Terms & Conditions

I am excited to help you with your travel. The following terms & conditions (the "Agreement") describe what you can expect from us. The terms "we", "us", and "our" refer to Kathryn Rosser and the term "you" refers to the individual who signs this agreement.

 

Terms & Conditions

1. Travelmation, through and in conjunction with the Travelmation Independent Travel Consultant (“ITC”) selected by Client, acts as a sales agent for Travel Suppliers. A “Travel Supplier” is an airline, hotel, vehicle rental company, tour operator, cruise line, or other supplier of travel services, with which you have booked travel through Travelmation as part of your booking/itinerary. Reference to Travelmation in these Terms & Conditions includes Travelmation, LLC, and its members, managers, officers, employees, agents, parents, subsidiaries, and affiliates. 2. Client is responsible for reviewing and understanding the terms and details of the confirmation of booking provided to Client by your ITC with respect to your travel and itinerary – including: (A) confirming that the dates and times of travel are correctly stated; (B) knowing and complying with payment due dates; and (C) knowing and understanding any applicable restrictions and/or penalties resulting from any cancellation or modification of a booking/itinerary (in whole or in part). Please review these details carefully! Client is also responsible to understand and comply with all requirements which could impact the Client’s ability to travel on the Client’s booking/itinerary – including, without limitation, any requirements relating to passports or other required identification, visas, vaccinations, immunizations, medical authorizations, or permissions for minors to travel. Client understands and acknowledge that travel to many parts of the world may involve the risk of a variety of hazards to health and/or safety, including but not limited to disease, crime, terrorism, and warfare. Because each Client’s risk tolerance is different, it is incumbent on Client to investigate and understand the risks inherent with travel to any area of the world, including any prevailing travel bans, restrictions, or warnings, and to make the decision as to whether the Client desires to undertake travel. Resources: Centers for Disease Control, www.cdc.gov/travel; United States Department of State, www.travel.state.gov. Travelmation strongly recommends that Client purchase trip cancellation and travel accident insurance. Client can inquire with ITC about the availability of such insurance. However, Travelmation and ITC are not insurance agents, and Travelmation and ITC make no representations or promises as to the availability, terms, or benefits of any such insurance, and Client should contact the company issuing any such insurance for any questions relating to the terms, benefit, conditions, or exclusions of such insurance. Failure of Client to review, understand, confirm, know, investigate, and/or comply in the areas listed in this paragraph 2 may result in Client’s loss of the ability to travel on the booking/itinerary (in whole or in part), or other losses, costs, damages, expenses, or injuries to Client, and Client expressly releases Travelmation and ITC from any claims or causes of action for losses, costs, damages, expenses, or injuries in any way arising out of the failure of Client to review, understand, confirm, know, investigate, and/or comply in these areas listed in this paragraph 2. Further, Client releases Travelmation and ITC from any claims or causes of action arising out of or resulting from: (A) the failure of Client to procure travel insurance or any denial (complete or in part) of any claim made under travel insurance; (B) any injury, disease, sickness, death, or loss of property sustained by Client while traveling. 3. Client acknowledges and agrees that neither Travelmation nor ITC shall be responsible or liable for - and Client hereby releases Travelmation and ITC from any claims or causes of action for – any loss, cost, expense, refund, damage, and/or injury (of any kind whatsoever) in any way arising out of or resulting from: (A) the acts or omissions (including negligence, gross negligence, or intentional misconduct) of any Travel Supplier; (B) bankruptcy, cessation of business, or default for any reason by a Travel Supplier; (C) failure of a Travel Supplier to provide services as advertised/promised, or to adhere to published schedules or itineraries, as well as any resulting delay or inconvenience; (D) any increase in price before or after booking by a Travel Supplier; (E) any defect in or failure of any vehicle, craft, equipment, or instrumentality owned, operated, or otherwise used or provided by a Travel Supplier; or (F) any act, error, or omission by or on the part of any other person or entity, other than Travelmation. Travelmation and ITC will work with Client should such circumstances arise, always striving for the highest satisfaction of the Client. 4. Client understands, acknowledges, and agrees that Client will make payment directly to the Travel Supplier, and that payment will not be made to, collected by, or held by Travelmation (or any account or merchant service of Travelmation). Travelmation reserves the right to grant exceptions to this requirement, but only if expressly agreed to in writing in advance by Travelmation (and in no event will Travelmation be liable or otherwise responsible for money paid by Client to any person or entity other than Travelmation). 5. By clicking “I agree to the Travelmation terms & conditions” below (or otherwise indicating consent to these terms and conditions), the Client agrees to comply with and be bound by these Terms and Conditions effective as to all bookings made after such consent is expressed. Travelmation reserves the right to amend or replace these Terms and Conditions at any time, in Travelmation’s sole discretion, with such amendment or replacement to apply prospectively to travel bookings made after the effective date of such amendment or replacement. Client acknowledges and understands that each Travel Supplier may have its own terms and conditions pertaining to a booking (please reference your booking confirmation). 6. By cancelling a vacation after planning and booking, I understand I am subject to a  cancellation fees by both the vacation supplier and agent. The agent has the authority to charge up to $200 cancellation fee.

Passport vs Birth Certificate for cruises: 

By signing this document, all members of my travel party using a birth certificate to board our ship understand that we must bring a CERTIFIED copy of our birth certificate for a CLOSED LOOP cruise with us to our embarkation port in the United States and our unexpired driver's license to the port to board the ship and neither document can be a paper copy. If we do not bring these documents, we risk being denied boarding and Brittany Stewart of Travelmation LLC is not responsible for any penalties we incur. Failure to bring these documents may result in FULL LOSS of our trip. 
 
By signing this document, all members of my travel party understand that a CLOSED LOOP cruise is a cruise that starts and ends at the same US based port. We cannot use a birth certificate for an European cruise or a cruise that starts/end in a different port. We also understand that Virgin Voyages will not accept certified birth certificates and we must have a passport regardless, if applicable. 
 
By signing this document, all members of my travel party using a birth certificate to board our ship also understand that if our driver's license name does not match our birth certificate that I also need to provide CERTIFIED documentation of the name change, such as a marriage certificate or divorce decree (examples - not  a full comprehensive list) when we arrive at the port and we must bring these documents to the port. We understand and have checked the cruise lines policies for exactly what documentation we need to bring to the port to board the ship.
 
By signing this document, all members of my travel party realize that Kathryn Rosser of Travelmation LLC always recommends having a passport to sail with a cruise line and though the cruise lines allow it, sailing with a birth certificate is not recommended by Kathryn Rosser of Travelmation LLC. If an emergency happens in another country while on our cruise and/or we miss re-boarding the ship, we realize that we will have to contact the US Embassy to help us leave the country and not Kathryn Rosser of Travelmation LLC.
 
By signing this document, I certify that all members of my travel party have their passport in hand or are in the process of applying/renewing their passports. All passports in our possession are valid for 6 months post our travel return date. If our passports are not in our possession,Kathryn Rosser of Travelmation LLC is not liable for any penalties we may incur from our passports not arriving in time. Kathryn Rosser of Travelmation LLC is not able to help us obtain our passports quicker and we must contact our congressmen and local passport office for assistance.
 
I certify that I have gone over these terms and conditions with all members of my travel party OR I speak on their behalf as a legal guardian.
