CONSUMER AGREEMENT

These terms and conditions (the "Agreement") describe what you are legally entitled to expect from us when you purchase travel-related services through us, in addition to your obligations as a customer. The terms "we", "us", "organization", and "our" refer to Kbyeee Getaways.  The term "you" refers to the customer visiting our website, booking a reservation through us, or otherwise using our services. By moving forward with our services, you are giving full consent for AGENCY _NAME to service you.

1. OUR AGREEMENT WITH YOU

PRODUCTS AND SUPPLIERS

We sell a variety of travel related products from different Suppliers and service providers ("Suppliers"). Each Supplier has its own terms and conditions that are applicable to your particular arrangements in addition to our general terms and conditions, and you should make sure you understand them.

Kbyeee Getaways is acting as a "Booking Agent" for products and services that are not directly supplied by us (e.g., air carriage and ground transportation, hotel accommodations, meals, tours, cruises, etc.). We are not a co-vendor of such products and services. You will be entering into a separate contract with such Suppliers in connection with such products and services.

COMMUNICATING WITH YOU

We will make every reasonable effort to communicate with you via the phone numbers, email addresses, mailing addresses, or other means as provided.

2. YOUR AGREEMENT WITH US

Any disability requiring special attention must be reported to Kbyeee Getaways at the time the reservation is made. Kbyeee Getaways will make reasonable attempts to accommodate the special needs of travelers, but are not responsible in the event it is unable to do so nor is it responsible for any denial of services by carriers, hotels, restaurants, or other independent suppliers.

DEPOSITS, PAYMENTS, AND REFUNDS

DEPOSITS

You understand a deposit must be made within 45 days of accepting your proposal. 

A deposit, as indicated in your proposal, along with a completed booking form is required for all new reservations with Kbyeee Getaways. This deposit holds your reservation at the agreed upon price at the time of deposit payment. It is your responsibility to ensure that all the details of your trip (name, birthdate, dates, location, etc.) are correct and to bring to our attention any errors or discrepancies within 24 hours of sending a deposit payment. 

Any packages, whether they are custom packages or social media packages, that fall within 30-45 days are considered last minute. These last minute trips are not eligible fore deposit holds and full payment will be required. Payment plans are not available for these last minute getaways, however “Buy Now, Pay Later” options may be available .

PAYMENTS

Only credit/debit card payments are accepted. We do not accept cash, CashApp, Zelle, Paypal, Venmo, ApplePay, GooglePay, SamsungPay, checks, or money orders. All travelers are required to complete an online credit card authorization form and no payments will be processed unless the form is completed. Payments are only accepted online. 

Final payment dates are clearly noted on the invoice and/or group page of your group (if applicable) as well as listed in your monthly email reminders.

Invoices can be setup with two (2) payments, deposit and final payment, or with monthly payments. 

• If you choose to not have monthly payments set up and want to pay on your own schedule, you will receive an email monthly on the same day each month as a friendly payment reminder.
• If you choose to set up a payment plan through Kbyeee Getaways, you will receive an email four (4) days prior to each payment due date as a friendly reminder.
• If you choose a 3rd party service to utilize for payments, Kbyeee Getaways will ensure to send a friendly reminder email four (4) days prior to each payment due date. 
• If you are on a payment plan NOT provided by Kbyeee Getaways, ie by a 3rd party outside of this organization, late fees will vary by vendor and will be provided to travelers upon selection of payment plan. It is your responsibility to ensure 3rd party payments are paid on time.
  
  

You must contact Kbyeee Getaways at least seven (7) days prior to final payment if there will be a delay in making the final payment. Final payment dates can be extended up to three (3) days and come with a fee of $50 that must be paid before Kbyeee Getaways will reach out to the supplier for an extension. This is in addition to any fees charged by the supplier.

Suppliers have specific time frames for payment due dates. Missing the final payment could result in automatic cancellation of your reservation and forfeiture of all previous payments. Kbyeee Getaways and/or the suppliers have the right to cancel your reservation. Any previous payments will be forfeited, unless travel insurance is purchased. Kbyeee Getaways will not be responsible for lost/canceled reservations.

As we are acting as your Booking Agent, any supplemental increases in price due to fuel costs, taxes, fees, and currency exchange rates will be borne solely by the consumer and thus we will pass on any such increase to you as we become aware of such increase. Subsequently, you are not guaranteed a lower price if at any time prior to your trip the price decreases.

REFUND POLICY

• All travel proposal fee payments are non-refundable.
• All deposits are non-refundable.
• After a deposit has been made, any refund of payments made towards the elected getaway are subject to the hotel/flight/transfer company refund policies. 
• Any refundable portions of payments made towards your trip will be refunded less any fees.
  • Fees include processing fees, supplier fees, and Kbyeee Getaways booking fees.

TRAVEL INSURANCE

Travel insurance is a vital part of your arrangements. It covers any unforeseen circumstance that may occur before or during the trip. We strongly recommend that you purchase adequate insurance for the duration of your travel.  

There are two main options for travel insurance: Basic and Cancel For Any Reason (CFAR).

Basic insurance can be purchased up until 24hrs before your trip. 

CFAR insurance can only be purchased within 14 days of making an initial payment towards the trip being covered. This is normally a deposit, but could also be a flight or excursion if those are being covered under the insurance and purchased prior to making a deposit. 

For stand alone travel insurance quotes, you may choose to purchase through our external link or have Kbyeee Getaways generate the quote for you.

All travel insurance quotes generated by Kbyeee Getaways will include Cancel for Any Reason travel insurance and will cover the duration of your trip if you are within the time period to qualify for the add-on. If you only want basic insurance, this must be requested.

You understand Kbyeee Getaways will not be liable in any regard for failure to adequately insure yourself. You agree to indemnify Kbyeee Getaways, its administration, personnel, and your Travel Advisor from responsibility for any consequences, both known and unknown, resulting from your not adequately insuring yourself and your trip. You understand Kbyeee Getaways is not required to assist you in any way if your trip is cancelled or delayed for any uncovered reason.

You understand that some coverages are considered add-ons and are not included in basic travel insurance. You understand these add-ons will increase the costs of your travel insurance should you decide they are necessary.

You understand travel insurance payments are non-refundable. Even if you file an insurance claim for your getaway, you will not receive a refund for the amount you paid for the travel insurance.

TRAVEL CHANGES AND CANCELLATIONS

CHANGES

Where a change to your travel arrangements requested by you is permitted and possible, our standard service fees, a minimum of $35 per change, will apply, in addition to any additional Supplier charges.

Please note that all reservation changes are subject to availability and the terms and conditions of the product purchased.

Changes to name details are not allowed by many airlines and other Suppliers. While we will make every possible attempt to make such a change if necessary, please bear in mind that most airlines and suppliers treat a name change as a cancellation, to which standard conditions and charges would apply.

In situations where pricing is dependent on the number of travelers for example villa reservations, a cancellation by one or more individuals will cause the total reservation to be re-booked at the current rate. It is the responsibility of the remaining travelers within the same reservations to ensure all payments are made.

We will ensure that you are promptly notified of any significant changes once we become aware of such change if there is time before your departure, but we accept no liability for any changes or costs incurred that may result.

Subject to the supplier’s terms and conditions, you will then have the choice of accepting the change of arrangements, accepting an offer of alternative travel arrangements if one is made available by the Supplier, or canceling your booked arrangements and receiving a credit.

If you have booked a flight and we are alerted to a significant schedule change by your airline before you leave the United States, we will contact you by email or telephone to advise you of this. Please ensure that you have given your contact email address and telephone number to us and that you regularly check for messages before you leave. We have no control over airline schedule changes and accept no liability for costs which may arise as a result of such changes.

After you have left the US, it is your responsibility to check with the airline that any onward flights you have confirmed are operating as booked. 

Flights must be taken in the sequence they appear on your ticket or e-ticket confirmation. If you plan not to take a flight as it is booked, please contact the airline as far in advance as possible to discuss your options. If you do not check in on time for a confirmed reservation, the airline may register you as a ‘no-show’, which could result in extra charges and/or your whole flight itinerary being cancelled and/or render your ticket void.

CANCELLATIONS

Please refer to our refund policy section if you are cancelling your getaway. If the reason for your cancellation is covered under the terms of your travel insurance policy, you may be able to reclaim your cancellation charges through your insurer.

All cancellations must be made in writing and emailed to brandi@kbyeeegetaways.com. There is a required post booking form and non-refundable cancellation fee of $35 per person. Both the form and fee must be received before the cancellation process can begin.

AGENCY ADVERTISED GETAWAYS AND HOSTED GETAWAYS

You agree and acknowledge that payment for individual rooms is the sole responsibility of individual guests. No space will be held until the required deposit is submitted to Kbyeee Getaways. 

If the individual guests do not make final payments on time, their individual travel arrangements will be cancelled, and and any prior payments will be forfeited. Access to booked travel services will also be denied, subject to the applicable local laws outlined in this agreement.  If the guest was sharing a room, the room will be re-priced based on the solo occupancy and the remaining guest would be responsible for covering any outstanding balance required to maintain the booking. In such an event, we will not be responsible in any way for lost deposits, incurred expenses or fees, or other lost monies. 

You agree and acknowledge that any prices quoted or advertised are subject to change and that Kbyeee Getaways cannot guarantee continued availability of specific rooms, air schedules, or pricing. We will not be responsible or obligated to honor any erroneous, outdated, or unavailable rooms, air schedules, or pricing.  

AGENCY ADVERTISED GETAWAYS

Kbyeee Getaways advertised getaways seen on social media and/or Kbyeee Getaways's website are pre planned itineraries that have been expertly designed for the destination. These Getaways can include any combination of airfare, transportation, lodging, meals, and activities, but at a minimum will include lodging and transportation.  

Deal pricing and availability are subject to change with market until a deposit or full payment is made to secure the trip. You understand that changing hotel, departure cities, number of days, or number of travelers can also alter package pricing.

HOSTED GETAWAYS

The accommodation listed with our hosted group travel packages is intended to be used with each travel experience. If changes become necessary for any reason, the accommodations substituted will be equivalent in standard to those shown. Unless requested otherwise, we will book non-smoking rooms. These Getaways can include any combination of airfare, transportation, lodging, meals, and activities, but at a minimum will include lodging, transportation, and activities.

ITINERARY & TRAVEL CONFIRMATIONS:

Flight information, if applicable, will be provided as soon as the confirmation is received. Full travel confirmations will be sent out via pdf format no later than ten (10) business days prior to departure. Full itineraries containing flights (if applicable) and hotel conformation, should not be shared with others who are not registered attendees. This is to ensure safety, unforeseen cancellations, and exclusive experiences arranged for registered attendees. 

By purchasing a getaway from Kbyeee Getaways you are acknowledging that the getaway details were curated in good faith but are subject to change due to unforeseen circumstances. Changes do not forfeit the contract between purchaser and seller. You also acknowledge and agree that there are unforeseen/inherent risks, injuries, and/or death associated with any activities/excursion you may partake in. Kbyeee Getaways will not be held liable/responsible for any unforeseen/inherent risks, injuries, and/or death during said activities. 

Therefore, you must understand and agree that you alone are responsible for participating in such activities/excursions and assume full responsibility/liability for such an incident/risk. Vacation proposals may be shared, for those who may wish to book themselves but will be considered unregistered attendees by Kbyeee Getaways unless the pay a deposit. Unregistered attendees will be responsible for setting up their own flights, hotels, transfers, excursions, and other necessary travel arrangements.

ACCIDENTAL DEATH AND DISMEMBERMENT:

You acknowledge and accept that all travel-related activities, excursions, and experiences involve inherent and unforeseen risks, including but not limited to injury, illness, or death. Kbyeee Getaways is not liable or responsible for any injuries, fatalities, or damages incurred while participating in such activities.

By engaging in any activities or excursions, you assume full responsibility for your participation and agree that Kbyeee Getaways bears no liability for any incidents, injuries, or risks that may arise.

Furthermore, Kbyeee Getaways does not assume any responsibility for damages, injuries, or fatalities resulting from the consumption of alcohol or any other substances. We are not liable for any consequences of alcohol or substance use, including but not limited to personal injury, property damage, or other adverse effects.

Kbyeee Getaways and its affiliates are not responsible for any accidents, injuries, deaths, or dismemberment occurring under any circumstances.

ADDITIONAL EXPENSES:

By purchasing a getaway from Kbyeee Getaways you acknowledge and are aware that it is your responsibility to purchase anything not included in this getaway. You understand that anything not included are any items and matter not referred to on the invoice, which could include but not limited to, domestic airfares to and from departing destination, air-related taxes and fees, excursions, additional fees charged by the airlines such as carry-ons, checked and/or excess baggage, seat selections, or any other airline services, resort fees, passport and visa fees, insurance of all kinds, room service, laundry, or phone calls.

Optional activities, excursions, experiences, nightlife, and all items of personal nature will be at your and/or your guest’s expense. Additional taxes and surcharges may be collected by foreign governmental and non-governmental entities.

PASSPORT, VISA AND IMMIGRATION REQUIREMENTS

It is your responsibility to fulfill the passport, visa, and other immigration requirements applicable to your itinerary. You should confirm these with the relevant embassies and/or consulates. Many countries require your passport to be valid for six (6) months or more after your date of entry. Kbyeee Getaways does not accept any responsibility in the case of you being unable to travel due to your not complying with any such requirements. 

Kbyeee Getaways will not be responsible for advising and/or obtaining required travel forms or documentation for any guest(s) unless otherwise stated. Kbyeee Getaways will bear no responsibility for any damaged, lost, and/or stolen travel documentation, or improper documentation or custom/government decision at time of entry.

It is your responsibility to ensure that all the details on your travel documents are correct and to bring to our attention any errors or discrepancies within 24 hours of booking. Your travel documents are valuable and should be safeguarded as if they were cash. It is not always possible to replace travel documents in the case of loss, theft, damage, etc.

Prior to booking international travel, we recommend that you review any U.S. Government’s prohibitions, warnings and advisories applicable to your destinations, you can find that information by going to https://www.travel.state.gov. By offering travel to any particular destination, we do not represent that travel to such destination is safe or without risk.

You further agree that in connection with your activities, you will not permit the use of our services or website by anyone that resides or is staying in a country for which such use is prohibited under U.S. regulations.

TRAVEL ADVICE AND VACCINATIONS

U.S. Citizens should refer to the travel advice posted by the U.S. Department of State at https://www.travel.state.gov for all the countries you intend to visit. Vaccinations may be required for some or all of the places you are intending to visit. It is your responsibility to ensure that you have arranged all necessary vaccinations for your itinerary.

IF YOU HAVE A COMPLAINT

If you have a problem during your vacation, please inform the relevant supplier (i.e. your hotel) immediately. Should they be unable to resolve the matter, please immediately contact us using the contact information you were provided upon booking. If you fail to contact us in a timely manner, we will not be permitted the opportunity to investigate your complaint and attempt to rectify any error while you are away, and this may affect your rights under this Agreement.

3. Use of our Services

INDEMNIFICATION

You agree to indemnify Kbyeee Getaways and our affiliates, and any of our Suppliers, and any such parties’ officers, directors, employees and agents from and against any claims, causes of action, demands, losses, damages, or other costs, (including reasonable legal and accounting fees) brought by you or third parties as a result of (a) your breach of this Agreement, (b) your violation of any law or rights of any third party, or (c) your use of our website.

PRIVACY POLICY

You consent to our processing and sharing of personal information about you and other members of your party that you have provided to us with the supplier(s). Your personal information will not be used for any other purpose. You represent that you have read and agree to the terms of our privacy policy.

FORCE MAJEURE

Kbyeee Getaways  and its affiliates shall be excused from liability for the failure or delay in performance of any obligation under this Agreement by reason of any event beyond Kbyeee Getaways’s  reasonable control including but not limited to Acts of God, fire, flood, explosion, earthquake, or other natural forces, war, civil unrest, accident, any strike or labor disturbance, epidemic, pandemic or any other event similar to those enumerated above.

Such excuse from liability shall be effective only to the extent and duration of the event(s) causing the failure or delay in performance and provided that Kbyeee Getaways has not caused such event(s) to occur and continues to use diligent, good faith efforts to avoid the effects of such event and to perform the obligation. You agree to accept reasonable alternatives to the planned itinerary which would include but is not limited to postponement of or rescheduled guaranteed tour departure, full supplier vouchers or partial supplier vouchers.

Notice of Kbyeee Getaways’s failure or delay in performance due to force majeure must be given to the affected Party promptly thereafter but no later than seven (7) days after it’s occurrence. The notice, delivered by email or postal mail, shall describe the force majeure event and the actions taken to minimize the impact thereof. All delivery dates under this Agreement that have been affected by force majeure shall be tolled for the duration of such force majeure.

 

4. Additional Terms

WARRANTIES, DISCLAIMERS AND LIMITATION OF LIABILITY

Kbyeee Getaways is acting as an independent contractor and no joint venture, partnership or employment relationship exists between you and us or our Suppliers as a result of this Agreement or your use of our website.

You agree to waive all claims for special, indirect, or consequential damages. You agree to indemnify and hold us harmless from and against our liability to third parties (including your guests and companions) arising from you or your guests' or companions’ actions or omissions. YOU AGREE THAT OUR MAXIMUM LIABILITY TO YOU WILL NOT EXCEED THE AMOUNT YOU HAVE PAID US.

Changes to this agreement must be made in writing and signed by both you and us.

Once we have completed the services described herein, this agreement will terminate automatically, except with respect to limitations on our liability and with respect to your indemnity.

VENUE OF CHOICE

This Agreement shall be construed and enforced in accordance with the laws of the State of Virginia. You are required to submit any claims against Kbyeee Getaways within 7 business days after the return of your trip (or when reasonably possible).

In the event of any legal action or proceeding arising from this Agreement, the parties agree that the state court forum for said litigation shall exclusively be in Fairfax County, VA in the court of appropriate jurisdiction, and that the federal court jurisdiction shall be in the Washington, DC. The parties hereto submit to the exclusive jurisdiction of such courts and hereby waive any objection or defense to such jurisdiction or venue, including any defense based upon inconvenient forum.

RESERVATION OF RIGHTS TO AMEND

We reserve the right at any time to modify this Agreement without prior notice to you. You may not assign your rights or obligations under this Agreement to any third party. We may terminate this Agreement at any time for any reason, and such termination shall not affect any right to relief to which we are entitled at law or in equity.

5. AUTHORIZATION AND ACCEPTANCE

CREDIT CARD AUTHORIZATION

By signing below, you authorize Kbyeee Getaways to use your credit card indicated on the invoice for a one-time payment for the noted amount. You understand the payment is for the services described on the invoice. You understand each time a payment is collected, you will have to sign a new credit card authorization agreeing to the aforementioned terms.  Your billing statement will reflect TJ* KBYEEE GETAWAYS  or the direct supplier as the merchant. Please allow 3-5 business days for your card to be charged after authorization has been provided. 

By signing below, you agree you are responsible for every charge you sign and authorize for. You agree you will not file a payment dispute or chargeback through your bank/financial institution and to instead utilize your travel insurance (if applicable) if you can no longer attend the planned getaway. If you did not purchase travel insurance, you understand any payments made towards your getaway are non-refundable unless your circumstances fit the above mentioned Refund Policy. You agree you will not file a chargeback in violation of Kbyeee Getaways’s Refund Policy. If a chargeback is requested and/or processed, you agree to repay Kbyeee Getaways for the full amount and be responsible for any fees incurred in recouping payment, including attorney’s fees.

ACCEPTANCE OF THESE TERMS AND CONDITIONS

By booking your arrangement with us or using our website, you are agreeing to be bound by the terms of this Agreement and any additional terms and conditions of any supplier that are applicable to your booking, travel arrangements or use of any website content. You agree on behalf of yourself and those you represent to comply with all such terms and conditions, including the payment of all amounts when due.

You agree that any violation of any such terms and conditions may result in (a) the cancellation of your reservation or purchase, (b) your forfeiture of any monies paid for your reservation or purchase, (c) you being denied access to the applicable travel related product or service, and (d) our right to debit your account for any costs we incur as a result of such violation. 

You represent and warrant that (a) you are of sufficient age to use our services and website and can create binding legal obligations in connection with your use, (b) you are legally authorized to act on behalf of those you represent and accept these terms and conditions on their behalf, and (c) the information supplied by you or members of your group is true and correct.

You are responsible for informing such other persons of all terms and conditions applicable to their travel arrangements. You understand that you are financially responsible for any use of our services or website by you and those using your name or account. 

By signing these terms, making a payment, utilizing our services, or visiting our website, you are stating you have read and agreed to all terms and conditions as listed.
