Cancellation-Refund policy:

- All Payments made to Laugh Travel & Live can be cancelled or refunded within 2 days of registering for the group trip.

-After these 2 days have passed, all payments made to Laugh Travel & Live will be nontransferable and nonrefundable.

-Refund window is 2 days(48 hours) after your initial trip registration date.

-Hosted Group trips with Laugh Travel Live host cancelled, will incur a $100 per person cancelation fee.

-Travel insurance that covers nonrefundable/nontransferable policies such as this are available

- In the event that a trip has to be rescheduled do to COVID restrictions the same terms will apply to the rescheduled or future trip.

The arbitrator's award shall be final, and judgment may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding or arbitration arises out of or concerns these Terms and Conditions, the prevailing party shall be entitled to recover its costs and reasonable attorney's fees. The parties agree to arbitrate all disputes and claims in regards to these Terms and Conditions or any disputes arising as a result of these Terms and Conditions, whether directly or indirectly, including Tort claims that are a result of these Terms and Conditions. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, including the scope and enforceability of this arbitration provision shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms and Conditions.

Class Action Waiver

Any arbitration under these Terms and Conditions will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH'S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE AND/ OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. LAUGH TRAVEL & LIVE AND/OR ITS SUPPLIERS HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH REGARD TO THIS INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LAUGH TRAVEL & LIVE AND/OR ITS SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE SITE, WITH THE DELAY OR INABILITY TO USE THE SITE OR RELATED SERVICES, THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS OBTAINED THROUGH THE SITE, OR OTHERWISE ARISING OUT OF THE USE OF THE SITE, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF LAUGH TRAVEL & LIVE OR ANY OF ITS SUPPLIERS HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES. BECAUSE SOME STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE SITE, OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SITE.

Termination/Access Restriction

Laugh Travel & Live reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of Florida and you hereby consent to the exclusive jurisdiction and venue of courts in Florida in all disputes arising out of or relating to the use of the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section.

You agree that no joint venture, partnership, employment, or agency relationship exists

between you and Laugh Travel & Live as a result of this agreement or use of the Site. Laugh Travel & Live's performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Laugh Travel & Live's right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by Laugh Travel & Live with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.

Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and Laugh Travel & Live with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and Laugh Travel & Live with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.

Changes to Terms

Laugh Travel & Live reserves the right, in its sole discretion, to change the Terms under which www.LaughTravelLive.com is offered. The most current version of the Terms will supersede all previous versions. Laugh Travel & Live encourages you to periodically review the Terms to stay informed of our updates.

The traveler authorizes Laugh Travel & Live and any employees, agents or third party affiliates to use ,copyright and publish these social media posts, videos, photos of Traveler(s) electronically or in print with or without the use of Traveler(s) name for lawful purposes such as publicity, advertising, illustration, promotion, internet content, social media and fund raising

Payment

I understand that there shall be no payment for this release.

Royalties

I understand that no royalty, fee, or other compensation shall become payable to me by reason of such use.

Revocation

I understand that with my authorization below the photograph(s) may never be revoked.

I hereby waive any right to inspect or approve the finished photographs or electronic matter that may be used in conjunction with them now or in the future, whether that use is known to me or unknown, and I waive any right to royalties or other compensation arising from or related to the use of the image.

RELEASE OF LIABILITY

In exchange for participation in the activity of traveling services, activities, transportation and events which may be provided by separate vendors and is organized by Laugh Travel & Live, of Florida, and/or use of the property, facilities and services of Laugh Travel & Live, I agree for myself and (if applicable) for the members of my family, to the following:

1. AGREEMENT TO FOLLOW DIRECTIONS. I agree to observe and obey all posted rules and warnings, and further agree to follow any oral instructions or directions given by Laugh Travel & Live, or the employees, representatives or agents of Laugh Travel & Live.

2. ASSUMPTION OF THE RISKS AND RELEASE. I recognize that there are certain inherent risks associated with the above described activity and I assume full responsibility for personal injury to myself and (if applicable) my family members, and further release and discharge Laugh Travel & Live for injury, loss or damage arising out of my or my family's use of or presence upon the facilities of Laugh Travel & Live, whether caused by the fault of myself, my family, Laugh Travel & Live or other third parties.

3. INDEMNIFICATION. I agree to indemnify and defend Laugh Travel & Live against all claims, causes of action, damages, judgments, costs or expenses, including attorney fees and other litigation costs, which may in any way arise from my or my family's use of or presence upon the facilities of Laugh Travel & Live.

4. FEES. I agree to pay for all damages to the facilities of Laugh Travel & Live caused by any negligent, reckless, or willful actions by me or my family.

5. CONSENT. I, Traveler of Laugh Travel & Live, consent to the participation of my Traveler, Traveler, in the activity of traveling services, activities, transportation and events which may be provided by separate vendors and is, and agree on behalf of the above minor to all of the terms and conditions of this Agreement. By signing this Release of Liability, I represent that I have legal authority over and custody of Traveler.

6. MEDICAL AUTHORIZATION. In the event of an injury to myself or a listed minor during the above described activities, I give my permission to Laugh Travel & Live or to the employees, representatives or agents of Laugh Travel & Live to arrange for all necessary medical treatment for which I shall be financially responsible. This temporary authority will begin on date of trip departure and will remain in effect until terminated in writing by the undersigned or when the above described activities are completed. Laugh Travel & Live shall have the following powers:

a. The power to seek appropriate medical treatment or attention on behalf of me or my child as may be required by the circumstances, including without limitation, that of a licensed medical physician and/or a hospital;

b. The power to authorize medical treatment or medical procedures in an emergency situation; and

c. The power to make appropriate decisions regarding clothing, bodily nourishment and shelter.

7. APPLICABLE LAW. Any legal or equitable claim that may arise from participation in the above shall be resolved under Florida law.

8. NO DURESS. I agree and acknowledge that I am under no pressure or duress to sign this Agreement and that I have been given a reasonable opportunity to review it before signing. I further agree and acknowledge that I am free to have my own legal counsel review this Agreement if I so desire. I further agree and acknowledge that Laugh Travel & Live has offered to refund any fees I have paid to use its facilities if I choose not to sign this Agreement.

9. ARM'S LENGTH AGREEMENT. This Agreement and each of its terms are the product of an arm's length negotiation between the Parties. In the event any ambiguity is found to exist in the interpretation of this Agreement, or any of its provisions, the Parties, and each of them, explicitly reject the application of any legal or equitable rule of interpretation which would lead to a construction either "for" or "against" a particular party based upon their status as the drafter of a specific term, language, or provision giving rise to such ambiguity.

10. ENFORCEABILITY. The invalidity or unenforceability of any provision of this Agreement, whether standing alone or as applied to a particular occurrence or circumstance, shall not affect the validity or enforceability of any other provision of this Agreement or of any other applications of such provision, as the case may be, and such invalid or unenforceable provision shall be deemed not to be a part of this Agreement.

11. DISPUTE RESOLUTION. The parties will attempt to resolve any dispute arising out of or relating to this Agreement through friendly negotiations amongst the parties. If the matter is not resolved by negotiation, the parties will resolve the dispute using the below Alternative Dispute Resolution (ADR) procedure.

Any controversies or disputes arising out of or relating to this Agreement will be submitted to mediation in accordance with any statutory rules of mediation. If mediation is not successful in resolving the entire dispute or is unavailable, any

outstanding issues will be submitted to final and binding arbitration under the rules of the American Arbitration Association. The arbitrator's award will be final, and judgment may be entered upon it by any court having proper jurisdiction.

Travels Disclaimer and Insurance Waiver

I understand that Laugh Travel & Live and Racquel Nicholson are not the source or supplier of the travel services I have requested, and acts solely as an agent for the actual suppliers of such services. I have been advised that the suppliers whose names appear in the information supplied to me are those who are actually responsible for providing the travel services I have purchased. I consent to and request the use of those suppliers and agree not to hold Laugh Travel & Live or Racquel Nicholson responsible should any of these suppliers: 1) fail to provide the travel services I have purchased; 2) fail to comply with any applicable law; or 3) engage in any negligent act or omission that causes me any sort of injury, damage, delay or inconvenience.

I accept that Laugh Travel & Live and Racquel Nicholson are not responsible for, nor will I attempt to hold either of them liable for any injury, damage or loss I may suffer on the account of any conditions, actions or omissions that are beyond reasonable control. I agree that this disclaimer includes the entire traveling party and that in the event of any disputes; they may only be litigated in the state of Florida, Palm Beach County, with a maximum penalty not to exceed the total earned by Laugh Travel & Live or Racquel Nicholson in the original transaction.

I will review my travel documents for accuracy upon receipt and understand that I may contact Laugh Travel & Live if I have any questions. I understand that discounted fares typically involve restrictions and that changing any aspect of my travel arrangements may result in the payment of additional money. Conversely, cancellation of any aspect of my travel arrangements may result in financial penalties, in accordance with the supplier’s cancellation policies.

I have been advised to use a form of payment other than cash or check that may offer me the opportunity to dispute the charge should a vendor cease operating, and I have been advised that most Airlines are currently operating under Chapter 11 bankruptcy protection.

Privacy notice:

The Transportation Security Administration (TSA) requires you to provide your full name, date of birth and gender for the purpose of security screening, under the authority of 49 U.S.C. section 114, the Intelligence Reform and Terrorism Prevention Act of 2004 and 49 C.F.R parts 1540 and 1560. You may also provide your Redress Number, if available. Failure to provide your full name, date of birth and gender may result in denial of transport or denial of authority to enter the boarding area. The TSA may share information you provide with law enforcement or intelligence agencies or others under its published system of records notice. For more on the TSA's privacy policies, or to review the system of records notice and the privacy impact assessment, please see the TSA website at www.tsa.gov.

I understand that the Transportation Security Administration requires me to carry a government issued identification card in order to board a flight. I have been advised that the name, date of birth and gender that appears on my identification card must exactly match the same such data that is listed on my airline ticket and in my booking records. I acknowledge that my failure to strictly comply with these requirements may result in denied boarding or an undue delay at an airport security checkpoint causing me to miss my flight.

Laugh Travel & Live is not responsible for the issuance of travel identification such as passports and/or visas and travelers should ensure they have or have been approved for the appropriate documents before purchasing travel.

I understand that if traveling internationally, I must have a valid passport and depending upon my destination and nationality, I may need to obtain one or more visas.

NOTE TO CLIENT: Passport and visa information may be obtained by contacting the Travel Advisory Section of the US State Department at 202.647.5225 or by visiting the State Department’s website at travel.state.gov. Non-US passport holders should be sure to contact the embassies of their destination and transit countries to obtain entrance requirements. To obtain medical information, you may contact the Centers for Disease Control at 404.332.4559 or visit the CDC’s website at www.cdc.gov.

I understand that the airline tickets, air tours or other products I am purchasing are subject to supplemental price increases that may be imposed after the date of purchase. Post-purchase price increases may be applied due to additional costs imposed by a supplier or government. I acknowledge that I may be charged additional sums by Laugh Travel & Live to offset increased fees, fuel surcharges, taxes, and fluctuations in foreign exchange markets or any combination thereof. I hereby consent to any post-purchase price increases and authorize Laugh Travel & Live to charge payment for such additional amounts after I have been notified of pricing change.

In some locations, your aircraft may be subject to insecticide spraying prior to the flight or while you are on the aircraft, you are strongly encouraged to always check the list of countries that require airlines to treat the passenger cabin with insecticides http://alturl.com/3rtty as this list is updated regularly.

I understand travel insurance has been offered to me for purchase to cover certain risks inherent in travel such as supplier bankruptcy, trip interruption and/or the inability to travel due to a medical or personal emergency. If I choose not to purchase travel insurance or if I purchase travel insurance on my own (not through Laugh Travel & Live), I understand that Laugh Travel & Live requires that I confirm or decline insurance in writing.

This is to confirm that, in keeping with all applicable laws, I am instructing the above agent to purchase travel and/or travel insurance against the form of payment verbally instructed.

I further understand that I have authorized this transaction and will hold Racquel Nicholson and Laugh Travel & Live harmless with respect to these instructions. It is understood that the above agency may request government issued photo identification and may verify the billing address of the card.

INDEMNITY AGREEMENT

This INDEMNITY AGREEMENT (this "Agreement") is made effective on May 11, 2020 by and between the Laugh Travel & Live (hereinafter, "Laugh Travel & Live"), of Florida and Traveler of Laugh Travel & Live Trips (hereinafter, "Traveler of Laugh Travel & Live Trips"), of Laugh Travel & Live and Traveler of Laugh Travel & Live Trips are sometimes individually referred to as "Party" and collectively referred to as the "Parties."'

WHEREAS, Traveler of Laugh Travel & Live will be performing the following services for Traveler of Laugh Travel & Live: Travel, activities, events, transportation; and

WHEREAS, in exchange for valuable consideration, Traveler of Laugh Travel & Live Trips desires to indemnify Laugh Travel & Live from any claims and/or litigation arising out of Traveler of Laugh Travel & Live Trips's performance of the work of providing these services.

NOW THEREFORE, in consideration of the mutual covenants and conditions contained herein, Laugh Travel & Live and Traveler of Laugh Travel & Live Trips hereby agree as follows:

TERMS

1. Indemnification. Traveler of Laugh Travel & Live Trips shall fully defend, indemnify, and hold harmless Laugh Travel & Live from any and all claims, lawsuits, demands, causes of action, liability, loss, damage and/or injury, of any kind whatsoever ( including without limitation all claims for monetary loss, property damage, equitable relief, personal injury and/or wrongful death), whether brought by an individual or other entity, or imposed by a court of law or by administrative action of any federal, state, or local governmental body or agency, arising out of, in any way whatsoever, any acts, omissions, negligence, or willful misconduct on the part of Traveler of Laugh Travel & Live Trips, its officers, owners, personnel, employees, agents, contractors, invitees, or volunteers . This indemnification applies to and includes, without limitation, the payment of all penalties, fines, judgments, awards, decrees, attorneys' fees, and related costs or expenses, and any reimbursements to Laugh Travel & Live for all legal fees, expenses, and costs incurred by it.

2. Authority to Enter Agreement. Each Party warrants that the individuals who have signed this Agreement have the actual legal power, right, and authority to make this Agreement and bind each respective Party.

3. Amendment; Modification. No supplement, modification, or amendment of this Agreement shall be binding unless executed in writing and signed by both Parties.

4. Waiver. No waiver of any default shall constitute a waiver of any other default or breach, whether of the same or other covenant or condition. No waiver, benefit, privilege, or service voluntarily given or performed by a Party shall give the other Party any contractual right by custom, estoppel, or otherwise.

5. Attorneys' Fees and Costs. If any legal action or other proceeding is brought in connection with this Agreement, the successful or prevailing Party, if any, shall be entitled to recover reasonable attorneys' fees and other related costs, in addition to any other relief to which that Party is entitled. In the event that it is the subject of dispute, the court or trier of fact who presides over such legal action or proceeding is empowered to determine which Party, if any, is the prevailing party in accordance with this provision.

6. Entire Agreement. This Agreement contains the entire agreement between the Parties related to the matters specified herein, and supersedes any prior oral or written statements or agreements between the Parties related to such matters.

7. Enforceability, Severability, and Reformation. If any provision of this Agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If a court finds that any provision of this Agreement is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited. The intent of the Parties is to provide as broad an indemnification as possible under Florida law. In the event that any aspect of this Agreement is deemed unenforceable, the court is empowered to modify this Agreement to give the broadest possible interpretation permitted under Florida law.

8. Applicable Law. This Agreement shall be governed exclusively by the laws of Florida, without regard to conflict of law provisions.

9. Exclusive Venue and Jurisdiction. Any lawsuit or legal proceeding arising out of or relating to this Agreement in any way whatsoever shall be exclusively brought and litigated in the federal and state courts of Florida. Each Party expressly consents and submits to this exclusive jurisdiction and exclusive venue. Each Party expressly waives the right to challenge this jurisdiction and/or venue as improper or inconvenient. Each Party consents to the dismissal of any lawsuit that they bring in any other jurisdiction or venue.

10. Signatures. This Agreement shall be signed on behalf of Laugh Travel & Live by Racquel Nicholson, Ms., and on behalf of Traveler of Laugh Travel & Live Trips by Traveler of Laugh Travel & Live Trips, and effective as of the date first written above.
