TISHA’S INFINITE TRAVELS CLIENT SERVICES AGREEMENT
This Client Services Agreement (“Agreement”) is entered into between Tisha’s Infinite Travels (“Agency”) and the undersigned Client (“Client”). By booking travel services through Agency, Client acknowledges and agrees to the following terms and conditions:
1. AGENCY ROLE
Agency acts solely as an independent travel planner and booking agent. Agency does not own, operate, manage, or control any airline, cruise line, hotel, transportation provider, tour operator, or other travel service provider (collectively, “Suppliers”).
All travel services are provided by independent Suppliers and are subject to the terms, conditions, policies, and limitations imposed by those Suppliers. Client agrees to be bound by all applicable Supplier terms.
2. CLIENT RESPONSIBILITIES
Client is solely responsible for:
-
Ensuring all travelers possess valid passports, visas, vaccination records, and required travel documentation.
-
Confirming passports are valid for at least six (6) months beyond the scheduled return date (unless otherwise required by destination).
-
Providing legal names exactly as they appear on government‑issued identification.
-
Reviewing all travel documents immediately upon receipt and notifying Agency of any errors within 24 hours.
-
Monitoring travel advisories, entry requirements, and health regulations for all destinations.
-
Disclosing any mobility limitations, medical conditions, or special needs that may affect travel arrangements.
Agency shall not be responsible for denied boarding, denied entry, delays, penalties, or additional costs resulting from incomplete or inaccurate documentation or failure to meet travel requirements.
3. FEES, PAYMENTS, AND AUTHORIZATION
-
All Agency research, planning, consultation, administrative, and service fees are earned upon booking and are non‑refundable.
-
By providing payment information, Client authorizes Agency to charge deposits, scheduled payments, final balances, and approved service fees on Client’s behalf.
-
Client is financially responsible for all charges authorized verbally, electronically, or in writing.
-
All prices are subject to change until paid in full and may fluctuate due to Supplier availability, fare increases, fuel surcharges, currency changes, or tax adjustments.
-
Failure to make payments by stated deadlines may result in automatic cancellation by the Supplier. Agency is not responsible for lost deposits, reinstatement fees, or rate increases due to missed payments.
-
Name corrections or changes after booking may result in Supplier fees or rebooking at Client’s expense.
Agency reserves the right to correct pricing errors or Supplier system errors. Client may accept the corrected price or cancel without penalty from Agency.
4. CANCELLATIONS AND CHANGES
All bookings are subject to the cancellation and refund policies of the applicable Supplier(s).
In addition to Supplier penalties, Agency charges a $100 non‑refundable administrative fee per person, per booking for any cancellation or major/destination change initiated by Client, regardless of reason. This fee applies whether or not a Supplier issues a refund.
All cancellation requests must be submitted in writing. Agency will process cancellations in accordance with Supplier procedures but cannot guarantee refunds or timelines.
5. REVISIONS AND SCOPE OF SERVICES
Agency services include initial consultation, planning, and booking as agreed.
Additional changes after booking, re‑quoting, switching Suppliers, itinerary restructuring, or excessive revisions may result in additional service fees at Agency’s discretion.
Agency is not obligated to provide unlimited revisions or ongoing modifications beyond the agreed scope of service.
6. INDEPENDENT ARRANGEMENTS
If Client makes independent travel arrangements outside of Agency (including flights, hotels, excursions, or transportation), Agency is not responsible for coordination issues, scheduling conflicts, penalties, missed connections, or disruptions resulting from those arrangements.
7. GROUP TRAVEL TERMS (IF APPLICABLE)
-
Group pricing may be based on minimum participation requirements.
-
If minimum participation is not met, Agency may adjust pricing, offer alternatives, or cancel the group experience.
-
If Client books double occupancy and their roommate cancels or fails to pay, Client agrees to assume any applicable single‑occupancy rate adjustments.
-
Agency is not responsible for roommate compatibility.
8. ITINERARY CHANGES
All itineraries are subject to change due to Supplier schedule adjustments, weather, operational requirements, or circumstances beyond Agency’s control.
Comparable alternatives will be provided when reasonably possible. Such changes do not constitute grounds for refund unless permitted by the Supplier.
9. TRAVEL INSURANCE
Travel insurance is strongly recommended and may be offered through Agency.
If Client declines travel insurance, Client assumes full financial responsibility for cancellations, delays, medical emergencies, illness, Supplier default, or other unforeseen events.
Coverage determinations and reimbursement decisions are governed solely by the insurance provider.
10. FORCE MAJEURE
Agency shall not be liable for failure or delay in performance due to acts of God, natural disasters, pandemics, government actions, war, civil unrest, labor strikes, airline schedule changes, mechanical failures, health emergencies, or any event beyond Agency’s reasonable control.
11. SUPPLIER INSOLVENCY
Agency is not responsible for Supplier insolvency, bankruptcy, financial default, or cessation of operations.
Refunds, if any, are subject solely to the Supplier’s policies and financial condition.
12. LIMITATION OF LIABILITY
Agency shall not be liable for any injury, loss, accident, delay, inconvenience, damage, or expense arising from:
Client agrees to travel at their own risk and acknowledges that changes in travel advisories do not constitute grounds for refunds unless permitted by the Supplier.
13. CLIENT CONDUCT
Client agrees to behave in a respectful, lawful, and responsible manner throughout the travel experience.
Agency reserves the right to remove any traveler from a group experience, without refund, if behavior is disruptive, unsafe, illegal, or violates Supplier policies.
14. PHOTOGRAPHY AND MARKETING RELEASE
Unless otherwise stated in writing, Client grants Agency permission to use photographs or video taken during travel experiences for promotional and marketing purposes.
15. CHARGEBACKS AND DISPUTES
Initiating a chargeback for services already rendered constitutes a material breach of this Agreement.
Client agrees to contact Agency directly to resolve any billing dispute prior to initiating a chargeback.
Client agrees to reimburse Agency for all costs incurred in defending improper chargebacks, including reasonable attorney’s fees.
16. REFUND PROCESSING
Agency does not control the timing of refunds issued by Suppliers or financial institutions and is not responsible for processing delays.
17. COMMUNICATION & RESPONSE TIME
Agency responds to inquiries during normal business hours. Response times may vary. Urgent issues during travel should be directed to the Supplier’s 24‑hour support line when applicable.
18. DIGITAL SIGNATURES & ELECTRONIC CONSENT
Electronic signatures, digital acceptance, and payment submission constitute full acceptance of this Agreement and are legally binding.
19. GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia.
20. ENTIRE AGREEMENT
This Agreement constitutes the entire understanding between Agency and Client and supersedes all prior communications, representations, or agreements, whether written or verbal.
If any provision of this Agreement is deemed unenforceable, the remaining provisions shall remain in full force and effect.
