I (the 'Contract Signee", "You", "My", "Me", "I") agree to be bound by the terms and conditions set forth herein. By signing this Consent & Liability Waiver (the “Agreement”), I hereby waive and release the Elegant Travel (the "Company") and its Administration Elegant Travel, Janice Neal, and its associates (collectively “Releasees”) from any and all liability arising out of my participation in the trip . I further agree to indemnify Releasees against any and third party claims resulting from my participation in the trip , including costs and reasonable attorney’s fees associated with enforcing any indemnification rights under this Agreement. I understand there is a non- refundable, non-transferrable deposit, and if applicable, a non- refundable, non-transferrable service fee in the cost . This Agreement constitutes the sole and entire agreement between the Company and me with respect to the trip , and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral. If any term or provision of this Agreement is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of this Agreement or invalidate or render unenforceable such term or provision in any other jurisdiction. All matters arising out of or relating to this Agreement shall be governed by and construed in accordance with the internal laws of the State of California without giving effect to any choice or conflict of law provision or rule. Any claim or cause of action arising under this Agreement may be brought only in the federal and state courts located in Los Angeles, California and I hereby consent to the exclusive jurisdiction of such courts.

The Protection Program/Plan is totally independent of Elegant Travel. Should You wish to take advantage of your Protection Program/Plan, You must contact the supplier directly. Elegant Travel, nor its affiliates, are responsible for placing a claim on your behalf, initiating or completing a claim or refund process, or representing You in anyway, regarding your Protection Program/Plan.
I have read and understand all cancellation charges and change fees related to the travel arrangements, and that I may not be entitled to a full refund should my travel plans change. In case of cancelation of non-refundable airline tickets or other arrangements, I agree to pay all applicable penalties according to the travel suppliers' rules & Elegant Travel' rules.
By signing below, I acknowledge that I have read, understand, and agree to the travel protection contract.
UNLAWFUL ACTIVITY
ELEGANT TRAVEL WILL ASSUME NO RESPONSIBILITY FOR PASSENGERS ENGAGING IN OR ALLEGED TO HAVE ENGAGED IN UNLAWFUL ACTIVITIES DURING THIS TRIP. IF APPREHENDED BY AUTHORITIES, NOTIFYING PERSONS LISTED ON AN EMERGENCY FORM WILL BE THE EXTENT OF OUR INVOLVEMENT. NO REPRESENTATIVES OF ELEGANT TRAVEL WILL APPEAR AT ANY POLICE STATIONS OR SCENE OF ANY SUCH ACTIVITY.
