YOUR AGREEMENT WITH THE TRAVELING CHUCKS

THE TRAVELING CHUCKS, LLC, acts as a sales agent for any airline, hotel, car-rental company, tour operator, cruise line, bus/train company, hotel, or other service provider named in your itinerary (Suppliers”).  We are not responsible for acts or omissions of the Suppliers or their failure to provide services or adhere to their own schedules.

We are not responsible for acts or omissions of Suppliers or its failure to provide services, adhere to its own schedules, or make refunds owed. We do not guarantee or insure the Supplier. We assume no responsibility for and shall not be liable for any wrongful or negligent acts or omissions on the part of the Supplier.  You hereby release us from all claims arising out of any problem covered in this paragraph. THE TRAVELING CHUCKS assumes no responsibility for and shall not be liable for any refund, personal injury, property damage, or other loss, accident, delay, inconvenience, or irregularity which may be caused by: (1) any defaults, wrongful or negligent acts, or omissions of the Suppliers; (2) any defect in or failure of any vehicle, craft, equipment, or instrumentality owned, operated, or otherwise used or provided by the Suppliers; (3) any wrongful or negligent acts or omissions on the part of any other party not under ABCs control; and (4) any Supplier price drop after your travel arrangements have been confirmed, paid in full, or ticketed. You hereby release THE TRAVELING CHUCKS from all claims arising out of any problem covered in this paragraph.

Travel arrangements involving airline and cruise components are subject to supplemental price increases that may be imposed by the supplier and/or government after you have completed your purchase. You hereby consent to any such price increases and authorize your credit or debit card to be used for them. Suppliers have their own contracts covering cancellation penalties and other terms and conditions, and that you may be bound by those contracts regardless of whether you receive notice of their terms. By signing below, you are consenting to those terms and conditions.

If THE TRAVELING CHUCKS is the merchant on your credit card transaction, you agree to the following: THE TRAVELING CHUCKS' services consist of facilitating the sale and paying the Suppliers, and once THE TRAVELING CHUCKS provides said services, you agree not to dispute the credit card charge. If a Supplier does not provide the service or ceases operations, your only recourse will be against the Supplier. If a Supplier goes bankrupt, your only recourse will be to file a claim with the Suppliers bankruptcy court.

THE TRAVELING CHUCKS has no special knowledge regarding the financial condition of the Suppliers, unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which may travel.  For information concerning possible dangers at destinations, THE TRAVELING CHUCKS recommend contacting the Travel Warnings Section of the U.S. State Department at (202) 647-5225 or www.travel.state.gov.  For medical information, THE TRAVELING CHUCKS recommend contacting the Centers for Disease Control at (877) FYI-TRIP or www.cdc.gov/travel.  You assume full and complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of your destination(s), and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination(s).  You hereby release THE TRAVELING CHUCKS from all claims arising out of any problem covered in this paragraph. You agree that the courts in Fulton County, Georgia will be the exclusive jurisdiction for all claims brought by you or THE TRAVELING CHUCKS, and you hereby submit to the personal jurisdiction of those courts. Certain bookings cannot be changed. In the event you need to make changes to a booking and a change is possible, you will be assessed a $25 administrative fee or more per person/per change.

For your protection, we strongly recommend that you purchase trip cancellation and travel accident insurance. However, no representation or description of the insurance made by our staff constitutes a binding assurance or promise about the insurance. We also strongly recommend that you use a credit card for your purchase, so that you can exercise your rights under the Fair Credit Billing Act if you do not receive the services you purchased.

PAYMENTS AND CANCELLATIONS

A deposit is due at the time a reservation is made. All payments are NON-REFUNDABLE and non-transferrable. All prices quoted in your prices quoted in your proposal are subject to change and are based on availability. 

Unless otherwise stated in your travel proposal or booking page, you can cancel and receive a refund of your payment, less your non-refundable deposit and any supplier-imposed penalties. Cancellation of a reservation after the final payment has been received, is subject to supplier imposed penalties/fees and a $100 cancellation fee per person. ALL payments for hosted Traveling Chucks experiences are non-refundable. All planning fees are non-refundable. 

Unless otherwise defined during the reservation process, final payment is 60 days due prior to departure or consumption according to each supplier’s (airline, hotel, cruise line, Transfer Company, sightseeing operators, and other travel service vendors) terms and conditions involved in your travel booking. If final and full payment is not received by the applicable due date, reservations are subject to cancellation and deposits shall be forfeited. In some cases there is NO REFUND once a booking is made and paid for. Your right to a refund if you change or cancel your travel plans is limited. All cancellation requests must be sent to THE TRAVELING CHUCKS in writing. As a result of cancellation, THE TRAVELING CHUCKS’ and third party supplier’s cancellation penalties will apply, which are detailed in your travel documentation, each supplier’s Web sites and www.thetravelingchucks.co cancellation penalties are advised at time of booking and provided to you upon confirmation. If you have any questions, or any penalties are unclear, please contact us. All cancellation fees will be charged to the credit card you authorized to pay for travel services, or deducted from the supplier’s refund.
