1. Travelmation, through and in conjunction with the Travelmation Independent Travel Consultant (“ITC”) working as a Flight Desk Agent ("FDA"), acts as a sales agent for Flight Monitoring and Management Services provided to a Travelmation Agent ("Agent") and their clients. This service is an annual subscription that is payable in advance or on a monthly basis. It is meant to provide support for the Agent up to a subscribed number of airline records during the subscribed period of time. If an Agent reaches the subscribed number of records before their subscribed period of time expires, they will be provided an opportunity for add-on support or to sign a new subscription agreement. Support is limited only to Agents with an active subscription agreement or a one time invoice support agreement. This is a service provided to Agents with no sales recognition or commission payable to the agent. FDA will act on the behalf of Travelmation Agents on the subscribed airline records to handle monitoring and management of flight changes, disruptions and special requests pertaining to the booked airline. Agent and/or Agent's client will forward any and all communications received directly from the airline for the FDA to manage with the airline.
2. Agent is still responsible for reviewing and understanding the terms and details of the confirmation of booking provided on behalf of their client with respect to their travel and itinerary – including: (A) confirming legal names have been used in booking airline records; (B) confirming that the dates and times of travel are correctly stated; (C) knowing and complying with payment due dates; and (D) knowing and understanding any applicable restrictions and/or penalties resulting from any cancellation or modification of a booking/itinerary (in whole or in part). Please review these details carefully with your client!
Agent is responsible to inform their client about the client's responsibility to understand and comply with all requirements which could impact the Client’s ability to travel on the Client’s booking/itinerary – including, without limitation, any requirements relating to passports or other required identification, visas, vaccinations, immunizations, medical authorizations, or permissions for minors to travel.
Agent is responsible to inform their client about the client's responsibility to understand and acknowledge that travel to many parts of the world may involve the risk of a variety of hazards to health and/or safety, including but not limited to disease, crime, terrorism, and warfare. Because each Client’s risk tolerance is different, it is incumbent on the Agent's Client to investigate and understand the risks inherent with travel to any area of the world, including any prevailing travel bans, restrictions, or warnings, and to make the decision as to whether the Client desires to undertake travel. Travelmation's Flight Desk strongly recommends that Agent's Client purchase trip cancellation and travel accident insurance, especially for international trips. Agent's Client can inquire with the Agent about the availability of such insurance. However, Travelmation and ITC are not insurance agents, and Travelmation and ITC make no representations or promises as to the availability, terms, or benefits of any such insurance, and Client should contact the company issuing any such insurance for any questions relating to the terms, benefit, conditions, or exclusions of such insurance.
Failure of Agent or Client to review, understand, confirm, know, investigate, and/or comply in the areas listed in this paragraph 2 may result in Client’s loss of the ability to travel on the booking/itinerary (in whole or in part), or other losses, costs, damages, expenses, or injuries to Client, and Client expressly releases Travelmation and FDA from any claims or causes of action for losses, costs, damages, expenses, or injuries in any way arising out of the failure of Client to review, understand, confirm, know, investigate, and/or comply in these areas listed in this paragraph 2. Further, Agent and Agent's Client releases Travelmation and FDA from any claims or causes of action arising out of or resulting from: (A) the failure of Client to procure travel insurance or any denial (complete or in part) of any claim made under travel insurance; (B) any injury, disease, sickness, death, or loss of property sustained by Client while traveling.
3. Agent is responsible to inform their client about the client's responsibility to acknowledge and agree that neither Travelmation nor FDA shall be responsible or liable for - and Client hereby releases Travelmation and FDA from any claims or causes of action for – any loss, cost, expense, refund, damage, and/or injury (of any kind whatsoever) in any way arising out of or resulting from: (A) the acts or omissions (including negligence, gross negligence, or intentional misconduct) of any Travel Supplier; (B) bankruptcy, cessation of business, or default for any reason by a Travel Supplier; (C) failure of a Travel Supplier to provide services as advertised/promised, or to adhere to published schedules or itineraries, as well as any resulting delay or inconvenience; (D) any increase in price before or after booking by a Travel Supplier; (E) any defect in or failure of any vehicle, craft, equipment, or instrumentality owned, operated, or otherwise used or provided by a Travel Supplier; or (F) any act, error, or omission by or on the part of any other person or entity, other than Travelmation.
Travelmation and FDA will work with Agent and the Agent's Client should such circumstances arise, always striving for the highest satisfaction of the Client.
4. By submitting my credit card authorization “I agree to the Travelmation terms & conditions” (or otherwise indicating consent to these terms and conditions), the Agent agrees to comply with and be bound by these Terms and Conditions effective as to all managed bookings made after such consent is expressed. Travelmation reserves the right to amend or replace these Terms and Conditions at any time, in Travelmation’s sole discretion, with such amendment or replacement to apply prospectively to travel bookings made after the effective date of such amendment or replacement. Agent acknowledges and understands that each Travel Supplier may have its own terms and conditions pertaining to a booking (please reference your booking confirmation).
