Terms & Conditions

We are McKee Travel and are excited to help you with your travel. The following terms & conditions (the "Agreement") describe what you can expect from us. The terms "we", "us", and "our" refer to McKee Travel and the term "you" refers to the individual who signs this agreement.

I have read, understand, and accept the following Terms and Conditions:

Travel Consulting

Travel Consulting services are based on professional expertise and education.  Services for the provision of Travel Consulting service includes: travel arrangements, reservations, ticketing and traveler support for air, rail, and lodging, car rental which includes arrangement, booking, ticketing, destination services, documentation, and research for national international services for personalized itineraries.

Air Travel 

Department of Transportation Airline Refunds

 

First off, the sky is not falling. There are a lot of good things in the DOT’s rule-making -- including many things that ASTA has been lobbying in favor of for many years. The initial proposed rule would have required all agencies to issue refunds -- even when the agency is not holding client money, or didn't take client money in the first place.

 

The rule that was actually issued only requires agencies to issue refunds if they are the "merchant of record" on the ticket transaction -- which is a very narrow universe of agencies and advisors.

 

So, this won't apply to most travel agencies. If you hold an ARC appointment and issue tickets through a GDS, your agency might appear on credit card statements as a merchant of record. If you're a hosted advisor and issue tickets on a GDS using your host agency -- it's possible that your host agency might appear on those credit card statements. But, in this day and age, when most advisors aren't on a GDS at all, it's unlikely that your agency is going to be the merchant of record when airline tickets are issued.

 

However, I’m recommending an update to your terms and conditions document nevertheless, in order to clarify your role and so that your clients are agreeing in your terms that they understand that your agency is not the “merchant of record” on airline transactions. If you are the merchant of record for airline tickets, this language may not be helpful, but I’d recommend including it, just the same.

 

In your terms and conditions document, replace the entire section on air tickets (for most of you, this will be Section 10 of your document, but verify and re-number as needed), with the following :
 

 10.   AIR TRAVEL, SCHEDULE RECONFIRMATION, CHECK-IN


 

Your airline ticket is a contract between you and the air carrier, even if you purchase through [SHORTHAND/ABBREVIATED NAME OF AGENCY]. If you purchase air travel through [SHORTHAND/ABBREVIATED NAME OF AGENCY], you acknowledge and agree that [SHORTHAND/ABBREVIATED NAME OF AGENCY] does not have the right to control the operations of independent airlines, and agree that [SHORTHAND/ABBREVIATED NAME OF AGENCY] is not liable for any personal injury, property damage related to your purchase of air tickets or air travel, including, but not limited to any act, error, omission, injury, loss, accident, or delay caused by any act, error or omission of the airline, including their failure to deliver services, partial or inadequate delivery of services, airline policies including refund or rebooking policies, fees for checked or carry-on luggage, fuel increases, bankruptcy or cessation of operations.

 


You understand and agree that McKee Travel functions solely and exclusively as a booking agent for the air carrier, that we do not handle or hold client funds for airline tickets, and that we are not the Merchant of Record under the meaning of that term under the Department of Transportation's regulations. Because [SHORTHAND/ABBREVIATED NAME OF AGENCY] does not hold or handle client funds, you understand and agree that any refund for cancelled or delayed flights, baggage fees or seat assignments must come directly from the airline and not from [SHORTHAND/ABBREVIATED NAME OF AGENCY].

McKee Travel shall not assume any responsibility for any air schedule changes. In rare instances, upon departure from a country, certain departure taxes must be paid in cash only, and may vary in price. Failure to use a reservation may result in automatic cancellation of all continuing and return flights, as well as forfeiture of airfares. 

Airline e-tickets expire a year from issue date unless carrier fare rules in passenger’s itinerary fare provide otherwise.

Due to enhanced security, it is strongly recommended that you check in a minimum of 2 hours prior to scheduled departure for domestic flights and 3 hours prior to scheduled departure time for international flights. Reconfirm flight times at least 24 hours prior to scheduled departure time for domestic flights, and 72 hours prior for international flights.

Frequent Flyer mileage accrual is at the discretion of the airline(s). McKee Travel has no liability if accrual of miles or points is denied or if upgrades are not allowed. Many airlines do not permit upgrades on airfare purchased in certain fare classes or when using frequent flyer miles, loyalty status or certificates.

Seat assignments are not guaranteed even after they are assigned, and McKee Travel has no control over airline seat assignments. Most airlines charge a fee to pre book a seat.
 

 

Wellness Travel

We may book wellness travel for clients, which may include yoga, meditation, medi-spa, and other activities, treatments and services intended to maintain, manage, or improve travelers’ health and well-being (“Activity” or “Activities”). We have no specialized knowledge of the practices or techniques employed by our Suppliers, and make no representations of the qualifications of the professionals and practitioners who offer these Activities. We make no representations that by participating in these Activities there will be any demonstrable improvement in your physical, mental, emotional, or spiritual well-being. We are not responsible if your participation in these activities leads to a worsening of any condition you may have. We are not responsible for any injuries you may sustain, illnesses you may contract, including injuries or illnesses that may result in loss of life. You acknowledge that you are voluntarily participating in the Activities on your itinerary, and that you understand that there are risks associated with your participation in the Activities, such as physical and/or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability, death or economic loss. These injuries or outcomes may arise from your own or other’s actions, inactions, or negligence, or the condition of the Activity location(s) or facility(ies). Nonetheless, you assume all risks of your participation in the Activity, whether known or unknown to you, including travel to and from the Activity (including air travel) or any events incidental to the Activity. 

Pricing:

Pricing on quotes are applicable to the date and time at which they are requested and are subject to change. Please note that per our supplier contracts we cannot offer a breakdown of pricing.

Quotes in foreign currency are subject to fluctuations in exchange rates and International credit card issuer fees. McKee Travel is not responsible for any increases due to fuel surcharges, government imposed taxes/fees or supplier-imposed increases. 

I understand that discounted fares typically involve restrictions and that changing any aspect of my travel arrangements may result in the payment of additional money.

I understand that airlines tickets, air tours or other products I am purchasing are subject to supplemental price increases that may be imposed after the date of purchase.  Post-purchase price increases may be applied due to additional costs imposed by the supplier or government.  I acknowledge that I may be charged additional sums by McKee Travel to offset increased fees, fuel surcharges, taxes, fluctuations in foreign exchange markets or any combination thereof.

Please note: 

When the travel supplier is charging in Euro USD amount listed on your McKee Travel invoice is approximate and may vary based on date of conversion and whether or not you bank charges a fee. Client is responsible for any differential due to this factor.

Professional Service Fees:

This fee ensures that McKee Travel is paid for their time whether or not you finalize your booking with us. This covers our time in consultation, research, pricing and support before, during and post travel.

Payments:

McKee Travel  has advised me to use a credit card as this may offer me the opportunity to dispute the charge should a vendor cease operating.

Documentation:

Travel documentation appropriate for entry to your itinerary destinations, such as passports, visas & inoculation certificates, remain each traveler’s responsibility.

I understand that the Transportation Security Administration (TSA) requires me to carry a government-issued identification card in order to board a flight.  I have been advised that the name, date of birth and gender that appears on the identification card must exactly match the same such data that is listed on my airline ticket and in my booking records.  I acknowledge that my failure to strictly comply with these requirements may result in denied boarding or an undue delay at an airport security checkpoint causing me to miss my flight. I further acknowledge that beginning on October 1, 2021, I must present a driver’s license or another form of identification that complies with the requirements of the Federal Real ID Act (see www.dhs.gov/real-id for more information).

I understand that if traveling internationally, I must have a valid passport and, depending upon my destination and nationality, I may need to obtain one or more visas.

Valid passports are required for all international destinations. If a passport is required to travel, the expiration date must be at least six (6) months following the return date of the planned travel.

I understand that McKee Travel will advise required documentation, and that travelers who do not meet advised requirements will be denied boarding.

Each foreign country holds different views of past criminal offenses - if you have a current or past offense, please contact that country directly for entry and exit requirements.

Travelers with DWI or DUI records should check whether current rules exclude admission to foreign destinations. McKee Travel feels it is an invasion of privacy for members of our staff to make such an inquiry and these requirements remain the traveler’s responsibility. For further information, please visit the U.S. State Department web site: travel.state.gov. 

It is each traveler’s responsibility to make certain that they have proper immunizations before travel - please see your health provider for advice.

Travel Documents:

I will review my travel documents for accuracy upon receipt, and I understand that I should contact McKee Travel immediately should I have any questions.

Note to client: Passport and visa information may be obtained by contacting the Travel Agent Section of the U.S. State Department at 202.647.5225 or by visiting the State Department's Web site at travel.state.gov. Non-U.S. passport holders should be sure to contact the embassies of their destination and transit countries to obtain entrance requirements. To obtain medical information, you may contact the Centers for Disease Control at 404.332.4559 or visit the CDC's Web site at www.cdc.gov

Check-in & Departure Responsibilities:

It is strongly recommended that you check in at the airport a minimum of 2 hours prior to scheduled departure for domestic flights and 3 hours prior to scheduled departure for international flights.*

It is the traveler’s responsibility to reconfirm flight times at least 24-72 hours prior to scheduled flights. McKee Travel will not assume responsibility for any air or schedule changes.

Certain countries require departure taxes that require payment in cash.

*Recommended check in times are subject to change without notification. It is the traveler’s responsibility to remain abreast of changes in condition or airport rules that might require earlier arrival times. This information can be found when entering your confirmation number on the airline website. 

Travel Protection/Insurance:

Travel protection and insurance is strongly recommended to protect your investment. Unless specifically noted, travel insurance is not included in the cost of client’s itinerary.

Information for travel insurance will be sent to you within a reasonable time frame after deposit based on trip cost and components. 

Additional Disclosure: 

I understand that McKee Travel is not the source or supplier of the travel services I have requested, and acts solely as an agent for the actual suppliers of such services. I have been advised that the suppliers whose names appear in the information supplied to me are those who are actually responsible for providing the travel services I have purchased. I consent to and request the use of those suppliers and agree not to hold McKee Travel responsible should any of these suppliers: 1) fail to provide the travel services I have purchased; 2) fail to comply with any applicable law; or 3) engage in any negligent act or omission that causes me any sort of injury, damage, delay or inconvenience.

I accept that McKee Travel is not responsible for, nor will I attempt to hold it liable for, any injury, damage or loss I may suffer on account of any conditions, actions or omissions that are beyond its reasonable control.

I further understand and acknowledge that travel to many parts of the world may involve the risk of a variety of hazards to my health and/or safety, including but not limited to disease, crime, terrorism, and warfare.  Because each traveler’s risk tolerance is different, McKee Travel is not in a position to advise me whether I should travel to any particular place at any particular time.  Rather, to assist me in making an informed decision, I should refer to objective third-party sources of travel information, such as that maintained by the U.S. Department of State (travel.state.gov).
