Terms & Conditions

We are Love + Leisure Boutique Travel Agency and are excited to help you with your travel. The following terms & conditions (the "Agreement") describe what you can expect from us. The terms "we", "us", "our", and "Travel Agency" refer to Love + Leisure Boutique Travel Agency and the terms  "I", "they", "traveler", "passenger",  "group leader", or "you" refers to the individual who signs this agreement.  If you are obtaining a quote for and/or securing or procuring travel for more than just yourself, all references below that reads “I” (and derivations thereof, including without limitation “you”) shall be read to mean you on behalf of yourself and each individual within your group for whom you are obtaining a quote and/or securing or procuring travel.

 
THIS IS A LEGALLY BINDING WORKING, RELEASE, WAIVER OF LIABILITY, AND ASSUMPTION OF RISK AGREEMENT (the “Agreement”). Please read it carefully before signing/accepting/acknowledging.
 
 
I understand that Love + Leisure Boutique Travel Agency, is not the source or supplier of the travel services, airline travel, or any third party operated excursion or activity that I have requested, and acts solely as an agent for the actual suppliers of such services. I have been advised that the suppliers whose names appear in the information supplied to me are those who are actually responsible for providing the services I have purchased. I consent to and request the use of those suppliers and agree not to hold Love + Leisure Boutique Travel Agency responsible should any of these suppliers: 1) fail to provide the travel services I have purchased; 2) fail to comply with any applicable law; or 3) engage in any negligent act or omission that causes me any sort of injury, damage, delay or inconvenience. Love and Leisure Boutique Travel Agency can accept no responsibility for losses or additional expenses due to delay or changes in air, sea or other services, sickness, weather, strike, war, quarantine or other causes.
 
I agree that neither Love and Leisure Boutique Travel Agency nor its parent, affiliates, subsidiaries or representatives will be or become liable or responsible in any way for any loss, costs, expense, injury, accident or damage to person or property resulting directly or indirectly from (i) the acts or omissions of the suppliers, including, but not limited to, delays or cancellation of services, cessation of operations, breakdown in machinery or equipment, technology problems, or changes in fares, itineraries or schedules, and/or (ii) acts of God, fire, acts of government or other authorities, wars, acts of terrorism, piracy, civil unrest, strikes, riots, thefts, pilferage, pandemics, epidemics, quarantines, other diseases, climatic aberrations, dangers incident to activities or from any other cause beyond Love + Leisure Boutique Travel Agency control. (iii) Chargebacks from guests in the group; the group leader will be responsible.
 
I affirm that I am voluntarily participating in the travel services that Love + Leisure Boutique Travel Agency has reserved. In addition, Love + Leisure Boutique Travel Agency is not responsible for special, indirect or consequential damages. I hereby agree to indemnify and hold Love + Leisure Boutique Travel Agency harmless from and against any and all claims, liabilities, and costs of any kind (including the costs of reasonable attorney’s fees and disbursements in defending such claims) to which they may be subject by reason of its negligence, the breach of this contract, or any other of its action. I understand that all reservation fares typically involve restrictions (including, but not limited to, restrictions related to cancellation) and that changing any aspect of my travel arrangements may result in the payment of additional money. I understand that Love + Leisure Boutique Travel Agency only accepts credit cards. By using a credit card, this may offer me the opportunity to dispute the charges should a vendor cease to operate.
 
I understand that the Transportation Security Administration (TSA) requires me to carry a government-issued identification card in order to board a flight. I have been advised that the name, date of birth and gender that appears on the identification card must exactly match the same such data that is listed on my airline ticket and in my booking records. I acknowledge that my failure to strictly comply with these requirements may result in denied boarding or an undue delay at an airport security checkpoint causing me to miss my flight. I understand that if traveling internationally, I must have a valid passport and depending upon my destination and nationality, I may need to obtain one or more visas. I take full responsibility and must determine the proper entry requirements when traveling internationally. This includes passports, visas, vaccinations, legal authorization, and any documents that may be required such as a minor traveling without parents. All passengers are required to have a valid passport to travel. Passports should be valid for at least six months after the return date. Traveler assumes complete and full responsibility for, and hereby releases Travel Agency from any duty of checking and verifying any and all passport, visa, vaccination, or other entry requirements of each destination, and all safety and security conditions of such destinations, during the length of the proposed travel. It is the passenger’s responsibility to have proper passports or government-issued IDs where permitted. It is the traveler’s responsibility to be informed of any state department warnings where they are traveling. I also need to be aware of any health risks and take the appropriate precautions.
 
Love + Leisure Boutique Travel Agency has no special knowledge regarding the financial condition of travel service providers selected for your tour, unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which you may travel. For information concerning possible dangers at destinations, Love + Leisure Boutique Travel Agency recommends contacting the Travel Warnings Section of the U.S. State Department at 1-888-407-4747 or www.travel.state.gov. For medical information, Love and Leisure Boutique Travel Agency recommends contacting the Centers for Disease Control at 1-800-232-4636 or www.cdc.gov/travel.It is the traveler’s responsibility to protect their purchases and Travel Insurance is strongly recommended.
 
Travelers are advised to obtain appropriate travel insurance coverage against these risks. By embarking upon his/her travel, the traveler voluntarily assumes all risks involved in such travel, whether expected or unexpected. The traveler is hereby warned of the above risks as well as possible travel industry bankruptcies and medical and climatic disruptions, and the possibility traveler may be unable to travel as scheduled because of personal emergency. Travel cancellation/interruption insurance is available and highly recommended.
 
I will review my documents when I receive them and notify the travel agency of any discrepancies.  It is the traveler's responsibility to have appropriate documents for identification. It is the traveler's responsibility to read online or in the brochure from cruise lines, hotels, resorts, suppliers or tour companies and be aware of any cancellation penalties. All monies paid for travel is subject to the refund/cancellation policy outlined below. Refunds, if due from airlines, tour companies, suppliers, resorts, cruise lines and hotels will be made to our customers only after the monies have been received from these sources by us. This process may take a minimum of 5-7 business days and possibly longer. Rates are subject to change and availability until a deposit is paid. Cancellation may incur a full payment penalty. Deposit may be non-refundable. Checks are not accepted. Cancellation within 65 days of group arrival is non-refundable. 
 
Many airlines charge fees for checked luggage, check with your airline for additional charges. Travel documents will be issued by Classic Vacations, Funjet Vacations, Apple Vacations, Blue Sky Tours, GoGo, Vacation Express, Delta Vacations, BedsOnline, Travel Impressions, or etc. Travel Agency may book through a host agency. Travel Agency, therefore, shall not be responsible for breach of contract, failure to comply with any laws such as the Americans with Disabilities Act (ADA), or any intentional or negligent actions or omissions on the part of such suppliers, which result in any loss, damage, delay, inconvenience or injury to travelers or travelers' companions or group members.
 
Unless the term "guaranteed" is specifically stated in writing on your tickets, invoice, or reservation itinerary, Travel Agency does not guarantee any of such supplier's rates, bookings, reservations, connections, scheduling, special requests, or handling of baggage or other personal effects. Travelers have done due diligence, are aware of the quality of the hotel accommodations chosen, and agree that Love + Leisure Boutique Travel Agency  will not be responsible if you are not satisfied. I understand that Love + Leisure Boutique Travel Agency  and their Agents may not be able to return my calls, schedule consults, or return emails until the evening after 5pm on weekdays. I agree that any action or proceeding brought by me against Love + Leisure Boutique Travel Agency  or their Travel Agents shall be brought solely in the courts of the city and state in which the travel agent resides. In the event any action or proceeding is initiated by me in a court outside of where the travel agent lives, I agree to pay Love + Leisure Boutique Travel Agency  costs and reasonable attorney fees associated with defending such action or proceeding.
 
Our Responsibility To You
  • Love + Leisure Boutique Travel Agency will answer all emails within 24hr- 48hrs unless otherwise notified (out of office)
  • Love + Leisure Boutique Travel Agency will provide a monthly report of bookings 
  • Love + Leisure Boutique Travel Agency will provide a payment schedule for all guests
  • Love + Leisure Boutique Travel Agency will schedule a final call with the group leader and confirm the booking with the hotel before the payment deadline
  • Love + Leisure Boutique Travel Agency will communicate with guests about the payment schedule, but will not be a mediator, be responsible for encouraging guests to book, be responsible for encouraging guests to attend activities or be responsible for communication via text, chat, or Facebook groups.

ROOM RATES

  • Room rates are quoted in US dollars, per person, per night, All inclusive (based on double occupancy). Rates are for Accommodation only, unless otherwise stated below.
  • Additional charges may apply for extra guests.
  • All reservations must be made directly with CV.
  • Room assignment will be subject to hotel availability. Specific bedding types are not guaranteed, unless otherwise specified in the room block. If additional suites or other specific room types are needed, a written request and written confirmation will be required to amend this contract.
  • Group rates are valid with the minimum requirements of ten (10) rooms for a minimum of three (3) nights, or the minimum requirement of the applicable promotion at time of signing.  If Group should drop below the minimum, the best available rate at the time of cancellation will apply to existing reservations.
  • Any request for early arrival and extended departures will be subject to availability.
  • Any additional rooms requested over the above stated allotment will be subject to availability and rate at time of request.
  • Above rates include current Hotel & Government taxes and are subject to change without notice.
  • Individual reservations will not be credited towards contracted room block or towards the calculation of concessions.
  • Any complimentary room(s) the group may earn will be provided for lowest booked category, for least number of nights unless otherwise stated under concessions. Please refer to the concessions section below on the complimentary room policy being offered, if any, for this particular group.
  • Group contracted rates only apply to room nights confirmed pre-travel. All in-travel modifications are subject to Best Available Rate and paid directly to the hotel.
  • Any deviations to the room block including exchanging rooms categories will be subject to availability and possible rate changes at the time of the request.
  • Hyatt Zilara admits Adults only (minimum age 18 years). NO EXCEPTIONS
  • Check-in / Check-out Check-in time is 3:00 PM, Check-out time is 11:00 AM
  • Maximum capacity in a guest room is two (2) adults and two (2) children under 12 years of age or three (3) adults and one (1) child under 12 years of age based on existing bedding (extra beds and cribs are subject to availability).
  • Children 2 years old and under are free when sharing a room with one or two accompanying adults; when sharing with only one (1) accompanying adult, the adult will be charged the single occupancy rate.
  • Children 3 years old up to 12 years old are subject to the charge indicated on the RATES table, per child, per night, when sharing the room with two (2) accompanying adults; when sharing the room with only one (1) accompanying adult, adult will be charged the adult single occupancy rate per night and the child will be charged the same child rate set RATES table, per child, per night.
  • Children over 12 years old are charged at the adult rate as second person in double occupancy or third person in triple occupancy, as indicated on the RATES table, per child per night.
  • Additional surcharge per person will be applicable per each private function requested by Group. Group shall contact CC Group Specialist for details.
  • Children under 13 years old are not allowed in any swim-up category room.
  • Above rates are only valid when there is a wedding ceremony or wedding event confirmed with the hotel.

 

All Inclusive Plan

Hotel offers the following services and amenities as part of the “All-Inclusive Plan”:

  • Breakfast, lunch, dinner, room service and snacks (private events not included)
  • Alcoholic and non-alcoholic drinks, bottled water, specialty coffees and teas at all of Hotel’s food and beverage outlets during their regular hours of operation
  • Basic Wi-Fi internet access
  • Non-motorized water sports (Exceptions apply)
  • Mini bar drinks
  • Exercise facilities, table games, scheduled stage shows and mini club activities (where applicable)
  • Gratuities
  • All applicable taxes (unless stated otherwise)

 

Please note that all meals and beverages are offered at Hotel’s restaurants and bars and are available during regular hours of operation. Services and amenities included in the “All-Inclusive Plan” but not used by guests shall not be exchanged for other services and do not qualify for discounts or refunds.

Any unused portions of the package are not refundable and are not exchangeable for other services.

 

Not Included 

  • Private Group events and/or functions have an additional surcharge, including any decoration, music and entertainment. Contact Group’s Specialist for details. 
  • Meeting room rental and audio-visual equipment rental
  • Business center
  • Laundry and dry-cleaning services
  • Liquor and wines by the bottle, sake and imported beer available at specialty outlets (for example, Japanese beer)
  • Personal items (including packages) delivered to guest rooms (room delivery fee will apply) 
  • Airport transfers
  • Items of personal nature:
  • Gift shop purchases
  • Spa services and treatments
  • Beauty salon services
  • Car rental
  • Currency exchange
  • Medical services
  • Cigarettes & cigars
  • Local/ long distance telephone charges (toll-free number service connection fee charges apply)
  • Golf: green fee, cart, driving range, shoe rental etc.
  • All lessons: tennis, water sports, scuba, golf, etc.
  • Tours and excursions
  • Any other charge or consumption not listed above under the “All-inclusive Plan”.

 

Group Terms & Conditions

Contractual Agreement
Group Tour Contract rates and room blocks are not considered to be definite until a signed copy of the group tour contract, terms & conditions and addendums have been received by CV.

Rooming List
Rooming Lists, including Full Names of all persons traveling with Group Tour, Arrival and Departure Flight information and all other information pertinent to the appropriate servicing of the group, must be submitted as contracted forty-five (45) days prior to group's arrival.  All rooms without names assigned will be released to Hotel's inventory upon notification, and the Group shall be charged for the rooms if the total of such rooms exceeds the Attrition Level as defined below.  Rooming list revisions must clearly note which names have been revised or deleted.  Special requests and Group VIPs must be included in the Rooming List.  Those occupying Complimentary Rooms and Upgraded Rooms must be noted.

Incidentals
Individual guest accounts are payable at check-out by cash or credit card.  In order to be able to access the ancillary services of the Hotel, each guest will be required to present a valid credit card upon check-in, on which an amount of sufficient pre-authorization can be obtained to cover the anticipated use of Hotel’s ancillary services.  All accounts must be settled prior to departure.

Private Group Functions
Classic Vacations does not participate in the planning, reservations or execution of any private functions or F & B requirements.  Any additional events, parties, set ups, etc. must be requested to and confirmed by the resort contact.  Additional costs and fees will be determined based upon size and requirements of the group, and payable to the hotel directly by separate contract.  A hotel on-site event coordinator will be assigned to the group once group is contracted and under deposit.

 

ROOM ATTRITION AND CANCELLATION POLICY          

Cancellation Policy: Begins January 26, 2025 as stated in this contract

To protect the bride å groom, in this agreement, we will be requiring the following:

-  Nonrefundable & Non-transferrable $200 per room deposit required at time of booking (plus the cost of insurance if chosen)
- Second Deposit of 20% will be due January 10, 2025 

- Third Deposit of 40% will be due February 10, 2025 
- Balance will be due March 28, 2025
 

Cancellation policy

  • January 26 - February 24, 2025 - cancellations are subject to a 10% penalty

  • July 17-August 15, 2024 - cancellations are subject to a 60% penalty

  • August 16, 2024 to date of travel - cancellations are subject to a 100% penalty

  • Notice: If cancellation occurs, 100% of the deposit is non-refundable. We highly recommend trip insurance to protect your vacation investment.

 

Length of stay for social groups initial room block will be for maximum of 5 peaknight.

30% of peak night block is allowable for 2 days pre/post if requested.

Length of stay for peak nights over 5 must be approved by revenue.

NO STUDENT GROUPS

The parties acknowledge and agree that Hotel does not accommodate any type of student groups, including but not limited to spring break groups. Any leisure or social group that is predominantly comprised of guests under the age of 25, must be of a family nature where at least one parent stays in the room with their children.

 

CHECK-IN/CHECK-OUT 

Check-in time at Hotel is 3:00 PM local time. Hotel will make commercially reasonable efforts to accommodate early arrivals. Check-out time is 11:00 AM local time. Group attendees staying in their rooms beyond the check-out time without Hotel authorization will be charged for an additional night stay at contracted Guest Room Rate.

 

NOISE CURFEW 

Please note that Hotel has a noise curfew of 10 p.m. for all outdoor sound amplification. Speakers should be placed facing the ocean unless otherwise approved by Hotel. For all outdoor sound amplification, the maximum sound level is 70 decibels. Sound check for the band/musicians should take place, at the earliest, one-hour before the start of the corresponding event.

 

OUTSIDE VENDORS 

Should Group elect to use any outside vendors to provide services during any of its events, including, but not limited to, audio/visual services, decorators, or others, Group must contact its Conference Services Manager as soon as possible. For any activity introduced onto Hotel’s premises by an outside vendor engaged by Group, Group will ensure that such vendors comply with the terms of this Agreement and with any requirements for such vendors as provided to Group by Hotel, including but not limited to entering into a services agreement with Hotel. 

Group will be fully responsible for such vendors’ actions or inactions and agrees to remove from Hotel’s premises any outside vendor that Hotel deems objectionable or whose activities cause reasonable concern. Upon request, Group will provide a certificate of insurance from such outside vendors covering their actions and naming Hotel, the Hotel owner and the entity that manages the Hotel as additional insureds with regard to their activities. Group acknowledges and agrees that Hotel shall not be responsible for the proper performance of any outside vendor hired by Group, even if such outside vendor has been duly authorized by Hotel. 

Please note that the use of any type of drone by our guests within the Hotel premises is strictly prohibited. Group may hire a professional photographer for purposes of taking pictures and/or videos at its private events, and if such photographer offers drone services, Group must obtain Hotel’s prior written authorization setting forth all the conditions under which the drone may be used by the professional photographer within the Hotel premises.

Hotel may only authorize the use of a drone that weighs less than 25kg. Please contact your Conference Services Manager for more details. Please note that additional fees shall apply for any outside vendor that Group hires. Please contact your Conference Services Manager for details. 

 

DÉCOR

In the event Group plans to use any decorations, displays, signs and/or banners, these items must be approved by Hotel prior to arrival. Any decorations, signs and/or banners must conform to local regulations and Hotel policy. Items may not be attached to walls, ceilings, windows and fixtures with nails, staples, tape or any other substances unless written approval by Hotel is given in advance. Any damage incurred by unauthorized attachment of décor materials will be charged to Group and must be settled prior to departure. Any specific set-up may be subject to additional fees, including but not limited to any regulatory permits where applicable.

 

INDEMNIFICATION AND HOLD HARMLESS 

Group agrees to defend, indemnify and hold harmless Playa Resorts Management Mexico, S. de R.L. de C.V., Hyatt Franchising Latin America, LLC, and their respective affiliates, and their respective officers, directors, stockholders, members, employees and agents from and against all claims, costs, losses, expenses, damages, actions, causes of action and/or liabilities, including reasonable attorneys’ fees, arising out of or resulting from (i) any act undertaken or committed by Group (including any of its members or attendees) or any contractors, vendors or subcontractors hired or engaged by Group in connection with the Enrollment Form or the Terms and Conditions, or (ii) any claim, action or cause of action, which may be asserted by a Group member or any Group attendee arising out of, or resulting from the Hotel's performance of this Enrollment Form.

 

SHIPPING OF MATERIAL 

Please advise your Conference Services Manager of any shipping requirements for your Group as soon as possible. Please note that each jurisdiction has its own set of guidelines and regulations regarding the shipment/transportation of materials into the country, including any applicable fees and customs duties and regulations. The parties acknowledge and agree that it is Group’s exclusive responsibility to become familiar with any such regulations and to fully comply with them. Hotel has limited storage facilities and therefore, is not able to store display materials or show merchandise for a period longer than five (5) days prior to the first date on the Room Night Commitment. Additional handling charges may apply based upon size, weight, time and storage of such materials. 

 

FORCE MAJEURE

In the event either party fails to perform its obligations hereunder in whole or in part, due to, but not limited to, acts of God, including fire, explosion, earthquakes, hurricanes, extreme inclement weather, epidemic, pandemic, quarantine, terrorism, civil disorder, public utility failure, curtailment of transportation affecting at least 50% of the group attendees, travel restriction issued by a governmental agency affecting at least 50% of the group attendees, strikes, labor slowdowns or unrest, flood, embargo, war, nuclear disaster or riot, existing and continuing at the time of performance of the obligations (a “Force Majeure Occurrence”), such failure to perform shall not be considered a breach of this Enrollment Form during the period of such disability. The disabled party shall use commercially reasonable efforts to meet its obligations hereunder during the period of such disability. 

 

The disabled party shall promptly and in writing notify the other party of the Force Majeure Occurrence and advise the other party of the extent of the disabled party’s disability and the expected duration of the disabled party’s inability to perform its obligations hereunder. The parties will use commercially reasonable efforts to provide a work-around solution to the Force Majeure Occurrence.



GENERAL TERMS AND CONDITIONS. The definitions, terms and conditions set forth in Exhibit A ("General Terms"), attached hereto are hereby incorporated into this Agreement.

Notwithstanding anything contained in your Cardholder Agreement with the provider that is to the contrary, written notice of rejection or cancellation of these arrangements must be received in writing within the time limits stated in the Terms & Conditions. If not received, no charge-backs or cancellation will then be accepted. Your signature on this charge confirmation form is an acknowledgment that you have received and read the Terms & Conditions and that you understand the Cancellation Policy, which details the supplier and company's policies on payments, cancellations, and refunds for the travel arrangements you have made. You should review this document thoroughly before finalizing any travel arrangements.  I am aware of all cancellation policies and agree not to dispute or attempt to chargeback any of the above signed for and acknowledged charges. Your card will not be charged when you submit this booking form. It will take 5-7 business days to process your card and it will be processed only after your booking has been confirmed. You will receive an invoice via email once your card has been processed and booking confirmed; the email will have payment plan instructions.
