This agreement is between you the [“User” or “you”] and JOURNET TRAVEL & CRUISE VACATIONS, LLC. (Collectively, “JTC VACATIONS”, “we”, “our” and “us”.)
JTC VACATIONS, reserves the right to update the Terms and Conditions at any time without notice to the user.
WHEN YOU USE THE SERVICES IN ANY WAY, AND BY PURCHASING ATTENDANCE FOR A GROUP TRIP OR PRIVATE TRIP PLANNING SERVICE, YOU: (A) ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS AND CONDITIONS OF SERVICE AND ALL OBLIGATIONS AND RULES THAT MAY BE INCLUDED WITHIN THESE TERMS AND CONDITIONS IN THEIR ENTIRETY; (B) AGREE TO BE BOUND BY THE TERMS; AND (C) ARE AUTHORIZED AND ABLE TO ACCEPT THESE TERMS.
If you do not agree with all of the provisions of this agreement, you cannot use the Services. To remove any doubt, in the event of any conflict or discrepancy between these Terms and conditions and any other provisions and/or terms and/or otherwise between JTC VACATIONS and you, the provisions and the terms of these Terms of Use will prevail. 1. USAGE
You will use this site in a manner consistent with any, and all, applicable laws, legislation, rules and regulations. If you violate any restrictions in these terms, you agree to indemnify JOURNET TRAVEL & CRUISE VACATIONS, LLC for any losses, costs or damages, including reasonable legal fees, incurred by JOURNET TRAVEL & CRUISE VACATIONS, LLC in relation to, or arising out of, such a breach.
2. PLAN YOUR TRIPS
You can plan your trips and travel later with ease. What is required is for you to indicate your interest on any of the group travel trips displayed by registering and submitting the required deposit. You also have the option to customize your own special group travel with your own friends and we will facilitate the planning for you.

CHANGES TO TERMS OF USE AND SERVICES. THESE TERMS MAY BE AMENDED OR CHANGED BY US IN OUR DISCRETION, WITH OR WITHOUT NOTICE, AT ANY TIME. We indicate at the top of the page when these Terms were last updated. Your continued access or use of the Website or any other Services following such changes will be deemed acceptance of such changes. In addition, we reserve the right to modify or cease providing all or any portion of the Services at any time, with or without notice. ACCESSING OUR WEBSITEWhile we endeavor to ensure the Website is available 24 hours a day, we do not guarantee that our Website, or any content on it, will always be available or be uninterrupted. We may suspend, withdraw, discontinue or change all or part of our website without notice. We will not be liable to you if for any reason our website is unavailable at any time or for any period. You are also responsible for ensuring that all persons who access our website through your internet connection are aware of these terms of use and other applicable terms and conditions and that they comply with them. 6. ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATIONWe reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.The Travel Coordinator reserves the right to make changes to any and all aspects of travel arrangements (which may include without limitation changes to the types and/or timing of activities available during the trip, the hosts, items and/or services included with the travel arrangements, accommodations, the itinerary, and/or the nature of the activities) if, in The Travel Coordinator’s sole discretion, deems it necessary to do so due for conditions that may be hazardous, dangerous, or otherwise adverse or threatening, if an act or omission of a third party prevents any such aspects of the travel meet up or any portion of the travel meet up, or for any other reason considered commercially necessary by the Travel Coordinator. You will not be eligible for any refunds of any amounts based on any such changes to the travel arrangements. All displayed accommodation is to be reserved and only confirmed on the basis that all trip slots sell out. Should this not be the case, the Travel Coordinator reserves the right to adjust the provisionally reserved accommodation to an alternative suitable option that is suitable for the final size of the group attendees.The itinerary is a general guide to the tour and region and any mention of specific destinations is not a guarantee that they will be visited or encountered - therefore the Travel Coordinator may make improvements that stem from weather changes, local factors, past travelers' comments, and research, to name a few examples. As a participant, you also expressly acknowledge these terms and also assume responsibility for inherent risks associated with physical activities you participate in. 7. PASSPORTS, VISAS AND ENTRY REQUIREMENTSYou are responsible for obtaining and maintaining a valid passport and all appropriate visas, permits, certificates, and/or other required documentation (“Documentation”) for the countries, jurisdictions, parks, areas, etc. you will visit during the travel destination. JOURNET TRAVEL & CRUISE VACATIONS, LLC is not responsible if you are denied entry or exit to/from any country or location due to a lack of valid Documentation.8. ALL TRAVEL CONTENT (INCLUDING IMAGES & VIDEOS)The Client using JTC VACATIONS services agrees that while participating in any getaway or trip, product images, photos or videos may be taken by JOURNET TRAVEL & CRUISE VACATIONS, LLC, other Clients and/or JTC VACATION’s representatives or Experience Providers that may contain or feature the Client in part or in whole. The Client acknowledges that they consent to any such pictures being taken and agree that hereby grants a perpetual, royalty-free, worldwide, irrevocable license to JOURNET TRAVEL & CRUISE VACATIONS, LLC, its affiliates and assigns, to reproduce for any purpose whatsoever (including marketing and promotions), in any medium whatsoever, whether currently known or hereinafter devised, without any further obligation to the Client or compensation payable to such Client.PHOTOS, VIDEO, OTHER MEDIA RELEASE By and in consideration for being permitted to participate in the trip, you irrevocably grant JOURNET TRAVEL & CRUISE VACATIONS, LLC and its agents and representatives all rights to use, reproduce, display, exhibit, publish, distribute, and/or produce derivative works based on your image, likeness, and voice as recorded by any camera and/or on any video, audio, and/or other media (collectively, “Likeness”) worldwide, in perpetuity, without compensation, payment, or other additional consideration of any kind, for any lawful purpose, including without limitation for marketing and trade purposes.By using JTC VACATIONS services, you agree that your Likeness may be used, reproduced, displayed, exhibited, published, edited, or distributed by JOURNET TRAVEL & CRUISE VACATIONS, LLC at its sole discretion. You understand that your Likeness may be used in various publications, promotional or marketing materials, and/or social media, unrestricted by time or geographic area and consent to such uses. You further understand and grant permission to JOURNET TRAVEL & CRUISE VACATIONS, LLC and its agents and representatives to electronically display any Likeness of you on the Internet or in other public settings. You hereby waive the right to inspect or approve any and all materials in which your Likeness may appear. You further waive any right to royalties or other compensation arising or related to the use of your Likeness. This release applies to all photographic, audio, and/or video recordings collected as part of, in connection with, and/or during the trip participated in (by JOURNET TRAVEL & CRUISE VACATIONS, LLC or any third party). There is no time limit on the validity of this release nor is there any geographic limitation on where materials including your Likeness may be used, reproduced, displayed, exhibited, published, and/or distributed by or on behalf of Company.9. PAYMENTSManaging your PaymentsYou can secure any trip by paying a deposit. The remaining balance can be paid across a period of monthly instalments. JTC VACATIONS is happy to create a payment plan that works around your preferred dates and months (service charge and administration fee applies). Alternatively, you also have the option to make a one-time interest fee payment.
Attendees must adhere to the payment plan dates set. If JOURNET TRAVEL & CRUISE VACATIONS, LLC does not receive your payments on or before the payment due date, we have the right to cancel your reservation and you will forfeit your deposit and the amount paid thus far.
Late Payment: Payments received 7 days after due date will be assessed a $15 late fee that will be added to invoice. Failure to make a payment after 8 days of the agreed upon date is a breach of contract and can / will result in the cancellation of your experience. If you are having trouble with making a payment you must email info@JTCvacations.com to notify the company and to avoid a late fee. JOURNET TRAVEL & CRUISE VACATIONS, LLC maintains the right to assign your spot to the next eligible individual on the wait list due to lack of payment /s.
Payment Processing
By providing a card payment or other payment method that we accept, you represent and warrant that you are authorized to use the designated payment method and that you authorize us (or our third party payment processor) to charge your payment method for all charges you incur for the purchase of any Subscriptions or other Products (including any applicable taxes and other charges). You are responsible for, and agree to pay, all such charges. If we or our third party payment processor cannot obtain authorization for charges to your payment method or if any amounts you authorize us to charge to your payment method are reversed or charged back for any reason, we may, at our option, in addition to any other remedies: cancel or suspend any of your subscribed trips, make second and/or subsequent attempts to charge your payment method, and/or use any other lawful means to collect payment on any outstanding amounts due to us. You will remain responsible to pay all applicable charges for all Orders.
Cancellations
a) Any cancellation of a booking by an individual must be delivered in writing via email to Cancellations@JTCvacations.com and be acknowledged by The Trip Planner in writing to
b) All trip deposits are non-refundable. You may request to have your payments applied to another trip if within cancellation window.
In the event of any change or cancellation under this , you acknowledge that you will have no right to a refund of payment (whether in whole or in part, except as expressly provided in and no right to claim compensation for any Liabilities incurred and/or sustained by virtue of any change or cancellation). Our vendor (s) for example, accommodation, transport and excursion companies, etc. require upfront commitments that must be adhered to the non-refundable policy.

When the travel arrangement package is offered to you (the individual) we have to ensure, through good-faith payments, that you will attend the group trip. Your group trip also includes other attendees, who are still scheduled to travel ahead, therefore should not be affected as a result of your own travel changes.
Our policy also applies to private trips however travelers can amend dates up to 12 weeks before initial travel dates.
Please note that all online payments will incur a $3 transaction website transaction fee.
10. DISCLAIMER OF WARRANTIES & LIABILITY
PLEASE NOTE THAT THE SERVICE WE PROVIDE TO USERS ARE PROVIDED ON AN ‘AS IS’ and ‘AVAILABLE BASIS’.
To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to our Website or any content on it, whether expressed or implied. We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence) breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with use of, or inability to use, our website and information.
We will not be liable for:
- Loss of profits, sales, business or revenue;
- Business interruption; or
- Any indirect or consequential loss or damage.
We will not be liable for any loss or damage caused by a web virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our Website or to you downloading any content on it, or on any website linked to it.We assume no responsibility for the content of websites linked on our Website. Such links should not be interpreted as endorsement by us of those linked websites. We will not be liable for any loss or damage that may arise from your use of them.11. INDEMNIFICATION.To the fullest extent permitted by applicable law, you agree to indemnify, defend and hold harmless JTC VACATIONS, and our respective past, present and future employees, officers, directors, contractors, consultants, equity holders, suppliers, vendors, service providers, parent companies, subsidiaries, affiliates, agents, representatives, predecessors, successors and assigns (individually and collectively, the “JTC VACATIONS Parties”), from and against all actual or alleged JTC VACATIONS Party or third party claims, damages, awards, judgments, losses, liabilities, obligations, penalties, interest, fees, expenses (including, without limitation, attorneys’ fees and expenses) and costs (including, without limitation, court costs, costs of settlement and costs of pursuing indemnification and insurance), of every kind and nature whatsoever, whether known or unknown, foreseen or unforeseen, matured or unmatured, or suspected or unsuspected, in law or equity, whether in tort, contract or otherwise (collectively, “Claims”), including, but not limited to, damages to property or personal injury, that are caused by, arise out of or are related to (a) your use or misuse of the Sites, Content or Products, (b) any Feedback you provide, (c) your violation of these Terms, (d) your violation of the rights of another, (e) any third party’s use or misuse of the Sites or Products provided to you and (f) any User Content you create, post, share or store on or through the Sites or our pages or feeds on third party social media platforms. You agree to promptly notify JTC VACATIONS of any third-party Claims and cooperate with the JTC VACATIONS Parties in defending such Claims. You further agree that the JTC VACATIONS Parties shall have control of the defense or settlement of any third-party Claims. This indemnity is in addition to, and not in lieu of, any other indemnities set forth in a written agreement between you and JTC VACATIONS.12. UNAUTHORIZED USEYou are responsible for configuring your information technology, computer programs and platform in order to access our Website. You should use your own virus protection software.You are prohibited from posting or transmitting to or from the Website any material:
- that is threatening, defamatory, obscene, indecent, seditious, offensive, pornographic, abusive, liable to incite racial hatred, discriminatory, menacing, scandalous, inflammatory, blasphemous, in breach of confidence or in breach of privacy; or
- for which you have not obtained all necessary licenses and/or approvals; or
