELEASE AND ASSUMPTION OF RISK

(To be executed by all Clients over 18 and on behalf of all minor Clients)

I understand and acknowledge that participation in the Best of South Africa & Victoria Falls tour, operated by African Travel, Inc. in partnership with Memorable Moments Travel, involves inherent risks and potential hazards, including but not limited to:

Acts of nature, unpredictable weather, and extreme conditions
Travel in remote locations with limited medical facilities and emergency assistance
Civil disturbances, political instability, or unforeseen local conditions
Risks associated with transportation by boat, automobile, train, aircraft, or other means
Wildlife encounters and safari activities in natural environments
Personal injury, illness, property damage, or loss resulting from travel activities

I voluntarily assume all risks associated with this journey and agree that Memorable Moments Travel and African Travel, Inc. shall not be held responsible for any personal injury, death, property damage, or financial loss incurred during or as a result of this trip. This includes any additional activities I may engage in that are not included in the itinerary.

I understand that it is my responsibility to ensure that I meet all passport, visa, vaccination, and health requirements for this trip. I acknowledge that it is my duty to review the U.S. Department of State travel advisories and the Centers for Disease Control and Prevention (CDC) guidelines regarding health and safety precautions.

In consideration of my participation, I hereby release, discharge, indemnify, and hold Memorable Moments Travel and African Travel, Inc., their agents, employees, officers, directors, affiliates, and subcontractors harmless from any claims, liabilities, or expenses arising from my participation in this tour. This waiver and release shall be binding upon me, my heirs, assigns, executors, and administrators.

I confirm that I have read and fully understand the terms of this Release and Assumption of Risk and agree to be bound by its conditions.

I understand that all reservations are subject to the policies of African Travel, Inc., and Memorable Moments Travel, which acts as an agent for independent travel service providers such as hotels, lodges, airlines, and ground operators.
I acknowledge that African Travel, Inc. and Memorable Moments Travel are not responsible for the actions or omissions of these independent operators.
I understand that travel insurance is required for this trip to ensure coverage in the event of unforeseen medical, travel, or emergency circumstances.
I agree to abide by the payment terms, including the non-refundable deposit and final payment deadlines.
I understand that cancellation fees apply per the cancellation policy and that failure to make payments on time may result in forfeiture of my reservation.
I acknowledge that changes to my booking after confirmation may incur additional fees.
I agree that any legal disputes regarding this trip shall be governed by the laws of the State of California and heard in the courts of competent jurisdiction.
