Terms & Conditions

Vybe Travel is excited to help you with your travels. The following terms & conditions (the "Agreement") describe what you can expect from us. The terms "we", "us", and "our" refer to Vybe Travel and the term "you" refers to the individual who signs this agreement.

The purchase of any travel services offered by Vybe Travel (also referred to in these terms & conditions as "Vybe") constitutes a contractual arrangement between you (also referred to in these terms & conditions as “traveler”) and Vybe, and represents your acceptance of Vybe’s Terms & Conditions as set out herein. Please ensure that you have carefully read and understand the Terms & Conditions prior to booking. You represent and warrant that you are authorized to accept Vybe’s Terms & Conditions on behalf of everyone named in your booking. You will be deemed to have accepted Vybe ’s Terms & Conditions on behalf of everyone named in your booking. You are advised to check Vybe’s website for the latest version of the Terms & Conditions prior to booking your trip.

Deposit and Payments
Vybe accepts payment via electronic fund transfer (EFT), and most major credit cards. A non-refundable, non-transferable deposit will be required per person per trip and will be specified per trip. This is a requirement for Vybe to reserve your space unless otherwise stated. The deposit must be received within 1 day of completing your registration or your reservation will not be confirmed. On certain departures, deposits may be required at time of booking to hold or guarantee space for you. Traveler booking is not confirmed and payment is not deemed made until the deposit is received by Vybe and Vybe sends a confirmation invoice to you via email.

Please review and verify your booking invoice thoroughly. Contact Vybe immediately if your invoice appears to be incorrect or incomplete, as it may not be possible to make changes later. Vybe cannot accept responsibility if it is not notified of invoice inaccuracies within 3 days of sending out the invoice. In the case of billing errors, Vybe reserves the right to re-invoice you with the correct pricing.

According to the Vybe website or booking site, payments are due according to the confirmed schedule for each trip. Failure to make payments on time may result in late fees of up to $75 or as stated in the specific trip details. Payment of the balance in full must be received by Vybe not less than 75 days before a scheduled departure with some limited exceptions set forth below. If final payment is not received by Vybe by the due date, the traveler's reservation will be cancelled and is non-refundable unless otherwise stated or unless travel insurance has been purchased. Customer cannot get a refund on the initial deposit and insurance cost if travel insurance was purchased.

Travel Documents
Travel Documents, including e-ticket itineraries, are sent via email approximately four weeks but no later than 1 weeks before departure provided full payment, completion of trip details confirmation and emergency contact details have been received. It is the customer's responsibility to alert Vybe to any discrepancies on final documents within 24 hours of receiving. 

Change Policies and Fees

Change requests must be in writing via the change form and cannot be made verbally. The customer is responsible for reviewing all modifications within 24 hours of the change. If any updates are needed Vybe will correct them within 48 hours or as soon as the hotel or vendor allows. If the customer does not review changes and additional corrections are needed, the $25 change fee will apply. 

The first change is free if changes are available, and all subsequent changes incur a $25 fee per change. 

No changes will be made after the final payment due date or any other date specified in the welcome email.

It is possible for some changes - such as the removal of guests or the addition of days - to result in an increase in package pricing. This will be reflected on your invoice. 

Cancellations and Cancellation Fees
Cancellations and refund requests must be in writing and cannot be made verbally.

The cancellation/refund schedule is as follows:

  1. All trips are non-refundable unless otherwise stated on the original booking page or original booking documents as our trips are fully customized.

  2. Travel insurance and initial deposits are always non-refundable. Refunds or travel credits with the purchase of insurance will be less the the cost of insurance and the cost of initial deposits. 

  3. Travel insurance must be purchased within 7 days of the initial booking date. If trip is paid in full, travel insurance must be purchased during initial booking. Travel insurance must be paid in full when added to booking. 

  4. Any trips not paid in full by specified due dates will result in cancellation of room and no refunds will be issued if travel insurance was not previously purchased. 

  5. There may be a 3-5 day extension period after the 50% room due date and the final payment due date in which payments will be accepted. However, a $75 late fee will be applied per day per room to the invoice each day the invoice is not paid. As per the original cancellation policy, all funds paid prior to the cancellation date will be forfeited. This extention must be requested in writing. 

  6. If one party in a room cancels, the room will increase to pricing for single occupancy. Th funds of the other party may be transferred at the canceled parties request  in writing minus the initial deposit and insurance or any other non-refundable fees. There is a $50 name change and fund transfer fee that will apply. 
Group Cancellations: 
  1.  If you are a part of a group booking cancellation policy and fees  may differ. If it does, it will be laid out on booking page. 
  2. If you are a part of a group of 10 rooms or more as a guest or group leader,  if at any time the group falls below 10 rooms, the group will cancel and all parties are responsible for any pricing increases.  Original cancellation policies still apply. 

Liability Statement
Neither Vybe Travel, its affiliates, owners, officers, agents, or employees, shall be held liable for any act, default, injury, death, loss, expense, damage, deviation, delay, curtailment or inconvenience caused to or suffered by any person or their property, howsoever arising, which may occur or be incurred by any organization or person, where such act, default, injury, loss, expense, damage, deviation, delay, curtailment or inconvenience may have been caused or contributed to by defects or failures of any aircraft, vessel, automotive vehicle or other equipment or instrumentality under the control of independent suppliers. You further understand that if you purchase any optional activities that are not part of your pre-booked charter itinerary (including, without limitation, shore excursions and tours, however conducted, airline flights and ground transportation), these activities are operated by independent contractors; the contract for the provision of that activity will be between you and the third party provider for such activity; the Company neither owns nor operates the third party supplier; and accordingly, you agree to seek remedies directly and only against the third party supplier and not hold the Company responsible for their acts or omissions.

Choice of Law; Resolution of Disputes
Any controversy or claim arising out of or relating to this Agreement, whether brought in rem or in person am, including without limitation any claim related to bodily injury, property damage or death, shall be settled by binding arbitration in the State of Louisiana, USA in accordance with the rules of the American Arbitration Association then existing, and judgment on the arbitration award may be entered in any court having jurisdiction over the subject matter of the controversy. This agreement to arbitrate does not waive or modify the liability release contained in this document. Such proceedings will be governed by substantive Louisiana law. The dispute will be resolved by a single arbitrator who must be a lawyer admitted to practice in the courts of at least one state in the United States. He must have a minimum of fifteen years' experience in civil litigation. The arbitrator in this case will be selected by the American Arbitration Association. Each party to the dispute shall have the right on a single occasion to veto the designation of an arbitrator so selected. The parties waive the right to rely on any state law or statute that creates an exception to enforcement of the requirement that disputes be resolved pursuant to arbitration. This is in the manner set forth in this provision.
