Terms & Conditions

PLEASE READ ALL OF THE FOLLOWING TERMS AND CONDITIONS CAREFULLY BEFORE USING DESERVING ADVENTURES AND TOURS SERVICES

Deserving Adventures and Tours– Travel Services Agreement

Effective Date: 10/1/2025

1. Agreement Overview

Welcome to Deserving Adventures and Tours! We are excited to assist you with your travel planning needs. This Travel Services Agreement (the "Agreement") outlines the terms and conditions under which Deserving Adventures and Tours (hereinafter "we", "us", or "our") will provide travel planning services to you, the client (hereinafter "you" or "client"). By engaging our services, you agree to these terms and conditions.

2. Services Provided

Deserving Adventures and Tours will provide customized travel planning services, including but not limited to the creation of travel itineraries, coordination of bookings, and management of vendor relationships. These services are designed to ensure that your travel experience is seamless and tailored to your preferences.

3. Trip Planning Fees and Non-Refundability

In consideration for our travel planning services, a non-refundable trip planning fee is required at the time of booking. This fee covers the time and expertise involved in planning, organizing, and coordinating your travel arrangements. This fee is non-refundable under any circumstances, including but not limited to cancellation, changes, or delays.

4. Payment Terms

All payments for travel services and bookings will be made directly to Archer Travel Service, Inc our designated vendors and payment processor, upon the confirmation of any proposal. You agree to make payments directly to Archer Travel Service, Inc or an approved 3rd party vendor, who will process all charges for your travel arrangements.

Payment for all confirmed travel services must be made in full according to the timeline outlined in your proposal. Please note that payment terms may vary depending on the vendor and the type of travel services being booked.

5. Travel Cancellations, Changes, and Refunds

Cancellations and changes to your travel plans may be subject to penalties, fees, and restrictions imposed by the individual travel vendors (e.g., airlines, hotels, cruise lines, and tour operators). Please note that all fees paid to Deserving Adventures and Tours are non-refundable under any circumstances.

Refunds, if any, will be processed according to the terms and conditions of the individual vendors and are not guaranteed by Deserving Adventures and Tours

6. Client Responsibilities

Accurate Information: You agree to provide accurate and truthful information regarding your travel preferences, personal details, and payment information.
Travel Documentation: You are responsible for ensuring that all required travel documentation, such as passports, visas, and any other necessary documents, are valid and in order for your trip.
Compliance with Vendor Policies: You agree to comply with all policies and regulations set forth by the travel vendors, including any additional terms and conditions related to bookings, cancellations, and refunds.

7. Liability and Disclaimers

While we strive to provide high-quality services and facilitate a seamless travel experience, Deserving Adventures and Tours is not responsible for the actions, omissions, or failures of the travel vendors, including but not limited to cancellations, delays, or other inconveniences beyond our control. We are not liable for any direct or indirect losses, damages, or expenses that may arise from the services provided by travel vendors.

8. Privacy and Security

We take your privacy seriously and are committed to protecting your personal and payment information. All personal data collected will be stored securely and only used to facilitate your travel arrangements. We comply with applicable data protection laws, including GDPR and other relevant privacy regulations.

9. Dispute Resolution and Arbitration

Any disputes arising from or related to this Agreement, including but not limited to its interpretation, performance, or breach, shall be resolved exclusively through binding arbitration in accordance with the rules of the American Arbitration Association (AAA).

As such, we are subject to the laws of the State of California, and such laws will govern this Terms of Use Agreement, without giving effect to any choice of law rules per Deserving Adventures and Tours' hosting agency, Archer Travel, and the proceedings shall be conducted in English or Spanish. The arbitrator’s decision shall be final and binding upon both parties, and judgment upon the award may be entered in any court of competent jurisdiction.

Payment Authorization & Acknowledgment

By signing or executing this payment, I authorize Deserving Adventures and Tours to charge the credit card or bank account indicated on this invoice for the specified amount as of today's date. This payment is for the services described on the invoice.

I certify that I am an authorized user of the provided credit card and agree not to dispute this charge with my credit card company, provided the transaction aligns with the terms outlined in this invoice.

I acknowledge that Deserving Adventures and Tours acts solely as a booking agent and is not responsible for the quality, conditions, or fulfillment of services provided by third-party vendors, including accommodations. I understand that any issues related to accommodations must be addressed directly with the service provider.

Additionally, I recognize the importance of travel protection and highly recommend purchasing travel insurance to safeguard against unforeseen circumstances, including cancellations or dissatisfaction with travel arrangements.

In the event of a cancellation, I understand that the travel agent will issue an invoice for the deposit amount before my reservation is canceled.

By signing below, I authorize Deserving Adventures and Tours to charge the credit card indicated on this invoice for the noted amount on today's date. This payment is for the services described on the invoice. I certify that I am an authorized user of this credit card. I acknowledge and agree that I will not dispute the payment with my credit card company, so long as the transaction corresponds to the terms indicated on this invoice. I also understand that in the event that I decide to cancel, the agent will invoice me for the amount of the deposit before my room is cancelled.

All rates are subject to restrictions, availability, and change. Archer Travel is Deserving Adventures and Tours, Host Agency CustomerService@ArcherTravel.com is registered with the States of CA # 2001330–10, FL # 35395, HI # TAR-6612, WA # 603352551 as a seller of travel. Deserving Adventures & Tours uses the personal data you disclose about yourself on this form only for the purpose of processing your requested travel purchase. We retain your personally identifiable data only as long as that processing requires. We do not share any of your personal data with any third party except for the purpose of completing your purchase, and then only with third-party travel providers and credit card processors who protect and only process your personal data for the limited purpose of this travel purchase. Following the completion of your travel that is the subject of this transaction, your personal information shall be securely destroyed unless Deserving Adventures & Tours is required by law to retain it, and then it will be retained only for that limited, legally required purpose.

Other Terms If any provision of this Terms of Use and Sale Agreement shall be unlawful, void or unenforceable for any reason, the other provisions (and any partially enforceable provision) shall not be affected thereby and shall remain valid and enforceable to the maximum possible extent. Customer agrees that this Terms of Use and Sale Agreement and any other agreements referenced herein may be assigned by Weiner's Ltd, in our sole discretion, to a third party in the event of a merger or acquisition. This Terms of Use and Sale Agreement shall apply in addition to, and shall not be superseded by, any other written agreement between us in relation to your participation as a Customer. Customer agrees that by accepting this Terms of Use and Sale Agreement, Customer is consenting to the use and disclosure of their personally identifiable information and other practices described in the ArcherTravel.com Privacy Policy.
