1. Introduction Welcome to Society 1955, LLC, your trusted travel partner. By booking any travel services or products with us, you agree to the following Terms and Conditions. These terms are designed to protect both parties and ensure a smooth booking experience. Please read them carefully before proceeding with your booking.

2. Payment Terms

  • All payments for bookings are due at the time of booking unless otherwise specified.

  • We accept payments via credit card, debit card, or other approved payment methods. All transactions are subject to verification, and we may require additional documentation to process payments, especially for large amounts.

  • If you choose to pay by credit card, you authorize us to charge the card for the total booking amount, including any additional fees or charges.

  • Payments are processed through a secure payment gateway, and we take every reasonable step to protect your payment information.

3. Non-Refundable Deposits

  • A non-refundable deposit may be required to confirm your booking, depending on the travel package or services selected.

  • In the event of cancellation or failure to pay the remaining balance by the due date, the deposit will not be refunded.

4. Cancellation and Refund Policy

  • Cancellations made within 60 days of the scheduled departure date will incur a cancellation fee, which will be $50 per room.

  • Refunds, if applicable, will be processed according to the terms set by the service providers (e.g., airlines, hotels, tour operators).

  • Travel insurance is recommended to cover cancellations or disruptions to your trip.

5. Chargeback Policy

  • You acknowledge that chargebacks are a serious issue that can harm both the business and the consumer. To avoid any misunderstanding, we urge you to contact us directly in case of any disputes, payment issues, or dissatisfaction with services. We will make every reasonable effort to resolve the matter fairly.

  • In the event that a chargeback is initiated, you will be held responsible for the costs associated with the chargeback, including but not limited to any fees or administrative costs incurred by the agency.

  • Chargebacks will only be accepted in cases where services were not provided or were significantly different from what was agreed upon. If a chargeback is deemed unjustified, the customer agrees to cover all associated fees, including any additional charges related to processing the dispute.

5.1. Prevention of Chargebacks

  • Direct Communication: We strongly encourage customers to contact us directly in the event of any issues or dissatisfaction with our services before resorting to a chargeback. Our team is committed to resolving any problems, whether related to booking discrepancies, services provided, or any other concerns.

  • Resolution Timeline: If a customer disputes a payment, the customer must make reasonable efforts to resolve the issue with us within 2 days of the booking date. This includes contacting our customer service team, providing necessary details, and allowing us to investigate the issue.

5.2. Circumstances for Chargebacks

  • Unauthorized Transactions: If a chargeback is initiated due to an alleged unauthorized transaction, the customer must provide a formal declaration from the card issuer confirming that the transaction was indeed unauthorized. A valid claim will only be considered if the transaction is found to be fraudulent.

  • Failure to Receive Services: If you have not received the services you have paid for, and the fault lies with us (e.g., the service provider canceled or failed to provide the service), we will work with you to resolve the issue or provide an appropriate refund. Please contact us directly before initiating a chargeback to allow us the opportunity to address the situation.

  • Discrepancies in Services Provided: If the service you received was substantially different from what was promised, we encourage you to communicate with us directly for a resolution. In many cases, we can offer an alternative, rebooking, or partial refund without the need for a chargeback.

5.3. Chargeback Process

  • Notification of Dispute: If you intend to initiate a chargeback, the customer must notify Society 1955, LLC via email prior to starting the dispute process. This gives us an opportunity to investigate and potentially resolve the issue before it escalates to a chargeback.

  • Documentation and Evidence: In order to ensure a fair dispute process, customers are required to provide any supporting documentation when initiating a chargeback. This includes:

    • Correspondence with our customer service team

    • Booking confirmation and receipts

    • Any evidence of services not provided or misrepresented

    • Travel insurance claims (if applicable)

  • Refund Attempts: If a chargeback is initiated without giving us the opportunity to resolve the issue first, we reserve the right to retain the right to withhold the disputed amount until the matter is resolved.

5.4. Chargeback Fees and Consequences

  • Chargeback Fee: In the event of a chargeback, the customer will be liable for a non-refundable chargeback fee of $50 per transaction to cover administrative costs incurred by the agency. This fee will be added to the total amount owed and may be charged in addition to the original payment amount.

  • Recovery of Funds: If a chargeback is initiated and found to be unjustified, we will work to recover the funds. The customer agrees to reimburse any legal or administrative fees incurred by the agency in connection with recovering the disputed amount.

  • Future Bookings: If you initiate a chargeback without valid grounds or without allowing us the opportunity to resolve the dispute, we reserve the right to refuse future bookings from you, cancel any existing bookings, or require payment upfront for any future transactions.

5.5. Chargeback Dispute Resolution Process

  • Agency's Role in Dispute: In the event that a chargeback is initiated, we will provide all relevant documentation to the payment processor or bank to prove that the services were provided or that the charge was legitimate.

  • Customer's Role in Dispute: If the chargeback is contested by the agency, the customer agrees to cooperate with the chargeback process by providing additional documentation or communicating with the bank as needed. Failure to cooperate with the dispute process may result in the chargeback being resolved in the agency's favor.

  • Resolution Timeline: We strive to resolve chargeback disputes as quickly as possible. Typically, chargeback investigations can take 3 to 5 weeks, during which time the payment processor or bank will review both the customer’s and our evidence. We will keep you informed of the status throughout the process.

5.6. Fraudulent Chargebacks

  • Zero Tolerance for Fraudulent Chargebacks: If we believe that a chargeback has been initiated fraudulently (e.g., the customer knowingly made a chargeback despite receiving services, or the customer misrepresented the situation), we reserve the right to take legal action against the customer for recovery of the funds, including any associated fees.

  • Reporting to Credit Bureaus: In cases of fraud, we may report the customer’s actions to credit bureaus and other relevant authorities, which could affect their credit score and ability to engage in future transactions.

5.7. Importance of Travel Insurance

  • Insurance as Protection: We recommend that all customers purchase travel insurance that covers cancellations, trip interruptions, and other unforeseen issues. Travel insurance can help minimize financial losses in the event that you need to cancel or modify your trip for legitimate reasons, reducing the likelihood of a chargeback.

By accepting these terms, you agree to notify us directly before initiating a chargeback. We are committed to resolving any issues in a timely and fair manner.

6. Booking Modifications

  • Any changes to a confirmed booking, including changes in travel dates, destinations, or services, are subject to availability and may incur additional charges. Please contact us as early as possible for any modifications.

  • Modifications to bookings may also be subject to the policies of the service providers, which may involve non-refundable fees.

7. Customer Responsibilities

  • It is the responsibility of the customer to ensure that all personal details, such as names, passport information, and travel dates, are accurate at the time of booking. Any errors in the information provided may lead to additional charges or complications.

  • You are responsible for ensuring you have the necessary travel documents (e.g., passports, visas) and comply with all entry requirements for the destinations you are visiting.

8. Force Majeure

  • Society 1955, LLC shall not be liable for any failure to perform its obligations due to unforeseen circumstances or events beyond our control, such as natural disasters, strikes, or political instability.

  • In such cases, we will make reasonable efforts to assist in rearranging your travel plans, but we cannot guarantee the availability of services.

9. Dispute Resolution

  • Any disputes arising from or related to these Terms and Conditions shall be resolved through negotiation and mutual agreement. If an amicable resolution cannot be reached, the dispute may be referred to a mediation service or an appropriate legal body in Pittsburgh, PA

  • You agree that all claims, disputes, or legal actions must be filed within 6 months from the date of the original booking.

10. Limitation of Liability

  • Society 1955, LLC shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services, including but not limited to personal injury, property damage, or loss of enjoyment.

  • Our liability in any case is limited to the amount paid for the specific service or package affected.

11. Privacy Policy

  • We respect your privacy and are committed to protecting your personal information. Our Privacy Policy outlines how we collect, use, and protect your data. By booking with us, you consent to our Privacy Policy.

  • Your personal details will be kept confidential and will not be shared with third parties except as necessary to process bookings or comply with legal obligations.

12. Final Agreement

  • These Terms and Conditions, along with any additional terms provided during the booking process, represent the entire agreement between you and Society 1955, LLC.

  • If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
