Terms & Conditions

 

Contractual Agreement

By purchasing travel booking services from Why Not Roam LLC ("Agency," "We," "Us"), you ("Traveler," "You") acknowledge and agree to the following terms and conditions ("Agreement," "Terms").

 

Scope of Services

The Agency provides travel planning and booking services, including travel experiences and personalized itineraries. We operate as an independent travel agency and work with third-party suppliers (e.g., airlines, hotels, tour operators) to facilitate your travel arrangements.

  • The Agency acts solely as a booking intermediary and does not own, operate, or control these third-party suppliers.
  • The Agency is not liable for the acts, omissions, or services provided by third-party suppliers.
  • Your contractual relationship for travel services (e.g., flights, accommodations, tours) is directly with the respective provider, and any claims or disputes must be addressed with them.
  • Third-party suppliers may include, without limitation, airlines, hotels, cruise lines, tour operators, destination management companies (DMCs), and other local service providers. Traveler acknowledges that the Agency may contract directly with certain independent suppliers to curate unique group experiences. These suppliers are independent entities not owned, managed, or controlled by the Agency or its host agency.
  • Travel conditions and regulations may change; it is your responsibility to stay informed via the U.S. Department of State travel advisories at travel.state.gov.

 

Payment Terms

  1. Deposits: A non-refundable deposit is required to secure your booking. The deposit amount will be specified at the time of booking.
  2. Planning Fees: Planning fees, when applied, are specific to each itinerary and are non-refundable..
  3. Pricing Conditions:
    1. Prices are subject to change until full payment is received.
    2. Prices will not increase after full payment, except for government-imposed taxes or fees.
    3. By purchasing travel services, you accept these pricing terms.
  4. Final Payment: The remaining balance must be paid in full by the due date specified at the time of booking. Failure to make timely payments may result in cancellation without a refund.
  5. Accepted Payment Methods:
    1. Payments are accepted via credit card and bank authorization.
    2. A signed Credit Card Authorization Form is required for payment processing, with a provided debit schedule.
  6. Supplier Insolvency: Payments collected by the Agency on behalf of a third-party supplier are transmitted to that supplier. The Agency is not responsible for the financial condition of any supplier or for their failure to provide the agreed-upon services. In the event a supplier defaults, becomes insolvent, or otherwise fails to deliver services, the Traveler’s recourse is limited to claims against the supplier, and the Agency shall not be liable for refunds or compensation beyond amounts recovered from that supplier.

 

Changes, Cancellations, & Fees

 

Change Fees:

  • After a booking is confirmed and a deposit/payment is received, any requested date changes will incur a $75 non-refundable administrative fee per traveler.
  • This fee is in addition to any change fees charged by third-party travel service providers.

 

Credit Card Transactions & Chargebacks:

  • If a travel provider fails to deliver services, claims must be directed to the provider, not the Agency.
  • By paying with a credit card, you agree not to initiate a chargeback against the Agency.
  • If a chargeback is attempted after funds have been transferred to the travel provider, you will be responsible for any resulting costs, including legal fees and air debit memos.
  • If your credit card is declined, you must settle the outstanding balance via money order or cash.

 

Additional Fees & Charges:

  • Some taxes, surcharges, and fees may be payable directly to hotels, car rental agencies, or other service providers at check-in.
  • Most properties and car rental/leasing companies require a credit card imprint upon check-in.

 

Cancellation Policy: All traveler-initiated cancellations must be submitted in writing. Refund eligibility is determined solely by the policies of third-party suppliers and may be subject to cancellation fees. You acknowledge that most travel bookings are non-refundable and that cancellations may result in fees up to 100% of the total booking cost, regardless of whether travel has commenced. The Agency has no obligation to provide refunds beyond those authorized by suppliers. You agree to indemnify and hold the Agency harmless from any supplier-imposed fees, penalties, or financial losses resulting from your cancellation.

 

Agency Fees: All fees charged by the Agency for planning, consultation, or administrative services are non-refundable.

 

Supplier Policies: Third-party suppliers (including but not limited to airlines, cruise lines, and hotels) have their own cancellation, change, and refund policies. These policies apply to your booking in addition to the Agency’s terms, and the Agency is not responsible for any supplier-imposed fees or restrictions.  For curated group experiences involving locally contracted suppliers or DMCs, Traveler acknowledges that those suppliers’ individual terms and conditions govern refunds, cancellations, or changes. The Agency will make reasonable efforts to communicate these policies in advance, but the final authority rests with the supplier.

 

Travel Insurance:  The Agency strongly recommends travel insurance to protect your investment.  If you decline travel insurance, you must sign a waiver acknowledging your decision and releasing the Agency from liability for any losses. However, no representation or description of the insurance made by The Agency to you constitutes a binding assurance or promise about the insurance.  The Agency is not an insurance company and has no responsibility for the submission, payment, or adjustment of any insurance claims. Any insurance claims that may fall under the relevant travel insurance policy must be submitted to the insurance company identified in the policy.

 

Documentation & Entry Requirements:  Passports & Visas: Traveler is responsible for ensuring they meet all passport, visa, and entry requirements for their destinations.  Any fines, penalties, payments, or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of You.  All individuals departing from the United States must have a passport that is valid at least 6 (six) months beyond their intended travel date. 

 

Real ID: As of May 3, 2023, if you plan to use your state-issued ID or license to fly within the U.S., it is your responsibility to make sure it is REAL ID-compliant. If you are unsure if your ID complies, please check with your local state department of motor vehicles or visit www.tsa.gov/real-id.

 

Vaccinations, Health & Special Requirements:  Traveler agrees to be aware of and comply with health requirements and vaccinations as mandated by destinations or suppliers, any additional costs of which are the responsibility of You.  You may reference the Center for Disease Control and Prevention for current information before and during travel. www.cdc.gov

 

Name Accuracy:  It is the Traveler's responsibility to provide accurate names and details that match government-issued identification.

 

Travel Documents: Travel documents include, without limitation, airline tickets, hotel vouchers, tour vouchers, or any other document (whether in electronic form or otherwise) used to confirm an arrangement with a service provider. Travel documents may be subject to certain conditions and/or restrictions such as, but not limited to, being non-refundable, non-date-changeable, and subject to cancellation and/or amendment fees. Travel documents cannot be transferred to another person to use. All airline tickets must be issued in the name of the passport/photo identity holder. Any errors in names, dates, and timings on your documentation will be your responsibility if we are not advised at the time of booking and may result in the booking being cancelled. Please reconfirm your flights at least 24 hours before departure.

 

Liability Disclaimer

The Agency acts solely as an agent for third-party suppliers and is not responsible for their actions, errors, omissions, or service failures. The Agency assumes no liability for injury, loss, death, delay, inconvenience, or damage to person or property arising from, but not limited to, acts of God, force majeure, illness, disease, war, civil unrest, strikes, labor disputes, terrorism, criminal activity, overbooking, transportation failures, or inadequate foreign facilities, including air-conditioning in public spaces, hotels, or motor coaches.

 

Traveler acknowledges that curated group travel experiences may involve local suppliers engaged directly by the Agency, such as guides, transportation companies, and DMCs. While the Agency exercises reasonable care in selecting reputable partners, it does not guarantee their performance and expressly disclaims liability for their acts, omissions, or failures.

 

If unforeseen circumstances (e.g., weather or flight delays) require additional overnight stays, you are responsible for associated costs, including accommodations, meals, and transfers. Baggage is carried at the owner's risk. The use of The Agency’s name on vehicles, signage, or other locations is for identification only and does not indicate ownership or control.

 

Substitution of Services: The Agency and its suppliers reserve the right to substitute accommodations, transportation, activities, or other services with comparable alternatives if circumstances beyond their control require changes. Reasonable efforts will be made to provide services of equal or greater value; however, no refunds will be issued for such substitutions unless required by the supplier’s own policies.

 

Prices are based on prevailing rates, including foreign exchange, and are subject to change without notice. Where liability cannot be excluded, it is limited to the value of purchased travel arrangements. You expressly agree that The Agency is not responsible for consequential losses or damages.

The Agency is not responsible for events beyond its control, such as natural disasters, pandemics, government actions, or travel disruptions.  Traveler agrees to assume all risks associated with their travel, including personal safety, health, and the safety of personal belongings.

 

Changes to Bookings

Any changes requested by the traveler are subject to availability and supplier policies. Fees may apply.  In rare cases where changes are necessary (e.g., supplier cancellations), the Agency will make reasonable efforts to provide suitable alternatives. Additional costs, if any, are the responsibility of the traveler.

 

Code of Conduct/Refusal of Service

Traveler is expected to treat other travelers, locals, and staff with respect and adhere to all local laws, customs, and supplier rules.  Suppliers reserve the right to refuse service to Traveler at their sole discretion, including, without limitation, if the Traveler: (i) Lacks proper documentation for the country of destination; (ii) Has a contagious disease; (iii) Is under the influence of alcohol, drugs, or narcotics; and/or (iv) Manifests disruptive and/or unruly behavior.  The Agency assumes no liability for the act of a supplier or service provider refusing service.

 

Photo & Video Release

By attending group trips led by the Agency, Traveler permits the Agency to use photos or videos taken during the trip for promotional purposes. 

 

Electronic Or Handwritten Signature

Both parties (Agency and Traveler) agree that Traveler may acknowledge and agree to these Terms: (i) electronically; (ii) by handwritten signature; (iii) by any other electronic means, including, without limitation, via email acceptance of these Terms; or (iv) by your implied consent deemed via your actions, which shall include without limitation the payment of the invoice and/or your use of the services provided by The Agency or any other travel supplier related to your booking. All such means will be deemed to constitute effective acknowledgement and execution of this Agreement and shall be sufficient to bind the parties to the terms and conditions of this Agreement.

 

Updates to Terms & Conditions

The Agency reserves the right to update these Terms & Conditions at any time. Travelers will be notified of significant changes via email or our website.

 

Governing Law

The construction, validity, and performance of these Terms and any disputes between the parties shall be governed by and construed according to the laws of the State of Georgia, without giving effect to its conflict of law principles, and any federal laws applicable therein. Both parties submit to the exclusive jurisdiction of the courts of the State of Georgia with respect to any legal proceedings relating to these Terms.  Travelers booking from states with Seller of Travel or consumer protection statutes acknowledge that the Agency is based in Georgia, which does not have Seller of Travel registration requirements, and agree that such statutes do not extend jurisdiction over this Agreement.
