Deck the Spa 2026
This Motorcoach Tour Services Agreement and Terms and Conditions (“Agreement”) is entered into between Destins by Dorsey, LLC, doing business as Travel Destinistas (“Travel Destinistas,” “Agency,” “we,” “us,” or “our”), and the individual traveler completing the reservation (“Traveler,” “you,” or “your”).
By electronically accepting this Agreement, submitting a reservation, and/or making any payment toward Deck the Spa 2026, you acknowledge that you have read, understand, and agree to be bound by these terms.

1. RESERVATIONS

A reservation is not confirmed until the required deposit has been successfully processed and the Traveler has completed all required booking information and accepted the applicable Terms and Conditions.
Reservations are subject to availability.
Travel Destinistas may close registration before the published deadline if available capacity has been reached.
Travelers are responsible for providing complete and accurate information when booking.
2. PRICING
Deck the Spa 2026 pricing is based upon the date the reservation is completed and the applicable pricing period:
Early Bird: $325 per person through October 4, 2026
Regular Price: $350 per person from October 5 through November 8, 2026
Last Minute Price: $385 per person from November 9 through November 15, 2026
Published pricing is subject to availability.
Once a reservation has been completed at the applicable published price, subsequent promotions or price changes do not entitle the Traveler to a refund, credit, or price adjustment unless Travel Destinistas expressly states otherwise in writing.
3. DEPOSIT AND FINAL PAYMENT
A $100 nonrefundable deposit per person is required to reserve a seat.
Final payment is due no later than November 15, 2026.
Travelers may make additional payments toward their balance before the final payment deadline.
Failure to pay the remaining balance by the published deadline may result in cancellation of the reservation without refund of amounts previously paid.
Travel Destinistas is not obligated to provide reminders regarding payment deadlines. The Traveler remains responsible for monitoring and satisfying all payment obligations.
4. NONREFUNDABLE AND NONTRANSFERABLE PAYMENTS
Except where otherwise required by applicable law, all payments made to Travel Destinistas for Deck the Spa 2026 are nonrefundable and nontransferable.
This policy applies to voluntary cancellation, inability to attend, illness, scheduling conflicts, transportation issues affecting the Traveler's ability to reach the departure location, failure to arrive on time, and other circumstances personal to the Traveler.
Failure to attend does not constitute cancellation by Travel Destinistas and does not create a right to a refund, credit, or transfer.
5. TRAVELER CANCELLATION
All cancellation requests must be submitted to Travel Destinistas in writing.
The date Travel Destinistas receives the written cancellation will constitute the effective cancellation date.
Because payments are nonrefundable and nontransferable, cancellation by the Traveler does not create an entitlement to reimbursement, future travel credit, or substitution of another traveler except where required by applicable law or expressly authorized by Travel Destinistas in writing.

8. ITINERARY AND SCHEDULE CHANGES
The currently published schedule is tentative.
Departure, arrival, reboarding, return times, activities, amenities, and other itinerary components may change because of traffic, weather, road conditions, operational requirements, supplier decisions, safety considerations, or circumstances outside Travel Destinistas' reasonable control.
Travel Destinistas reserves the right to make reasonable itinerary modifications when necessary.
A reasonable itinerary, schedule, amenity, or supplier modification does not automatically constitute cancellation of the tour or create an entitlement to a refund.
9. MOTORCOACH DEPARTURE AND LATE ARRIVAL
Travelers are responsible for arriving at the designated Houston pickup location by the communicated check in time.
The motorcoach is scheduled to depart promptly.
Travel Destinistas and the motorcoach operator are not required to delay departure for late arriving Travelers.
A Traveler who misses the motorcoach is responsible for all costs associated with reaching WorldSprings independently, if doing so remains possible.
No refund or credit will be issued for missing the motorcoach because of late arrival.
The same requirements apply to the scheduled departure from WorldSprings.
A Traveler who fails to return to the designated meeting location by the announced reboarding time may be responsible for arranging and paying for independent transportation back to Houston.
10. THIRD PARTY SUPPLIERS
Travel Destinistas arranges services provided by independent third parties, which may include motorcoach operators, WorldSprings, restaurants, wellness providers, and other vendors.
These suppliers are independent entities and are not employees or agents of Travel Destinistas except to the extent applicable law expressly provides otherwise.
Travel Destinistas does not control the day to day operations, personnel, equipment, premises, policies, or performance of independent suppliers.
Supplier services are subject to the supplier's own rules, availability, operating procedures, safety requirements, and terms.
11. ASSUMPTION OF RISK
Traveler understands that participation in motorcoach transportation, mineral pools, hot water environments, saunas, steam or heat experiences, cold plunges, wet surfaces, walking areas, food and beverage services, wellness activities, and group travel involves inherent and other risks.
These risks may include, without limitation, slips and falls, exposure to heat or cold, dehydration, transportation incidents, illness, physical injury, allergic reactions, actions of other participants, and risks associated with third party facilities and services.
Traveler voluntarily chooses to participate in Deck the Spa 2026 with knowledge that such risks exist and assumes the risks inherent in the activities in which Traveler elects to participate, to the extent permitted by applicable law.
12. HEALTH AND PERSONAL RESPONSIBILITY
Traveler is responsible for determining whether participation in the trip and any activity is appropriate for the Traveler's individual circumstances.
Travelers should consult an appropriate medical professional before participating in activities involving heat, cold immersion, mineral pools, saunas, or other wellness experiences when they have questions or concerns regarding their ability to participate safely.
Travel Destinistas does not provide medical advice or medical supervision.
Travelers are responsible for medications, mobility needs, dietary considerations, allergies, and other personal requirements.
In an emergency, Traveler authorizes Travel Destinistas to contact emergency services when reasonably necessary. Any medical, transportation, or other expenses incurred remain the responsibility of the Traveler.
13. ALCOHOL AND INTOXICATION
Alcohol consumption is voluntary and at the Traveler's own expense.
Travelers who choose to consume alcohol are responsible for doing so responsibly and complying with WorldSprings and supplier policies.
Travel Destinistas reserves the right to deny continued participation to a Traveler whose intoxication or conduct creates a reasonable safety concern or materially interferes with the experience of other guests.
No refund will be provided when participation is terminated because of prohibited or materially disruptive conduct.
14. TRAVELER CONDUCT
Travel Destinistas is committed to maintaining a safe and respectful group environment.
Travelers may not engage in threatening behavior, harassment, violence, verbal abuse, discrimination, intentional property damage, dangerous conduct, material disruption of the group, or repeated refusal to follow reasonable safety instructions.
Travel Destinistas reserves the right to terminate a Traveler's participation when reasonably necessary to protect the safety, welfare, or experience of the group.
A Traveler removed for conduct reasons will be responsible for arranging and paying for transportation and other expenses resulting from removal.
15. AGE REQUIREMENT AND IDENTIFICATION
Deck the Spa 2026 is restricted to Travelers age 21 and older.
Travelers may be required to present valid government issued photo identification.
A Traveler who cannot establish eligibility to participate may be denied participation without refund.
16. PHOTOGRAPHY, VIDEO, AUDIO AND PUBLICITY RELEASE
This section should be conspicuous on your checkout page.
By participating in Deck the Spa 2026, Traveler understands and agrees that photography, video recording, audio recording, and other media may occur throughout the experience, including aboard the motorcoach, during group activities, at WorldSprings, and during other portions of the event.
Traveler grants Destins by Dorsey, LLC, doing business as Travel Destinistas, permission to photograph, film, record, reproduce, edit, publish, display, distribute, and otherwise use Traveler's image, likeness, voice, appearance, and statements captured during the event for lawful business, advertising, promotional, marketing, social media, website, email, print, and related commercial purposes.
Such materials may be used without additional notice, approval, inspection, or compensation to Traveler.
Traveler understands that photographs and recordings may be published publicly and may remain available after the event.
This authorization applies to photographs and recordings created by or on behalf of Travel Destinistas during the event.
If you intend to use guest submitted photographs too, I would add a separate provision for that rather than trying to stretch this release to cover media you did not create.
17. FORCE MAJEURE
Travel Destinistas shall not be responsible for failure, interruption, delay, modification, or cancellation caused by circumstances beyond its reasonable control, including severe weather, natural disasters, governmental action, road closures, transportation disruptions, labor disputes, public health emergencies, civil unrest, terrorism, supplier failure, utility interruption, or other events that could not reasonably be prevented or controlled by Travel Destinistas.
When such circumstances occur, Travel Destinistas may make reasonable changes to the itinerary, timing, suppliers, transportation, or activities.
Refunds, credits, or rescheduling in such circumstances will depend upon amounts actually recoverable from suppliers, contractual obligations, applicable law, and the specific circumstances involved.
I prefer this language over “no refunds under any circumstances” because it avoids promising something your supplier contracts or applicable law may ultimately prevent you from enforcing.
18. TRIP CANCELLATION BY TRAVEL DESTINISTAS
This is missing from your old agreement and I consider it important.
Travel Destinistas reserves the right to cancel Deck the Spa 2026 when reasonably necessary because of insufficient participation, supplier cancellation, safety concerns, force majeure, or circumstances materially affecting the ability to operate the experience.
If Travel Destinistas voluntarily cancels the entire event for reasons within its reasonable control and does not provide a substitute or rescheduled experience, amounts paid directly to Travel Destinistas will be handled in accordance with the applicable supplier contracts and law.
Travel Destinistas is not responsible for consequential or incidental expenses independently incurred by Traveler, including transportation to the Houston departure point, accommodations, personal purchases, or other arrangements not purchased directly through Travel Destinistas, except where otherwise required by law.
19. TRAVEL INSURANCE
Travel insurance is strongly recommended.
Travelers are responsible for reviewing insurance terms, coverage, exclusions, eligibility requirements, and applicable deadlines directly with the insurance provider.
Travel Destinistas does not guarantee that any particular loss, cancellation, illness, delay, or other circumstance will be covered by an insurance policy.
Insurance claims must be submitted directly to the applicable insurance provider.
20. CHARGEBACKS AND PAYMENT DISPUTES
I would replace your current Section 17 completely.
Traveler acknowledges that the refund and cancellation policies contained in this Agreement are disclosed before purchase.
Before initiating a payment dispute concerning a matter that may reasonably be resolved directly with Travel Destinistas, Traveler is encouraged to contact Travel Destinistas and provide a reasonable opportunity to review and respond to the concern.
A Traveler's voluntary cancellation, failure to attend, late arrival, missed motorcoach departure, removal for prohibited conduct, or dissatisfaction with a service that was provided substantially as described does not, by itself, alter the agreed refund policy.
Nothing in this Agreement waives or restricts any right that cannot lawfully be waived, including applicable rights relating to unauthorized transactions or legitimate billing errors.
Traveler remains responsible for amounts properly due under this Agreement and for lawful costs or fees recoverable in connection with a wrongful payment dispute, to the extent permitted by applicable law.
That last paragraph is considerably safer than “you agree not to initiate chargebacks for any reason.” The CFPB specifically recognizes consumer rights to dispute certain billing errors and charges, so I would not put language into your contract that purports to eliminate those rights.
21. LIMITATION OF LIABILITY AND RELEASE
This is the section I especially want reviewed by your Texas attorney.
To the fullest extent permitted by applicable law, Traveler releases and agrees not to hold Destins by Dorsey, LLC, doing business as Travel Destinistas, and its owners, officers, employees, representatives, contractors, and agents liable for losses, damages, injuries, delays, or expenses arising from inherent travel risks, acts or omissions of independent third party suppliers, or circumstances outside Travel Destinistas' reasonable control.
Any release relating to Travel Destinistas' own negligence is intended to apply only to the extent expressly permitted by Texas law.
Nothing in this Agreement is intended to release liability that cannot legally be waived.
Texas courts have applied special fair notice requirements to advance releases purporting to relieve a party from its own negligence, which is why I would not simply write “Travel Destinistas isn't liable for anything.”
22. DISPUTE RESOLUTION AND BINDING ARBITRATION
Any dispute arising from or relating to this Agreement or participation in Deck the Spa 2026 that cannot be resolved informally shall, to the extent permitted by applicable law, be resolved through binding individual arbitration in Harris County, Texas.
The arbitration shall be conducted by a mutually agreed arbitration provider under the applicable consumer arbitration rules.
Claims shall be brought individually and not on behalf of a purported class or consolidated proceeding, to the extent permitted by applicable law.
The arbitrator shall have authority to award remedies available under applicable law.
Texas law recognizes contractual binding arbitration arrangements, but the exact arbitration procedure should be specified rather than merely saying “binding arbitration in Houston.”
Your attorney should determine whether you want AAA, JAMS, or another specified administrator and whether a class action waiver belongs here.
23. GOVERNING LAW
This Agreement shall be governed by the laws of the State of Texas, without regard to conflict of law principles, except where federal law controls.
24. ELECTRONIC COMMUNICATIONS
Traveler consents to receive trip related communications electronically at the email address and telephone number provided during booking.
Traveler is responsible for providing accurate contact information and monitoring communications concerning payment deadlines, departure information, itinerary changes, and other important event information.
25. PERSONAL PROPERTY
Travelers are responsible for safeguarding their own money, electronics, jewelry, luggage, clothing, and other personal property.
Travel Destinistas is not responsible for personal property lost, forgotten, stolen, damaged, or left aboard transportation or at a supplier facility except to the extent liability cannot legally be excluded.
26. ACCOMMODATIONS AND ACCESSIBILITY
Travelers requiring accessibility accommodations or assistance should notify Travel Destinistas before booking or as early as reasonably possible.
Travel Destinistas will communicate reasonable requests to applicable suppliers but cannot guarantee that every requested accommodation can be provided by independent suppliers.
Travelers remain responsible for evaluating whether the transportation, facilities, and activities are appropriate for their individual needs.
27. SEVERABILITY
If any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in effect to the fullest extent permitted by law.
28. ENTIRE AGREEMENT
This Agreement, together with any specifically incorporated Travel Destinistas Terms and Conditions and applicable booking disclosures, constitutes the agreement between the parties regarding Deck the Spa 2026.
No oral representation or informal communication modifies this Agreement unless confirmed in writing by Travel Destinistas.
29. ELECTRONIC ACCEPTANCE
By checking the acknowledgment box and completing the booking process, Traveler confirms:
“I have read and understand the Deck the Spa 2026 Motorcoach Tour Services Agreement and Terms and Conditions. I understand the cancellation and nonrefundable payment policies, assumption of risk provisions, photography and publicity release, and dispute resolution provisions, and I agree to be bound by them.”
