		<field type="paragraph" subtype="p" label=", (hereinafter, “Participant’’) enter this Liability Waiver and Travel Agreement (hereinafter, “Contract’”’) with Christina Prieto &amp;amp; Live In Harmony Retreats, (hereinafter, “LIHR”). The parties enter this Agreement in good faith and agree as follows:"/>&#13;
		<field type="header" subtype="h3" label="I. PRODUCTS AND SERVICES"/>&#13;
		<field type="paragraph" subtype="p" label="I understand that LIHR acts solely as a retreat organizer and independent coordinator of third party travel related services, serving as an intermediary to arrange travel related products and services associated with my participation in travel to Costa Rica. Products and services include but are not limited to coordinating accommodations, events, meals, excursions, tours, transportation, and daily scheduled itinerary. LIHR is an intermediary to arrange travel product services, not a tour guide. These products and services are not directly supplied or provided by LIHR (e.g. ground transportation, tour guides, lodging accommodations, meals, excursions, tours, etc). Each provider of such products or services applicable to your travel arrangements (hereinafter “Suppliers”) has their own terms and conditions. Accordingly, you understand that you are authorizing LIHR to contact such Suppliers on your behalf in connection with their products and services. I understand that LIHR is an independent contractor and no joint venture, partnership, or employment relationship exists between LIHR and the Suppliers."/>&#13;
		<field type="header" subtype="h3" label="II. PAYMENT"/>&#13;
		<field type="paragraph" subtype="p" label="I agree to pay LIHR trip tuition as outlined on trip website (https://liveinharmonyretreats.com/costa-rica/kim/) for the following: Heal Through Play Costa Rica Wellness Retreat (hereinafter, “Retreat”). Full payment due by midnight on April 15th, 2025. Post-dated checks and automated debit payment plans available if requested by participant, as agreed to by LIHR per individual basis. Any and all payments made are non-refundable. Payment of a deposit enables LIHR to book travel, hold a reservation, and engage in other actions on your behalf. LIHR has no obligation to provide me any information concerming the costs utilized in establishing the pricing of the trip. No refunds will be given for any unused pre-paid service included in your travel brochure or any changes made in the itinerary beforehand or while en route, including changes in excursions, guides, restaurants/meals, transportation services, etc. Full payment as well as the required registration forms, including a clear, legible copy of the picture page of your passport is due by the registration deadline of midnight on April 15th, 2025. Failure to provide these within 7 days of departure is considered a breach of this Contract and will result in the cancellation of services without refund."/>&#13;
		<field type="header" subtype="h3" label="III. CANCELLATION AND REFUND POLICY"/>&#13;
		<field type="paragraph" subtype="p" label="Any and all payments sent to LIHR for Retreat, whether deposit and/or balance payment are non- refundable for any reason after midnight on April 15th, 2025. Partial refunds for late arrivals or early departures are not granted. Partial refunds for any services not used while on a Retreat are also not granted."/>&#13;
		<field type="header" subtype="h3" label="IV. FOREIGN TRAVEL &amp;amp; ASSUMPTION OF RISK"/>&#13;
		<field type="paragraph" subtype="p" label="I acknowledge that travel to foreign countries may involve many risks not known to LIHR, independent contractors, representatives, Participant, or anyone else involved or attending this Retreat. These risks may not be reasonably foreseeable at this time or at the time of the Retreat in which I participate, and may not normally be associated with foreign travel. I knowingly and voluntarily agree to assume any and all risks associated with such travel. I am aware of and hereby acknowledge the inherent risks associated with Retreat activities, including, but not limited to, the risks associated with yoga, hiking, swimming, horseback riding, climbing, cliff jumping, animal encounters, all-terrain vehicle usage, strenuous activity, and other foreign travel risks. I am aware of the risks of injury, death, and property damage that may result from, among other causes, the acts or omissions of this Retreat and its owners, operators, officers, employees, independent contractors, representatives, and/or agents including but not limited to LIHR. I further assume all risks associated with my participation in the travel Retreat including, without limitation, the risk of negligent or intentional acts or omissions or theft by other participants or third parties, and the risk of injury caused by the condition of any property, facilities or equipment used during the Retreat. Participant understands that participation in all physical activities is voluntary and that Participant may decline participation at any time."/>&#13;
		<field type="header" subtype="h3" label="V. RELEASE OF LIABILITY"/>&#13;
		<field type="paragraph" subtype="p" label="I voluntarily, and with full understanding of the legal significance of my actions, waive and release, on behalf of myself, my heirs, and my estate, all claims of any nature against LIHR, including but not limited to claims for injury, loss, damage, accident, delay, irregularity, or expense arising out of or related to participation in the Retreat. LIHR shall not be liable for delays, changes, interruptions, or cancellations resulting from circumstances beyond its reasonable control, including but not limited to weather events, natural disasters, governmental actions, pandemics, transportation disruptions, political unrest, acts of God, or any other unforeseen event. I further release LIHR from any claims arising out of, resulting from, or connected with the Retreat, including but not limited to the acts, omissions, or alleged negligence of LIHR, its officers, employees, agents, contractors, or representatives."/>&#13;
		<field type="header" subtype="h3" label="VI. INDEMNIFICATION AND HOLD HARMLESS"/>&#13;
		<field type="paragraph" subtype="p" label="It is expressly understood and agreed that LIHR are not providing personal chaperones or supervision with respect to this Retreat and that I am responsible for my individual conduct, health and safety at all times. I agree to defend, indemnify and hold harmless LIHR and their officers, employees, independent contractors, representatives, and/or agents for any and all demands, costs, losses, expenses, claims, recoveries, judgments and liabilities (including attorneys’ fees) of any nature arising out of, or in consequence of, my acts, words, conduct, etc. in any way connected with my participation in the Retreat including, but not limited to, damage to property, any injuries or death sustained by any person(s)."/>&#13;
		<field type="header" subtype="h3" label="VII. MODIFICATION OF RETREAT"/>&#13;
		<field type="paragraph" subtype="p" label="LIHR will make every effort to accommodate your requests and to ensure that your travel experience is delivered by the Suppliers as consistently as possible with the description of the Retreat brochure. I understand that the remoteness of the destination, local custom, political upheaval, pandemic related closures, or other issues and/or prevailing weather conditions may cause minor inconvenience or modification to portions of the Retreat. LIHR reserve the right to modify and/or cancel any tour arrangements due to reasonable circumstances. I fully and completely release LIHR from any claims or liability that may result from risks, financial and otherwise, that may result from your decision to travel to Costa Rica."/>&#13;
		<field type="header" subtype="h3" label="VIII. TRAVEL DOCUMENTS AND INSURANCE"/>&#13;
		<field type="paragraph" subtype="p" label="I understand that it is my responsibility to ensure that all necessary travel documents such as passports are obtained and are valid. I understand that travel insurance is recommended, but not required. Obtaining travel insurance is my responsibility and LIHR is not liable for any damages arising from my failure to obtain travel insurance. LIHR is not responsible for cancellations due to actions by vendors or other third parties, nor for cancellations due to acts of nature. LIHR is not responsible for personal expenses incurred by Participant including but not limited to airline tickets, vaccinations, trip/medical insurance fees, baggage loss, family crisis, employment conflicts, evacuation, weather, accident/sickness/ illness, or for costs incurred due to travel delays or flight cancellations. For this reason it is recommended that adequate trip insurance is purchased by Participant, and monies may be able to be reclaimed under the terms of your trip insurance policy through your insurer."/>&#13;
		<field type="header" subtype="h3" label="IX. REPRESENTATION OF GOOD HEALTH"/>&#13;
		<field type="paragraph" subtype="p" label="I am responsible for discerning whether travel to Costa Rica is appropriate for my health, physical abilities and interests. Travel to Costa Rica requires certain physical capabilities. I am in good health, have no physical conditions that affect my ability to travel and/or participate in any of the activities involved in this Retreat as outlined in Retreat trip brochure, and I have not been advised otherwise by a medical practitioner. I acknowledge that LIHR is in no way responsible for any costs related to my medical care. Participant authorizes LIHR to seek emergency medical treatment on Participant’s behalf if necessary during the Retreat. Participant agrees to be solely responsible for any medical expenses incurred."/>&#13;
		<field type="header" subtype="h3" label="X. CHOICE OF LAW; VENUE"/>&#13;
		<field type="paragraph" subtype="p" label="This Contract shall be governed by the laws of the State of Florida. The parties agree that any lawsuit brought to enforce the terms of this Contract and/or to recover any alleged damages arising from this Contract must be filed in the Circuit Court of Florida in and for Orange County, or, subject to applicable jurisdictional requirements, in the United States District Court for the Middle District of Florida, and each of the parties consents to the jurisdiction of such courts (and of the appropriate appellate courts) in any such action or proceeding and waives any objection to such venue."/>&#13;
		<field type="header" subtype="h3" label="XI. BROAD CONSTRUCTION"/>&#13;
		<field type="paragraph" subtype="p" label="This Contract is a legally binding agreement and will be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law."/>&#13;
		<field type="header" subtype="h3" label="XII. ENFORCEABILITY"/>&#13;
		<field type="paragraph" subtype="p" label="If any provision of this Contract is held by a court of competent jurisdiction to be invalid or unenforceable, the remainder of the Contract shall remain in full force and effect and shall in no way be impaired."/>&#13;
		<field type="header" subtype="h3" label="XIII. KNOWING AND VOLUNTARY EXECUTION"/>&#13;
		<field type="paragraph" subtype="p" label="I acknowledge that I have carefully read this Contract, understand its contents, and understand that this Contract includes a release of liability and an assumption of the risk. I acknowledge that LIHR is materially relying on this waiver and is allowing you to engage or decline in activities including but not limited to climbing, swimming, paddle boarding, cliff jumping, hiking, yoga, etc."/>&#13;
		<field type="header" subtype="h3" label="XIV. USE OF PICTURES AND VIDEOS"/>&#13;
		<field type="paragraph" subtype="p" label="LIHR may use any pictures or videos taken during the Retreat. This includes digital images which may be posted online. By participating in this Retreat, I agree that I am consenting to the use of my image or likeness by LIHR for marketing purposes, including but not limited to electronic and printed promotional material for personal or professional use."/>&#13;
		<field type="header" subtype="h3" label="XV. DISCLOSURE OF PERTINENT INFORMATION"/>&#13;
		<field type="paragraph" subtype="p" label="It is essential that any pertinent information, including any social, emotional or physical problems that might limit your active participation in the Retreat be discussed with LIHR prior to acceptance and attendance in the Retreat. I understand that any and all activities are optional. LIHR intends to be the facilitator of a pleasant experience for the participant and all involved."/>&#13;
		<field type="header" subtype="h3" label="XVI. CONDUCT"/>&#13;
		<field type="paragraph" subtype="p" label="Excessive consumption of alcoholic beverages or use of any illegal substance, abuse or harassment of other participants or people, disorderly conduct, theft or damage to any property or place, or any activity that would offend or harm others will not be tolerated and will result in immediate termination of Retreat participation without refund. LIHR reserves the right to decline to accept or retain a person for any reason which affects the operation of the tour or the right and welfare or enjoyment of the other tour members."/>&#13;
		<field type="header" subtype="h3" label="XVII. GENERAL"/>&#13;
		<field type="paragraph" subtype="p" label="Participant may not assign rights or obligations under this Contract to any third party. This is a release of legal rights. Read and understand it before signing. The signature below shall be deemed to be the consent to all the terms and conditions herein. I have read, I fully understand, and I completely accept the terms and conditions of this Contract."/>&#13;
