By signing below, I authorize Crown Legacy Travel to charge the credit card provided herein.
These Credit Card Terms and Conditions (this "Agreement") governs the TERMS OF USE OF THE CREDIT CARD provided by you, the client ("you", "your" or the "Client") to Crown Legacy Travel LLC ("we", "our”, “us" or the "Travel Agency"). This Agreement includes warranty disclaimers and liability exclusions. PLEASE READ THIS AGREEMENT CAREFULLY BEFORE ACCEPTING ANY SERVICES PROVIDED BY US OR MAKING ANY PAYMENTS. IF THERE IS ANY PART OF THE TERMS AND CONDITIONS SET FORTH IN THIS AGREEMENT THAT YOU DO NOT AGREE WITH, DO NOT USE ANY SERVICE PROVIDED BY THE TRAVEL AGENCY OR MAKE ANY PAYMENTS TO THE TRAVEL AGENCY. By acknowledging and agreeing to accept the Terms and Conditions set forth in this Agreement, you are creating a legally binding agreement between you and the Travel Agency.
Acceptance of Terms and Conditions: The Terms and Conditions set forth in this Agreement shall be deemed a part of and are expressly incorporated by reference into any and all agreements, forms, and other documents either entered into between the Travel Agency and you or delivered to you by us; provided that in the event of any conflict, the terms and conditions of this Agreement shall prevail.
By accepting any services provided by us or paying any fees and/or deposits, you are affirmatively representing that you have read and accepted the Terms and Conditions set forth in this Agreement on behalf of yourself and each person in your traveling party.
1. Invoice: You will receive an invoice outlining the details of your trip. You agree to review the Invoice in detail and confirm that all the names are spelled exactly as spelled on your passport, the room/cabin assignment and location (when provided) are acceptable, and all amounts are correct and agreed. 2. Pricing and Payments: Price quotes are applicable to the date and time at which they are requested. Quotes in foreign currency are subject to fluctuations in exchange rates and credit card issuer fees. The Travel Agency is not responsible for any increases due to fuel surcharges, government-imposed taxes/fees or supplier-imposed increases. The provisions of this Section shall survive termination of this Agreement.
A. DEPOSIT: All deposits are NON-REFUNDABLE and NON-TRANSFERABLE. Travel reservations are not confirmed until a deposit is made. Your travel invoice will reflect the amount needed to confirm your vacation. Unless stated otherwise, prices may fluctuate between the time a quote is rendered and when the deposit is furnished.
B. PAYMENTS: The Travel Agency only accepts payments in United States
Dollars. Payments can be made via major debit and credit cards. Accepted cards are: Mastercard, Visa, Discover and American Express. Credit or debit card should be in your name. Credit card authorizations will be required for all payments.
C. PAYMENT PLANS: We are pleased to offer, for your convenience, a monthly payment plan for your travel plans solely to the extent that payment in full is not required at the time of booking. Additionally, no payment plan is available for reservations made sixty (60) days or less from the date of travel.
D. FINAL PAYMENT: Reserved travel plans must be paid in full on or before the final payment date. Your travel invoice will state the date your final payment is due. Any reservations not paid in full on or before your final payment date is subject to cancellation, with no notice and no refund of payments made.
E. LATE PAYMENT: If your travel itinerary is not paid in full by the final payment date, a late fee of $100.00 per person will automatically be assessed one day after your final payment date. This fee is non-refundable and non-negotiable.
F. REINSTATEMENT OF RESERVATIONS: If your travel reservations have been canceled, and you notify us within 7 calendar days of cancellation that you want to reinstate your reservation, a service reinstatement fee of $100.00 will be added to your invoice and must be paid in advance in order to apply for reconfirmation of services.
In the case where a reservation is canceled and reinstated, it is not guaranteed that the passenger will receive the same exact itinerary for the same price. This will be considered a new reservation and subject to the pricing and terms and conditions at the time the reservation is reinstated. Passenger understands that the passenger will be responsible for any increase in travel costs upon reinstatement of the reservation.
G. RESERVATION CHANGES: Changes to an existing reservation, whatever the cause, will incur a $50.00 (per person per change) charge in addition to any fees charged by the Service Provider. Name changes to airline reservations may be subject to full cancellation and rebooking.
H. CANCELLATIONS: To cancel your planned travel, the Travel Agency charges a non-refundable fee of $50.00 per person. This fee is payable at the time of the cancellation request and the planned travel will not be canceled until this fee is paid. Unless otherwise stated in your travel documents, you may cancel and receive a refund of your vacation payments, less any non-refundable payments and any fees or penalties of the Service Providers. There are no refunds if the planned travel is canceled after the final payment date. All cancellations must be submitted via email to info@crownlegacytravel.com. If for any reason, any Service Provider is unable to provide the services for which you have contracted with such Service Provider, your remedy lies against such Service Provider, and not against the Travel Agency. In the event that payment has been made to the Travel Agency by credit card pursuant to a credit card authorization form, you agree that you will not seek to charge back your payment to the Travel Agency for any reason (other than fraud by the Travel Agency). If the Travel Agency incurs any costs, including but not limited to attorneys' fees, to recover any payments charged back by your credit card company, you agree that you will be liable for these costs. If the credit card is declined, you guarantee that you will settle any amounts owing to the Travel Agency immediately. The Travel Agency may charge interest on any invoiced amounts not paid within 30 days of the due date at a rate of: (1) 1.5 % per month on the outstanding amount, or (2) if the laws of the jurisdiction applicable to your travel mandate a lower rate, the highest rate allowable under the law.
3. Chargebacks: We understand that travel may not go as planned. However, trip payments are a binding agreement where you give the Travel Agency approval and authorization to charge your credit card for the approved amount. As such, you and each member of your travel party waive any right to a chargeback for any reason (except fraud), including, but not limited to, a force majeure event and cancellation for any reason. If there is any refund owed pursuant to this Agreement, the Travel Agency will put forth our best efforts to provide that refund to you within a reasonable amount of time. You understand and agree that any refund from a Service Provider is also subject to the terms of conditions of the applicable Service Provider, including the form in refund being in the form paid or a travel credit. There may be a delay in obtaining refunds, including credits, from that Service Provider to then provide you with such refund. This process may take a while. We ask for patience in this process and that you do not request a chargeback with your credit card company. Going through this process will cause a delay in the refund process.
In the event that you attempt, without our authorization, to chargeback, reverse, or recollect a trip payment already made, you agree to pay the Travel Agency a $100.00 fee to cover the time and effort to provide information to your credit card company. This fee will be charged to the card upon which the initial deposit was made. This will be charged regardless of if the chargeback is successful. In addition, we reserve the right to collect all additional costs, fees, and expenses associated with such chargeback, reversal, or recollection including, without limitation, attorney fees. The provisions of this Section shall survive termination of this Agreement.
4. Other Provisions: The provisions set forth in the Terms and Conditions Agreement previously executed by you equally apply to this Agreement as if fully set forth herein.
