By signing below, I acknowledge charges and I agree not to dispute or attempt to charge back any of the acknowledged charges. I understand this Agreement is a binding agreement with Tropical Travel Inc. Any payment constitutes acceptance of the terms in this contract.
PAYMENT AGREEMENT AND AUTHORIZATION OF CREDIT CARD PAYMENTS WITH TROPICAL TRAVEL INC - By booking with Tropical Travel Inc., you agree to the terms and conditions contained herein. Any payment constitutes acceptance of the terms herein. All policies, procedure and terms contained herein are subject to change at any time without notice at Tropical Travel and supplier’s sole discretion. Transactions will be processed automatically on the due date. Tropical Travel is acting as an agent for the tour organizer, and not as a Tour Operator. Tropical Travel and the tour operator for your package has taken reasonable steps to ensure that proper arrangements have been made for your vacation. Tropical Travel and the tour operator are not an agent of independent travel providers, and expressly disclaim any liability for their actions or omissions.
DEPOSITS AND PAYMENTS - TSA regulations require you to provide your full name as it appears on your travel documents, date of birth, and gender at the time of booking for the purpose of watch-list screening. You are responsible for any change fees to correct names. If traveling Internationally the document will be your passport. If Domestic, will be your valid driver’s license or state ID.
INTERNATIONAL TRAVEL AND DENIAL OF ENTRY - Important- Covid testing, or vaccines may be required for entry to your destination, or departure. These rules are subject to change without notice. US Citizens traveling to International Destinations are requiring a negative Covid test before boarding return flight home. Most hotels are providing free or low-cost testing. This rule applies to vaccinated and unvaccinated travelers. Should you have a positive test and be required to quarantine in destination, some but not all hotels are providing low cost or free rooms.
CDC policies are continually under review and may change multiple times before your trip departs. Your Travel Consultant will confirm entry/ return requirements for your trip approximately 2 weeks before departure in your E-Tickets. If you have recently recovered from Covid, pay special attention to the area under "Passengers" on the CDC Website, as you may be able to get a doctor exemption from testing letter. It is your responsibility to read the rules and ask for clarification if needed. Read the entire rule here: CDC Website
All International packages require a valid passport, with expiration date at least 6 months from return date. Non-US Citizens should check with their consulate for valid entry requirements. Tropical Travel is not liable for any passenger who is unable to travel or denied re-entry into US due to improper documents. Some countries may deny entry to travelers with a minor criminal record. Check with country requirements to ensure you can travel. Cancel or change fees may apply if you are denied for these reasons.
CANCELLATIONS, CHANGE FEES & REFUNDS - Your right to any refunds if you change your plans is limited. Cancellations and changes to any booking are subject to both Tropical Travel Administrative fees and fees imposed by tour operators, airlines, hotels, and other suppliers. Changes or revisions after deposit start at $100 per change. Most, but not all airlines are allowing changes to be made to reservation dates. The customer will be responsible for any increase in price or change fees, and change/ cancel fees charged by Tropical Travel.. Standard cancellation policies- Many airfares and hotel reservations are nonrefundable without travel insurance and nontransferable. You may be charged 100% cancellation/change penalties, depending on the date of cancellation. Nonrefundable hotels incur penalties upon deposit. Once travel has begun, there will be no refunds for any unused or partially used travel component for any reason. Standard change and cancellation policies apply to bookings made with future travel credits. Cancellation penalties for cancellations within 45-30 days of departure start at $400 per person, 30 days or less, no refund without travel insurance. Administrative penalties for cancellation are $750.00 per person and payable upon cancellation. Administrative penalties are covered by Travel Insurance when cancelling for a covered reason. Cancel for any Reason Insurance does not cover $250 per person Administrative Penalties paid at the time of cancellation.
LUGGAGE AND PERSONAL PROPERTY - Baggage fees are not included in your vacation. Information on carrier baggage policy and fees, liability for lost, misconnected and damaged baggage or other personal property can be obtained by visiting the airline website. All lost or damaged luggage must be reported to an airline representative at the destination airport by before you leave the airport. Tropical Travel does not accept liability for client luggage or personal property. Travel insurance will cover lost bags. TSA approved locks are recommended.
FLIGHT INFORMATION - All flight times are subject to change. It is your responsibility to reconfirm your flight times prior to departing for the airport. If you fail to check in for your flight at the required time, you may be denied boarding and may not be eligible for a refund. Tropical Travel assumes no responsibility for any passengers making independent connections to flights not booked with Tropical Travel. Pre-assigned seat selection is at the discretion of the air carrier and may require payment of an additional fee.
GOVERNING LAW AND DISPUTE RESOLUTION - This Payment Agreement shall be governed by the laws of the Commonwealth of Texas. Should a claim or dispute with any of the travel or excursion providers, you will notify us within 30 days & we will provide you with as much assistance as reasonably possible to assist you in resolving the dispute. Tropical Travel does not control and cannot be responsible for such factors as weather, government actions, terrorism, mechanical breakdowns, pandemics, your physical, medical or mental disabilities, your failure to obtain valid travel documents or follow travel instructions, or for denied entry at destination or re-entry into the U.S. Should a dispute or controversy arise concerning the terms and conditions of this Agreement or involving a loss, injury or damage arising out of or relating to your trip, any legal action against Tropical Travel Inc. shall be brought exclusively in the Texas Court of Common Pleas of Ellis County. If any term or provision of this Agreement with tropical Travel is determined by a court of competent jurisdiction to be invalid or otherwise enforceable, such holding will not affect the validity or enforceability of the remaining terms and provisions. Tropical Travel Inc. will therefore not be held responsible for breach of contract or any international or careless actions or omissions on the part of such suppliers, which result in any loss, damage, delay or injury to you & your travel companions.
SAFETY and COVID-19 - Tropical Travel Inc. herein gives notice that it cannot be held responsible for any disruption or travel and/or related services in "troubled areas" due to monetary crisis, political or social unrest, labor problems, mechanical or construction difficulties, climactic aberrations, local laws, diseases, or novel conditions including terrorism, or supplier's financial conditions. For travel advisories check the US State Department. For destination health info, check the CDC website. Drink responsibly. Tropical Travel and the tour operator do not represent or warrant that travel to such destination is without risk and is not liable for any damages of loss that may result from travel. By traveling you assume all risks, hazards and dangers arising from or related in any way to the risk of contracting Covid19 or any other communicable disease or illness, or a bacteria, virus, or other pathogens capable of causing communicable disease or illness, whether occurring before, during, or after travel, however caused or contracted, and voluntarily waive all claims and potential claims against Tropical Travel Inc, and their Independent Agents, and any of their respective present and future affiliated, partners, members, officers, employees, vendors, and their affiliated companies relating to such risks.
NOT INCLUDED (Ancillary items subject to change) - Hotels in Hawaii resort fees from $10-$47 per room, per night payable directly to the hotel; $29 departure tax payable upon departure from Costa Rica; $28 Antigua departure tax payable at airport upon arrival-cash only, Barbados government levy of $5.50- $10 per room per night, based on the rating/ranking attributed to the hotel by the Barbados Hotel and Tourism Association, collected at hotel check-out. Environmental levy is payable at hotels in Cancun – 25 Mexican pesos per room per night. Riviera Maya hotels will collect 20 Mexican pesos per room per day. Tour operators and cruise lines reserve the right to pass through and charge a fuel supplement without prior notice, should the closing price of oil increase above $65.00 USD per barrel on the NYMEX (New York Mercantile Exchange Index). In the event a fuel supplement is charged, this will apply a supplementary charge to both existing and new bookings, regardless of whether such bookings have been paid in full. Your Travel Consultant will advise you if this needs to be collected at any point from deposit-departure.
HAZARDOUS MATERIALS - Federal law forbids the carriage of hazardous materials aboard the aircraft, in your luggage, or on your person. Violations can result in 5 years' imprisonment and penalties of $250,000 USD or more (49 U.S.C. 5124). Hazardous materials include explosives, compressed gases, flammable liquids & solids, oxidizers, poisons, corrosives, and radioactive materials. There are special exceptions for small quantities (up to 70 ounces total) of medicinal and toilet articles carried in your luggage and certain smoking materials carried on your person. Note: Spare batteries electronic cigarettes or other battery-operated electronic smoking devices and fuel cells are not permitted in checked or hold baggage. These items MUST be packed in carry-on baggage. If your carry-on bag is gate checked, the spare batteries and fuel cells must be removed and carried in the cabin. Visit FAA Pack Safe for more info.
Tropical Travel Inc. shall be held harmless and not responsible for resulting disputes taken by fellow travelers arising due to the signor agreeing to & signing this Agreement. Signor acknowledges that is his/her responsibility to inform all travelers on the reservation of the Agreement and give all passengers a copy. You agree you will not seek charge back to your payment through Tropical Travel. If Tropical Travel incurs any costs, including to but limited to attorneys’ fees, to recover ant payments charged back by your credit card company, you agree that you will be liable for these costs. By signing below, the signor acknowledges that he/she has read & accepts the Tropical Travel Agreement as a binding Agreement & verifies that he/she is acting as a representative for all travelers listed on the reservation.
