TRAVEL SERVICE AGREEMENT


This Travel Service Agreement (“Agreement”) outlines the terms under which Destins by Dorsey, LLC (“Company,” “we,” “us”) provides travel planning and booking services to the traveler(s) (“Traveler,” “you”).

By submitting a deposit, making a payment, or confirming a booking, you acknowledge you have read, understand, and agree to these Terms & Conditions for yourself and all members of your travel party (including minors, if applicable).


1) RESERVATIONS & TRAVELER INFORMATION

A. Required Identification

  • Reservations must be made using the Traveler’s full legal name exactly as it appears on the government-issued ID/passport that will be used for travel.

  • If a name correction is requested after documents are issued or suppliers have ticketed/confirmed services, Traveler is responsible for all supplier penalties/fees and any additional costs.

B. Deposits

  • All reservations require a non-refundable deposit paid to the Company. No exceptions.

  • We do not begin booking or confirming travel components until the required deposit is received and cleared.


2) PASSPORTS, VISAS & ENTRY REQUIREMENTS

A. Traveler Responsibility

  • Travelers are solely responsible for obtaining and carrying all required travel documents, including passports, visas, vaccine documentation (if applicable), and entry/exit forms.

  • Many destinations require passports to be valid at least six (6) months beyond travel dates, and some require blank visa pages.

  • Requirements vary by citizenship. Guidance we provide is typically based on U.S. citizen travel; non-U.S. citizens must confirm entry requirements with the appropriate consulate/embassy.

B. Accuracy of Submitted Information

  • Travelers must provide accurate personal details (name, DOB, gender, address, contact info, etc.) and review invoices/documents promptly.

  • Destins by Dorsey, LLC is not responsible for denied boarding, missed travel, or supplier penalties caused by incorrect or late Traveler-provided information.


3) CHANGES (INCLUDING NAME CHANGES)

  • Any requested change to a booking (for any reason) may result in:

    1. a $100 Company service fee, plus

    2. all supplier change/cancel/reissue fees, fare differences, and penalties.

  • This includes changes to names, dates, flights, hotel details, transfers, and removal of services (including optional tours).

  • Airline name changes may require cancellation and rebooking under the airline’s rules; this can mean higher pricing and additional penalties.

  • Changes requested after departure are subject to local/vendor pricing at the time of change and must be paid as directed (often directly to the supplier).

  • Unused services are non-refundable.


4) PAYMENTS, LATE FEES & CANCELLATIONS

A. Payment Options

  • Travelers may pay in full at booking or follow an approved installment plan if offered for the trip.

  • Payment due dates are firm. If a payment is 30 days past due, the reservation may be cancelled automatically, and all paid amounts may be forfeited based on supplier rules and this Agreement.

B. Final Payment

  • If final payment is not received by the deadline, the reservation may be cancelled and all funds paid may be forfeited (including deposits), subject to supplier penalties.

C. Reinstatement of Cancelled Reservations

  • If your reservation is cancelled and you request reinstatement within 14 days, a $250 reinstatement service fee (international tours) will apply and must be paid before we attempt to restore services.

  • Reinstatement is not guaranteed and depends on supplier availability and rules.

D. Cancellations Must Be in Writing

  • All cancellations must be submitted in writing (email is acceptable). The effective cancellation date is the date/time we receive written notice.

E. Refund Policy (Important)

  • Destins by Dorsey, LLC does not guarantee refunds. Travel is governed by supplier contracts (hotels, airlines, tour operators, etc.) that set their own penalties.

  • If you cancel, you may be eligible for reimbursement only through travel insurance 

F. Travel Insurance

  • Travel insurance is strongly recommended for all travelers. It may help protect your investment for covered reasons (medical, trip interruption, supplier default coverage depending on policy, etc.).


5) TRAVELER ACCOMMODATIONS

A. Roommate Matching (International Tours)

  • Roommate matching may be available for select tours.

  • To participate: select Double Occupancy and complete the roommate survey.

  • Matches are typically confirmed once both travelers are at least 75% paid.

  • Roommates agree to share accommodations for the entire trip. The Company is not responsible for interpersonal conflicts.

  • If new room arrangements become necessary, each Traveler is responsible for securing and paying for their own accommodations. The Company is not required to provide or cover additional lodging.

B. Group Experience & Conduct

To protect the quality of the group trip, the Company may refuse participation or remove a traveler whose conduct is disruptive, unsafe, or negatively impacts others (including intoxication, illegal drug use, harassment, or repeated disregard for group rules).

  • Any costs related to removal, early return, alternative travel, or cancellations are the Traveler’s responsibility.

  • Unused services are non-refundable.

C. Photo/Video Release

  • Travelers grant permission for the Company to capture photo/video during the trip and to use the content for marketing and promotional purposes without compensation, unless the Traveler notifies the Company in writing prior to travel.


6) AIR TRAVEL TERMS

A. Luggage

  • Unless otherwise stated, travelers should plan for:
    Option 1: 1 checked bag + 1 personal item OR
    Option 2: 1 carry-on + 1 personal item

  • Baggage fees and rules are set by airlines and may change at any time.

B. Airline Schedules, Seats & Missed Flights

  • Airlines control schedules, routing, seat assignments, and operational changes. We are not responsible for airline delays, cancellations, missed connections, schedule changes, or seat reassignments.

  • If an airline requires tickets to be issued early (common during high demand), Traveler may be required to pay sooner than originally planned to secure the fare/space. If payment is not made, seats may be released and rebooking costs become the Traveler’s responsibility.

C. Airline Ticketing & Refundability

  • Once ticketed, airline fares are typically non-refundable and may be subject to change fees and fare differences.

D. Frequent Flyer Programs

  • Mileage accrual and eligibility are determined solely by the airline. Discounted or private fares may earn reduced or no miles. Provide your frequent flyer details early and confirm at check-in.

E. Communicating Flight Changes

  • If you change flights directly with the airline, you must notify the Company in writing. If we are not informed, we are not responsible for missed transfers or land services impacted by the change.


7) HOTEL TERMS

A. Room Types & Bedding

  • Room types and bed configurations are request-based and not guaranteed. Final assignment is at the hotel’s discretion.

  • Triple/quad rooms often have two beds. Single rooms may be smaller than standard.

B. Check-In/Check-Out

  • Standard check-in is typically after 3:00 PM and check-out is typically by 12:00 PM, unless otherwise stated by the property.

C. Hotel Standards Abroad

  • International hotel amenities (including air conditioning) may differ from U.S. expectations and may be limited seasonally or by local standards.

D. Substitutions

  • If necessary, we may substitute accommodations or components of equal standard due to availability, operational needs, or circumstances beyond our control.


8) MEALS, TRANSFERS, TOURS & GRATUITIES

A. Meals

  • Meals are included only as stated in the itinerary. Beverages are not included unless specifically noted.

  • Dietary requests must be submitted in writing at least 4 weeks before departure. We will communicate requests but cannot guarantee accommodations.

B. Transfers

  • Transfers are provided only as outlined in the itinerary and may depend on purchasing airfare through the Company (when applicable).

  • Land-only travelers or travelers arriving/departing outside scheduled dates are responsible for their own transfers.

  • Delays due to immigration/customs/baggage/flight issues may require Travelers to arrange alternate transportation at their own expense.

C. Itinerary & Sightseeing

  • Itinerary times are approximate and may change due to weather, traffic, operational concerns, holidays, or vendor adjustments.

  • Travelers are responsible for arriving on time for scheduled activities. Late arrivals may be treated as a no-show with no refund.

D. Gratuities (Escorted Tours)

Suggested daily tips (unless otherwise noted):

  • Driver: $7 per person, per day

  • Tour Guide: $8 per person, per day


9) HEALTH, SAFETY & ACCESSIBILITY

A. Health Requirements

  • Consult your healthcare provider and review guidance from public health authorities prior to travel.

  • If you become ill during travel or arrive with symptoms that require medical attention, you may be separated from group activities for safety. All related costs are the Traveler’s responsibility.

B. Travelers With Disabilities

  • Choose an itinerary appropriate for your physical abilities. Many tours involve walking, stairs, uneven ground, and fast-paced schedules.

  • If assistance is required, you must travel with a companion who can provide that assistance. Tour staff cannot provide personal care.

  • Notify the Company of accessibility needs prior to booking so we can evaluate feasible options; accommodations cannot be guaranteed.

C. International Accessibility Limitations

  • Many international properties and transport services are not required to meet U.S. ADA standards and may not accommodate wheelchairs, scooters, or walkers due to space constraints.


10) ASSUMPTION OF RISK, LIABILITY WAIVER & DISPUTE RESOLUTION

A. Independent Suppliers

Destins by Dorsey, LLC acts as a travel services organizer/agent and does not own or operate airlines, hotels, transportation providers, or tour operators. These suppliers are independent contractors. We are not liable for their acts, omissions, negligence, or failures.

B. Assumption of Risk

Travel involves inherent risks including injury, illness, delays, accidents, criminal activity, weather events, and other circumstances outside Company control. By participating, you voluntarily assume these risks for yourself and your travel party.

C. Limitation of Liability

The Company is not responsible for loss, damage, injury, death, delay, or inconvenience caused by events beyond our control including (but not limited to) acts of God, government actions, war, terrorism, strikes, mechanical breakdowns, supplier overbooking, or civil unrest.

D. Emergency Medical Authorization

You authorize the Company and/or suppliers to arrange emergency medical care if necessary. You are responsible for all associated costs.

E. Binding Arbitration

Any dispute arising from this Agreement or travel services shall be resolved through binding arbitration.


11) VOLUNTARY PARTICIPATION & SIGNATURE

By signing, you confirm:

  • You have read and agree to these Terms & Conditions

  • You accept responsibility for all travelers on your reservation

  • You understand cancellation/change penalties and refund limitations

  • You accept the assumption of risk and liability terms

The terms and conditions set forth in this agreement, also referred to as the “Terms,” constitute the entire understanding and agreement between you, the tour participant, also referred to as “Traveler,” and Destins by Dorsey, LLC d/b/a Travel Destinistas, a Texas company, also referred to in this agreement as “Travel Destinistas,” “Company,” “we,” “us,” or “our,” with respect to any and all bookings, reservations, tours, travel services, and transactions made with Travel Destinistas.

By booking a trip or tour with us, paying a nonrefundable and nontransferable deposit, making any payment toward a trip, or signing this agreement, you accept and agree to be bound by these Terms on your own behalf and on behalf of all persons included in your reservation, including any minor for whom you are authorized to sign. You further authorize Travel Destinistas to perform travel planning, booking, and related services for each traveler listed on the reservation.

IDENTIFICATION

Travelers are required to make reservations in the full legal name exactly as it appears on the government issued identification they will use for travel. Any name changes requested after booking or after travel documents have been issued may result in additional supplier fees, airline penalties, administrative charges, or cancellation and rebooking requirements, all of which shall be the traveler’s sole responsibility.

RESERVATIONS

Reservations may be made through our website, approved booking page, invoice link, or by working directly with Travel Destinistas through an approved communication channel. A reservation request does not guarantee space or confirmation. A booking is not accepted and no contract for services exists until the required deposit or payment is received and written confirmation is issued by Destins by Dorsey, LLC d/b/a Travel Destinistas.

Travel Destinistas reserves the right to refuse, decline, or cancel any reservation request prior to confirmation in its sole discretion. Travelers are responsible for reviewing all trip details, package inclusions, exclusions, pricing, payment schedules, and applicable terms before submitting payment.

Any quote, proposal, itinerary, or package presentation is subject to change until the reservation is confirmed and the required payment is received.

BOOKINGS AND ACCEPTANCE

A booking is not accepted and no contract for services exists until the required deposit or payment is received and written confirmation is issued by Travel Destinistas. We reserve the right to decline any booking request in our sole discretion before confirmation is issued.

Reservations must be paid in accordance with the payment terms listed on the applicable booking page, invoice, proposal, or confirmation. Any reservation not paid in accordance with the required payment schedule may be treated as canceled and will remain subject to these Terms and all supplier penalties.

PAYMENTS

We use third party payment processing platforms, including but not limited to TravelJoy, to process credit and debit card payments. By submitting payment, you represent and warrant that you are an authorized user of the payment method used and that the information provided is accurate and complete.

Unless otherwise stated in writing, all payments made to Travel Destinistas are applied to the traveler’s reservation and are subject to the cancellation, refund, and supplier terms applicable to that reservation.

FORM OF PAYMENT

We accept major credit and debit cards through our authorized third party payment platforms and invoicing systems. We do not guarantee acceptance of any particular form of payment outside those systems.

THIRD PARTY CARDHOLDER AUTHORIZATION

To protect your reservation, your payment, and Destins by Dorsey, LLC d/b/a Travel Destinistas, additional documentation is required whenever a credit or debit card is used and the name on the card does not match the name of at least one traveler listed on the reservation.

Due to the increase in chargebacks, fraud, and payment disputes, Travel Destinistas reserves the right to require and review supporting documentation before accepting or processing any such payment. Payment will not be applied to the reservation until all required documentation has been received, reviewed, and approved by Travel Destinistas.

In these circumstances, the cardholder must provide the following:

  1. A valid copy of the cardholder’s driver’s license or other government issued photo identification

  2. A signed handwritten letter authorizing Destins by Dorsey, LLC d/b/a Travel Destinistas to charge the card for the approved amount

The written authorization letter must include all of the following:

  1. Cardholder first and last name exactly as shown on the identification

  2. Traveler first and last name exactly as listed on the reservation

  3. Trip reservation number

  4. Destination

  5. Travel dates

  6. Authorized payment amount

  7. Last four digits of the credit or debit card being used

  8. Billing address associated with the card

  9. Best phone number and email address for the cardholder

  10. A clear statement authorizing Destins by Dorsey, LLC d/b/a Travel Destinistas to charge the card for the amount listed

  11. The cardholder’s signature and date signed

If the cardholder is not one of the travelers, the authorization letter must also state the cardholder’s relationship to the traveler.

For fraud prevention and the protection of all parties, travelers and cardholders should not send full credit card numbers by email unless specifically instructed to do so through a secure and approved payment process. Travel Destinistas may refuse, delay, reverse, or cancel any payment request that does not satisfy its documentation and verification requirements.

Travel Destinistas reserves the right to request additional documentation, decline any third party payment, or require an alternate form of payment in its sole discretion.

OVER THE PHONE CREDIT OR DEBIT CARD PAYMENTS

By providing payment information over the phone, you authorize Destins by Dorsey, LLC d/b/a Travel Destinistas to charge the credit or debit card for the amount stated on the invoice sent to the email address on file. You certify that you are an authorized user of the card provided and that the transaction corresponds to the services and amounts reflected on the invoice.

All over the phone payments are final, nonrefundable, and nontransferable upon receipt unless otherwise stated in writing. Travel Destinistas will update the invoice to reflect receipt of payment and provide an electronic receipt.

DEPOSITS

A deposit is due at the time of reservation unless otherwise stated in writing. All deposits are final, nonrefundable, and nontransferable. Deposit amounts, payment schedules, and final payment deadlines vary by trip and will be stated on the applicable booking page, invoice, or confirmation.

FULL PAYMENT

Reservations may be paid in full at the time of booking, provided space remains available and the applicable supplier permits full payment.

LATE PAYMENTS AND LATE FEES

If you elect to pay in installments, you agree to remain current on the payment schedule reflected on your invoice. A twenty dollar late fee will be assessed to any installment payment that remains unpaid fifteen days after its due date, unless a different late fee is stated on the booking page or invoice for a specific trip.

Any reservation not paid in full by the final payment deadline may be subject to cancellation and a fifty dollar late fee, unless a different fee is specified in writing for that trip. If a hosted trip reservation is canceled for nonpayment, all monies paid remain nonrefundable and nontransferable.

REINSTATEMENT OF RESERVATION

If your reservation is canceled due to nonpayment or if you request reinstatement after canceling, Travel Destinistas may, in its sole discretion and subject to availability, attempt to reinstate the reservation. A seventy five dollar reinstatement fee per person will apply and must be paid in advance. Reinstatement is not guaranteed and may be subject to additional supplier fees, price changes, or new terms.

LAST MINUTE RESERVATIONS

Unless otherwise stated in writing, all reservations must be made no later than thirty days prior to departure. If requested services cannot be confirmed, payments collected for unconfirmed services will be refunded. If services are confirmed, final payment may be due immediately or within twenty four hours of confirmation, and all applicable cancellation penalties will apply.

CREDIT OR DEBIT CARD CHARGEBACK POLICY

If you are dissatisfied with our services for any reason, you agree not to initiate a chargeback or payment dispute before first providing Travel Destinistas a reasonable opportunity to address the matter.

By booking with us, signing this agreement, or making payment, you agree that chargebacks are not to be used to avoid or circumvent the cancellation and refund policies applicable to your booking. You further agree that chargebacks are not an appropriate substitute for the insurance claim process, supplier review process, or direct communication with our office.

Travel Destinistas reserves the right to dispute any chargeback and to provide the card issuer with copies of these Terms, invoices, booking records, communications, authorizations, and supplier records. To the fullest extent permitted by law, if a chargeback is resolved in our favor, you agree to reimburse us for any fees, costs, administrative time, and reasonable attorney’s fees incurred in responding to the dispute.

REFUNDS AND CANCELLATIONS

Hosted Trips by Travel Destinistas

All sales for trips hosted by Travel Destinistas are final. All payments, including deposits, installment payments, and final payments, are nonrefundable and nontransferable for any reason unless otherwise expressly stated in writing by Travel Destinistas.

This policy applies to cancellations by the traveler, missed payments, work conflicts, family emergencies, schedule conflicts, medical issues, fear of travel, weather concerns, airline delays, and any other circumstance not expressly covered by a valid travel protection claim through the traveler’s insurance provider.

Because Travel Destinistas enters into contractual agreements with hotels, cruise lines, airlines, destination management companies, and other travel suppliers that may impose strict nonrefundable terms, travelers understand and agree that hosted trip payments cannot be transferred to another person, another trip, or another date.

CUSTOM AND PRIVATE GROUP TRIPS

For custom trips, private group trips, destination weddings, family groups, social groups, leisure groups, and other trips in which Travel Destinistas is acting as the travel advisor for a group organized by a separate group leader or client, refunds shall be governed by the applicable supplier cancellation policy and timeline.

In those cases, any available refund is limited strictly to the amount, if any, actually recoverable from the supplier, less any nonrefundable deposits, administrative charges, service fees, planning fees, credit card processing fees where legally permitted, and any cancellation penalties imposed by suppliers.

If no refund is available from the supplier, no refund shall be due from Travel Destinistas.

CANCELLATION BY TRAVELLER

All cancellation requests must be submitted in writing by email to admin@traveldestinistas.com and must include the traveler’s full name, invoice number, destination, and travel dates. Cancellations are not effective until acknowledged in writing by Travel Destinistas. If you do not receive an acknowledgment within three business days, it is your responsibility to follow up and confirm receipt.

No verbal cancellation, voicemail, social media message, or text message shall be deemed effective unless confirmed in writing by Travel Destinistas.

RESERVATION CHANGES

Any requested change to an existing reservation, including but not limited to name corrections, rooming changes, optional services, or date modifications, must be made in writing and is subject to approval by the supplier and Travel Destinistas. A fifty dollar change fee per person will apply, in addition to any supplier imposed fees, fare increases, cancellation penalties, or rebooking costs.

Replacing one traveler with another traveler constitutes a cancellation and new booking, not a change, and all applicable cancellation terms will apply.

Unused services are nonrefundable.

PRICES

All prices are per person unless otherwise stated and are based on the occupancy and package terms shown on the booking page, invoice, or proposal. Prices do not include items of a personal nature, including but not limited to laundry, beverages, meals not specifically listed, passport fees, visa fees, vaccinations, travel insurance, gratuities, baggage fees, seat assignments, and other incidental charges unless expressly included.

Prices are subject to correction for human or computer error. Travel Destinistas reserves the right to correct inaccurate pricing or service descriptions. If the corrected price results in an increase of more than ten percent of the total trip cost, the traveler may cancel within five days of written notice and receive a refund of amounts paid to Travel Destinistas for the affected booking, less any nonrefundable supplier costs already incurred if permitted by law and applicable contract.

PASSPORTS, VISAS, ENTRY REQUIREMENTS, AND HEALTH DOCUMENTS

Travelers are solely responsible for obtaining and carrying valid passports, visas, entry permits, vaccination records, health certificates, and any other documentation required by the destination, transit country, airline, cruise line, or supplier.

Passports for international travel should generally be valid for at least six months beyond the return date unless a different rule applies. Some destinations also require blank visa pages. Entry requirements may change at any time and may differ depending on citizenship, residency, itinerary, and method of travel.

Any information provided by Travel Destinistas regarding travel documentation is provided as a courtesy only and may apply only to United States citizens. Non United States citizens are solely responsible for confirming all requirements with the applicable consulates, embassies, immigration authorities, airlines, cruise lines, or other relevant providers.

Travel Destinistas is not liable for any denied boarding, denied entry, missed departure, delay, additional expense, loss, or damages arising from incomplete, invalid, or inaccurate travel documentation.

TRAVEL INSURANCE

Travel Destinistas strongly recommends that every traveler purchase comprehensive travel protection, including coverage for trip cancellation, trip interruption, travel delay, baggage loss, medical expenses, and emergency evacuation.

Travelers are solely responsible for reviewing, selecting, purchasing, and understanding their own insurance policy. Travel Destinistas is not an insurer and makes no representation or warranty regarding the availability, adequacy, exclusions, or benefits of any policy. Any claim for reimbursement must be submitted directly to the insurance provider in accordance with that provider’s terms.

If a traveler declines to purchase travel insurance, the traveler assumes full financial responsibility for any losses, damages, cancellations, interruptions, medical expenses, travel delays, missed connections, lost baggage, or other travel related events that may occur.

For travelers interested in cancel for any reason coverage, such policies often must be purchased within a short window after the initial trip deposit. It is the traveler’s responsibility to determine eligibility and purchase within the required timeframe.

HEALTH AND FITNESS TO TRAVEL

Travelers are responsible for ensuring that they are medically and physically fit for travel and for participation in the booked itinerary. Travel Destinistas and its suppliers reserve the right to refuse travel, remove a traveler from part or all of a trip, or require a traveler to remain isolated or quarantined if the traveler appears ill, poses a health or safety risk, or fails to comply with health related rules, requirements, or instructions of any supplier, destination, or authority.

No refunds or credits will be issued for unused trip components resulting from illness, quarantine, failure to meet health requirements, or removal from all or part of a trip for health or safety reasons.

TRAVEL DOCUMENTS AND FINAL TRIP INFORMATION

Provided full payment has been received by the applicable final payment date, final trip documents and itinerary details are generally sent by email approximately thirty days prior to departure, unless a different timeline applies to a specific booking.

If paper documents are requested where electronic documents are available, a thirty dollar document handling fee may apply. A complete physical mailing address is required. No post office boxes.

ROOMMATE MATCHING

Roommate matching may be offered on select hosted trips for travelers who request double occupancy but do not have a roommate at the time of booking. Roommate matching is offered as a courtesy only and is not guaranteed.

If a suitable roommate match is not secured by the deadline established for the trip, the traveler agrees to be responsible for any additional amount due, including but not limited to the single occupancy rate or any applicable room upgrade difference. Travel Destinistas is not responsible for incompatibility between matched roommates, changes in traveler participation, cancellation by a matched roommate, or disputes arising between roommates.

Travelers requesting roommate matching understand and agree that shared accommodations involve personal preferences, habits, and lifestyle differences, and Travel Destinistas makes no representation or warranty regarding compatibility. Once a roommate is assigned, any requested change remains subject to availability, supplier rules, and applicable change fees.

Roommate matching is available only where expressly stated on the applicable booking page.

CANCELLATIONS OR CHANGES BY TRAVEL DESTINISTAS

Travel Destinistas reserves the right, in its sole discretion, to cancel, modify, postpone, substitute, or reschedule any aspect of a trip, including but not limited to accommodations, transportation, suppliers, itinerary, activities, routes, schedules, and travel dates, for reasons including but not limited to safety, comfort, operational issues, supplier changes, minimum participation requirements, civil unrest, weather, mechanical issues, government actions, health concerns, or Force Majeure.

If Travel Destinistas makes a significant change prior to departure, we will use reasonable efforts to notify affected travelers as soon as practicable. In some cases, additional payment may be required due to supplier changes, transportation costs, tax increases, or other factors outside our control.

Except as otherwise expressly required by law, Travel Destinistas is not liable for any refund, compensation, incidental expenses, consequential damages, or out of pocket costs arising from cancellation, modification, delay, postponement, or rescheduling of a trip. At our sole discretion, and without obligation, we may attempt to recover and pass through any supplier refunds actually received, less nonrefundable supplier charges and our administrative costs.

FORCE MAJEURE

Travel Destinistas shall not be deemed in breach of these Terms or otherwise liable for delay, cancellation, modification, interruption, or nonperformance caused in whole or in part by events beyond our reasonable control, including but not limited to acts of God, weather events, floods, fires, natural disasters, pandemics, epidemics, quarantines, disease outbreaks, government orders, travel advisories, border closures, war, terrorism, civil unrest, strikes, labor disputes, supplier insolvency, mechanical failures, transportation interruptions, or any other unforeseen or unavoidable event.

In the event of Force Majeure, Travel Destinistas or its suppliers may vary, postpone, reschedule, substitute, or cancel any trip or service. Refunds, if any, shall be limited to amounts actually recovered from suppliers, less nonrefundable costs and administrative fees. No compensation, consequential damages, or reimbursement for incidental expenses shall be owed by Travel Destinistas.

AIR TRAVEL

Travel Destinistas does not own or operate airlines and is not responsible for airline schedules, flight changes, delays, cancellations, seat assignments, baggage handling, denied boarding, fare rules, or service failures. Airline tickets and reservations may be subject to separate airline terms and conditions, including immediate ticketing requirements, schedule changes, and fare increases.

If airfare is not issued directly by Travel Destinistas, we are not responsible for penalties, additional costs, or missed connections associated with those tickets. The traveler is solely responsible for complying with airline rules and recommended check in times.

FREQUENT FLYER PROGRAMS

Frequent flyer mile accrual, eligibility, upgrades, and related benefits are controlled solely by the airline. Travel Destinistas makes no representation that any airfare or itinerary will qualify for mileage or upgrades. Travelers are responsible for providing accurate frequent flyer information and for confirming eligibility directly with the airline.

CONTACT INFORMATION AND SECURE FLIGHT DATA

Travelers are responsible for providing accurate contact and identification information, including full legal name, date of birth, gender where required, address, phone number, and email address. Travel Destinistas is not responsible for missed communications, document delivery failures, or denied boarding resulting from inaccurate or incomplete information provided by the traveler.

TRAVELERS WITH DISABILITIES AND SPECIAL NEEDS

Travelers requiring special accommodations, mobility assistance, medical support, or other assistance must notify Travel Destinistas in writing before booking. Accommodation requests are subject to supplier availability and destination limitations and cannot be guaranteed.

Travel Destinistas does not provide personal care attendants, mobility assistance, lifting assistance, medical assistance, or supervision. Travelers requiring such assistance must travel with a qualified companion capable of providing it.

Travel Destinistas reserves the right to decline participation or remove a traveler from a trip if the traveler’s condition, conduct, or needs materially impact the safety, comfort, or experience of that traveler or others, or if required accommodations cannot reasonably be provided. Any resulting expenses shall be the sole responsibility of the traveler.

WHEELCHAIRS, WALKERS, AND MOBILITY DEVICES

Some destinations, hotels, cruise ships, transfer vehicles, excursion sites, and international infrastructure may not be accessible to wheelchairs, walkers, scooters, or other mobility devices. Travel Destinistas does not guarantee accessibility and is not responsible for the inability of suppliers or destinations to accommodate such devices.

Travelers must disclose mobility needs before booking so that we may determine whether reasonable accommodations may be available. Even where requested, accommodations are not guaranteed.

INDEPENDENT SUPPLIERS

Travel Destinistas acts solely as an intermediary between the traveler and independent travel suppliers, including hotels, resorts, cruise lines, airlines, ground operators, transfer companies, tour operators, destination management companies, and other travel service providers.

Travel Destinistas does not own, control, manage, or operate these suppliers and is not responsible for their acts, omissions, negligence, bankruptcy, insolvency, service failures, overbookings, schedule changes, injuries, losses, damages, or defaults. All tickets, vouchers, reservations, and bookings are subject to the terms and conditions of the respective suppliers.

ASSUMPTION OF RISK, RELEASE, AND LIMITATION OF LIABILITY

Travel involves inherent risks, both known and unknown, including but not limited to illness, injury, death, accidents, crime, foodborne illness, water related risks, transportation incidents, acts of other travelers, acts of third parties, political instability, weather events, and other hazards. By participating in any trip booked through Travel Destinistas, you voluntarily assume all such risks on behalf of yourself and all travelers included in your reservation.

To the fullest extent permitted by law, you release, waive, discharge, and covenant not to sue Destins by Dorsey, LLC d/b/a Travel Destinistas and its owners, officers, directors, employees, independent contractors, agents, representatives, successors, and assigns from and against any and all claims, demands, causes of action, damages, losses, liabilities, costs, and expenses arising out of or relating to personal injury, emotional distress, illness, death, property loss, property damage, delay, inconvenience, loss of enjoyment, or other harm resulting from or connected with your trip, except to the extent caused by our willful misconduct or gross negligence where such limitation is prohibited by law.

In no event shall Travel Destinistas be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost opportunities, or out of pocket expenses, regardless of the legal theory asserted.

If Travel Destinistas is found liable for any claim arising out of services provided under these Terms, the maximum recovery shall not exceed the amount actually paid to Travel Destinistas for the specific booking giving rise to the claim.

This release and limitation of liability shall be binding on the traveler and on the traveler’s heirs, representatives, assigns, and estate.

PASSENGER AGREEMENT

All travelers are required to complete any required booking forms, traveler information forms, waivers, authorizations, and passenger agreements requested by Travel Destinistas before travel documents are released and, in some cases, before reservations can be finalized.

For travelers booking online or through a digital booking page, completion of the booking process, submission of traveler information, payment of the deposit, and acceptance of these Terms constitute execution of the Passenger Agreement and agreement to be bound by all applicable terms, conditions, waivers, releases, and supplier requirements.

Travel Destinistas reserves the right to withhold travel documents, suspend booking activity, cancel a reservation, or deny participation where required forms, agreements, identification, or requested documentation have not been completed, submitted, or approved by the stated deadline. Any resulting supplier penalties, cancellation charges, or losses shall remain the sole responsibility of the traveler.

PHOTOGRAPH AND VIDEO RELEASE

By participating in a trip booked through Travel Destinistas, you grant Destins by Dorsey, LLC d/b/a Travel Destinistas the right to photograph, record, and use your image, likeness, voice, statements, and appearance in photographs, video recordings, audio recordings, testimonials, and promotional materials for lawful business purposes, including marketing, advertising, social media, website content, media coverage, future trip promotion, and related commercial use, without compensation or further approval, unless prohibited by law.

You waive any right to inspect or approve the final use of such materials and release Travel Destinistas from claims arising from such use, including claims for defamation, invasion of privacy, or rights of publicity, except where prohibited by law.

WEBSITE USE

This website, including www.traveldestinistas.com and any related booking pages, forms, trip pages, and linked content operated by Destins by Dorsey, LLC d/b/a Travel Destinistas, is offered to users conditioned upon acceptance of these Terms and any additional notices, disclaimers, policies, and conditions published on the site.

By using the website, submitting an inquiry, requesting a quote, completing a form, or making a reservation through the site, you agree to be bound by these Terms and all applicable policies referenced on the website.

Travel Destinistas makes reasonable efforts to keep website content accurate and current but does not guarantee that all descriptions, pricing, availability, dates, inclusions, images, supplier information, or other content appearing on the website will always be complete, current, or error free. Content may be updated, corrected, changed, or removed at any time without notice.

Travel Destinistas shall not be liable for any loss or damage arising from reliance on website content, temporary unavailability of the website, technical errors, typographical errors, pricing errors, supplier changes, or interruptions in access. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles.

SEVERABILITY

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect to the fullest extent permitted by law.

ENTIRE AGREEMENT

These Terms, together with the applicable booking page, invoice, supplier terms, payment schedule, and any written confirmation issued by Travel Destinistas, constitute the entire agreement between the parties and supersede all prior discussions, representations, or understandings relating to the booking.
