Terms and Conditions
These Terms and Conditions ("Agreement") govern all travel planning, reservation, booking, and related services provided by Mandy Herring of Parks and Passports Travel By Mandy, LLC ("Travel Advisor"), an independent contractor operating under Travelmation, LLC.
By requesting travel planning services, authorizing any reservation, making any payment, or accepting travel documents, the client ("Client") acknowledges that they have read, understood, and agree to be bound by these Terms and Conditions.
1. Agency Relationship
The Travel Advisor acts solely as an independent sales agent for third-party travel suppliers, including but not limited to airlines, cruise lines, hotels, resorts, tour operators, transportation providers, insurance companies, and other travel service providers ("Suppliers").
The Travel Advisor does not own, operate, manage, or control any Supplier and therefore is not liable for any act, omission, negligence, bankruptcy, financial default, delay, cancellation, injury, property damage, overbooking, schedule change, or other action or inaction of any Supplier.
2. Assumption of Travel Risks
The Client understands that travel involves inherent risks, including but not limited to:
Illness or injury
Accidents
Weather events
Natural disasters
Government actions
Political unrest
Terrorism
Pandemics or epidemics
Transportation delays
Flight cancellations
Itinerary changes
Lost or delayed baggage
Force majeure events beyond anyone's control
The Client voluntarily assumes all such risks and releases and holds harmless the Travel Advisor, Parks and Passports Travel By Mandy, LLC, and Travelmation, LLC from any liability arising from these events.
3. Client Responsibility
The Client is solely responsible for ensuring they meet all travel requirements applicable to their trip, including but not limited to:
Valid passports
Visa requirements
Entry documentation
Health and vaccination requirements
Customs regulations
Airline requirements
Cruise line requirements
Pregnancy restrictions
Traveling with minors
Destination-specific regulations
While the Travel Advisor may provide general guidance, the Client accepts full responsibility for complying with all travel requirements.
4. Passport Requirements
For international travel, passports should generally be valid for at least six (6) months beyond the scheduled return date unless otherwise stated by the destination country.
Failure to meet passport requirements may result in denied boarding or denied entry without refund. The Client accepts full responsibility for any resulting expenses.
5. Visas and Entry Requirements
Visa and entry requirements are subject to change without notice.
Obtaining and maintaining all required travel documentation remains solely the Client's responsibility.
The Travel Advisor shall not be liable for denied entry or any expenses resulting from missing or incorrect documentation.
6. Review of Travel Documents
The Client agrees to carefully review all confirmations, invoices, itineraries, travel documents, and tickets immediately upon receipt.
This includes verifying:
Traveler names exactly as they appear on government-issued identification
Dates
Destinations
Flight information
Cruise information
Hotel reservations
Payment amounts
Final payment deadlines
The Client must notify the Travel Advisor immediately of any errors.
Failure to do so may result in change fees, cancellation penalties, or denied travel for which the Client accepts full responsibility.
7. Pricing and Availability
Travel pricing is dynamic and subject to change until reservations are confirmed and any required deposits have been received.
Quotes are not guaranteed until booked.
Suppliers reserve the right to modify pricing, taxes, fuel surcharges, government fees, port charges, resort fees, baggage fees, and other mandatory charges at any time.
The Client agrees to pay any such increases imposed by the Supplier.
8. Payments, Cancellations, and Refunds
All payments authorized by the Client are made directly to the applicable Supplier unless otherwise disclosed.
The Travel Advisor does not hold client travel funds.
Cancellation policies, penalties, future travel credits, refunds, and reimbursement decisions are established solely by each Supplier.
The Travel Advisor has no authority to alter, waive, or override Supplier policies and shall not be responsible for denied refunds or penalties imposed by Suppliers.
9. Credit Card Authorization and Chargebacks
The Client acknowledges that all charges authorized through the Travel Advisor are valid and authorized by the cardholder.
The Client agrees that dissatisfaction with a Supplier's services, cancellation policies, travel experience, or refund determination does not constitute grounds for initiating a credit card chargeback against an authorized transaction.
Should a billing concern arise, the Client agrees to first contact the Travel Advisor and the applicable Supplier to seek resolution.
If the Client initiates an unwarranted or invalid chargeback for an authorized transaction, the Client agrees to remain financially responsible for all amounts owed, including any collection costs, administrative expenses, court costs, reasonable attorney's fees where permitted by law, and any losses incurred by Parks and Passports Travel By Mandy, LLC or Travelmation, LLC as a result of the chargeback.
Nothing in this Agreement limits the Client's legal right to dispute unauthorized or fraudulent credit card charges.
10. Travel Insurance
Travel insurance is strongly recommended for every traveler.
Travel insurance may provide valuable protection for cancellations, interruptions, medical emergencies, evacuations, baggage loss, travel delays, supplier insolvency, and other unforeseen events.
If the Client declines travel insurance, the Client accepts full financial responsibility for any losses incurred and releases the Travel Advisor from liability associated with uninsured travel risks.
11. Supplier Financial Default
The Travel Advisor is not responsible for the financial condition, bankruptcy, insolvency, or cessation of operations of any Supplier.
Any recovery of funds due to Supplier insolvency shall be governed solely by the applicable Supplier, insurance policy, or applicable law.
12. Itinerary Changes
Airlines, cruise lines, hotels, and tour operators reserve the right to modify schedules, equipment, ports of call, accommodations, or itineraries at any time.
The Travel Advisor shall not be responsible for any inconvenience, additional expenses, or losses resulting from such changes.
13. Electronic Communications
The Client authorizes the Travel Advisor to communicate using email, text message, telephone, or other electronic means.
The Client acknowledges that electronic communications are not always secure and agrees to promptly review all communications and notify the Travel Advisor of any discrepancies.
14. Limitation of Liability
The Travel Advisor shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or relating to the Client's travel arrangements.
In no event shall the Travel Advisor's liability exceed the amount of any planning fee actually paid directly to the Travel Advisor for professional services.
15. Errors and Omissions
The Travel Advisor makes every reasonable effort to provide accurate information.
The Client acknowledges that typographical errors, pricing errors, supplier errors, and inadvertent omissions may occasionally occur.
The Travel Advisor reserves the right to correct any such errors and shall not be liable for any resulting inconvenience or changes.
16. Acceptance of Terms
Authorization to book travel, submission of payment information, payment of deposits or balances, acceptance of travel documents, or travel itself constitutes acceptance of these Terms and Conditions for all travelers included within the reservation.
The Client represents that they are authorized to accept these Terms on behalf of every traveler included in the booking.
17. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida.
Any dispute arising under or relating to this Agreement shall be resolved exclusively in the appropriate state or federal court located in the State of Florida, and the Client consents to the jurisdiction of such courts.
18. Severability
If any provision of this Agreement is determined to be unenforceable or invalid under applicable law, the remaining provisions shall remain in full force and effect.
19. Entire Agreement
These Terms and Conditions constitute the entire agreement between the Client and the Travel Advisor regarding travel planning services and supersede any prior oral or written representations concerning the subject matter herein.
