Beacon Pointe Antarctica Expedition - Terms & Conditions

Important Notice: This document outlines the terms and conditions for participants in the Beacon Pointe Antarctica Expedition, organized and facilitated by Geo Travel Co. Please read these terms carefully before signing. Your signature indicates your full understanding and acceptance of these terms, including the limitations of liability of Geo Travel Co.

1. Nature of Services Provided by Geo Travel Co.

Geo Travel Co. (hereinafter "the Agency") acts solely as a retail travel agent and an intermediary for the sale of travel products and services, including but not limited to cruise accommodations, flights, ground transportation, and ancillary services. The Agency's role is limited to facilitating bookings on behalf of the participant(s) (hereinafter "Client" or "Clients") with third-party suppliers, primarily Atlas Ocean Voyages (hereinafter "the Cruise Line"), and other relevant providers (e.g., airlines, hotels, transfer companies).

The Agency is NOT the direct provider of the travel services. All travel services are provided by the Cruise Line and other third-party suppliers, subject to their own terms and conditions, contracts of carriage, tariffs, and rules.Clients acknowledge that they are bound by the terms and conditions of these third-party suppliers, in addition to the terms set forth herein.

2. Limitation of Liability of Geo Travel Co.

CLIENTS EXPRESSLY AGREE THAT GEO TRAVEL CO., ITS OWNERS, EMPLOYEES, AND AGENTS SHALL NOT BE HELD LIABLE FOR ANY LOSS, INJURY, DAMAGE, DELAY, ACCIDENT, OR IRREGULARITY THAT MAY BE OCCASIONED BY REASON OF ANY DEFECT IN ANY VEHICLE, OR THROUGH THE ACT OR DEFAULT OF ANY COMPANY OR PERSON ENGAGED IN CARRYING OUT THE ARRANGEMENTS OF THE EXPEDITION, OR IN CONNECTION THEREWITH, INCLUDING, BUT NOT LIMITED TO:

  • Acts or omissions of the Cruise Line or any other third-party supplier: This includes any failures, breaches of contract, negligence, or other actions or inactions by Atlas Ocean Voyages, airlines, hotels, ground operators, or any other service providers involved in the expedition.

  • Changes to Itinerary or Services: Any changes, cancellations, delays, or re-routings of the cruise itinerary, transportation, accommodations, or other services caused by the Cruise Line, third-party suppliers, weather conditions, governmental actions, force majeure events, or any other circumstances beyond the Agency's direct control.

  • Personal Injury, Illness, or Death: Any bodily injury, illness, death, emotional distress, or property damage sustained by the Client or their companions during the expedition, regardless of cause.

  • Loss or Damage to Property: Loss, theft, damage, or destruction of personal belongings, luggage, or any other property belonging to the Client.

  • Financial Insolvency: The financial default or insolvency of any third-party supplier, including the Cruise Line.

  • Errors in Booking Information: Any errors or omissions in booking information provided by the Client that result in issues with reservations or services.

  • Client Responsibility: The Agency shall not be responsible for any losses incurred due to the Client's failure to obtain necessary travel documents, comply with health requirements, or adhere to the terms and conditions of the Cruise Line or other suppliers.

The Agency's sole responsibility is to act as an intermediary in booking travel services. Any recourse for issues arising from the services themselves must be directed to the responsible third-party supplier.

3. Payment Terms and Authorization

By signing below, I authorize Geo Travel Co. to charge the credit card provided herein for all payments related to my booking(s) on the Beacon Pointe Antarctica Expedition.

Deposits:

  • Deposits are due at the time of booking in order to hold a stateroom.

  • A courtesy option may be held for 72 hours by request if booked 60 days or more prior to departure.

  • If booked 60 days or less prior to sailing, a 24-hour option will apply, with full payment due immediately thereafter.

  • Deposit amounts are as follows:

    • $1000 per person for staterooms (AO-E1 categories).

    • 25% per person for suites (NS, JS, DS).

  • If a deposit is not made by the third day (or within 24 hours for short-term options), the option will expire, and the stateroom will go back into general inventory.

  • Staterooms will not be taken out of inventory or held for any group without a full deposit payment and guest names and booking information as it appears on their passports.

Final Payment:

  • For all berths held in this group, final payment is due on or before 120 days prior to departure.

  • Please note: final payment not received by the due date may result in cancellation of all or part of the group booking.

  • Any staterooms or suites allocated to the group after the final payment date must be paid in full at the time of booking.

General Payment Clause:

  • Once a payment (deposit or final) is made, the booking is still subject to all group terms and conditions within this agreement, including, but not limited to, cancellation terms, name changes, administration fees for changes within a given time period, etc.

4. Cancellation Schedule and Terms

The following cancellation charges (cruise cancellation fees per guest) will be assessed for all cancellations received from the booking date until the scheduled date of departure:

  • Deposit - 121 Days Prior to Departure: $250 Per Person Administration Fee

  • 120 to 91 Days Prior to Departure: 25% Cancellation Fee

  • 90 to 76 Days Prior to Departure: 50% Cancellation Fee

  • 75 to 46 Days Prior to Departure: 75% Cancellation Fee

  • 45 to 0 days prior to departure: 100% cancellation fee

100% cancellation fee will be imposed for non-appearance at the port of cruise embarkation at the scheduled time of departure.

5. Name Change Policy

  • Deposit to 121 days prior to sailing: A $50.00 name change fee will apply. One name change per booking will be allowed.

  • After Final Payment (120 Days) - Up to 61 Days Prior to Departure: A $250 Change Fee Per Person will apply.

  • Changing both guests’ names on a booking is considered a full cancellation. Such requests will be treated as a cancelled booking, and full cancellation terms (as per Section 4) will apply.

  • 60 - 0 Days Prior to Departure: No Name Changes allowed. Any change at this point is considered a cancellation, and full cancellation penalties (100% fee) will apply.

6. Ancillary Cancellation Terms

  • Pre/Post Hotels and Transfers: 100% Cancellation within 60 days of departure. No name changes allowed after 60 days.

  • Land Programs: 100% Cancellation within 90 days of departure. No name changes allowed after 90 days.

  • Travel Insurance: Cancellation allowed up to 120 days prior to departure.

  • Shore Excursions: Cancellations allowed up to 7 days prior to departure.

7. Optional Shore Excursions/Expedition Activities (Antarctica)

  • Optional shore excursions may be pre-booked or reserved (depending on the itinerary) up to 6 months prior to sailing (or sooner if the tour options are published and available).

  • Shore excursions for Epicurean and Cultural Expeditions may be booked and paid for in advance.

  • Polar Expedition activities (Antarctica) may be reserved in advance, but guests will not be charged until they are onboard. Charges will appear on the guests' onboard statements if they participate.

  • All premium activities for Antarctica sailings will be deployed and ready to book 120 days prior to sailing. These optional excursions are first come, first served.

  • The Agency (Geo Travel Co.) and the Cruise Line's groups department are NOT responsible for pre-booking or keeping track of activities for any individual group members. It is solely the travel advisor's or group leader's responsibility to pre-book/reserve all activities for themselves and their invited guests.

Specific Optional Excursions for Antarctica Expeditions (Weather Permitting, Per Person Rates):

  • ANT301 Sea Kayaking: $200 per outing, per person.

  • ANT304 Camping: $750 per outing, per person.

8. Travel Insurance Highly Recommended

Clients are strongly advised to purchase comprehensive travel insurance at the time of booking to protect against unforeseen circumstances including, but not limited to, trip cancellation, interruption, medical emergencies, evacuation, baggage loss, and itinerary changes. Travel Insurance may be purchased up until Final Payment (120 days prior to departure). Geo Travel Co. shall not be responsible for any financial loss incurred by Clients who decline or fail to purchase adequate travel insurance.

9. Governing Law and Dispute Resolution

These terms and conditions shall be governed by and construed in accordance with the laws of [Your State, e.g., Utah], without regard to its conflict of laws principles. Any disputes arising out of or in connection with this agreement shall be resolved exclusively in the state or federal courts located in [Your County/City, e.g., Salt Lake County, Utah].

10. Acknowledgment and Acceptance

I/We, the undersigned Client(s), acknowledge that I/we have read, understood, and agree to all the terms and conditions set forth above, including the limitations of liability of Geo Travel Co. I/We understand that Geo Travel Co. acts as an agent only and is not responsible for the acts or omissions of third-party suppliers.
