Independent Contractor Under Travelmation, LLC

These Terms and Conditions (“Agreement”) govern all travel planning and booking services provided by Mandy Herring (“Travel Advisor”), an independent contractor operating under Travelmation, LLC. By requesting travel planning services and/or authorizing the booking of travel arrangements, the client (“Client”) acknowledges, understands, and agrees to be bound by this Agreement.


1. Agency Disclosure

The Travel Advisor acts solely as an agent for third-party travel suppliers, including but not limited to airlines, cruise lines, hotels, resorts, tour operators, and transportation providers (“Suppliers”). The Travel Advisor does not own, operate, manage, or control any Supplier and is not responsible for the acts, omissions, or defaults of any Supplier.


2. Assumption of Responsibility and Risk

The Client acknowledges that travel involves inherent risks, including but not limited to illness, injury, delays, cancellations, changes in itinerary, governmental actions, and force majeure events. By booking travel, the Client voluntarily assumes full responsibility for all risks associated with travel and releases the Travel Advisor from any liability arising from such risks.


3. Client Responsibility for Travel Requirements

The Client is solely responsible for ensuring compliance with all travel requirements applicable to their itinerary, including but not limited to:

  • Passport validity

  • Visa and entry requirements

  • Health and vaccination requirements

  • Airline, cruise line, and supplier policies

  • Requirements related to pregnancy or traveling with minors

The Travel Advisor will provide general guidance and education to the best of her knowledge; however, final responsibility for meeting all travel requirements rests exclusively with the Client.


4. No Liability for Client Negligence

The Travel Advisor shall not be held liable for any costs, fees, penalties, losses, denied boarding, denied entry, trip interruption, or cancellation resulting from the Client’s failure to meet travel requirements or comply with Supplier or governmental regulations. Any costs incurred due to Client negligence shall be the sole responsibility of the Client.


5. Passport Validity

For international travel, passports must be valid for a minimum of six (6) months beyond the Client’s planned return date to the United States, unless otherwise specified by the destination country or Supplier.

The Client acknowledges that failure to meet this requirement may result in denied boarding or entry and agrees that all costs, penalties, or losses arising from passport issues are the sole responsibility of the Client. Acceptance of this Agreement constitutes acknowledgment of this requirement.


6. Visas and Entry Documentation

The Client is responsible for obtaining any required visas, permits, or entry documentation. Entry requirements are subject to change without notice, and the Travel Advisor shall not be responsible for any consequences resulting from changes or enforcement of such requirements.


7. Travel Insurance

The purchase of travel insurance is strongly recommended. Travel insurance may provide coverage for trip cancellation, interruption, medical expenses, delays, and other unforeseen events.

If the Client elects to decline travel insurance, the Client assumes full financial responsibility for any losses or expenses incurred and agrees to release the Travel Advisor from any liability related to uninsured travel risks.


8. Review of Travel Documents

The Client is responsible for reviewing all invoices, confirmations, and travel documents upon receipt, including but not limited to:

  • Traveler names (as they appear on government-issued identification)

  • Travel dates and times

  • Payment due dates

  • Cancellation policies and penalties

Any errors must be reported immediately. Failure to notify the Travel Advisor in a timely manner may result in change fees or penalties for which the Client shall be solely responsible.


9. Payments, Cancellations, and Refunds

All payments, cancellations, penalties, and refunds are governed by the individual policies of the Suppliers. The Travel Advisor has no authority to override Supplier policies and shall not be responsible for denied refunds or penalties imposed by Suppliers.


10. Acceptance of Terms

Authorization to book travel constitutes acceptance of these Terms and Conditions for all travelers included in the reservation. The Client confirms that they have read, understood, and agreed to this Agreement.


11. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the state in which Travelmation, LLC is registered, without regard to conflict of law principles.
